SEPTEMBER 18th. 1967
An adjourned meeting of the Board of' Commissioners for the County of Harnett,
North Carolina, was held at the Courthouse in Lillington, North Carolina, its
usual place of meeting, at 4 o'clock P.M., on September 18th. 1967.
Present: Chairman M. H. Brock and Commissioners C. E. McLamb,
J. E. Womble, Gilbert Brown
Absent: W. J. Cotton, Jr.
Also present: H. D. Carson, Jr. County Accountant and Inez Harrington,
Register of Deeds and ex officio Clerk of the Board of Commissioners.
Commissioner C. E. McLamb introduced the following order authorizing bonds
which were read:
ORDER AUTHORIZING $ 5,000,000
SCHOOL BUILDING BONDS
WHEREAS, the Harnett County Board of Education has certified to
this Board a resolution passed on June 5th. 1967, showing that adequate
school facilities are not now available in Harnett County as required by
law, and that it is necessary for the proper maintenance, conduct and im-
provement of the public school system in Harnett County to erect additional
school buildings, enlarge existing school buildings and acquire necessary
land and equipment therefor to provide additional school facilities in said
County, the estimated cost of which is $5,000,000; and
WHEREAS, said resolution requests theBoard of Commissioners to take
all necessary steps in order that funds may be provided for such school
facilities; and
WHEREAS, the Board of Commissioners has carefully examined the facts
and has determined and does hereby find as a fact that said statement of said
resolution are true and that it has become the duty of said Board of Comm-
issioners, acting as an administrative agent of the State in providing a State
system of public schools, to order the issuance of bonds of the County of
Harnett so that the school facilities mentioned in paragraph 1 of the order
may be provided in order to maintain the six months! school term in the
County of Harnett as required by Section 3 of Article IX of the Constitution;
now. therefore,
Be It Ordered And Resolved By The Board Of Commissioners
For The County Of Harnett:
1. That, pursuant to the County Finance Act, as amended, and in
order to maintain the six months' school term in said county of Harnett
as required by Section 3 of Article IX of the Constitution, the County of
Harnett, North Carolina, is hereby authorized to contract a debt, in addition
to any and all other debt which said County may now or hereafter have power
or authority to contract, and in evidence thereof to issue School Building
Bonds of said County in an aggregate principal amount not exceeding $ 5,000,000
for the purpose of providing funds, with any other available funds, for erect-
ing additional school buildings and other school plant facilities, remodeling,
enlarging and reconstructing existing school buildings and other school plant
facilities and acquiring necessary land and equipment therefore in order to
provide additional school facilities in the County of Harnett
2. That a tax sufficient to pay the principal of and the interest
on said bonds when due shall be annually levied and collected.
3. That a statement of the debt of the County for school purposes
has been filed with the Clerk and is open to public inspection.
4. That this order shall take effect when approved by the voters of
the County at an election as provided in said Act.
THEREUPON, on motion duly made, seconded and unanimously carried,
the Board designated the County Accountant as the officer to make and file
with the clerk the sworn statement of debt and assessed valuation of the
County which is required by The County Finance Act, as amended, to be filed
before the final passage of the order which was introduced at this meeting.
Thereupon the County Accountant filed with the Clerk, in the presence
of the Board, the sworn statement of debt and assessed valuation as so
required.

Thereupon the order entitled: "ORDER AUTHORIZING $ 5,000,000
SCHOOL BUILDING BONDS" was passed on first reading.
On motion duly made, seconded and unanimously carried the
Board fixed 102Tclock A.M., October 2, 1967, as the hour and day for
the public hearing upon the foregoing order, and directed the clerk
to publish said order, together with the appended note as required by
The County Finance Act, as amended, in The Daily Record, not later
than the tenth day before said date.

