Mid -Month Meeting - July 21, 1975
MID -MONTH MEETING
The mid -month meeting for July was held on July 21, 1975. The Chai
man called the meeting to order at 7:30 P. M., and asked Commission
er Brock to lead the evening prayer. All the members were in atten
ance, also the County Auditor, H. D. Carson, Jr., who is also the
Clerk to the Board.
MINUTES The minutes from the previous meeting were read and approved.

ORDINANCE:
Mass Gatherings
In reference to the bids that were opened earlier for the furnish-
ing of gasoline for the county, the recommendation of the committee
was that the bid be awarded to Warren Brothers. The Board agree
unanimously on the recommendation and authorized the manager to
issue a letter of award to Warren Bros. Oil Company, Erwin, N. C.
H. D. Carson, Jr., County Auditor, presented a request to charge
off tax balances for the years 1963 and 1964. The following action
transpired:
Commissioner Cotton made a motion which was seconded by Commission -
er Alphin, that the tax balances for the years 1963 and 1964 be
charged off in accordance with resolution of July 1, 1970, as
recorded in Minute Book 12, at page 402. The vote was unanimous.
James Goff, Chairman Extension Department, appeared before the
Board to introduce to them Mr. Earl Childress who is an applicant
for the vacanct in the Extension Department caused by the resignat-
ion of Charles Hammond. He indicated that Mr. Childress had
been recommended also by the State Extension Department. Commiss-
ioner Brock moved that he be employed by the county to fill the
vacancy and that his salary be in compliance with the county policy
applying to the hiring of persons. Mr. Childress said he would
assume his duties on August 1, 1975. Commissioner Cotton seconded
the motion and the vote was unanimous.
Regarding the Ordinance regulating Mass Gatherings, as recorded in
Minute Book 13, at pages 440 -441: Commissioner Cotton, having
introduced an "Ordinance for Regulation of Mass Gatherings" on
June 16, 1975, and the proposed ordinance having been considered by
the members of the board, Commissioner Cotton moved for the adopt-
ion and upon a second to the motion by Commissioner Alphin and a
unanimous vote of the Commissioners, the following was adopted in
accordance with N. C. G. S. 153A -45:
ORDINANCE FOR REGULATION OF MASS GATHERINGS
1. PURPOSE. The intent and purpose of this Ordinance is to provide for
the protection of the public health, welfare and safety of those persons in
attendance at mass gatherings and of those persons who reside near or
are located in proximity to the sites of mass gatherings or are directly
affected thereby.
2. DEFINITIONS. The following definitions shall apply in the enforce-
ment and interpretation of this Ordinance:
(a) "Mass gathering" means the congregation or assembly in which
admission is charged in reasonable contemplation of profit of more than 500
people for a continuous period of more than six (6) hours in an open space
or open air, or in permanent buildings or structures. A mass gathering in
a permanent building or structure shall include only those assemblies
which by reason of their size the County Health Director determines to be
likely to pose a threat to public health safety or welfare through unsat-
isfactory provision of adequate public safety, fire and sanitary facilities.
A mass gathering shall not include an event sponsored by a school or other
agency of government or any private school when the assembly is of a size
and scope such that there is a reasonably apparent capability to service
the needs of that assembly without threatening the public health, welfare
or safety, as determined by the County Health Director.
(b) "Person" means any person, firm, corporation or legal entity/
(c) "Permittee" means any person who is issued a permit under this
ordinance by the County Health Director.
(d) "County Health Director" shall mean the Harnett County Health
Director or his authorized representative.
3. PERMIT REQUIRED, REVOCATION OF PERMIT. (a) No person shall or-
ganize, sponsor or hold any mass gatherings unless a permit has been issued
to such person by the County Health Director under the provisions of this
Ordinance. A permit shall be required for each mass gathering and is not
transferable to other persons.

