HomeMy WebLinkAbout030119793O5 SPECIAL MEETING OF THE HARNETT COUNTY BOARD OF COMMISSIONERS, MARCH 1, 1979 ORDER The Harnett County Board of Commissioners met in special session on Thurs- day, March 1, 1979, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Edward H. McCormick, County Attorney, was also present. Lloyd G. Stewart, Commissioner, and H. D. Carson, Jr., Clerk to the Board, were absent. Chairman Jesse Alphin called the special meeting to order at 4 p.m., for the purpose of discussing the acquisition of land for the proposed Harnett County Airport. EXECUTIVE Commissioner Shaw made a motion that the Board of Commissioners adjourn SESSION into executive session. Commissioner Collins seconded the motion and the issue carried unanimously. Chairman Jesse Alphin called the meeting back to order at 4:30 p.m. AMENDMENT Commissioner Brock made a motion that the Contingency Fund, Code 74 -200, be amended in the amount of $202,370. These monies will be used for the pur- chase of land for the proposed Harnett County Airport. Commissioner Shaw seconded the motion and it carried with a unanimous vote. URCHASE Commissioner Collins made a motion that the following resolution relating to the purchase of 115.64 acre tract of land for the County Airport be adopted. Commissioner Brock seconded the motion and it carried with a unanimous vote. RESOLVED that the County of Harnett purchase a certain 115.64 acre tract of land from D. E. Lasater, Jr., and wife, Margaret M. Lasater and that the Chairman of the Board and the Clerk be and they are hereby authorized to pay for the same by issuing a check in the amount of $202,370.00 to D. E. Lasater, Jr., and to County Attorney Edward H. McCormick and deliver the same to Edward H. McCormick who is directed to deliver payment to D. E. Lasater, Jr., upon receiving a good and marketable title by Warranty Deed from the Lasaters, free of all liens and encumbrances but subject to a gas line easement; that County Manager M. H. Brock be and he is hereby authorized to execute "Data for Farm Reconstitution Form" - ASCS 155 to the effect that no crop allotments will be received by the County of Harnett in connection with this purchase. CONTRACT Commissioner Shaw made a motion that the following resolution authorizing the contract with D. E. Lasater, Jr., et ux be adopted and that this con- tract be spread upon the minutes of this Board meeting. Commissioner Collins seconded the motion and it carried with a unanimous vote. RESOLVED that the County of Harnett enter into a certain contract with D. E. Lasater, Jr., and wife, Margaret M. Lasater relating to an easement and other matters involved in a purchase of a 115.64 acre tract of land and the Chairman of the Board, Jesse Alphin, and the Clerk to the Board, H. D. Carson, Jr., be and they are hereby authorized to execute said contract on behalf of the County. THIS CONTRACT, made and entered into this 1st day of March, 1979, by and between the County of Harnett, a body politic and corporate of the State of North Carolina, and D. E. Lasater, Jr., and wife, Margaret M. Lasater, of Harnett County, State of North Carolina, hereinafter referred to as "County" and "Lasaters" respectively; W I T N E S S E T H: THAT WHEREAS, Lasaters have conveyed a certain 115.64 acre tract to County by deed of even date for $202,370.00, and WHEREAS, certain matters relating to said transfer have been agreed upon by the parties; NOW, THEREFORE, the County and the Lasaters in consideration of the premises and other good and valuable considerations, agree: 1. That the County will provide an access road from a public road to the existing farm road on Lasaters property where it intersects the southern property line (being the line described as North 45 degrees 00 minutes West 1,310,00 feet) of said 115.64 acre tract or at some other point mutually agreeable to the parties. The access road will be located on a 60 foot non - exclusive easement for ingress and egress to be conveyed by County to Lasaters and shall be an easement appurtenant to and running with the lands of Lasaters. The traveled portion of said road shall be at least 16 feet in width to accommodate motor vehicles and farm equipment, shall be built up for lateral drainage and covered with crush and run gravel. County agrees that Lasaters shall continue to use the existing access road located on the 115.64 acre tract until easement is conveyed and road constructed. The foregoing shall be accomplished by County on or before the existing access road is rendered unuseable by Lasaters. To the extent that said access road is on the 115.64 tract, Federal Aviation Administration (FFA) concurrence shall be required. 306 2. That within 90 days from date of this contract, Lasaters may remove the bulk tobacco curing barn from the 115.64 acre tract. 3. That subject to the County's need to enter upon the premises to survey, test, inspect, or construct the proposed airport project, Lasaters may retain possession of the cleared portion of the property for farm year 1979 and the County agrees to use every reasonable effort to keep damages to any growing crops or grasses to a minimum; upon notice by the County, Lasaters shall vacate the premises and there- after they agree that the County shall have quiet enjoyment thereof. 4. That ad valorem taxes shall be paid by Lasater on said property for 2 /12ths of the year, 1979. IN WITNESS WHEREOF, this instrument has been executed by the Chairman of the Board of Commissioners of Harnett County attested by the Clerk, all in accordance with and by authority of the Board of Commissioners of Harnett County and said Board has caused this instrument to be executed in its name by its Chairman and duly attested by its Clerk on the lsth day of March, 1979; and IN WITNESS WHEREOF, the Lasaters have hereunto set their hands and seals this the lsth day of March, 1979.
