REGULAR SESSION CALL TO ORDER The Harnett County Board of Commissioners met in regular session on Tuesday, September 3, 1974, Monday being a legal holiday. Proper notification was made as to the change of the meeting date. The Chairman called the meeting to order at 9:30 p.m., with the following members present: Chairman M. H. Brock, Commissioners C. E. McLamb, W. J. Cotton, Jr. and Bobby R. Etheridg -. Also present, Edward H. McCormick, County Attorney. MORNING PRAYER Chairman Brock offered the morning prayer. READING AND APPROVAL OF MINUTES The minutes of the previous meeting were read and approved. JAMES GOFF, CO. EXT. AGT. Mr. James Goff, County Extension Agent, presented a report of the Harnett County Recreation Committee. Mr. Goff reported that through Region M Council of Governments and under the Comprehen- sive Employment and Training Act, monies had been made available for recreation in the local areas. He stated that after consideration, the Committee decided to use the funds in the amount of $7,000, to purchase equipment for the programs now in existence within the local areas. Mr. Goff stated that bids were let for the equipment and that the equipment is tooling distributed by Mr. G. D. Considering the cost of replacement, it was re- commended that the instrument be repaired. Upon motion by Commissioner C. E. McLamb, seconded by Commissioner W. J. Cotton, Jr., Mr. Goff was authorized to have the transit r' repaired up to a cost of $250.00. Motion carried. REQUEST FROM AMERICAN RED CROSS Letter of Request for Contribution from Mr. Marvin Raynor, Chairman of the N. C. Chapter of the American Red Cross: "WHEREAS, August 29, 1974, The Executive Committee, on behalf ^ of the Red Cross Blood Program passed a resolution in support of the services to the citizens of Harnett County as follows: NOW THEREFORE, BE IT RESOLVED that the Harnett County Chapter of the American Red Cross do hereby ask for a contribution in the amount of $1,000.00 from the Harnett County Commissioners to assure the continuation of the American Red Cross Blood Program in Harnett County for the coming of 1974 and 1975. The Executive Committee of the Harnett County Chapter of the American Red Cross greatly appreciates the County Commissioners Considering this request. Sammy Stephenson, Highway Commissioner, appeared before the Board along with Mr. Donald Cooper, District Engineer of DOT and Mr. E. H. Butler, Chief Engineer of the 6th Division of DOT. E. McLamb moved that the board approve the above report and that a resolution to this effect be forwarded to the Department of Transportation. Commissioner W. J. Cotton, Jr., seconded the motion and it carried unanimously. 1318 AIRPORT COMMITTEE REPORT Action Mr. Tony M. Tucker, Director of Harnett Development Commission and Mr, Keith Finch, Chairman of the Airport Committee appeared before the board to bring the board up to date on the progress of the committee. Mr. Tucker reported that a suitable site was under investigation and had been tentatively approved by FAA. He informed the board that a 344 acre site located south of Buies Creek and that appraisal of the property was now in progress. The tract of land is owned by D. E. Lasater and Mr. Ralph Hanna 1 has been secured as the appraiser. Mr. Tucker pointed out that the Airport Committee was primarily seeking approval of the pro- ject and the geographic location of the site, approval of the engineering contract and the authorization to proceed with the option once the appraisal has been completed and the price of the1j land established. Commissioner W. J. Cotton, Jr., moved that the board accept the proposal as presented by the Airport Committee and approve the engineering contract upon recommendation of the committee and allow the committee to continue to negotiate to option the nec- essary land when all FAA and other requirements have been met. Motion was seconded by Commissioner C. E. McLamb and carried. N.C. Department of Natural & Economic Res. Mr. James Kier of the North Carolina Department of Natural & Econ omit Resources, Mort Congleton and Debra Gallant of Region M Council of Government appeared before the board to explain a pro -1 posal of the Division of Community Assistance which will provide 1 technical assistance in management and planning matters relating to Harnett County. resolution for participation TAX COLLECTOR W.E. Jones I. TECHNICAL ASSISTANCE WITH MANAGEMENT AND PLANNING MATTERS. The Department of Natural and Economic Resources will provide technical assistance designed to assist Harnett County's elected officials and citizens in the assessment of needs and opportunities for expanding and managing local services and growth This assistance will function in the following areas: (1) Expanding or establishing a community data file and organizing data into an easily available community pro- file. This profile will be used in compiling, pres- enting, and analyzing the county's social, economic, governmental and developmental needs. (2) Proceed to assist the elected officials and