HomeMy WebLinkAbout07221974300 MEETING OF THE BOARD OF COMMISSIONERS OF JULY 22, 1974 MID -MONTH MEETING The July mid -month meeting of the Harnett County Board of Commiss- ioners was held on Monday, July 22, 1974, in the Commissioners Roo k Courthouse,Lillington. The Chairman called the meeting to order at 7:35 p.m., with the following members present, C. E. McLamb, W. J. Cotton, Jr., and Gilbert Brown. Also attending was H. D. Carson, Jr., Clerk to the Board and Edward McCormick, County Att- orney. MINUTES The reading of the minutes was delayed for later recall. SERVICE DISTRICT #1. Casey Fowler The first item of business was Service District #1, and was the factor which prompted a joint meeting of the Planning Board, representatives from Moore- Gardner & Associates with the Harnett Board of Commissioners. Mr. Brock gave three topics that were to be discussed: A- A grant the county could receive. B- The status of Campbell College in the Service District. C- The topic of discussion held with the Local Government Comm- ission in Raleigh. Mr. Casey Fowler, Chairman of the Planning Board, opened the dis- cussion and then gave the floor to Roy Spainhour from Moore -Gard- ner to make the statements. Mr. Spainhour stated that he had received written support for the Service District #1 from the town officials of Coats, Lillington and Angier. He then gave an analysis of the situation as it pertains presently to Campbell College: there are 559 separate customers, 31 connections for college physical plant buildings. Other facts: Total cost of the project $ 6,480,000. Clean Water Bond 1,587,000. Balance $ 4,893,000. At 5% interest, the amount needed to repay each year would be $285,164.04, plus operating costs in addition to that figure whit would be $178,799.96, which would total per year $463,964.00 - total cost per year to the county. To pay these amounts, the lev on those persons living and owning property in this district woul be 18$. Without the 559 persons connected with Campbell College, the levy would be 20$ ad valorem tax. Chairman Fowler spoke and reported that the Planning Board was in full support of the program. Frank Lewis, Mayor of Lillington, stated that he would also like to see the implementation of the program begun as soon as possibl Commissioner McLamb stated that he would like to propose the plan be begun if the money is available. Commissioner Cotton moved that Casey Fowler, Mr. Moore, Edward McCormick and Chairman Brock be au thorized to meet again with Local Government Commission, in order to begin the implementation in the proper procedure. Commissioner McLamb seconded and the issue passed. The meeting with Local Government was tentatively set for July 26, 1974. GRANT ACCEPTANCE FROM DEPT. OF HUMAN RESOURCES Pertaining to Part A of the materials received from the Depart- ment of Human Resources, Section III - Acceptance, Commissioner Cotton moved that the Clerk and Chairman be authorized to execute the grant acceptance - $1,521,943. - Commissioner Brown seconded the move and the issue passed. PETITION FROM THOMAS LANIER Thomas Lanier, Assistant Director of Civil Defense, came-before the Board on behalf of the Angier Rescue Unit District. He pre - sented the following petition to the Board: PETITION to Honorable M. H. Brock, Chairman and members of the Board of County Commissioners of Harnett County, Lillington, North Carolina. The undersigned, Tom Lanier, Assistant Civil Defense Director of Harnett County, respectfully shows unto the Board: I That as Civil Defense Director, it has come to his attention that a need exists in the area of Harnett County known as Black River Township for increased rescue squad services. II 1. That it has been determined that a special service district can be established under Article 16 of G. S. 153A -300 et seq. It reads: Action "Purposes for which districts may be established. The Board of Commissioners of any county may define any number of service districts in order to finance, provide, or maintain for the districts one or more of the following services, facilities and functions in addition to or to a greater extent than those financed, provided or maintained for the entire county:" . . . (7) "ambulance and rescue . . . . "(This sub- paragraph seven (7) was added by Chapter 1375 of the 1973 Session (2nd Session in1974) and was ratified on April 12, 1974 and made effective that date.) 2. Attached hereto is a calendar for establishing the district and a calendar for holding a referendum on approval by the people of a levy for rescue purposes. 