OCTOBER 1, 1979 CALL TO ORDER PRAYER APPROVAL OF MINUTES DON DUPREE.,,DOT The Harnett County Board of Commissioners met in regular ses- sion on Monday, October 1, 1979, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: Lloyd G. Stewart, M. H. Brock, Bil Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. H. D. Carson, Jr., Clerk td the Board, and Edward H. McCormick, County Attorney, were also present. Chairman Jesse Alphin called the meeting to order at 9:15 a.m. Commissioner Shaw led the morning prayer. The minutes from the Harnett County Board of Commissioners mee ing of September 17, 1979, were read and approved. Don Dupree, District Engineer, with the North Carolina Depart- ment of Transportation appeared before the Board to discuss road matters and situations in Harnett County. ADDITION OF MAGNOLIA Commissioner Shaw moved for the adoption of a resolution reque t- AND SANDALWOOD DRIVE ing the N. C. Department of Transportation to add Magnolia and Sandalwood Drive in Rolling Springs Subdivision to the N. C. Secondary Road System for Maintenance. Commissioner Stewart seconded the motion and the issue carried. PETITION:: PAVE STFEETS The Board forwarded a petition to Don Dupree, District IN BUFFALO ESTATES Engineer, from the residents of Buffalo Estates, requesting the Department of Transportation to pave the streets in Buffalo: Estates. PROCLAMATION: NATIONAL Carolyn Blanding, spokesperson for the 4 -H Clubs in Harnett 4 -H WEEK IN HARNETT County, appeared before the Board and presented the following COUNTY resolution requesting the Board to proclaim the week of Octobe 7 through 13, 1979, NATIONAL 4 -H WEEK IN HARNETT COUNTY: REAPPOINTMENTS TO HEALTH BOARD PUBLIC LIABILITY INSURANCE CO. THAT, WHEREAS, THE HARNETT COUNTY 4 -H membership has expressed a desi to sponsor and coordinate a program during the month of October, 1979, for instruction and training of young people in the county with respect to set individual goals and work toward achieving them. THAT, WHEREAS, 4 -H is expanding youths' horizons, as they seek new knowledge, acquire life skills and build on personal strengths. 4 -H inspi youth to stretch the limits of self, to reach out, share and learn with others. 4 -H challenges youth to st high goals and to achieve them. THAT, WHEREAS, 4 -H strengthens citizenship and leadership abilities and encourages youth and their leaders to assume positive roles in a free) democratic society. By broadening opportunities for greater understanding and service to community, National and world 4 -H is expanding horizons. NOW, THEREFORE, WE THE HARNETT COUNTY BOARD OF COMMISSIONERS do hereb proclaim the week of October 7 through 13, 1979: NATIONAL 4 -H WEEK IN HARNETT COUNTY - and commend this observance to all citizens Done This First Day of October, Nineteen Hundred and Seventy -Nine. /s/ Jesse Alphin, Chairman Commissioner Collins moved for the adoption of the foregoing resolution. Commissioner Shaw seconded the motion and the issue carried. Commissioner Brock moved for the reappointments of Joyce And- rews, Roy H. Byrd, and Dr. Roberts to the Harnett County Board of Health for a three -year term, 1979 -81. Commissioner Collins seconded the motion and the issue carried. Commissioner Shaw made a motion that M. H. Brock and Lloyd G. Stewart be authorized to implement the Public Liability Insurance Program for Harnett County Law, Enforcement Officers and Employees. Commissioner Stewart seconded the motion and the issue carried. s 36 LAND USE VALUE REFUND - KIRBY A. MANNING TAX COLLECTOR'S REPORT TAX ATTORNEY Commissioner Brock made a motion that the Board adopt the following land use values for Harnett County. Manning and wife, Bertha H., 821 S. Burlington St., Erwin, NC. A house and garage was removed from their property, but by mistake they were charged for it. Commissioner Collins made a motion that the Board approve the refund in the amount of $89.24 to Kirby A. Manning and wife, Bertha H., Erwin, NC Commissioner Stewart seconded the motion and the issue carried. Earl Jones, Tax Collector, appeared before the Board and reported on the activities of his department for the month of September, 1979, and his plans for the month of October, 1979. D. Carson, Jr., to execute the agreement between the County of Harnett and North Carolina Natural Gas Corporation. Commissioner Collins seconded the motion and the issue carried with a unanimous vote: RESOLVED that the Agreement dated September 16, 1979 by and between the County of Harnett and North Carolina Natural Gas: Corporation be and the same is hereby approved and Chairman Jesse Alphin and Clerk H. D. Carson, Jr., be and they are hereby authorized to execute said Agreement, a copy of which is attached to these minutes. THIS AGREEMENT is made this,the 16th day of September, 1979, by and between the COUNTY OF HARNETT, a body politic and corporate of the State of North Carolina hereinafter referred to for convenience as the "County" and NORTH CAROLINA NATURAL GAS CORPORATION, a North Carolina corporation with its principal office on Highway #117, BY PASS, P. 0. Box 1319, Goldsboro, North Carolina, hereinafter referred to for convenience as the "Gas Company" W I T N E S S E T H: For and in consideration of Ten Dollars ($10.00) and other good and valuable consideration paid by the County to the Gas Company, and in consideration of the mutual promises contained herein the parties agree as follows: FIRST: