HomeMy WebLinkAbout0904196753 SEPTEMBER 4, 1967 The regular meeting of the Board of Commissioners was held at Harnett County Courthouse on Monday, September 4, 1967, at 10 :00 A. M. attended as follows: Chairman Brock, Commissioners Womble, Brown, Cottom and McLamb, County Attorney, Wiley F. Bowen, County Auditor, Herbert Carson, Clerk to Board, Inez Harrington, and Assistant Clerk to the Board, Mrs. Mildred Dobbins. Chairman Brock called the meeting to order and presided. Invocation was offered by Commissioner Womble. Minutes of August Meeting were read by Inez Harrington, Clerk to Board, and after due correction were approved. Commissioner Cotton presented the following resolution which was seconded by Commissioner McLamb and adopted by the Board: Be it resolved that Mrs. Mildred Dobbins be appointed Assistant Clerk to the Board of Commissioners and she be paid $2C.00 per day for each meeting; that she be compensated $2.00 per hour for such other duties per- formed on behalf of the Board; that this schedule may be adjusted upon determination of the actual duties to be performed by Mrs. Mildred Dobbins. The following reports were approved and filed: Clerk of Superior Court - Elizabeth F. Matthews Veterans Service Office - Jean M. Irvin Register of Deeds - Inez Harrington Clerk of Recorders Court - Kyle Harrington Harnett County Elec. Inspectors - B. H. Sellars and L. Perry Cameron Tax Collector - Earl Jones W. Earl Jones, Tax Collector, appeared before the Board and gave a detailed report of the collections in his office which showed an increase over the past years. Mr. Jones requested the Board to provide a table in the vault in his office which would replace the high -back counter. Commissioners McLamb and Cotton were appointed by the Board to work this out with Mr. Porter and the Technical School which will build the table as Mr. Jones designs for his use. Mr. Jones stated that he uses his personal separate account in his office as had been done by his predecessors. He was advi satisfactory with the Commissioners if the County Auditor author or if he and the County Auditor could work out a better plan it for making refunds sed that this was ized this account, would be all right. Sparks - Anderson Creek Township: Upon investigation, it appears that Mr. Sparks conveyed in September, 1957, the land listed to him for the years 1958 through 1967. The individual who purchased the property from Sparks and subsequent owners have listed the property in question. Therefore, there has been double listing and the tax supervisor and tax collector have been advised by my office to release the listing to J. A. Alford Elliott Case- Rental Payment received by my office in the amount of $40.00 all of which was delivered to the auditor's office; an attorney's fee of $2.00 has been paid on this collection. 2. Winifred Grady Case- Property in estate is subject to a sale by orders of the court and is presently under sale. In discussions with Mr. John Allen McLeod, it seems that the bids are presently sufficient to pay the County lien in full. 3. Atlas Johnson Case - The present property owners, R. D. Hamilton and wife, have filed answer denying the County's claim, alleging that they paid to the County Attorney the sum of $1,000.00 which was represented to them to be the entire claim of the County by the County Attorney, Balance of Lien is $1930.63. 4. Charlie Elmon Denning Case- Publication of notice of Process for defendants is sill being had. No answer has been filed in this suit. 5. Frances Mitchell Matthews Case- Time for filing answer has just expired; a Judgment ordering the sale of property will be entered immediately. 6. James Franklin Altman Case- Time for filing answer has just expired; a Judgment ordering the sale of property will be entered immediately. 7. Rosella Tart Hardison Case- No property from which to satisfy lien. Recipient owned only a life estate in real estate. 8. buncan Darroch Case- Amount of Lien- $3632.00; Upon a discussion of this case with the Administrator's attorney, it appears the administrator wishes to take action to pay this lien. The attorney was told to take action within a reasonable time or the county would be forced to take action. The county lien will expire on August 14, 1969. 9. Sarah McArtan Pope Case- Attorney for present property owners, C. W. Coleman and wife, has obtained an order for extension of time within which to answer. A possible settlement ofthis action is presently being discussed and will be report to the next Board meeting. S.D. Ingraham, Certified Public Accountant, appeared before the Board and presented the report of his audit of the county offices for the year ending June 30, 1967. Each Commissioner and County Attorney were given a copy of this audit. Mr. Ingraham stated that all of the county offices had cooperated with him fully during this audit and that the books were found to be in excellent condition. He also stated that the records in the office of the Board of Elections do not show the amounts paid out for misc. expenses such as postage. He recommended that the Chairman of the Board of Elections issue receipts for all monies received and any expenditures should be made by the County Auditor. In the past the Chairman of the Boardof Elections has been depositing his receipts in the name of "Chairman of Board of Directors" and giving the deposit slip to the County Auditor for his records. Mr. Brock stated that the Chairman of the Board of Elections is ready to turn all funds over to the Auditor when directed to do so. The Board advised Mr. Brock to request the Chairman of said Board to turn all funds over to the County Auditor. There was a discussion of the possibiity of a blanket bond on all county employees not now bonded, and this matter will be discussed later after the County Attorney has an opportunity to check into it. The Board directed the County Auditor to refund the amount of $4.60 to C. C. Edwards, C/0 W. W. Edwards,,First Federal Savings and Loan Association, Box 2208 Five Point Durham, N. C. 27702 since his property,which includes 3 lots in Averasboro Township, had been listed twice for the years 1965 -1966. Mr. Cotton made motion that this refund be made and was seconded by Mr. Brown and the motion carried. Mr. Vernon Porter, Consultant of Economic Opportunity Program, appeared before the Board and discussed using the workers of the Manpower Development Program in the building of addition rooms between the courthouse and the jail. This building would house the sheriff and his staff with a conference room and possibly storage room, and will permit the closing of the courthouse after office hours and during the weekend. Mr. Womble made the motion that the Building Committee get together with Mr. Porter and work out plans for the building and present it to the Board when theplans are complete. The motion was seconded by Mr. Cotton, and the motion carried. 