(b) A permit may be revoked by the County Health Director at any
time if he finds that the mass gathering is being or has been maintained or
operated in violation of this Ordinance, or that prior to the mass gather-
ing, the planning or preparation for the mass gathering is not in compliance
with paragraph 7 of this Ordinance. A permit may be revoked upon the
request of the permittee or upon abandonment of the operation. A permit
may be revoked upon the request of the permittee or upon abandonment of the
operation. A permit will otherwise expire upon satisfactory completion of
the post - gathering cleanup following the close of the mass gathering.
4. APPLICATION FOR PERMIT. (a) Application for a permit for a mass
gathering shall be made to the County Health Director on a form and in
a manner prescribed by him, by the person who will organize, sponsor or
hold the ma -s gathering. The application shall be filed with the County
Health Director at least 30 days prior to the commencement of the mass
gathering. A fee of Ten Dollars ($10.00) shall accompany the application.
(b) The application shall contain the following information:
identification of the applicant, identification of any other person(s) resp-
onsible for organizing, sponsoring or holding the mass gathering, the
location of the proposed mass gathering, the estimated maximum number of
persons reasonably expected to be in attendance at any one time, the date
or dates and the hours during which the mass gathering is to be conducted,
and a statement as to the total time period involved.
(c) The application shall be accompanied by an outline map of the area
to be used, to approximate scale, showing the location of all proposed
and existing privies or toilets; lavatory and bathing facilities; all water
supply sources including lakes, ponds, streams, wells, storage tanks, etc;
all garbage and refuse storage and disposal areas; all entrances and exits
to public highways; and emergency ingress and egress roads.
(d) The application shall be accompanied by such additional plans,
reports and information required by the County Health Director as he
shall deem necessary to carry out the provisions of this Ordinance.
5. PROVISIONAL PERMIT; PERFORMANCE BOND; LIABILITY INSURANCE. (a) With-
in ten (10) days after the receipt of the application, the County Health
Director shall review the application and inspect the proposed site for
the mass gathering. If it reasonably appears that the requirement of this
Ordinance can be met by the applicant, a provisional permit shall be issued.
(b) If the County Health Director shall deem it necessary to pro-
tect the health, welfare and safety of those persons in attendance at
mass gatherings and of other persons who may be affected by mass gatherings
and to carry out the provisions of this Ordinance, he may require the
permittee within five (5) days after issuance of the provisional permit
to file with the County Health Director a performance bond or other surety
to be executed to the County in the amount of Five Thousand Dollars
($5,000.00) for up to 10,000 persons and One Thousand Dollars ($1,000.00)
additional for each additional 5,000 persons or franction thereof,
reasonably estimated to attend the mass gathering. The bond, if required,
shall be conditioned on full compliance with this Ordinance and shall be
forfeitable upon noncompliance and a showing by theCounty Health Director
of any injury, damage or other loss to the County or local governmental
agencies caused by the noncompliance. The permittee shall in addition
file satisfactory evidence of public leability and property damage ins-
urance in an amount determined by the County Health Director to be reason-
able (but not to exceed One Million Dollars ($1,000,000.00) in amount in
relation to the risks and hazards involved in the proposed mass gathering.
6. ISSUANCE OF PERMIT; REVOCATION; FORFEITURE OF BOND; CANCELLATION.
(a) If, upon inspection by the County Health Director fifteen (15) days
prior to the starting date of the mass gathering, or earlier upon request
of the permittee, the required facilities are found to be in place and
satisfactory arrangements are found to have been made for required services,
and other applicable provisions of this Ordinance are found to have been
met, theCounty Health Director shall issue a permit for the mass gathering.
If, upon such inspection, the facilities, arrangements, or other prov-
isions are not satisfactory, the provisional permit shall be revoked and
no permit issued.
(b) Upon revocation of either the provisional permit or the permit,
the permittee shall immediately announce cancellation of the mass gathering
in as effective a manner as is reasonably possible, including but not limited
to the use of whatever methods were used for advertising or promotion
the mass gathering.
(c) If the provisional permit or the permit is revoked prior to or
during the mass gathering, the County Health Director may order the permittee
to install such facilities and make such arrangements as may be necessary
to accommodate those persons who may nevertheless attend or be present
at the mass gathering despite its cancellation and to restore the site to a
safe and sanitary condition. In the event the permittee fails to comply
with the order of the County Health Director, the County Health Director
may immediately proceed to install such facilities and make such other

arrangements and provisions for cleanup as may minimally required
in the interest of public health and safety, utilizing such county and
local funds and resources as may be available to him. Prior to or within
60 days after such action, the County Health Director may apply to a court
of competent jurisdiction to order forfeiture of the permittee's perform -
ance bond or surety for violation of this Ordinance. The court may order
that the proceeds shall be applied to the extent necessary to reimburse
the County and other government agencies for expenditures made pursuant
to the action taken by the County Health Director upon the permittee's
failure to comply with his order. Any excess proceeds shall be returned to
the insurer of the bond or to the surety after deducting court costs.
7. RULES AND REGULATIONS. The Rules and Regulations to protect the
health welfare, and safety of those attending mass gatherings and of other
persons who may be affected by mass gatherings adopted on October 28, 1971,
and promulgated by the North Carolina Division of Health Services are here-
by adopted as the rules and regulations of Harnett County, except where
they conflict with any of the provisions of this Ordinance. These rules
and regulations dated October 28, 1971 are incorporated hereby reference
pursuant to G. S. 153A -47 and an official copy shall be filed int the
Office of the Clerk to the Board of Commissioners and made available by
him for public inspection.
8. PENALTY. Any person who violates any provision of this Ordinance
shall be guilty of a misdemeanor and shall be punished as provided in
G.S. 14 -4. The County Health Director may through a court of competent
jurisdiction enjoin violations of this Ordinance.
9. SEVERABILITY. If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held to be invalid, such dec-
ision shall not affect the remaining portions thereof.