STATEMENT CONCERivING SCHOOL INDEBTEDNESS
I, H. D. Carson, Jr. , County Accountant of the ^ounty of
Harnett, North Carolina, cfo maw and file the following statement of the
financial condition of said County, having been designated by the Board
of Commissioners for that purpose. Said statement includes a statement
of debt incurred and to be incurred for school purposes under orders
either introduced or passed, whether evidenced by bonds, notes or other-
wise, and whether incurred by original creation of the debt or by assump-
tion of debt, including debt incurred by the County Board of Education, and
including debt to the State or any department thereof, but not including
obligations incurred to meet appropriations in anticipation of revenues to
an amount not exceeding the amount of the last preceding tax levy for
school purposes:
(a) The assessed valuation of property
as last fixed for County taxation ... . $125,000,000.00
(b) Outstanding debt for school
purposes $1,526,000.00
(c) Bonded school debt to be
incurred under orders either
passed or introduced:
School Building Bonds 5,000 000
(d) The sum of items (b) and (c) $ 6,526,000.00

money or investments thereof
pledged and held for the payment of
principal of outstanding school debt None

The Board of Commissioners for the County of Harnett, North Carolina, met in
adjourned regular session at the County Courthouse in Lillington, North Carolina,
the regular place of meeting, at 10 o'cbck, A.M. on October 2, 1967.
Present: Chariman M. H. Brock, and Commissioners W. J. Cotton, Jr., Gilbert
Brown, C. E. McLamb and J. E. Womble. Absent: None.
The Chairman announced that this was the date and hour fixed by the Board for
the public hearing upon the order entitled:
"ORDER AUTHORIZING $5,000,000 SCHOOL BUILDING BONDS ", and that the Board would
immediately hear any and all citizens and taxpayers who might desire to protest against
the issuance of said bonds.
No citizen or taxpayer of the County appeared, either in person or by attorney,
to protest against the issuance of any of said bonds, and the Clerk announced that
no protest in writing, signed by any citizen or taxpayer, had been presented, except
Gilbert Stewart, residing at Route 2, Lillington, North Carolina, who appeared in
person and protested against the issuance of the bonds.
Thereupon, upon motion of Commissioner W. J. Cotton, Jr., seconded by
Commissioner J. E. Womble and carried, the order introduced and passed on first
reading on September 18, 1967, entitled: "ORDER AUTHORIZING $5,000,000 SCHOOL
BUILDING BONDS ", was read a second time and placed upon its final passage. The
vote upon the final passage of said order was:
Ayes: Commissioners M. H. B rock, W. J. Cotton, Jr., Gilbert Brown, C. E.
McLamb and J. E. Womble.
Noes: None.
The Chairman then announced that the order entitled: "ORDER AUTHORIZING
$5,000,000 SCHOOL BUILDING BONDS" had passed.
The Clerk was thereupon directed to publish said order in The Daily Record,
once in each of two successive weeks, and to publish at the foot of said order the
appended note as required by The County Finance Act, as amended.
Thereupon Commissioner W. J. Cotton, Jr. introduced the following resolution
which was read:
RESOLUTION CALLING A SPECIAL
BOND ELECTION
BE IT RESOLVED by the Board of Commissioners for the County of Harnett:
Section 1. A special bond election is hereby called to be held on Saturday,
December 2, 1967, between 6 :30 A.M. and 6:30 P.M., at which there shall be sub-
mitted to the qua]ified voters of Harnett County the following question:
Shall an order finally passed on October 2, 1967,
authorizing the County of Harnett, North Carolina, to
contract a debt, in addition to any and all other debt
which said County may now or hereafter havepower or
authority to contract, and in evidence thereof to issue
School Building Bonds in an aggregate principal amount not
exceeding $5,000,000 for the purpose of providing funds, with
any other available funds, for erecting additional school
buildings and other school plant facilities, remodeling,
enlarging and reconstructing existing school buildings and other
school plant facilities, and acquiring necessary land an d
equipment therefor, in order to provide additional school
facilities in the County of Harnett to maintain the six months
school term in said County as required by Section 3 of Article
IX of the Constitution, and authorizing the levy and collection
of a sufficient tax for the payment of the principal of and the
interest on said bonds, be approved?
Section 2. For said bond election the regular registration books for
elections in said County shall be used and such books shall be open for the
registration of voters not theretofore registered tom 9 A.M. until sunset on each
day, beginning Saturday. November 4, 1967 and closing Saturday, November 18, 1967.
On each Saturday during such registration period such books shall be open at the
polling places. Saturday, November 25, 1967, shall be Challenge Day.
Section 3. The Clerk of the Board of Commisoners shall cause a notice to be
published in The Daily Record at least thirty days before the election, and thereafter
twice before the election at intervals of at least one week between publication,
reading substantially as follows:

