TAYLOR, DOT APPROVAL OF MINUTES The Harnett County Board of Commissioners met in regular session on Monday, July 14, 1980, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Bill Shaw, Rudy Collins, Lloyd Stewart, and Chairman Jesse Alphin presiding. H. D. Carson, Jr., Clerk to the Board, and Edward H. McCormick, County Attorney, were also present. Chairman Jesse Alphin called the meeting to order at 9 a.m. Commissioner Bill Shaw led the morning prayer. Mr. Homer C. Taylor, Assistant District Engineer with the North Carolina Department of Transportation, appeared before the Board to discuss road matters and situationsin Harnett County. The meetings from the Harnett County Board of Commissioners meetings held on June 16 and 20 were approved as read. APPOINTMENTS TO REGION Commissioner Collins made a motion that Mr. James Goff, "M" ADVISORY COMMITTEE Mr. Jackie McLamb, and Mr. M. H. Brock be appointed to the Region "M" Development Advisory Committee, Commissioner Stewart seconded the motion and the issue carried. APPRECIATION TO ALTON GRAY FOR SERVICE ON LEE - HARNETT MENTAL HEALTH BOARD MAINTENANCE CONTRACT ON NORTHEAST METRO HVAC SYSTEMS APPOINTMENT OF CONNIE WOOD TO LEE - HARNETT MENTAL HEALTH BOARD TAX COLLECTOR'S REPORT INDUSTRIAL EDUCATION CENTER Chairman Jesse Alphin presented a plaque to Mr. Alton Gray which represented the Board's appreciation for the seventeen years he had served on the Lee - Harnett Mental Health Board. Commissioner Brock made a motion that the maintenance contract for the heating, air conditioning and temperature control units on the Northeast Metropolitan Water District Building be awarded to Environmental Management Systems, Inc., of Raleigh, North Carolina, Commissioner Stewart seconded the motion and the issue carried. Commissioner Collins made a motion that Connie Wood be appointe to serve on the Lee - Harnett Mental Health Board. Commissioner Brock seconded the motion and the issue carried. Earl Jones, Tax Collector, appeared before the Board and pre- sented the report on the activities of his department for the month of June, 1980, and his plans for the month of July, 1980, to the Commissioners. Commissioner Brock made a motion that the Board of Commissioners adopt the following resolution concerning the Industrial Educa- tion Center for Harnett County. Commissioner Shaw seconded the motion and the issue carried: WHEREAS, there is a pressing need for an Industrial Education Center in Harnett County to increase the job skill level, raise the per capita income and enhance the potential for industrial development in the County; and WHEREAS, this need was fully described in the original proposal Harnett County submitted to the Economic Development Administration for a county Industrial Education Training Center on September 10, 1979; and WHEREAS, it is now necessary for the County to update its application for an Industrial Education Training Center. NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMIS- SIONERS, that: 1. The County will not develop this Industrial Education Center into a community college facility at any time in the future nor will the training center have any relationship to a high school; and 2. The County will accept the responsibility to maintain the grounds and buildings and to operate this facility as a County public building; and 3. The County will make only this one request for federal assistance in establishing an Industrial Education Center in Harnett County; and 4. The County will designate $75,000 as the local match in the funding of the Industrial Education Training Center plus meet other finan- cial needs which may arise. 448 PROPOSED MAINTENANCE CONTRACT WITH JOHNSON CONTROLS Rolin Choate with Johnson Controls appeared before the Board and presented a proposed contract for the Board's consideration on the HVAC systems of the County Office Buildings. Commis- sioner Stewart made a motion that this contract be . referred to a committee consisting of M. H. Brock and Bill Shaw for review . and that this committee be authorized tOE take action concerning this contract. Commissioner Collins seconded the motion and the issue carried. BLALOCK SUBDIVISION Commissioner Collins made a motion that the plat for Blalock Subdivision in Black River Township be approved, Commissioner Shaw seconded the motion and the issue carried. CHARGE -OFF DELINQUENT H. D. Carson, Jr., County Finance Officer, made a request to TAXES FOR 1968 and 1969 charge off delinquent taxes for the years of 1968 and 1969, as in accordance with a resolution passed by the Board of Commissioners on July 1, 1970, recorded in Minute Book 12, Page 402. Commissioner Brock made,. motion that this request be approved, Commissioner Collins seconded the motion and the issue carried. REFUND -- GORDAN L. TOWNSEND, JR., AND MARY QUINN TAX ATTORNEY'S REPORT EXPENDITURE AND REVENUE REPORT FIRST CITIZENS BANK