The Harnett County Board of Commissioners met in regular session on
Monday, April 21, 1980, in the Commissioners Room, County Office
Building, Lillington, North Carolina, with the following members
present: M. H. Brock, Bill Shaw, Rudy Collins, and Vice Chairman
Lloyd Stewart presiding. H. D. Carson, Jr., Clerk to the Board,
and Edward H. McCormick, County Attorney, were also present.
Chairman Jesse Alphin was absent.
CALL TO ORDER Vice - Chairman Lloyd Stewart called the meeting to order at 7:30 p.m.
PRAYER Commissioner Rudy Collins led the evening prayer.
APPROVAL OF The minutes from the Harnett County Board of Commissioners meeting of
MINUTES April 8, 1980, were approved as read.
INDUSTRY TARGET Mr. Richard Kesler with the Region "M" Council of Governments appear -
STUDY ed before the Board to discuss a proposed industry targeting study
for Harnett County which will be funded entirely by the U. S. Depart-
ment of Housing and Urban Development. Mr. Kesler informed the Com-
missioners that the purpose of the study would be to consider the
locational advantages and disadvantages of the county and then identi
fy certain industries that would benefit by locating in our county.
He continued to explain that the objective of this study would be to
compose a list of specific companies that would be prime candidates
for location in Harnett and have the money to invest in a new
manufacturing plant. Mr. Kesler stated that the Region "M" staff
with the assistance from the Research Triangle Institute would con-
duct the study under the supervision of the Development Commission.
In February, Mr. Kesler appeared before the Harnett Development
Commission to get their input on the study. Mr. Kesler informed
the Commissioners that the Development Commission recommended
1) that the goals of the study be as follows:

A. Increase wages in Harnett County
B. Increase per capita income in the County
C. Reduce the County's unemployment rate
D. Strengthen the County's tax base
2) that through the use of the study, the county attempt to attract
the following types of industry
A. Industries that employ between 250 and 500 persons in their
plants
B. Industries that are non - polluting or that generate only mini-
mal levels of pollution
C. Industries that pay wages higher than the average manufactur-
ing wage in the County, which was $3.93 per hour in 1978.
D. Industries that, in addition to hiring county residents will
bring new people into the County.
E. Industries that offer opportunities to primary wage earners.
Mr. Kesler presented the foregoing recommendations for the Board's
consideration. Following a discussion of this proposed study, the
Board of Commissioners indicated that they were in full support of
this project.
Susan Cheek, with the Region "M" Council of Government's staff;
Buddy Brown, Secretary- Treasurer of the Harnett County Historical
Society; and John Todd with Senator Morgan's staff appeared before
the Board and gave a presentation on a grant application for a
Historic properties survey to be conducted in Harnett County. Ms.
Cheek explained that the major goal of this project would be to
develop and publish a comprehensive countywide survey of historically
and culturally significant properties in Harnett County. She inform-
ed the Board that this would be a $39,280 grant with HCRS grant funds
in the amount of $18,250 and local funds in the amount of $11,730 -
cash and $9,300 in -kind services. Upon motion of Commissioner Shaw,
seconded by Commissioner Collins the above - mentioned grant applicatic
was approved.
MEMORANDUM OF A copy of the Memorandum of Understanding between the N. C. Agricul-
UNDERSTANDING tural Extension Service, N. C. State University, A & T State Univer-
EXTENSION DEPT. sity, and the Harnett County Board of Commissioners was filed with
the Board. It was the decision of the Board to take this matter under
consideration until a later date.
AGREEMENT WITH Commissioner Brock made a motion that Jesse Alphin, Chairman of the
ERWIN FIRE DEPT. Board, be authorized to execute the following contract entering into
AND RESCUE SQUAD an agreement with the Erwin Fire Department and Rescue Squad, Inc.
Commissioner Collins seconded the motion and the issue carried:

CONTRACT AND AGREEMENT
THIS CONTRACT AND AGREEMENT, Made and entered into this 21st Day of
April, 1980., by and between the COUNTY OF HARNETT, party of the first part, also
referred to as County, and the ERWIN FIRE DEPARTMENT AND RESCUE SQUAD, INC.,
party of the second part, also referred to as Fire Department;
W I T N E S S E T H:
THAT WHEREAS, N.C.G.S. 69 -25.5 provides that counties may provide for fire
protection in a fire district by contracting with any incorporated nonprofit
volunteer or community fire department; and
WHEREAS, the new N.C.G.S. 159 -13 (a) (8), which became effective
July 1, 1973, provides that the budget ordinance "may be in any form that the
Board of Commissioners of Harnett County deems most efficient in enabling it to
make the fiscal policy decisions embodied therein, but it shall be so organized
that the accounty system will show appropriations and revenues by line item
within at least the following funds: ... by ..." the County of Harnett; and
WHEREAS, the party of the second part is a nonprofit corporation
organized for fire protection purposes; and
WHEREAS, it serves .a special tax district created by a vote of the people;
and
WHEREAS, the County of Harnett levies and collects the taxes and is
responsible for appropriating said funds for the use and benefit of the citizens
in the fire protection district; and
WHEREAS, the County desires to grant a long -term contract to enable party
of the second part to make long -range plans; and
WHEREAS, the County desires to standardize all its arrangements with Fire
Departments in the County;
NOW, THEREFORE, in consideration of the premises and the consideration
of TEN DOLLARS to each the other in hand paid, the parties hereto contract
and agree as follows:
1. The party of the first part contracts and agrees that it will cause
to be assessed or levied a special tax of up to 8 cents ($.08) per one hundred
dollar valuation of all real and personal property in the Erwin Rural Fire
Protection District unless otherwise limited by law and /or a vote of the people;
and will collect said tax as a part of the ad valorem taxes of the County of
Harnett provided however, beginning with the fiscal year 1980 -81 the amount
levied annually shall be based on the needs projected in the budget estimate
submitted by the Fire Department to the County and approved by the County Com-
missioners.
2. That a special or separate fund shall be maintained by the County for
funds collected as a result of said special tax.
3. That monthly collections of current taxes shall be paid to Erwin
Fire Department and Rescue Squad, Inc., by the 15th day of the month following
the month of collection by the County; that quarterly collections of delinquent
taxes shall be remitted by the 15th day of the first month after the end of
each quarter.
4. The party of the second part shall provide the necessary equipment
and personnel for furnishing adequate fire protection as determined by the
North Carolina Department of Insurance, Fire and Rescue Service Division, for
all property located within the Erwin Rural Fire Protection District, and it
will furnish said fire protection free of charge to all persons and individuals
located in said District in an efficient and workmanlike manner.
5. That all funds paid to the party of the second part by the party of
the first part shall be used exclusively to provide fire protection within said
Erwin Rural Fire Portection District, and to pay other legitimate fire protectior
expenses including principal and interest on the aforementioned loan made by the
Farmers Home Administration.
6. It is agreed that thei,party of the first part may inspect all books
and accounts for the party of the second part at any time that it shall desire;
it is further agreed that the Fire District will present to the County Commis-
sioners an annual audit by a C.P.A. which audit shall be in conformity with
existing audit policies of the County. -
7. The party of the second part agrees to comply with County budgeting
procedure and other procedures provided for by State Law and agrees to submit
budget estimates to the Board of Commissioners on the standard forms used by
county departments-the party of the second part also agrees to use standard