citizen with definition of policies and priorities; determina- tion of specific, sometimes quantifiable, objectives to be achieved in line with community development policies formulation and evaluation of alternative strategies to meet determined objectives; finalization of programs and allocation of resources as means of implementing development policies. (3) Aid in the implementation of programs through coor- dination of available and applicable local, regional, state, and federal capabilities and resources. Improve intergovernmental relations. (4) Monitoring and evaluation of on -going programs. (5) Perform research and assistance with implementat- ion of basic policies adopted by the governing body in conjunction with the community planning and develop- ment process. Based on previous problem seeking activities in Harnett County the following work items could be completed by the Depart- ment of Natural and Economic Resources during the contract year. However, should more pressing problems emerge that would affect development, the expansion of services, or the protection of the environment, these following items would not be binding. (1) Base Mapping (2) Land Development Plan A resolution for participation in the project was presented for adoption by the board. The matter was held in abeyance. Mr. W. Earl Jones, Tax Collector presented a report from his department. Mr. Jones reported that 1974 notices for collection of taxes are prepared and ready for mailing. The charge was given to Mr. Jones to proceed with the collection of the 1974 taxes. CHARGE TO TAX COLLECTOR NORTH CAROLINA HARNETT COUNTY TAX SUPERVISOR BLACK RIVER RES CUE DISTRICT 1974 Taxes TO: W. Earl Jones, Harnett County Tax Collector You are hereby authorized, empowered and commanded to collect the taxes set forth in the tax books filed in the office of the Harnett County Tax Supervisor and in the receipts herewith delivered to you, and in the amount and from the taxpayers therein set forth, (and also, all other taxpayers and taxes represented by official tax receipts for years other than the current year) and such taxes are hereby declared to be a first lien on all real property of the respective taxpayers in Harnett County and this order shall be a full and sufficient authority todirect, require and enable you to levy on and sell any real or personal property of said taxpayers, for and on account thereof in accord- ance with law. Blanchard Assistant Clerk to the Board Mr. Thomas Allen, Tax Supervisor, reported the progress of his department. He submitted a request for release from penalty charges from The Open Air Market in the amount of $20.06. Receipt forn No. 5853. It was pointed out that this is a release from penalty and not a refund. Upon a motion by Commissioner C. E. McLamb, seconded by Commissioner Bobby R. Etheridge, request was granted. Motion carried. Mr. Allen reported that the calendar for establishing the Black River Rescue District has been fulfilled, that notices were mailed to all persons on the Black River Scroll. A certified copy from the Harnett County News that due notice has been given was presented. A public hearing will be h eld at 8:00 p.m. on September 3, 1974. A tentative moving date of September 11 through 13 was set. The meeting was adjourned to the Town Hall in Angier for the pur- pose of a public hearing for the Black River Rescue District at 8:00 p.m. this date. In the Executive meeting, called immediately after the adjourn- ment of the daytime meeting of the Board at the Courthouse, the Board adopted a resolution and contract with the N. C. Depart- ment of Natural Resources (see earlier reference in this day's record of the minutes), and authorization was given to the Chair- man and Clerk to execute the document. Motion was made by Comm- issioner Cotton, seconded by Commissioner MUDS Etheridge and the vote was unanimous. PURCHASE OF TYPEWRITER FOR SHERIFF Motion by Commissioner Cotton, Seconded by Commissioner McLamb that the Sheriff's Department be authorized to purchase a tre- writer and that it be charged to the present budget. Motion unanimously passed. 8:00 P.M., PUBLIC HEARING CALLED TO ORDER The /public hearing was called to order at 8:00 p.m.. Approximate - ly nterested persons attending and all the Commissioners were present except Mr. Gilbert Brown. 