MINUTES OF THE REGULAR SESSION OF THE BOARD OF COMMISSIONERS FOR DECEMBER, 1975.

CALL TO ORDER

The Harnett County Board of Commissioners met in regular ses-
sion on Monday, December 1, 1975. With Chairman Bobby R.
Etheridge presiding the following members were present Jesse
Alphin, W. J. Cotton, Jr., M. H. Brock and Lloyd Stewart. Alsc
present was H. D. Carson, Jr., Clerk to the Board.
The Chairman called the meeting to order at 9:40 a.m.
Dr. Fisher offered the morning prayer.
The minutes of the previous meeting were read and approved.
Don Dupree, District Engineer of the Department of Transporta-
tion, appeared before the board and discussed several road
matters.
FIRST- CITIZENS BANK After a short discussion Commissioner Brock made a motion that
AGENT First Citizens Bank and trust Company be designated as the
paying agent for Harnett County's bonds and /or coupons. Com-
missioner Alphin seconded the motion and it carried unanimously!.
CASWELL CENTER CONTRI- In the past, the Board of Commissioners have made a contribu-

Santa Claus. Commissioner Cotton made a motion contribute

Commissioner Alphin seconded and the issue passed.
Henry Thompson, Director of the Health Department appeared
before the Board regarding the Home Health Agency Support.
After a discussion with the Board concerning this, the Chair-
man said to table this matter until the mid month meeting and
this will give the Board a change to study this in more detail
W. Earl Jones, Tax Collector, gave the report of his November
activities and his December plans for the Tax Collector's
Department.

HARNETT COUNTY DECLARED
DISASTER AREA C. P. Stewart appeared before the Board to request that Harnett
County be declared a disaster area eligible for emergency loan
due to the adverse weather conditions during the 1975 crop
growing season. Mr. Stewart asked that the Board send a lette
to the Governor of North Carolina regarding this matter. Com-
missioner Cotton . made a motion that the Board honor this reque
and write the Governor a letter requesting that the United
States Department of Agriculture declare Harnett County a disas
ter area. Commissioner Stewart seconded this motion and the
issue carried unanimously.
THOMAS ALLEN, TAX
SUPERVISOR
Thomas Allen, Tax Supervisor, appeared before the Board in
regards to Harold Lloyd Manor. of Route 1, Erwin, who appeared
before the Board at the mid month meeting in November request-
ing that a penalty for late listing be lifted from his tax
receipt due to the fact that his job entails travel over the
state and he failed to list before the deadline. There was
no action taken.
Clayton Clark, Bunnlevel, North Carolina,frefund on late list-
ing penalty for 1975 Tax Receipt #223 in/the of $57.46. Mrs.
Hazel W. Clark refund on late listing for the year 1975 in
Stewart Creek Township in the amount of $5.01. Commissioner
Brock made a motion that the Board honor this request and
Commissioner Cotton seconded, the issue carried.
Thomas Allen advised the Board of Commissioners that this was
the fourth year and horizontal adjustments could be made as of
January 1 of the fourth year following the revaluation. The
Board discussed this matter. .Commissioner Brock made a motion
that no adjustments of real property should be made and that
the existing property schedule should continue to be used.
Commissioner Stewart seconded and the issue carried.

The Tax Supervisor presented a list of list takers and county-
wide appraisers for the year 1976 and recommended the acceptant
of the Board. Commissioner Cotton moved for their acceptance.

Commissioner Cotton moved to approve the Personal Property
Schedule of Values for 1976. Commissioner Alphin seconded and
the issue carried.
In regards to the tax listing dates for the year of 1976, Com-
missioner Brock moved that the tax listing begin in the town-
ships on January 2, 1976, and continue until January 31, 1976.
Commissioner Cotton seconded and the issue carried.
The meeting adjourned at 12:00 p.m.
The Board reconvened at 12:15 after anexecutive session, and
reorganization is as follows:
Commissioner Cotton made a motion that the appointments and
reorganizations remain the same as last year and Commissioner
Stewart seconded. The issue passed with a unanimous vote.

