MINUTES OF THE REGULAR MONTHLY MEETING OF JULY, 1972.
REGULAR MEETING The Board of Commissioners met in regular session on Monday, July'3,
1972 with the following present: Chairman M. H. Brock, D. P. Ray, Jr
W. J. Cotton, Jr., and C. E. McLamb. Commissioner Gilbert Brown was
not present. Also present, Edward H. McCormick, County Attorney and
H. D. Carson, Jr. Clerk to the Board.
i&CALL TO ORDER
MINUTES
The Chairman called the meeting to order at 9:20 a.m. and Tom McKay,
Pastor of Erwin Methodist Church, offered the morning prayer.
The minutes of the last meeting were read and approved.
ORDER OF BUSINESS
ROAD PETITIONS
The following road petitions were presented for the pleasure of the
Board:
Lillington Township, .8 mile, 4 homes, known as the Wildlife Road,
request for addition to the system.
SR 1789, 2 miles, 8 homes, Averasboro Township, request for addition
to system.
Commissioner Cotton moved to approve the first road petition, Comm-
issioner Ray seconded the move and it carrbd. The Board requested
Commissioner McLamb to hold the other petition presented and find outs'
more about it.
KENNETH.AUTRY Mr.. Kenneth Autry of the State Highway Commission came before the Board
to discuss county road projects.
TAX SUPERVISOR Mr. Thomas Allen, Tax Supervisor, presented the rpport of his office.0

REQUEST FOR REFUND
PRIV. LICENSE Mr. Jones presented the following request for refund:

Commissioner Ray moved to refund the taxes in the amount of $10.
on the recommendation of the Tax Collector, Commissioner Cotton
the motion and it carried.
E. Marshall Woodall, Tax & Welfare Lien Attorney, presented the
report of his actions for the month of June, 1972

BIDS FOR 6 CARS Commissioner McLamb made a motion to authorize the Chairman to let bids
for equipment consisting of 6 automobiles for the Sheriff's Department,
Commissioner Ray seconded the motion and it carried.

INVITATION FROM
LEE - HARNETT The Chairman read a letter of invitation from Lee-Harnett Mental Health
Center for lunch at the next regular meeting which will be August 7, 1972.
The Board accepted the invitation.

ANGIER The Chairman read a letter from Angier Chamber of Commerce regarding j
their endorsement or recommendations of the 1 sales tax. r;
ORDINANCE REGULATING
CARNIVALS At the request of the Commissioners, County Attorney McCormick pre-
pared and read the following ordinance for the pleasure of the Board
of Commissioners:

ORDINANCE OF THE COUNTY OF HARNETT
THAT, WHEREAS, the Board of County Commissioners are concerned about
the effect of carnival shows and like companies and the usual activities
conducted thereat including riding devices and shows involving indecent
exposure.

AND, WHEREAS, the Board of County Commissioners pursuant to N.C.G.S.
153 -0(55) desire to pass an ordinance prohibiting or regulating such
activities in the interest of public morals and safety;
AND, WHEREAS, N.C.G.S. 105 -39 provides that State license fees shall
be refunded when issued for such activities in a county which probibits
such activities.
NOW THERE FORE, be it enacted by the Board of County Commissioners of
Harnett County that:
1. No person, firm, or corporation engaged in the business of
a carnival company or a show of like kind, having merry go-
rounds, ferris wheels, riding devices, gambling devices and
other like amusements conducted for profit, by any person,
shall be permitted to operate in Harnett County and such
operationis hereby expressly prohibited, unless the follow-
ing requirements are met, to wit:
A. The applicant prepare a written itemized list as provided
for in sub - paragraph B. in such form as tie Tax Collector
may require.
B. The applicant for such license shall personally appear
before the County Commissioners at a regular board meet-
ing and file with the Commissioners a written itemized
list of each activity to be conducted and a brief descrip-
tion of such activity, the location where such activities
shall be held, the duration of such activities and the
name and address, both temporary and permanent, of the
person in general charge of all activities and the name
and address, both temporary and permanent, of each inde-
pendent operator who may be in charge of each separate
activity. This itemized written list shall be signed under
oath by the applicant who shall be the person having general
charge of such activities.
C. No activity on the list which the Commissioners question
on the grounds of public safety and morals shall be
aproved unless and until a public hearing is held after
first giving notice of such hearing for two conseative
weeks in a newspaper of general circulation in the county
and unless and until said commissioners shall find as a
fact after such hearing that these activities are in the
best interest of public safety and morals.
D. Upon approval of said written itemized list of activities
either at a regular meeting or at a special meeting
following a public hearing, the Tax Collector da11 issue
a privilege license for the operation of such activities
as are approved and the applicant shall pay for such
license the sum of $50.00 for each week of operation or
portion thereof during which the activities are conducted.
Provided, however, this ordinance shall not apply to such
operations at agricultural fairs which operated at least one year
prior to March 24, 1939.
2. Violation of this ordinance shall be punishable as a misdemeanor as
provided for by State Law.
Enacted unanimously this the 3rd. day of July, 1972.

