HomeMy WebLinkAbout08031981HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, AUGUST 3, 1981 The Harnett County Board of Commissioners met in regular session on Monday, August 3, 1981, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Barbara D. Smith, Assistant Clerk to the Board, and Edward H. McCormick, County Attorney,were also present. CALL TO ORDER Chairman Jesse Alphin called the meeting to order at 9:15 a.m. PRAYER Commissioner M. H. Brock led the morning prayer. MINUTES APPROVED The minutes from the Harnett County Board of Commissioners meeting of July 20, 1981, were approved as read. DON DUPREE, DOT Don Dupree, District Engineer with the North Carolina Department of Transportation, appeared before the Board to discuss road matters and situations in Harnett County. RESOLUTION REGARD - Commissioner Brock made a motion that the Board adopt the following ING MARKINGS BY resolution regarding the marking of the aircraft operational areas DOT AT AIRPORT at the Harnett County Airport. Commissioner Stewart seconded the motion and the following resolution was duly adopted: PLAT FOR RIVERFIELD SUBDIVISION RENOVATIONS OF JAIL FACILITY THAT WHEREAS, The Harnett County Board of Commissioners (hereinafter referred to as "Sponsor ") has made an application to the Department of Transportation (hereinafter referred to as "Department ") for the Department to mark the aircraft operational areas at the airport; and WHEREAS, the Department, using Department personnel and equipment and 100% State funding, will mark the aircraft operational areas at the airport which will be defined by the Division of Aviation; NOW, THEREFORE, BE AND IT HEREBY IS RESOLVED, that the Chairman of the Sponsor be and he hereby is authorized and empowered to enter into an agreement with the Department, thereby binding the Sponsor to fulfillment of its obligation incurred under this resolution and its agreement with the Department. Commissioner Collins made a motion that the Board approve the plat for Riverfield Subdivision, located on SR 1779, owned by John Wellons, Commissioner Shaw seconded the motion and it carried. Larry Knott, Operations Officer with the Harnett County Sheriff's Department, appeared before the Board and informed them that the County had received a proposal from W. E. Fripp, Jr., Architect with Grier -Fripp and Associates, to prepare the preliminary plans, specifications, and cost estimates to renovate and expand the Harnett County jail facility in order for the County to comply with all codes, statutes, and requirements of the N. C. Department of Human Resources, at a cost not to exceed $5,600; and if the Board, when they are ready to proceed with the final document, should commission Grier - Fripp, Inc., as the Architects, this preliminary design cost would be included in and become a part of the total Architectural /Engineering fee. Following a discussion of this matter, Commissioner Stewart made a motion that the County authorize a feasibility study to be conducted on renovating the jail facility and that a committee consisting of Commissioner Shaw, M. H. Brock, County Manager, and representatives from the Sheriff's department be authorized to negotiate proposals to conduct a feasibility study on renovating the jail facility and bring its recommendation back to the Board. Com- missioner Collins seconded the motion and it carried. SALE OF SURPLUS Commissioner Brock made a motion that the Board adopt the following PROPERTY resolution authorizing the sale of surplus property. Commissioner Shaw seconded the motion and it carried. THAT, WHEREAS, the property described below has a value less than $5,000; and WHEREAS, G. S. 153A -176 and G. S. 160A -270 (b) permits the sale of personal property at public auction upon expiration of ten days after publication of the resolution authorizing the sale. THAT: NOW, THEREFORE BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS, A. The following described property be and it is hereby declared surplus. B. M. H. APPLICATION FOR Henry Thompson, Health Director, appeared before the Board and HOME HEALTH/ informed the Commissioners that the application (See Minute HOMEMAKER Book 14, Page 570) he had submitted for the funding of 2.5 Home Health /Homemaker positions had been approved, and requested that his budget be amended to reflect this grant. Commissioner Stewart made a motion that the budget :amendment recorded in Minute Book 14 Page 638, be approved Commissioner Shaw seconded „the motion and it carried. ORDINANCE. CON- Commissioner Brock introduced the following ordinance entitled; CERNING: AIRPORT "AN ORDINANCE ESTABLISHING MINIMUM STANDARDS FOR CONSTRUCTION OF HANGARS HANGARS AT HARNETT COUNTY AIRPORT" and moved for its adoption; seconded by Commissioner Collins, the following ordinance passed upon the following vote: Ayes 5 Noes 0 Absent 0 Abstained 0 AN ORDINANCE ESTABLISHING MINIMUM STANDARDS FOR CONSTRUCTION OF HANGARS AT HARNETT COUNTY AIRPORT BE IT ORDAINED BY THE COUNTY BOARD OF COMMISSIONERS OF HARNETT COUNTY: Section 1. Authority. This ordinance is adopted pursuant to North Carolina General Statute 153A -275, which statute permits a County by ordinance to adopt reasonable rules and regulations to protect and regulate a public enterprise belonging to or operated by it. Section 2. Purpose. The purpose of this ordinance is to establish rules and regulations which are minimum standards for the construction of our location or hangars at Harnett County Airport. Section 3. Compliance with Laws and Regulations; Permits. Each hangar constructed or located at Harnett County Airport shall comply with all federal, state, county, and local building codes and other regulations pertaining thereto, including electrical and plumbing codes, if applicable. Permits may be obtained through the Harnett County Inspection Department upon compliance with all applicable laws. Section 4. Design Approval. A complete set of floor plan drawings and specifications for any hangar construction proposed at Harnett County Airport shall be submitted to the Airport Committee for review and approval of design. Section 5. Materials. All hangars will be constructed of metal or masonry materials or a combination of the two with an exterior light green color. Floor areas of hangars shall be concrete or asphalt, except, however, if concrete runners are used for the wheel areas, the remaining area of the floor may be a compacted surface. Section 6. Size. Each hangar constructed will be sufficient in size to fully enclose within its lateral limits each aircraft using the facility. Section 7. Penalty. If any person shall violate any provision, rule or regulation of this Ordinance, he shall be guilty of a misdemeanor and upon conviction punished as prescribed by North Carolina General Statute 14 -4. Each day thata person shall continue to do any act in violation of such provision, rule or regulation shall constitute adistinct and separate offense. Further, this ordinance may be enforced by injunction and order of abatement as provided for in N.C.G.S. 153A -123. Section 8. Severability. If any section, sentence, clause orphrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. Snipes, Heirs, Buckhorn Township, in the amount of $91.45, land was priced incorrectly. Commissioner Collins made a motion that the aforementioned refund be approved. Commissioner Shaw seconded the motion and it carried. TAX Thomas Allen, Tax Collector, appeared before the Board and reported COLLECTOR on the activities of his department for the month of July and his plans for August. SHERIFF'S Larry Knott, Operations Officer with the Harnett County Sheriff's REPORT Department appeared before the Board and presented a report on the operations of the Sheriff's department for the month of July, 1981. 6 BID ACCEPTED FOR Commissioner Brock made. a motion that the- .Board accept the bid EQUIPMENT FOR from North Carolina Equipment Company to purchase one Used Model LANDFILL 175B International Crawler Loader, Serial Number 16050, from the County at the cost of $15,000. Commissioner Brock informed the Board that this piece of equipment had been duly advertised on July 24, 1981, for sale per Upset Bid Procedure and in accordance with G. S. 160A -269, and the County had only received the bid from North Carolina Equipment Company. Commissioner Shaw'.seconded the motion and it carried.