Removal and Relocation of Gas Line. The Gas Company will remove its gas line located on Airport property owned by Harnett County and formerly owned by- Lasater and Ryals and locate it on County Airport property along a line designated on Sheet 2 of a map designated "Project Layout Plan and Safety Plan" hhl EASEMENT TO N. C. GAS CO. AREAWIIE HOUSING OPPORTUNITY PLAN prepared by John Talbert 4 Associates, Inc., dated July, 1979, which map is incorporated herein by reference. The Gas Company will provide cost data for removal and relocation of its lines in conformity with Federal Aviation Adminis- tration requirements and bill such cost to the County of Harnett for payment. The removal and relocation costs shall include labor, cost of materials, and incidental expenses but shall not include personal or property damages to any person as a result of such removal and relocation work. Second: Payment by the County. The County agrees to pay said removal and relocation costs promptly upon removal and relocation of the gas line by the Gas Company and upon receipt of a bill from the Gas Company in conformity with F. A. A. requirements. Third: Survey. The County will promptly cause a survey to be made together with markings indicating where the relocated gas line is to be placed on County property. The area surveyed shall be 30 feet in width, 20 feet to the right of the line (as the gas will flow) and 10 feet on the left and said area shall extenlfrom where the existing gas line intersects the southern line of the County Airport property, shall extend around the Airport property as delineated on the map hereinabove referred to and shall end where the northern line of the Airport property is intersected by the existing gas line of the Gas Company. Fourth: Easement. The County upon completion of said removal and relocati work shall grant an Easement in and to the Airport lands described in the third paragraph above to the Gas Company. The Easement shall be in standard form, a copy of which has been furnished to the County. Fifth: Size of Relocated Line. The Gas Company plans to use a 4" pipe for the relocated portion of its gas line rather than the existing 3" line and will bill the County for the 4" line. The larger line is needed because of the several bends in the relocated line which would significantly impair the flow of gas in a 3" line. The cost differential between a 3" line and a 4" line will be insignificant since 3" lines are in short supply and consequently costs almost as much as a 4" line. The County agrees to pay for the 4" line. DONE BY AUTHORIZATION duly given by the respective governing bodies of the undersigned. NORTH CAROLINA NATURAL GAS CORPORATION BY Vice President /s/ Arthur Gnann COUNTY OF HARNETT BY: Chairman /s/ Jesse Alphin Commissioner Brock made a motion to grant an easement in and to the airport lands to the North Carolina Gas Company. Commissioner Stewart seconded the motion and the issue carried. Commissioner Brock moved for the adoption of the following resolu- tion agreeing to participate in the areawide housing opportunity plan of the Region "M" Council of Governments. Commissioner Shaw seconded the motion and the resolution was adopted with a unanimous vote. WHEREAS, there is a need for providing assistance to residents of Harnett County and its municipalities in housing and community development; and WHEREAS, Region "M" Council of Governments, composed of twenty -four general purpose governments, has prepared a regional housing goals and objectives and WHEREAS, Region "M" Council of Governments has prepared an Areawide Housing Opportunity Plan and it is to the advantage of many local governments in this region that such a Plan exist for the benefits therefrom, and WHEREAS, Harnett County has a Community Development Program together with its Housing Assistance Plan and has been awarded a Community Development Grant by the U. S. Department of Housing and Urban Development and accordingly has an on -going program for accomplishment of this Community Development Program together with its Housing Assistance Plan; NOW, THEREFORE, BE IT DECLARED: That the governing body of Harnett County finds our Housing Assistance Plan generally consistent with the annual and three year goals by housing type and the three -year goals by household type as shown in this Areawide Housing Opportunity Plan, and agrees that this Housing Opportunity Plan will be an instrument to help in future deliberations for consistency with said Plan as changes may be made in our Housing Assistance Plan and Community Development Program, in recognition that there is flexibility in this Housing Opportunity Plan which will be reviewed and refined on an annual basis. 372 Accordingly, the governing body of Harnett County hereby agrees with the goals and implementation proposals of the Region "M" Areawide Housing Opportunity Plan and agrees through implementation of our Community Development Program and its Housing Assistance Plan to help accomplish this Areawide Housing Opportunity Plan and accordingly hereby adopts said Region "M" Areawid Housing Opportunity Plan. METAL BUILDING - Commissioner Stewart made a motion that M. H. Brock and Bill ANDERSON CREEK LAND- Shaw be and they are hereby authorized to implement the procedure FILL necessary to furnish a metal building for the Anderson Creek Landfill. Commissioner Collins seconded the motion and the issue carried.