The question hereinabove set forth contains a statement of thepurpose for
which the bonds are authorized by the order referred to in said question.
If said bonds are issued a tax will be levied for the payment of the
principal and interest thereof on all taxable property in Harnett County.
For said election the regular registration books for elections in siad County
will be used and such books will be open for the registration of voters, not
theretofore registered, from 9 A.M. until sunset on each day beginning Saturday,
November 4, 1967, and closing Saturday, November 18, 1967. On each Saturday during
such registration period said books will be open at the polling plates. Saturday,
November 25, 1967, is Challenge Day.
Any qualified voter of the County who is qualified to vote by absentee ballot
under the provisions of the General Statutes of North Carolina, particularly Article
10 of Chapter 163. in a State -wide general election is authorized to vote an
absentee ballot in said special bond election in accordance with said provisions
of the General Statutes relating to absentee voting. Any qualified voter of the
County who is qualified to vote by absentee ballot in said special bond election
may apply for an absentee ballot not earlier than forty -five days prior to said
special bond election and not later than 6 :00 p.m., Wednesday, November 29, 1967,
at the office of the Harnett County Board of Elections, Agricultural Building,
Lillington, North Carolina, Qualified voters who are not certain whether they are
eligible to vote by absentee ballot should contact said Harnett County Board of
Elections.

WELFARE CASE REPORT
1. Alford Elliott case - Extensive investigation has been made to determine the heirs of
Mr. Elliott. It seems to be impossible to locate the names and addresses of all heirs;
a suit will be started immediately with service of process for all unknown heirs being
published in the newspaper.
2. Winifred Grady case- Real Property involved in this case is under orders of sale by
the Court. One tract of land is under a confirmed sale of $1,625.00; the other tract of
land is under a bid of $2,307.50.
3. Atlas Johnson case- Present property owners deny County's claim; case will be for tri
4. Charlie Elmon Denning Case - Time within which the defendants may answer the County's
claim or complaint expired on September 25, 1967. Order of sale for the land in question