line items for accounting devised or consented to by the County Accountant
from time to time.
8. This contract shall expire on the 1st day of July, 1982, and may not
be trasnferred or assigned without consent of the County.
9. The party of the second part further agrees to file with the
County Auditor a true copy of the Articles of Incorporation, existing By -Laws
and any changes made thereto from time to time; further, the party of the
second part agrees to adopt By -Laws which meet all minimum legal requirements
and which By -Laws, in addition thereto, have reasonable provisions enabling
citizens of the community to participate in the affairs of the corporation at leas
at an annual meeting and vesting in a Board of Directors the authority to manage
the affairs of the corporation without a vote of the membership to the
extent permitted by N.C.G.S. 55A, the North Carolina Nonprofit Corporation Act.
10. That nothing contained in this contract shall be construed to prohibit
the Fire Department from entering into mutual aid pacts with other fire department
or doing any other act in furtherance of its fire fighting and prevention duties;
nor shall any requirements stated herein cause the County to be liable for any
acts or obligations of the fire department and its members. Nothing contained
in this contract shall be construed to restrict the fire department from
entering into contracts to provide similar fire protection and prevention services
to other fire protection districts or municipalities, provided, however, such
additional contractual relations with other districts or municipalities do not
affect the services to Erwin Rural Fire Protection District nor the rating of
the fire department with the North Carolina Department of Insurance, Fire and
Rescue Service Division.
IN TESTIMONY WHEREOF, the party of the first part has caused this instrument
to be executed by the Chairman of the Board of County Commissioners and attested
by the Clerk of the County Board of Commissioners, and the party of the second
part has caused this instrument to be signed in its name by its President, attests
by its Secretary, and its corporate seal hereto affixed, all by order of its
Board of Directors duly given.

Dan Gardner, Captain of the Harnett County Ambulance Service appeared
before the Board and presented the following proclamation for the
Board's consideration:
WHEREAS, Emergency Medical Services personnel provide essential life - saving
medical care to the citizens of Harnett County; and
WHEREAS, several hundreds of individuals are involved in providing emergency
medical services across the County, a service that is provided 24 hours a day,
7 days a week, many time in adverse weather conditions and sometimes in situations
that endanger their own lives; and
WHEREAS, a large proportion of these individuals volunteer their time to
provide this valuable service; and
WHEREAS, recognition is due to these individual who serve on behalf of all
Harnett Countians; and
WHEREAS, it is further recognized that well- informed citizens are an essential
aspect of providing timely emergency care;
NOW, THEREFORE, WE, THE HARNETT COUNTY BOARD OF COMMISSIONERS, do hereby
proclaim the week of April 20 -27, 1980, as
EMERGENCY MEDICAL SERVICES WEEK IN HARNETT COUNTY
and commend this observance to our citizens.

Commissioner Collins made amotion that the foregoing resolution be
approved. Commissioner Shaw seconded the motion and the issue
carried.
The following cooperative agreement was presented to the Board
for consideration:
In accordance with Paragraph 3E of the cooperative agreement between Harnett
County Board of Commissioners and the Soil Conservation Service dated June
26, 1975, Harnett County agrees to reimburse the Soil Conservation Service
$14,000 for the period July 1, 1980 to June 30,1981, relative to the Soil
Survey program in the County.
If you concur in the above, please indicate your approval by signing two
copies of this letter and returning them to the above address. All terms
of the original agreement remain in effect.

Commissioner Brock made a motion that the Board approve the fore -
going agreement between Harnett County and the Soil Conservation
Service. Commissioner Collins seconded the motion and the issue
carried.
Commissioner Brock made a motion that Phillip Lakernick of Dunn
be appointed to the EMS Board. Commissioner Collins seconded
the motion and the issue carried.
M. H. Brock, County Manager, informed the Board that Oscar N.
Harris.& Associates submitted the following proposal to audit the
1979 -80 records of the County:

Commissioner Shaw made a motion that the Board accept the foregoing
proposal from Oscar N. Harris & Associates to do the 1979 -80 audit
of the County. Commissioner Collins seconded the motion and the
issue carried.
ADJOURNMENT There being no further business, the Harnett County Board of
Commissioners meeting of April 21, 1980, duly adjourned at 9 p.m.