3. That before a hearing can be held on forming a district, it is necessary to prepare a report conforming to the requirements of law and it is also necessary to give written notice to taxpayers in the district. WHEREFORE, the undersigned petitions the board to appoint a person to prepare the required report and designate an official of the County to give the required Notice to taxpayers in the proposed district. This 16th day of July, 1974. /s/ Tom Lanier Assistant Civil Defense Director. �jZ 'J Commissioner{ moved the adoption of the following resolution, Comm- issioner McLamb seconded and it was passed: RESOLUTION Whereas, Tom Lanier, Assistant Civil Defense Director for Harnett County, has presented to the Board of County Commissioners a Petition requesting that a report of the Ambulance and Rescue Serv- ice Requirements for the area of Harnett County known as Black River Township be prepared in accordance to G.S. 153A- 301(b) and filed with the Commissioners; and WHEREAS, it appears to the Board of County Commissioners that Tom Lanier, Assistant Civil Defense Director, is a proper person to conduct a study and prepare the necessary report; and WHEREAS, Notice to all taxpayers in the proposed district mut: be given thirty (30) days prior to any public hearing; NOW, THEREFORE, It is resolved by the Board of County Commissioners of harnett County: 1. That Tom Lanier be and he is hereby authorized to conduct a study of the needs for a service district for rescue services in the territory of Harnett County known as Black River Township and prepare a report as required by Chapter 153A, Article 16 of the General Statutes of North Carolina; that he determine whether or not the Town of Angier agrees to be included. 2. That Tax Supervisor Tom Allen is hereby requested to determine the most practicable and feasible manner of giving notice to all taxpayers in Black River Township and make necessary araange- ments for giving such notice. This the 22nd day of July, 1974. LIBRARY APPOINTMENTS Commissioner Brown moved that the foregoing incumbent members to the Library Board be reappointed and for the number of years indicated, Commissioner McLamb secontd the motion and it passed: Mr. R. Brantley requested that he be allowed to hook onto the water line at the Lee - Harnett Mental Health Center in Buies Creek to furnish water to his dwelling that is adjacent. Commissioner Brown moved that the County grant an easement across its Mental Health property in Buies Creek to Kenneth R. Brantley and also to grant to him the right to tap onto the water line now existing on the property, provided that: ,02 FOUR COUNTY FAIR DATES RES. TO AMEND BUDGET ADJOURNED 1. Kenneth R. Brantley pay to the County of Harnett the sum of $350. as a tap on fee and as a fee for the easement,; and 2. Provided that Kenneth R. Brantley will not permit others to tap onto this water line without prior permission from the County of Harnett, and provided further if the tap on is made that Kenneth R. Brantley will restore the landscaping and driveway to its present condition, 3. Provided further that Kenneth R. Brantley agrees to become a part of any district water system established by the County of Harnett, 4. Provided further that this right apply to Kenneth R. Brantley, his successors and assigns and 5. Provided that the conditions of this resolution be put into the form of an agreement between the County of Harnett and Kenneth R. Brantley, and that theChairman of the Board of County Commissioners and the Clerk to the Board be given the authority to execute this agreement. Commissioner McLamb seconded and the issue carried. The Board received notice that the Four County Agricultural Fair was scheduled for September 16 through September 21, 1974. The following resolution was presented by the County Auditor in re- ference to Budget amendments: WHEREAS, it appears that the several budgets of the General County Fund will be over - expended during the budget year 1973 -74; and WHEREAS, it will be necessary of over -spend these budgets in the due process of operation of the several departments; THEREFORE, be it ordered by the Board of County Commissioners that the County Auditor is hereby authorized to pay any and all necess- ary expenses of the several departments in the operation of their office.