8. Debro Williamson case - Information necessary for suit has been obtained and
a suit will be filed this month. The County will not be able to have this pronerty
foreclosed for the recipient is still living and using the property as a homesite.
A judgment to be satisfied later can be obtained.
9. Winnie Messer Norris case - A suit has been drawn and will b e filed today.
10. Mary Ellen Phillips case - Only personal property is involved and the estate
has not been settled.
In regards to Welfare Case No. 1 above - Alford Elliott "ase- Mr. Woodall stated
that one of the distant heirs had paid approximately S300.00 with the understanding
that the property would belong to her when the lien was satisfied. This, however, was
a misunderstanding on the part of the heir. Mr. Woodall was advised by the boa-d that
when this property was advertised and sold this heir should be reimbursed the amount
paid by said heir.
Regarding Welfare Case No. 7 above -Sarah McArtan Pope case, Mr. Woodall stated
that he had been offered p200.00 in settlement of the lien, and pointed out that the
statute has run out on this case. Upon recommendation of Marshall Woodall, Tax Lien
and Welfare Case Attorney, Commissioner McLamb made the motion that the County accept
1200.00 in settlement of said lien. The motion was seconded by Commissioner Cotton,
and the motion carried.
Mrs. Elizabeth Matthews, Clerk of superior Court, appeared before the Board and
requested that t hey set the pay rate and authorize payment for t he part -time help
she had secured to help with the Jury Commission. Commissioner Cottom made a motion
they be paid at the rate of 51.45 per hour, and the County Auditor be authorized to
make payment to these ladies working inithe Commission Office. The motion was
seconded by Commissioner McLamb and the motion carried.
Mr. Wiley F. Bowen, County Attorney reviewed his Answer and Counter -Claim which
he had ready to file with the Court upon approval of the B oard in the Ross vs County
action, and the following Resolution was adopted by the Board: Attorney Wiley F.
Bowen having read the propose ApswgF Qd Counter -Claim to suit entitled Neill McK
Ross vs. M. H. Brock, et alj is- tierety empowered, authorized and directed to verify
the Answer and Counter -Claim on behalf of the County of Harnett. Mr. Bowen received
the Board's approval to file said Answer and Counter -Claim with the court.
Commissioner Gilbert Brown made the motion that the Board offer a reward of Five
Hundred Dollars for the capture and conviction of the murderer of E. F. Byrd. The
motion was seconded by Mr. McLamb and the motion carried.
Commissioner C. E. McLamb made a motion that the County give the sum of Five
Hundred Dollars each to the Dunn Rescue Sound and the Erwin Resque Squad, and that
the Board authorize a like sum to any other approved rescue squad in the County. The
motion was seconded by Mr. Cotton and the motion carried.
Mr. M. H. Brock, Chairman, presented a renuest to the Board signed bv two property
owners to delete from the highway system Road 2028. Mr. Cotton made the motion that the
Board approve this request, seconded by Mr. Brown and the motion carried. Mr. Sam
4'•ilson, District Engineer of State Highway Commission, appeared before the Board and
was informed of the action the Board had taken on Road 2028 and he stated that he felt
the request would be honored when it was received by the Commission.
The following resolution with reference to sale of property to A. J. b'bite,was
presented to the Board by Mr. Wiley F. Bowen, County Attorney; to he nlnced in the
minutes:
NORTH CAROLINA R E S O L T J T I O N
HARNETT COUNTY
THAT t''HFREAS, A. J. White has offered the sum of Two Thousand
Dollars (&2,000) for the hereinafter described tract bf land, and,
WHEREAS, the Board of County Commissioners accepted said offer,
subject to a promise by A. J. White to make the following improvements:
1. Clear, grub and grade the entire lot and Harnett Street
between First Street and Second Street and second Street
between Front street and Harnett Street.
2. Install the necessary storm sewers, manholes, junction
boxes, and catch basins.
3. Install the necessary sanitary sewer manholes.
4. Pave Harnett Street between First Street and Second Street.
Pave Second street between Front Street and Harnett Street.
(All pavement shall be 20 feet wide and be of 11" bituminous
concrete on a 6" gravel base course.)
AND, WHEREAS, interested bidders were given the opportunity to file an up-
set bid in a notice which was run in the Harnett County News on the 17th day of
August, 1967, and,

WHEREAS, no upset bid was filed by August 22, 1067, as set forth in said
notice, and,
WHEREAS, the Board of County Commissioners finds the following facts:
1. That the sale of said lot is in the best interest of the inhabitants
of the county since:
(a) The property is not in use for county purposes and is not
income producing.
(b) A sale would place money in the county treasury.
(c) A sale would transfer the property to a private individual,
and, hence,be taxable by both the county and the town.
(d) A sale under the conditions for improvement sproposed by
Mr. White would immediately further development of the county
seat.
2. That said property is not presently being held for county purposes or
use and that its sale would not tend to embarrass or prevent the performance
of duties owed by the Board to the public since: -
(a) Other more suitable land is presently held by the county for
future expansion.
(b) Engineers have declared the property unsuitable for county
purposes.
(c) The town concurs in such a sale.
AND, WHEREAS, the Board may require that said property be reconveyed to
the County if the foregoing improvements are not made within twelve months
from the date of the deed to said property.
AND, WHEREAS, the County has agreed that if Mr. White sells any lot or
lots during the course of development of said property, then any lot so sold
shall be free from the conditions of the contract, to the end that the
purchaser may obtain good title to the same and go forward with the develop -
ment of said portion of said property.
NOW, THEREFORE, IT IS RESOLVED AND ORDERED BY THE BOARD OF COUNTY
COMMISSIONERS OF HARNETT COUNTY THAT:
1. A warranty deed for said property be grsnted to A. J. White.
2. A contract setting forth the terms of this resolution be executed
by and between A. J. White and the County of Harnett.