1320 RESOLUTION A CALLED MEETING The following inserted pages becomes a part of the minutes of the public hearing held on Tuesday, September 3, 1974: Pages numbering 320.1 through 320.10. At the close of the public hearing, the Board members composed themselves for a meeting of the Board. A motion was made by Commissioner McLamb, seconded by Commissioner Etheridge that the auditor be authorized to reimburse the registration fee to those who attended the North Carolina Association of County Commissionenjs in the amount of the fee in its entirety, $30.00. Motion carried. The meeting adjourned at 9:15 p.m. Be Chairman Brock 3ae,/ R E.S 0 L U T 10 N BE IT RESOLVED by the Board of Commissioners for the County of Harnett: Section 1: A special property tax referendum is hereby called to be held between 6:30 a.m. and 7:30 p.m. on Tuesday, November 5, 1974, at which time there shall be submitted to the qualified voters of Angier -Black River Emergency Rescue Service District (the boundaries of which are identical to Black River Township) the question stated in the Notice of Special Property Tax Referendum set forth in section three of this resolution. Section 2: For said referendum, (i) the regular registration books for elections in Black River precinct, Harnett County shall be used and the registration books, process or records rr shall be open for the registration of qualified persons and for public inspection in the manner, under the conditions and at the times and places as provided in said notice set forth in Section 3 of this resolution, (ii) the registrars, judges, and other officers of elections appointed by the County Board of Elections of Harnett County for Black River precinct and voting place in said precinct shall be the election officers for such precinct and voting place, and (iii) the precinct and voting place shall be the one fixed by said County Board of Elections as provided in said notice set forth in Section 3 of this resolution, subject to change as provided by law. wae 5,2,0x. Section 3: The County Auditor and ex officio Clerk shall cause a notice to be published in The Harnett County News and the Angier Independent once at least fourteen days before Monday, October 7, 1971j. (being the last day in which persons may register for said referendum) and once again not less than seven days before said day, such notice to read substantially as follows: NOTICE OF SPECIAL PROPERTY TAX RE±I'ERENDUM IN THE ANGIEER -BLACK RIVER AMBULANCE AND RESCUE SQUAD SERVICE DISTRICT (the boundaries of which are identical with Black River Township), HARNETT COUNTY, NORTH CAROLINA A special property tax referendum will be held an the Angier -Black River Ambulance and Rescue Service District (the boundaries of which are identical with Black River Township), Harnett County, North Carolina between 6:30 a.m. and 7:30 p.m on Tuesday, November 5, 1972.., at which time there will be submitted to the qualified voters of said district the following question: "Shall Harnett County be authorized to levy annually a property tax at an effective rate not in excess of fifteen cents (S.15) on the One Hundred Dollars (S100.00) value in the Angier -Black River Emergency Ambulance and Rescue Squad Service District for the purpose of pro - viding emergency ambulance and rescue squad service ?" For said referendum the regular registration books for elections in Black River precinct, County of Harnett will be used and the registration books, process or records will continue to be open for the acceptance of registration applications and the registra- tion of qualified persons between the hours of 8:30 a.m. and 5:00 P.M. on Monday to Friday, inclusive, of each week •at``the Office of the -3- County Board of Elections of Harnett County located at Agriculture Building, 19 East Front Street, in Lillington. In addition, registration applications will be accepted and qualified persons may register with the registrar for the precinct of Black River in Harnett County at said registrar's home or at the Town Hall and qualified persons may also contact the County Board of Elections at the office of said Board mentioned above, telephone number (919) 893 -4495. The last day for new registration of those not now registered under Harnett County's permanent registration system is Tuesday, October 7, 1974. The last day on which registered voters who have changed residence from one precinct to another may transfer registration is Tuesday, October 7> 1974• Any qualified voter of the County who is qualified to vote by absentee ballot under the provisions of the General Statutes of North Carolina, particularly Article 20 of Chapter 163, in a state- wide primary or general election is authorized to vote an absentee ballot in said special property tax referendum in accordance with said provisions of the General Statutes relating to absentee voting. Any qualified voter of the County who is qualified to vote by absentee ballot in said special property tax referendum may apply for an absentee ballot not earlier than sixty days prior to said special property tax referendum and not later than 6:00 p.m., Wednesday, October 30, 1974 at the office of the County Board of Elections mentioned above. 