HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, MARCH 17, 1980
ALL TO ORDER
The Harnett County Board of Commissioners met in regular session on Monday, March
17, 1980, in the Commissioners Room, County Office Building, Lillington, North
Carolina with the following members present: M. H. Brock, Lloyd G. Stewart,
Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. H. D. Carson, Jr.
Clerkto the Board, and Edward H. McCormick, County Attorney were also present.
Chairman Jesse Alphin called the meeting to order at 7 p.m.

ACTION
The minutes from the Harnett County Board of Commissioners meeting of March 10,
1980, were approved as read.
Commissioner Bill Shaw, who serves on the Buildings and Grounds committee, report-
ed on the bids which were received on March 17, 1980, at 10 a.m. for the purchase
of a crawler dozer for the landfill operations. Commissioner Shaw informed the
Board that four companies participated in the bidding and submitted the following
proposals:

Commissioner Brock made a motion that the Chairman authorize a committee to
study the proposals and to award or deny the bids to a firm. Commissioner
Stewart seconded the motion and the issue carried. Chairman Jesse Alphin
appointed M. H. Brock, County Manager; Commissioner Bill Shaw, and Corbett Coats
Landfill Supervisor; to serve on this committee.
MEMO OF UNDERSTANDING Helen Crews, Director of the Harnett County Department of Social Services
FOR IN -HOME SERVICES presented a Memorandum of Understanding for In -home Services to the Board for
consideration. Mrs. Crews explained to the Board that the objective of this
memo was to coordinate theservicesbetween the Social Services. Department,
the Health Department, Community Development, and the Council on Aging in order
to more effectively and efficiently serve the eligible clients and to assist
them so they will be able to remain in their own home rather than going to
an institution. Commissioner Brock made a motion that the Board endorse the
following Memorandum of Understanding for In -home Services Coordination.
Commissioner Stewart seconded the motion and the issue carried:
I. The purpose of this memorandum is:
1. To specify the responsibilities and activities of the Harnett County
Department of Social Services, the Harnett County Health Department,
the Harnett County Community Development Agency, and the Harnett County
Council on Aging in the delivery of in -home services;
2. To ensure that in -home services are being coordinated locally; and
3. To describe the local coordination process for the delivery of in -home
services.
II. Participation by the above -named agencies has resulted in the development of
an in -home services coordination plan. The coordination plan is attached to
this Memorandum of Understanding.
III. This section describes the coordination process and mechanism used in develop-
ing the in -home services plan and the process and mechanism for implementing
the plan.

HEARING
The Directors of the four agencies met in January and February to select the
lead agency and to plan the coordination of in -Home services in Harnett County.
The Department of Social Services was chosen as the lead agency. Through these
meeting, the obtaining and pulling together of pertinent information and a
number of telephone contacts the attached plan was developed. The responsibili
for writing up the completed plan and the Memorandum of Understanding is
that of the lead agency, the Department of Social Services.
In order to carry out the plan as described in the attachment, bimonthly
meetings of the committee members will be held. If indicated, there will be
more frequent communication. As needed, information will be presented to
the Board of County Commissioners for their consideration and /or action.
This agreement is in effect until July 1, 1981. It may be amended by mutual
consent of the four agencies. An agency may terminate its participation under
the Memorandum of Understanding by giving thirty days written notice to the
other agencies.
This document is a Memorandum of Understanding between the following agencies:

Attorney, presented to the Board of Commissioners the plat
of Carolina Lakes Subdivision for the Board's consideration.
Shaw made a motion that the plat for Phase II of Carolina Lakes
located in Barbecue Township, be approved. Commissioner Collins
motion and the issue carried.
Chairman Jesse Alphin recessed the regular scheduled meeting of the Board
for the purpose of holding a public hearing for the creation of the proposed
Northern Harnett Rescue District.
PUBLIC HEARING CALLED Chairman Jesse Alphin called the public hearing to order at 8 p.m. and explaine
TO ORDER - PURPOSE to the group present that the purpose of this meeting was to give the citizens
living in Hector's Creek and Buckhorn Townships an opportunity to express their
views on the creation of the proposed Northern Harnett Rescue Service District.
Mr. Alphin then turned the meeting over to Edward H. McCormick to explain to
the citizens the legal aspects of this hearing.
EDWARD H. MCCORMICK
Mr. McCormick, County Attorney, gave a brief history of the study for the
creation of the proposed rescue district and explained the future plans for
district if the Board of Commissioners chose to establish the rescue service
district after hearing the views of the persons who appeared before them at
the hearing, tonight.
Wayne Sears,Mr. Pegram, Hoke Smith, Johnnie McLean, Wayne Gilbert, Richard
Hilton, Glenwood Caviness, Joe Sears, James V. Griffon, Troy Matthews, Ben
Burchett, Bobby Durrow, Larry Knott, the Chief of Fuquay Rescue, Danny Moody,
Melvin Rogers, Kathryn Kinton and James Tudor all appeared before the Board
and stated that they were in favor of the creation of the proposed rescue
district for the following reasons:
1. There is a need for providing rescue service in the Buckhorn and Hector
Creek Area.
2. It is impossible to establish a volunteer service in this area because ther
are not enough interest in the community
3. It is economically feasible to provide the proposed services without
unreasonable annual tax levies.