Tony Tucker, County Planner presented a letter from S. Earl
Stewart agreeing to close and cease operation of Stewart's Air
port when the proposed Harnett County airport is in operation
for a sum of $5,000. Motion was made by Commissioner Alphin
and seconded by Commissioner Cotton to approve Mr. S. Earl
Stewart's proposal. The issue carried.
Tony Tucker also presented an "Option To Purchase Airspace and
Other Aeronautical Rights" as follows:
THIS OPTION Made and entered into this 1st day of December, 1975
by and between the COUNTY OF HARNETT, a body politic of the State
of North Carolina, hereinafter called the "County" and SHELTON STEWAR
Widower; SHELTER EARL STEWART and wife, JULIA P. STEWART, all of
Harnett County, North Carolina, all of whom are hereinafter referred
to and called "Stewart ";
W,-I T N E S S E T H :
THAT WHEREAS, the County of Harnett is in the process of estab-
lishing a County Airport; and
WHEREAS, lands hereinafter described are owned by Stewart and an
airport and landing field is located thereon and Stewart has certain
rights to the approaches to the landing field and the adjoining air-
space; and
WHEREAS, the County has authority to acquire such air rights by
virtue of the laws of the State of North Carolina to include N.C.G.S.
63 -36 and N.C.G.S. 153A -158; also see N.C.G.S. 153- A149(c)(4); and
WHEREAS, acquisition of the air rights referred to herein are
necessary requisites to the establishment of a county airport;
NOW, THEREFORE, in consideration of the promises and other good
and valuable considerations referred to herein, the parties agree:
1. The County of Harnett pays herewith the sum of One Hundred
Dollars ($100.00) to Stewart, the receipt of which is hereby acknow-
ledged and agrees to pay the additional sum of Four Thousand Nine
Hundred Dollars ($4,900.00) if the County exercises this option as
hereinafter provided for.
2. Upon exercise of this option by the County, Stewart agrees t
relinquish the right to use premises hereinafter described as an air-
port and agrees to relinquish the right to airspace over the property
and to relinquish the right to the approaches to the landing field
on the property and any and all other aeronautical rights.
3. The right to exercise this option by the County and purchase
the rights specified shall run for five (5) years from the date this
option is executed.
4. The terms of this option shall be binding on the heirs, suc-
cessors and assigns of the parties desidnated herein as Stewart and
the terms of this option shall run with and be a burden upon the
lands hereinafter described.
5. The airport and landing field referred to herein are located
on the following described tract of land:
FIRST TRACT:
Lying and being in Grove Township, Harnett County and being
part of the Shelton Stewart lands and described as follows:
BEGINNING at an iron stake in the run of Tar Branch the divi-
sion corner of Mary Hazel Stewart Byrd and Earl Stewart, said
point being located about 75 feet North of the public road
and runs North 69 degrees 21 minutes West 1,114 feet to an
iron stake, the division corner in J. H. Stewart line; thence
as a line with J. H. Stewart South 14 degrees 30 minutes
West 1,236.5 feet to an iron stake corner on a ditch bank
beside a 16 inch pine tree, (note the old bearing on this
line in a deed conveying in 1924 by U. A. Stewart, Widower,
to Shelton Stewart, reads North 7 degrees 0 minutes East
a variation of 7 degrees 30 minutes); thence as the old deed
South 84 degrees 30 minutes East 213.18 feet to an iron
corner in the field a corner with Harvey McLeod; thence as
his line as the old deed South 32 degreet 30 minutes East
1,538.46 feet to a large poplar in the run of Tar Branch;
thence as the various courses of Tar Branch in a northerly
direction to the beginning, containing 42.66 acres more or
less.

dated February 10, 1964 wherein Shelton Stewart conveyed the
foregoing land to Shelton Earl Stewart and wife, Julia P.
Stewart and retained a life interest.
SECOND TRACT:
All other land owned by Stewart to which the aeronautical
rights relating to the airport and landing strip herein
referred to exist.