300: Qualified voters who are not certain whether they are registered or qualified to vote by absentee ballot should - contact the "County Board of Elections at the office of said Board mentioned above. The registration books for elections in Harnett County will be open to inspection by any registered voter of the County during the normal business hours of the County Board of ,Elections on the days when the office of said Board is open, and such days- are Challenge Days. The registrars, judges and other officers of elections appointed by the County Board of Elections will serve as the election officers for said referendum. The precinct and the voting places for said property tax referendum, subject to change as provided by law, is as follows: Black River Precinct Angier Town Hall Main Street Angier, North Carolina,' Thad H. Cotton, seconded by Bob Etheridge, the foregoing resolution entitled: "RESOLUTION CALLING FOR A SPECIAL PROPERTY TAX REFERENDUM" was passed by the following vote. Ayes: 3 Noes; a The Chairman, M. H. Brock, declared the hearing closed at 9:00 p. 3020.7 R E S O L U T I O N THAT, WHEREAS, a report concerning a proposed Ambulance and Rescue Service District for the area of Harnett County known as Black River Township was filed with the Board of Commissioners of Harnett County on August 5, 1974; and WHEREAS, the Town of Angier had consented to be a part of such district on July 19, 1971.; and WHEREAS, The Board of Commissioners of Harnett County called a public hearing to be held on September 3, 1974 at 8:00 p.m. at the Town Hall in Angier; and WHEREAS, the Commissioners directed Herbert Carson to publish a copy of the notice of such hearing in The Angier Independent on August 22, 197L1; that an affidavit from the editor of The Angier Independent has been filed with the Clerk to the Board of Commissioners showing that such notice was duly given; and WHEREAS, Thomas Allen was directed to mail a copy to all property owners within the boundaries of the proposed district as shown on the county tax records as of January 1, 1974 and has filed his certificate of service with the board; and WHEREAS, the hearing was held at the stated time and place and the following persons appeared and spoke for the proposed district: Mr. J. W. Johnson, President, Angier Chamber of Commerce; Mr. Paul Bailey, immediate past president of Angier Chamber of Commerce; Mr. Haywood Hall, Angier Banker; Mr. Eddie Smith, President of Angier Rescue Squad; Ms. Inez Lee; Mr. Lee Wayne Tutor and Mr. Earl Overby; an d WHEREAS, there was no opposition voiced to the proposal; and 3Qop WHEREAS, the Commissioners having fully considered the views of those who appeared at the hearing and having duly considered the r' facts presented in the report filed with the Board on August 5, 1974 ,. regarding the establishment of a proposed Ambulance and Rescue Squad Service District and having specifically considered those facts set forth in Part II of the report regarding standards, the Board finds nd concludes that: 1 The is a demonstrable need for providing ambulance and rescue "service in the area of Harnett County known and defined as Black River Township :since there has been an average of 22 emergency calls a month to the existing volunteer rescue squad serving the area. It is impossible or impractible to provide rescue services on a county wide basis under the proposed system of volunteers who have' a primary interest in their community ;_ that, urther, volunteers 1.6 Harnett County do not have a central hospital in the county to which injured persons can Le taken it would be impracticable to expect volunteers to go to the county seat of all the adjoining counties of Lee, Cumberland and Wake; that the present proposal is practicable because the volunteers in the Angier area' are served by the nearby hospitals of .Wake County. It is economically feasible to provide the proposed services for the proposed district without unreasonable or burdensome annual tax levies, it being projected that the annual levy will not exceed .15 per 100.00 of valuation. 32c. 7 -3- 4. There is a demonstrable demand for the persons residing in the district in that there now exists 22 emergency calls per month and such emergency service has been requested by the following: (1) The Town of Angier, (2) The Chamber of Commerce, (3) The Kiwanis Club and, further, the demand has been such that 27 citizens now work on a volunteer basis with the Rescue Squad in Angier. NOW, THEREFORE, be it resolved by the Board of Commissioners of Harnett County that: ■ 1. An Ambulance and Rescue Service District is hereby established and defined as follows: A. Boundary or Area to be Served. The area to be served by the Ambulance and Rescue District shall be that area of Harnett County now described and defined as Black River Township and shall include the area known, described and defined as The Town of Angier. B. Name of the Service District. The service district shall be known as "Angier - Black River Emergency Ambulance and Rescue Service District. C. Specific Services to be Provided. The services shall be limited to the following: a. Rescue Services. b. Emergency Ambulance Service. D. Plan. The plan for providing such services shall be in accordance with the plan set forth in the report heretofore filed with the Clerk to the Board of Commissioners by Tom Lanier. This resolution shall be effective July 1, 1975 if a property tax for the purpose o providing ambulance and rescue services is approved by a vote of the people living in the Angier-Black River Emergency Ambulance and Rescue Service District.