Mr. Wiley F. Bowen, County Attorney, informed the Board that the County should
be receiving funds from the State Board of Elections and from the Federal to help
off -set the expenses of primary elections pursuant to Statutes 163 -122 and 14,3- 77.11.
Mr. Herbert Carson, Oounty Auditor, state that, to his'lcnowledge, he had only received
one check from the State for ,#3,000.00 as reimbursement to county for State called
election. Mr. Carson was instructed to call the State Auditor and follow this uo.
Mr. l'homas Allen, Tax Supervisor, appeared before the Board and requested that
a refund of S124.10 be made to Mr. Ralph Johnson. Mr. Allen discovered this error
in his office, and he stated that he had checked the tax records and Mr. Allen has
paid his taxes up -to -date.
The Board also considered a request for release of Penalty by Dunn Promoters,
Inc. Mr. bowen, County Attorney, in explaining the situation to the Board stated that
Dunn Promoters, Inc. held the property in its name for the sole purpose of assisting
Morganite to come here. Morganite is to pay off the deed of trust and taxes. Dunn
Promoters, Inc. -simply did not list the property until it was brought to their attentio
that this was their responsibility, at which time they did list the property. Mr.

Bowen stated further that the purpose of Dunn Promoters, Inc. was to promote business
and industry in their area, and was not a profit making organization as he understood
it. Mr. Bowen stated that under these circumstances, in his opinion,. the Board would
be justified in granting this release.
Motion was made by Commissioner Cotton that thenfund in the amount of 112h.10 to
Mr. Ralph Johnson be authorized, and that the Reouest for Release of Penalty by Dunn
Promoters, Inc. be granted. The motion was seconded by Commissioner Brown, and the
motion carried.
Mr. .arl Jones, Tax Lollector, appeared before the board and gave a renort of the
Total current and Delinquent Taxes received during the Month of September, 1967, and
stated that he would mail a full report to the Commissioners as soon as it was
completed.
At the request of Mr. Marshall Woodall, the following resolution was adopted by
the Board: Upon recommendation of Marshall Woodall, Tax Lien and Welfare Lien Attorney,
that the lien against Oscar Heyward Gregory in the amount of $204.0.00 be released
inasmuch as it appears that the lien was paid to the former County Attorney on or
about the 31st day of May, 1963.
Mr. M. H. Brock, Chairman, presented a request from the Harnett County Good Neighbor
Council for 1100 for the use of the Council in purchasing stationery, postage and
other materials, and also a request that the following persons be appointed to the
Harnett County Good Neighbor Council to serve with the present Council:

Mr. Brock stated that the 1100.00 could come from the budget of Mr. Vernon Porter.
A motion to grant the request for 1100 to come from Vernon Porter's Budget, and to
appoint the above named persons to serve on said Council was made by Commissioner
Brown and Seconded by Commissioner Cotton. The motion carried.
Mr. Cliff Amons appeared before the Board on behalf of the Livestock and Poultry
Cooperative and requested financial assistance from the County to pay the insurance
premium on the arena property. He stated that the property was in themme jointly
of the County and the Cooperative, and that the Cooperative, except for a little
advertising, had no means of raising revenue. Mr. bowen, " ounty Attorney, explained
that the title to the property was placed in the name of the County, in his opinion,
for the sole purpose of executing the original deed of trust, and that the County
in fact does not own the property, and therefore he could find no statutory authority
to allow payment.
Mr. Wiley F. Bowen, County Attorney, discussed with the Board the present procedure
used by the different county offices in getting county funds into the county treasury.

county. Mr. Bowen stated that pursuant to Statute lg3 -135 every person and employee
whose duty is to receive any moms belonging to the ounty shall deposit receipts
with
whose, treasurer within twenty -four hours, and he further stated that if the
County w ould use this system as provided by law it would get better use of its money.
Mr. Carson, '' ounty Auditor, was directed by the Bo-rd to contact each office vhich is
responsible for receiving money for the County and direct them to make a denosit
every twenty -four hours in proper account in bank and obtain two deposit slips of which
one will be given to the County Auditor, Herbert Carson.
Upon appearance of Graham Henry, Commissioner, and Elizabeth Matthews, Clerk of
Superior Court, who both stated that they could not obtain help for .less than r2.n0
per hour, and the persons stated they would not work for less than $2.00 per hour,
Commissioner Cottom made motion that payment to clerks to Jury Commission be made
at the rate of X2.00 per hour in lieu of 11.45 as approved this day. This motion was
seconded by Commissioner Brown and the motion carried.