REPORT OF THE MANAGER
County Manager Brock reported on the following activities of the
ji County: The progress being made on CETA funds from the from the
Office of Manpower Services, the Health Facility for the Pineview
Area, in that it will be ready for delivery within three weeks, and
that requests for grants from Coastal Plains were being prepared.
LIBRARY BUDGET AMENDMENT
REQUESTED Commissioner Brock presented a request that the Library budget be amenIld-
ed in the amount of $1,000. in State Funds and $1,987. in Federal
funds, due to calculations in grants figures. Commissioner Alphin
moved the request be granted, Commissioner Brown seconded and the
vote was unanimous.

By a motion of Commissioner Brown, a second by Commissioner Alphin,
and a unanimous vote, the following vehicles were declared as surplus !

Commissioner Cotton moved that Charles Ellen be permanently exempted
from having to purchase peddlers license and that he and the Tax
Collector be notified of this action. Commissioner Alphin seconded
the motion and it passed.
DECLARATION OF
National Farm Safety Week
James Goff, Chairman Extension Department, presented and read to the
Commissioners, a proclamation declaring the week of July 25 -31 as
National Farm Safety Week for 1975. Commissioner Cotton moved for
the adoption of the proclamation, Commissioners Brown and Alphin
seconded and it passed. The proclamation follows:
PROCLAMATION
NATIONAL FARM SAFETY WEEK 1975
Our very lives are sustained by agricultural products. The importance
of each and every person involved in the production of these agricultural
products is often forgotten.
These people work long hours and are routinely exposed to equipment and
situations which can be extremely dangerous. Several farmers and farm helpers
lose their lives each year due to accidents on the farm. Some of these
accidents could be avoided with proper precautions. We need each and everyone
of our agricultural producers.
THEREFORE, the Harnett County Board of Commissioners do hereby designate
the week of July 25 -31, 1975 as Harnett County Farm Safety Week. During this
week and the ensuing year we urge all who live and work on the farm to plan and
implement ideas aimed at accident prevention. We further urge all individuals
who work on agricultural supportive jobs to aid the farmers through encourage-
ment and making available to them all information and educational aids possible.
Please let us remember that every life is worth a few minutes of preventive
planning.

MASSAGE PARLORS
Regarding massage parlours, Commissioner Cotton introduced the foll-
owing ordinance entitled "ORDINANCE OF THE COUNTY OF HARNETT ", and
asked that, according to procedure, the ordinance lie for two weeks
before any action be taken. The ordinance follows:
ORDINANCE OF THE COUNTY OF HARNETT
TITLE: AN ORDINANCE REGULATING THE BUSINESS OF MASSAGE AND MASSAGE PARLORS
1. Definitions. (a) "Massagist" (either male or female). One who offers
to massage another for a salary or fee.
(b) "Massage parlor." Any place of business where massagists are
employed to offer massage for a salary or fee.
2. Licensed health professionals excluded. Licensed health professionals
acting in the ordinary course of their profession are neither "massagists" as
defined in paragraph 1 (a) nor owners of "massage parlors" as defined in
paragraph 1(b).
3. License required. A person may not (a) work as a massagist or (b) oper-
ate a massage parlor unless licensed.
4. Issuing of licenses, fee required. The Sheriff shall issue a license
to any eligible person who pay s an annual fee of $50.00 (Fifty Dollars) for a
massagist's license or of $500.00 (Five Hundred Dollars) for a massage parlor
license. Such licenses shall be valid for one year only and must be renewed
annually.
5. Persons ineligible for licenses. The following persons may not be
licensed to work as a massagist or to hold a massage parlor license:
(a) A person who has been convicted of a crime involving sexual mis-
conduct including but not limited to those covered by G. S. 14, Article 26
(Offenses Against Public Morality and Decency) and G.S 14, Article(Prostitution).
(b) A person under 18.
(c) A person convicted of violating this ordinance.
6. Posting required. (a) The Sheriff shal provide a copy of this ordinance
for posting to each massage parlor licensee upon licensing.
(b) Each massage parlor licensee shall display in a prominent place the
license issued pursuant to this ordinance together with a copy of this ordinance.
(c) Each massagist shall post his license in his work area.
7. Fingerprinting required. An applicant for a license shall submit to
fingerprinting. The fingerprints may be sent to the S.B.I., F.B.I., or other
appropriate law enforcement agencies.
8. Prohibitions and limitations. (a) Minimum Age. (1) No person in the
business of massage may massage a person under 18 except under the direction
of or by order of a licensed health professional. (2) No person may employ one
under 18 to work as a massagist.
(b) Limitation on hours of operation. Massage parlors may operate
only between the hours of 8 o'clock a.m. and 10 o'clock, p. m.
(c) Limitation on scope of massage. No massagist may in the course
of business massage the penis, scrotem, mons veneris, vulva, or vaginal area of
another.(d) Inducement to violate ordinances or provisions of General Statutes
relating to sexual misconduct. No person may induce a licensee or employee or
agent thereof to violate this ordinance or any provision of the General Statutes
of North Carolina pertaining to sexual misconduct including but not limited to
that covered by G.S., Article 26, (Offenses Against Public Morality and Decency),
and G. S. 14, Article 27 (Prostitution).
(e) Licensee required to supervise. Massage parlor licensees shall super-
vise the conduct of massagists in their employ. Failure to suppress illegal
activity is grounds for revocation of a license.