56 Mr. Porter requested the &uthority to at Maple Grove School to the workshop there. allow Mr. Porter to spend up to $50.00 to ac seconded this motion and it carried. install a water line from the main line Commissioner Cotton made a motion to complish this; Commissioner Brown Mr. Porter commented on the possibility of a vocational adult class at Bunn - level. Mr. Brock stated that the Board would go on record as supporting this if it is needed. Mr. W. A. Messer of the Dunn -Erwin Ambulance Service appeared before the Board and stated that the Dunn -Erwin Ambulance Service could not continue to operate with- out some assistance from the County. The County Attorney pointed out that Mr. Messer had previously appeared before the Board and had been advised at that time to obtain the services of an attorney to assist him in this matter. Mr. Bowen, County Attorney, also stated that the Board had no authority to act since they did not have a formal petition from the said Ambulance Service. Mr. Messer presented the following resolution to the Board of Commissioners: September 4, 1967 TO WHOM IT MAY CONCERN: As everyone knows, the ambulance companies throughout the state have been operating at a loss and we are no exception. We were told that the board could not do anything. We were advised to get a lawyer. We hired a lawyer and still nothing has been done. We cannot keep going operating at a loss every month, so unless something is done or we see where something is definitely being done according to the North Carolina Ambulance Bill, we will be forced to close our doors no later than midnight, Sept. 30, 1967. Dunn - Erwin Ambulance Service /s/ W. A. Messer Owner Mr. Brock stated that he had received a letter requesting payment of approximately $300.00 on insurance premium on the Harnett Livestock Arena property. The County Attorney advised the Board that he had checked the records of Harnett County, the file at Home Savings & Loan Association, and , also, Section 1133 of 1961 Session Law, and, in his opinion, Harnett County is not responsible for the payment of this insurance. After discussion by the Board Mr. McLamb made the motion that the County not pay this since it has no authority to do so, this motion was seconded by Mr. Brown and the motion carried. The County Attorney was directed to write a letter to the Board of this Cooperative advising them of the action of the Board of Commissioners. As a matter of record the statement from Moore, Gardner & Associates, Inc. and a letter from Howard W. Watkins County Supervisor Commissioner Cotton made the motion which was seconded by Commissioner McLamb that the following recommendations made by the County Attorney be accepted and placed in the minutes, and the motion carried: 1. That a complete list of all insurance purchased by the County together with the amount of premiums paid and to whom paid be furnished the Commissioners by the Auditor. 2. That the Commissioners study the feasibility of establishing a "Harnett County Insurance Advisory Plan." That the proposed plan be brought to the attention of the municipal officials within the county so that they too might consider adlopting the plan. 3. All official bonds taken or renewed by the Board of Com missioners be recorded by the Clerk. That the clerk record in the proceedings of the Board the names of those commissioners who are present at the time of the approval of any official bond, and who votes for such approval. G.S. 109 -11 & G. S. 109 -12. 4. That the Commissioners prepare and keep on record in the Office of the Register of Deeds a list of all public cemeteries in the county outside the limits of incor- porated towns and cities, and not established and maintained for the use of an , incorporated town or city, together with the names and addresses of the persons in possession and control of the same. To such list shall be added a list of the public cemeteries in rural districts of such county which have been abandoned. That the ' Commissioners furnish to the division of publications in the Office of the Secretary of State copies of the list of such public and abandoned cemeteries. G. S. 65 -1. 5. Sheriff be advised to report to the Board of Commissioners the condition and number of blankets and bedclothing owned by the county, pursuant to G. S. 153 -53. The Board authorized the Auditor to pay W. A. Johnson, Attorney, the sum of $325.00 for services rendered in checking welfare liens and tax foreclosure matters for the period April 26, 1967 through August 31, 1967. Mr. Frank Lewis, Assistant Civil Defense Director, appeared before the Board and gave a report of the operations of the garbage disposal sites. He also invited the Board to meet with the town mayors in a joint- meeting on September 14, 1967 at 7:00 P.M. at Johnson's Place when the Engineers of Moore - Gardner & Associates wi`11 present the plans of county -wide water resource and the sewer system. McLamb Mr. Frank Lewis and Commissioner /were authorized to attend the Southeast Clean Air Conference to be held in Miami, Florida in September. Mr. Brock, Chairman, announced that the Board of Commissioners would join the Board of Education on September 18 for a visit to the Waiden Whitley High School, Wendell„ N. C. 58 Commissioner Wombel stated that Representatives from the Farm Bureau, Earl Pearsall and Kelly Mims, would come to a meeting to discuss with the Board recreational facilities and stated that the county would be under no obligation. Mr. Womble was asked to contact them at telephone number 4678112, Cary, N. C. and request that they present what information they have on this at a future meeting.