OF ANGIER NAMES AS DEPOSITORY FOR METRO BILL SHAW NOMINEE TO SERVE ON CARDINAL HEALTH BOARD CONTRACT OF EMPLOY- MENT - IV -D PROGRAM Thomas Allen, Tax Supervisor, appeared before the Board and requested a refund to Gordon L. Townsend, Jr., and Mary Margaret Quinn, Dunn, North Carolina, on two houses which were torn down about 5 years ago. The amount of the refund would be $72.32. Commissioner Collins made a motion that the Board approve this refund to Gordon Townsend and Mary Quinn in the amount of $72.32. Commissioner Stewart seconded the motion and the issue carried. Brock, County Manager, filed a copy of the Quarterly Expenditure and Revenue Report with each of the Commissioners Upon motion of Commissioner Brock, seconded by Commissioner Collins, the First Citzens Bank & Trust Company of Angier, North Carolina, is hereby named as DEPOSITORY for the Northeast Metropolitan Water District of Harnett County, North Carolina. Commissioner Brock inforemd the Board that Burr Webster had submitted the nomination of William Alexander Shaw, Jr., to serve on the Cardinal Health Board. Commissioner Collins made a motion that the Board of Commissioners write a letter of endorsement to Cardinal Health concerning this nomination. Commissioner Brock seconded the motion and the issue carried. Commissioner Stewart made a motion that Chairman Jesse Alphin be authorized to execute the following contract concerning the IV -D Program in the County. Commissioner Shaw seconded the motion and the issue carried. 449 STATE OF NORTH CAROLINA COUNTY OF HARNETT CONTRACT OF EMPLOYMENT THIS CONTRACT made and entered into this the first day of July, 1980, by and between the Harnett County Department of Social Services, IV -D Division, party of the first part, and Edward H. McCormick, Attorney, party of the second part: W I T N E S S E T H: THAT WHEREAS, the party of the first part desire to employ said party of the second part as its counselor at law for the County of Harnett upon the following terms: 1. This Contract shall begin on the first day of July, 1980, and shall exist and continue until terminated by either of the parties. 2. Said party of the second part, upon reasonable notice, is to be available for consultation, legal advice and representation on all legal matters arising from the duties of the party of the first part under Sections 128 through 140 of Chapter 110 of the North Carolina General Statutes and Title 42 of the United States Code, Sections 651 through 660 and the federal regulations lawfully promulgated pursuant thereto. 3. Said party of the second part agrees to comply with all the requirements of Sections 128 through 140 Chapter 110 of the North Carolina General Statutes, Title 42 of the United States Code, Sections 651 through 660, and the regulations promulgated pursuant thereto relating to the performance of program legal services including, but not limited to, maintaining such records as are required by the party of the first part, to make said records available for federal or state audit if required, and to make financial, statistical, and program progress reports as are required. 4. For his services under this contract, the party of the first part agrees to pay the party of the second party Forty Dollars ($40) per hour for each hour spent by the party of the second part providing legal services under the Child Support Enforcement Programs of the North Carolina Department of Human Resources. Such hourly rate shall encompass all expenses, including but not limited to, those for salary, supplies, office space, heating and maintenance for office space, telephone service, long distance telephone calls and travel. The party of the second part is not to be reimbursed for any extraordinary expense incident to performing the services included under this agreement; except, that the party of the first part agrees to pay all court costs and filing fees which are required to be paid in conjunction with services provided by the attorney under this agreement. IN TESTIMONY WHEREOF said parties have executed this contract in triplicate originals, one of which is to be retained by the party of the first part, one of which is to be retained by the party of the second part, and one of which is to be filed with the Child Support Enforcement Sections, Division of Social Services, Department of Human Resources, Raleigh, North Carolina. NEW FIRE ACTIVATION M. H. Brock, County Manager, informed the Commissioners that the SYSTEM FOR COUNTY County was still having trouble with the encoder at the sheriff's department and that N. C. Communications had submitted a proposal for the Board's consideration on a new county fire activations system which would replace the defective system. Commissioner Shaw made a motion that the County appropriate $12,025 for the purchase of this equipment, Commissioner Collins seconded the motion and the issue carried.