9. Massage parlors subject to inspection. The Sheriff or any member of
his department may inspect massage business premises during the hours that they
are open for business.
10. Revocation. (a) The Sheriff shall revoke the license of any licensee
who has violated this ordinance.
(b) Such revocation may be made only after written notice of the grounds
for revocation has been given to the licensee and he has had an opportunity to
answer the charges.
11. Violation a Misdemeanor. Violation of this ordinance is punishable by
a fine of not more than $50.00 (Fifty Dollars) or imprisonment for not more
than 30 (thirty) days.
12. Injunctive relief available. This ordinance may be enforced by any
appropriate equitable remedy as authorized by G. S. 153A -123.
Attorney Edward McCormick presented the following for consideration
of the Board regarding the sale of property in the Town of Coats:
THAT, WHEREAS, the County of Harnett was the high bidder at
the tax foreclosure sale of that lot in the Town of Coats, Grove
Township, Harnett County, North Carolina, formerly owned by Jackson Lee
Pleasant and wife, reference is made to that case - County of
Harnett v Jackson Lee Pleasant and others SD No. 3368, and
WHEREAS, the owner's interest in said lot has been trans -
ferred by the owner to Rachel P. Salmon who has requested the County
of Harnett to assign its bid to her upon condition she pay all costs
of the tax foreclosure suit and all back taxes, and the County of
Harnett has agreed.
NOW, THEREFORE BE IT RESOLVED:
That the Chairman and the Clerk be and they are hereby
empowered and authorized to execute in the county's
name an instruement properly assigning its high bid in the
aforesaid tax foreclosure suit unto Rachel P. Salmon
upon condition that she shall first pay all costs of the
Tax foreclosure suit and all delinquent taxes together
with penalties and interest. Done July 21, 1975.

Commissioner Cotton moved to approve the foregoing resolution,
Commissioner Brock seconded the motion and the issue passed
favorably.
Paul Soublet came to the Boardneeting regarding a right -of -way
problem. He was referred to the County Attorney for consultation..
LANDFILL REPORT BY
County Mgr. The County Manager reported to the Board the progress and existing
conditions of the entire landfill program of the county. The Comm-
issioners declared the Mamers area a point to implement a Pilot
Program for a mini - landfill site, at a projected expenditure in
a reasonable amount, as follows for the first year:
Site $500 - Ramp Construction $3,000. — Rent- containers 12 x $170.
$2,040. - Container service 52 x $80. $4,160. - Gen. Maintenance
$500.. After discussion, Commissioner Alphin moved to execute a
Pilot Program in the Mamers Area as proposed by the County Manager,
and asked that a detailed record be kept of the operation, Comm-
issioner Brown seconded the motion and the issue passed.
OUNTY SURVEYOR
ike Donovan Mike Donovan, County Surveyor, appeared before the Board to discuss
county -wide tax mapping. He requested a budget of $1,500. for this
fiscal year to begin the project and to purchase a steel cabinet in
which to house the maps and records. He was accompanied by James
Spell, Tax Supervisor from :Sampson County, who showed the Commiss-
ioners maps that were being presently used in his county and told
them of the advantages of such a system. The Chairman asked that Mr
Donovan and Thomas Allen, Tax Supervisor, prepare a consolidated
proposal, perhaps in writing, for the consideration of the Board
at their next meeting.

now in the County and was available at any time and would welcome
