HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, NOVEMBER 6, 1978
CALL TO ORDER
PRAYER
APPROVAL OF MINUTES
The Harnett County Board of Commissioners met in regular ses-
sion on Monday, November 6, 1978, in the Commissioners Room,
County Office Building, Lillington, North Carolina, with the
following members present: Commissioners M. H. Brock, Lloyd
G. Stewart, Bill Shaw, W. J. Cotton, Jr., and Chairman Jesse
Alphin presiding. H. D. Carson, Jr., Clerk to the Board, and
Edward H. McCormick, County Attorney were also present.
Chairman Jesse Alphin called the meeting to order at 9:10 a.m.
Edward H. McCormick, County Attorney, led the morning prayer.
The minutes from the October 16, 1978, meeting were read and
approved.
DOT- -Don Dupree Don Dupree, District Engineer with the Department of Transport
ation, appeared before the Board to discuss road matters and
situations in Harnett County.
SECONDARY CONSTRUCTION Commissioner M. H. Brock introduced and moved for the adoption
PROGRAM of the following resolution requesting additional priorities
be added to the 1978 -79 Secondary Construction Program. Com-
missioner Cotton seconded the motion and the issue carried.
WHEREAS, the Harnett County Board of Commissioners adopted a resolu-
tion in special session on the Sixth of March, 1978, requesting the North
Carolina Department of Transportation to improve the secondary roads
(Priorities 1 through 13) in Harnett County with the fund appropriated for
the fiscal year 1978 -79; and
WHEREAS, the North Carolina Department of Transportation was unable
obtain the necessary right -of -ways on Priorities 3, 4, and 6: and
WHEREAS, the Harnett County Board of Commissioners approved by resolu
tion on September 18, 1978, the addition of Priorities 14 through 18 to
the 1978 -79 Secondary Construction Program; and
WHEREAS, the North Carolina Department of Transportation was unable t
obtain the necessary right -of -ways on several of the priorities.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commis-
sioners, that the following Priorities 19 through 25 be added to the
previously approved 1978 -79 Secondary Construction Program:

AMENDMENT -- SPECIAL Commissioner Stewart made a motion that the Special Appropria-
APPROPRIATIONS, Code tions Budget, Code 54 -191, be amended in the amount of $10,500
54 -191 for 201 planning monies received from the State ($1,500) and
EPA ($9,000). Commissioner Shaw seconded the motion, and it
carried with a unanimous vote.
CONTRACT FOR CATERING
MEALS TO COUNTY JAIL
Commissioner Cotton made a motion that M. H. Brock, County
Manager, be authroized to negotiate the following described
contract for the furnishing of meals to the Harnett County
Jail by the Harnett County Youth Center. Commissioner Stewart
seconded the motion, and it carried with a unanimous vote.
This contract is hereby executed between the Department of Correction
Division of Prisons, Harnett"'Youth Center and the County of Harnett. The
purpose of this contract is the furnishing of meals to the Harnett County
Jail by Harnett Youth Center.
That for the purpose and subject to the terms and conditions herein-
after set forth the County of Harnett agrees to purchase meals from
Harnett Youth Center. The terms and conditions of this contract are as
follows:
1. Cost will be at the prevailing rate established by the Department
of Correction which is currently at seventy -five cents per meal and may be
increased as necessary due to escalating food cost consideration.
2. Individual insulated containers for each meal served will be
furnished by the Harnett County Jail. Containers for liquids will also be
furnished by the Harnett County Jail and may be in either separate or bulk

