The Harnett County Board of Commissioners meet at the Harnett County Courthouse
at 10:10 o'clock a.m. to hold a public hearing. Present for this hearing were
Chairman M. H. Brock; Commissioners Brown, Cotton, McLamb and Womble; County Attorney,
Wiley F. Bowen; Clerk of the Board, Herbert Carson; and Recording Secreatry, Mildred
Dobbins.
Mr. Brock, Chairman of the Board of Commissioners, called the meeting to
order and stated the purpose of the meeting "Petition made by Delmas Whittington,
trading as Dunn Ambulance Service."
Mr. W. A. Johnson, Attorney at Law, appeared before the Board to protest the
application for a franchise by Mr. Whittington. He appeared on behalf of a local firm,
O'Quinn and O'Quinn, who, he stated, had been in business for a number of years
providing funeral director and ambulance operation services throug?kie
h/ county. He
contended that the Board of Commissioners did not have the authority to grant a
franchise to any ambulance operator, since the North Carolina Statute provides that
before the Board can grant a franchise, there first must be notice given of a public
hearing to determine if adequate and continuing ambulance service is being provided
in the county, and, if, at this public hearing, it is determined from evidence
presented that an ordinance is necessary to preserve, protect and promote the
public welfare, then, at this point and only at this point, the Board would have the
power to enact an ordinance if it elects to do so. He stated that he had read the
petition of Mr. Whittington, the notice in the minute docket and was unable to read
into any of the minutes any indication or suggestion that the County Commissioners
have a hearing to determine whether or not the county was to adopt an ordinance. He
stated that, in his opinion, said petition has nothing to do with public hearing to
adopt ordinance, and that it was his position that the Board had not had a hearing
on this question, and no hearing having been held, the Board could not adopt an
ordinance and could not grant a franchise to any party. He further stated the he
had no knowledge of any ordinance enacted by the county requiring a franchise before
operating an ambulance service. Mr. Johnson stated that he felt it was in order, at
this point, for to Board to make a decision as to whether or not the Board had given
notice and held public hearing to inact an ordinance before he continued.
Mr. Brock, Chairman of the Board of Commissioners, stated that the Board would
hear everybody that appeared and take it under advisement.
Mr. Robert C. Bryan, Attorney at Law, appeared before the Board on behalf of his
client, Delmas Whittington. He stated that Mr. Whittington is presently operating his
ambulance service, and if the notice previously filed was not sufficient to meet the
requirements of North Carolina Statutes to issue a franchise, he wanted the Board
to do something to give some protection to Mr. Whittington. He stated that it seemed
to him Mr. Johnson protested primarily to the area set out in the petition of Mr.
Whittington, and that they may have reached an agreement concerning the area whereby
there will be no conflict with their clients. He stated that Mr. Whittington had
requested a franchise of an area outlined in his petition, and that he had authorized
him to amend the petition to enable both O'Quinn & O'Quinn and his ambulance service
to have a franchise to cover the entire county. Mr. Bryan further stated that Mr.
Whittington needed the protection of a franchise because it has been determined that
more than one ambulance service cannot operate profitably in the area served by him.
Mr. W. A. Johnson stated under the law, it was his opinion, that Mr. O'Quinn
is entitled to a county wide franchise which they would request if the County Board
decided to inact an ordinance.
Mr. Brock stated that it appeared from the discussion that O'Quinn and O'Quinn
was not interested in serving the Dunn Area, and Mr. Whittington was not interested in
operating his service in the Lillington Area, and Mr. Bryan stated that economy itself
would solve this problem.
Mr. Bryan further stated that if failure to hold public hearing to determine if
ordinance was necessary might raise a technical objection which could cause some questio
about a franchise granted by the County, he would agree that such a notice should be
give land hearing held. He stated that, in the meantime, he would like an indication
from the Board that his client was going to be protected if he continues to go on as
he presently is.
Mr. Brock stated that he felt the Board would do all that it could to enable
Mr. Whittington to continue his ambulance service, but it appeared at this point that
the Board could not legally give the assurance Mr. Bryan requested.

Commissioner Brown raised the question of citizens in outlying areas who get
ambulance service from outside the County, and asked how a franchise of an ambulance
service might affect them. Mr. Bryan stated that the franchise would prohibit another
ambulance service being based in Harnett County, but, in his opinion, would not
affect ambulances from other counties serving' Harnett County.
Mr. Wiley F. Bowen, County Attorney, stated that it was his understanding of
the Statute that if the county refused to take action, Mr. Whittington could then
petition the municipalities for franchise and it may be this could avoid all these
fringe area problems. Mr. Brock ā€˛Chairman, pointed out, however, that this would
tside
mean there would be no service for resident?Hese municipalities. Mr. Bowen stated
that many problems exist concerning ambulance service thDughout this area, and, to
date, many larger counties have not been able to solve these problems in an equitable
manner.
The Board of Commissioners took no action, and Mr. Brock, Chairman, stated that
he would take this under advisement for further action.