ACTION: Commissioner Ray moved to adopt the foregoing ordinance, Comm-
issioner McLamb seconded the move and it carried unanimously.
REPRESENTATIVES FROM
SPOUT SPRINGS Warrie Nixon, Ivey J. Moore, James W. Parsons, Ralph M. Hardin, Jack
Holt and Ronald H. Rath appeared before the Board in behalf of the
Spout Springs Fire District in relation to the foregoing ordinance,
also, Rev. John Foy came before the Board.
J.A. SENTER FOR N.C.
FARM BUREAU John A. Senter came before the Board in behalf of the N. C. Farm Bureau
and requested adoption of the resolution as follows:
WHEREAS, the continuation of the policy of taxing farmland
based on the value of its highest and best use or sales value
will force the selling of productive farmland against the wishes
of the owners, thereby accelerating the trend in the decline of

the family farm -, and
WHEREAS, FARM OWNERS ARE NOT PROVIDED THE INCENTIVE NOW AND
FOR the future to build, maintain, and improve buildings upon
areas affected creating an undesirable countryside that portends
rural and urban slums which, thereby, decreases the value of the
tax base, and
WHEREAS, the needs for food and fiber for the state
and nation will not be met if this problem goes unsolved, and
WHEREAS, there is a need to provide open spices for ecological
and recreational purposes, and
WHEREAS, the necessary planning for future orderly development
and use is critically needed in order that solid tax base can be
established and maintained,
THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
of Harnett County requests to whom it may concern that objecti'e I'
analysis be made of the classification, appraisal, valuation, assess-1
ment, and taxation of farmland in North Carolina and legislation
enacted to prevent the forced conversion of farmland to other uses,
to protect the investments made by farm owners over a period of years!
to provide for the production of food and fiber now in the future in i
areas nearby the craters of need and to assure equity in taxation and
soundness of tax revenue to better serve the needs of the citizens of
this county.
The resolution was unanimously adopted.
RE: COUNTY BUILDING
Mr. Senter spoke in favor of the Agriculture Employees of the County 1
in reference to building a new Agriculture Building. He had in his
possession resolutions drawn by Agricultural Extension Advisory Bprd,
and by the Soil Conservation Service Board of Directors. He stated
that if an effort was made apparent that there would be a building
built, the Farm Bureau would donate $1,000. and the SCS would donate
$250.00.

The Chairman announced a meeting for July 18, 1972, with the Development
Commission. He ordered the meeting date confirmed.
'1972 -73 BUDGET RESOLUTION
It was moved by Commissioner Cotton and seconded by Commissioner McLamb
that the budget for the fiscal year 1972 -73 be adopted as follows andwhich
includes a 5% cost of living increment for the Sheriff and the Register
of Deeds, as provided by GS 153 - 48.2(4); upon the recommendation of the

The Chairman, M. H. Brock, reconvened the Commissioners meeting of July 3, 1972, on
July 6, 1972, with all members of the Board present. Also present, H. D. Carson, Jr.
Clerk and County Attorney, Edward H. McCormcik. The meeting was held in the Annex
Building of the Board of Education. The other boards in attendance was the Board of
Education and the Dunn Special School District Board, or their appropriate represent -
atives and other interested parties, also a Finance Committee formed from three steering
committees within the County.
The Harnett County Tax Collector, W. Earl Jones, led in prayer.
The purpose of the meeting was to discuss the financing of the School Bond Issue that
is under consideration, the election for which will be held in the fall. The issue
is for the construction of three consolidated schools in the county and in the amount
of seven million dollars.

the County, by levy of the Commissioners or by vote of the people. Many other facets
of the issue was brought out and discussed.

2. Call for vote of bonds
3. Call for vote of abolishing Special School Tax when new schools are completed.