4. There is a demonstrable demand for the persons residing in the district.
Barbara Barbour, Jenny Currin, Ralph Johnston, and Elmore Matthews appeared before
the Board and stated that they were not in favor of the creation of the proposed
Northern Harnett Rescue Service District for the following reasons:
1. They could be provided service by the Harnett County Ambulance Services faster
than services from Fuquay.
2. They felt the people should be more informed on the district.
3. They did not feel it was economically feasible.
After everyone present had an opportunity to express their views on the creation
of the proposed rescue service district, Chairman Jesse Alphin called for a show of
hands of all those in favor of creating Northern Harnett Rescue District. Of the
estimated 150 persons present, 125 raised their hands in support of the district.
Chairman Jesse Alphin officially declared the public hearing closed at 9:30 p.m.
REGULAR MEETING Chairman Jesse Alphin called the regular meeting of the Harnett County Board of
RECONVENED Commissioners back to order at 9:35 for the purpose of considering the following.
Commissioner Collins made a motion that the Board adopt the following resolution
establishing the rescue district. Commissioner Stewart seconded the motion and it
carried with a unanimous vote:
THAT, WHEREAS, a report and supplemental report concerning a proposed Rescue
Service District for the area of Harnett County known as Buckhorn and Hector's Creek
Townships was filed with the Board of Commissioners of Harnett County on January
7, 1980; and
WHEREAS, the Board of Commissioners of Harnett County called a public hearing to be
held on March 17, 1980, at 8 p.m. at the County Office Building on First and Front
Streets in Lillington, North Carolina; and
WHEREAS, the Commissioners directed Herbert Carson to publish a copy of the Notice
of such hearing in the Harnett County News at least four weeks prior to the hearing
date; that an affidavit from the editor of the Harnett County News has been filed
with the Clerk to the Board of Commissioners showing that such notice was duly
given; and
WHEREAS, Thomas Allen was directed to mail a copy to all property owners within
the boundaries of the proposed district as shown on the county tax records as of
Janury 1, 1979, and he has filed his certificate of service with the board; and
WHEREAS, the hearing was held at the stated time and place and the following person
appeared and spoke for the proposed district:
Wayne Sears, Mr. Pegram, Hoke Smith, Johnnie McLean, Wayne Gilbert, Glenwood
Caviness, Joe Sears, James V. Griffon, Troy Matthews, Ben Burchett, Bobby Durrow,
Larry Knott, the Chief of Fuquay Rescue, Danny Moody, Melvin Rogers, Kathyrn
Kinton, James Tudor; and
WHEREAS, the following persons appeared and spoke in opposition to the proposed
district:
Barbara Barbour, Jenny Currin, Ralph Johnston, Elmore Matthews; and
WHEREAS, the Commissioners having fully considered the views of those who appeared
at the hearing and having duly considered the facts presented in the report and
supplemental report filed with the Board on January 7, 1980, regarding the
establishment of a proposed Rescue Service District and having specifically con -
sidered those facts set forth in Part II of the report regarding standards, the
Board finds and concludes that:
1. There is a demonstrable need for providing rescue service in the area of Harnett
County Known and defined as Buckhorn and Hector's Creek Townships.
2. It is impossible or impractible to provide rescue service on a county wide
basis under the proposed system of volunteers who have a primary interest in
their community.
3. It is economically feasible to provide the prosed services for the proposed
district without unreasonable or burdensome annual tax levies, it being project
that the annual levy will not exceed $.07 per $100 of valuation.
4. There is a demonstrable demand for the persons residing in the district.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS that:

RESOLUTION
1. A Rescue Service District is hereby established and defined as followins:
A. Boundary or Area to be Served. The area to be served by the Rescue District
shall be that area of Harnett County now described and defined as Buckhorn
and Hector's Creek Township.
B. Name of the Service District. The service district shall be known as "Northern
Harnett Rescue Service District ".
C. Specific Services to be provided. The services shall be limited to the
following: Rescue Services.
D. Plan. The plan for providing such services shall be in accordance with the
plan set forth in the report dated January 7, 1980, heretofore filed on
January 7, 1980.
Commissioner Collins moved for the adoption of the following resolution calling for
a special property tax referendum on May 6, 1980. Commissioner Shaw seconded the
motion and the issue carried.
BE IT RESOLVED by the Board of Commissioners for the County of Harnett:
Section 1: A special property tax referendum is hereby called to be held between
6:30 a.m. and 7:30 p.m. on Tuesday, May 6, 1980, at which time there shall be sub-
mitted to the qualified voters of Northern Harnett Rescue Service District (the
boundaries of which are identical to Hector's Creek and Buckhorn Townships) the
question stated in the Notice of Special Property Tax Referendum set forth in section
three of this resolution.
Section 2: For said referendum, (i) the regular registration books for elections
in Hector's Creek Precinct and Buckhorn Precinct, Harnett County,shallbe used and
the registration books, process or records shall be used and the registration books,
process or records shall be open for the registration of qualified persons and for
public inspection in the manner, under the conditions and at the times and places as
provided in said notice set forth in Section 3 of this resolution, (ii) the
registrars, judges, and other officers of elections appointed by the County Board
of Elections of Harnett County for said precincts and voting places in said precincts
shall be the election officers for such precincts and voting places, and (iii) the
precincts and voting places shall be the ones fixed by said County Board of Elections
as provided in said notice set forth in Section 3 of this resolution, subject to
change as provided by law.
Section 3: The County Auditor and ex officio Clerk shall cause a notice to be
published in The Daily Record once at least fourteen days before Monday, April 8, 198
(being the last day in which persons may register for said referendum) and once
again not less than seven days before said day, such notice to read substantially
as follows:
NOTICE OF SPECIAL PROPERTY TAX REFERENDUM IN THE NORTHERN HARNETT RESCUE SERVICE
DISTRICT ( the boundaries of which are identical with Hector's Creek and Buckhorn
Townships), HARNETT COUNTY, NORTH CAROLINA.
A special property tax referencum will be held in the Northern Harnett Rescue
Service District (the boundaries of which are identical with Hector's Creek and
Buckhorn Townships), Harnett County, North Carolina between 6:30 a.m. and 7:30 p.m.,
on Tuesday, May 6, 1980, at which time there will be submitted to the qualified
voters of said district the following question:
"Shall Harnett County be authorized to levy annually tax at an effective rate
not in excess of seven cents ($.07) on the One Hundred Dollars ($100.00) value in the
Northern Harnett Rescue Service District for the purpose of providing rescue service?
For said referendum the regular registration books for elections in Buckhorn and
Hector's Creek precincts, County of Harnett will be used and the registration books,
process or records will continue to be open for the acceptance of registration
applications and the registration of qualified persons between the hours of 8 a.m
and 5 p.m. on Monday to Friday, inclusive, of each week at the Office of the County
Board of Elections of Harnett County located at the Old Agriculture Building,
19 East Front St., in Lillington.
In addition, registration applications will be accepted and qualified persons
may register with the registrar and judges for the precincts of Buckhorn and
Hector's Creek in Harnett County at their homes and qualified persons may also
contact the County Board of Elections at the office of said Board mentioned above,

ADJOURNMENT
The last day for new registration of those not now registered under Harnett
County's permanent registration system is Tuesday, April 8, 1980.
The last day on which registered voters who have changed residence from one
precinct to another may transfer registration is Tuesday, April 8, 1980.
Any qualified voter of the District who is qualified to vote by absentee ballot
under the provisions of the General Statutes of North Carolina, particularly
Article 20 of Chapter 163, in a statewide primary or general election is
authorized to vote an absentee ballot in said special property tax referendum
in accordance with said provisions of the General Statutes relating to
absentee voting. Any qualified voter of the District who is qualified to
vote by absentee ballot in said special property tax referendum may apply for
an absentee ballot not earlier than sixty days prior to said special property
tax referendum and not later than 5 p.m., Wednesday, April 30, 1980, at the
office of the County Board of Elections mentioned above.
Qualified voters who are not certain whether they are registered or qualified
to vote by absentee ballot should contact the County Board of Elections at
the office of said Board mentioned above.
The registration books for elections in Harnett County will be open to inspect-
ion by any registered voter of the County during the normal business hours of
the County Board of Elections on the days when the office of said Board is
open, and such days are Charllenge Days,
The registrars, judges, and other officers of elections appointed by the
County Board of Elections will serve as the election officers for said
referendum.
The precincts and the voting places for said property tax referendum, subject
to change as provided by law, are as follows:

Section 4: The form of the paper ballots to be used for said referencum shall

or deliver a certified copy of this resolution to the County Board of Elections
of Harnett County within three days after the adoption hereof.
Section 6: This resolution shall take effect upon its passage. Thereupon,
upon motion of Commissioner Collins, seconded by Commissioner Shaw, the
foregoing resolution entitled: "RESOLUTION CALLING FOR A SPECIAL PROPERTY TAX
REFERENDUM" was passed by the following vote: Ayes: 5 Noes: None
There being no further business, the Harnett County Board of Commissioners
meeting of March 17, 1980, duly adjourned at 9:45 p.m.