3. Harnett County Jail designated personnel will call the Harnett Youth
Center Kitchen Supervisor on duty well in advance of each meal time (normally
approximately one hour) with notification of the number of meals desired for the
next meal period.
4. Harnett County Jail authorities will be responsible for picking up
prepared meals at each meal time at Post #1 at Harnett Youth Center.
5. Incidental items, eg., silverware, napkins, etc., that are needed to
facilitate each meal will be furnished by the Harnett County Jail.
6. Billing for services rendered will be initiated by the Administrative
Office of Harnett Youth Center at the end of each calendar month and submitted t
the Harnett County Manager's office for payment. Payment for meals provided wil
be in the form of a check made payable to the N. C. Department of Correction -
Harnett Youth Center and will be rendered to the institution by the tenth of the
following month for meals provided during the prior month.
7. This contract will commence approximately January 1, 1979, and will
continue indefinitely provided that either party shall have the right to termin-
ate this contract upon thirty days notification in writing to the other party.
In testimony whereof said parties have executed this contract in triplicate
one of which is retained by each of the parties and one copy retained by the
Assistant Secretary for Fiscal Affairs, Department of Correction.
Commissioner Cotton made a motion that Harnett County exercise the
following described option to purchase property lying in the Town
of Lillington, from Charles M. Nobles and wife, Patsy H. Nobles.
Commissioner Shaw seconded the motion and the issue carried.
THIS OPTION, made and entered into this 23rd day of October, 1978, by
and between CHARLES M. NOBLES and wife, PATSY H. NOBLES, of Harnett County,
North Carolina, parties of the first part, and the COUNTY OF HARNETT, a public
body politic and corporate of the State of North Carolina, party of the second
part, said parties for convenience being referred to sometimes as the "Owners"
and the "County" respectively;
W I T N E SSE T H:
That for and in consideration of the sum of Five Thousand Dollars ($5,000.)
paid to them by the County, the receipt of which is hereby acknowledge, the
Owners have given and granted and by these presents do hereby give and grant
unto the County of Harnett, the sole and exclusive right to purchase from them
those certain lots lying in the Town of Lillington, Township of Lillington,
Harnett County, North Carolina, and more particularly described as follows:
Being a lot 110 ft. by 165 ft. on Ivey and Second Streets in Lillington,
the Southeastern corner of Block No. 10 of the Town of Lillington and
more particularly described in separate tracts as follows:
First Tract: BEGINNING at the intersection of Ivey Street with Second
Street and runs with the northern margin of Ivey Street, North 68 degrees
30 minutes West 105 feet to iron stake corner; thence at right angles to
Ivey Street and parallel to Second Street, North 21 degrees 30 minutes
East 75 feet to new iron stake corner; thence parallel with Ivey Street
and at right angles to Second StreetSouth 68 degrees 30 minutes East 105
feet to iron stake in the western margin of Second Street; thence with the
western margin of Second Street South 21 degrees 30 minutes West 75 feet
to the Beginning iron stake corner, and being a lot 75 by 105 feet in the
Town of Lillington. See deed from Mary B. Carlson to John T. Cash and
wife, recorded in Book 421, Page 281, Harnett County Registry.
This is the same property conveyed to Charles M. Novels and wife, Patsy
H. Nobles from Mary B. Carlson, widow, by deed dated April 29, 1966 and
recorded at Book 486, Page 133, Harnett County Registry.
Second Tract: The combination of two lots as described below with the one
exception below:
A lot, the Southeastern corner of Block No. 10 of the Town of Lillington
as described in Deed dated April 14, 1948 by H. T. Spears, unmarried, to
Lucile Spears Johnson, recorded in Book 305, at Page 453 of the Harnett
County Registry, being a lot 165.0 feet x 66.0 feet with 165.0 feet front-
ing on Second Street and 66.0 feet fronting on Ivey Street.
And a lot, adjacent to the above and on the West side thereof, as describec
in Deed dated December 6, 1950 by the various heirs of H. T. and Lucie
Spears to Lucile Spears Johnson recorded in Book 562 at Page 150 of the
Harnett County Registry, being a lot 44.0 feet by 165.0 feet, with 44.0
feet fronting on Ivey Streetand with a depth of 165.0 feet.

LESS AND EXCEPTING:
A lot, the Southeastern corner of Block No. 10 of the Town of Lillington as described in deed
dated May 9, 1962, by Lucile Spears Johnson and husband, Walter Lee Johnson to Mary Bethea Carlson,
recorded in Book 415 at Page 169 of the Harnett County Registry, being a lot 105.0 feet x 75.0
feet with 105.0 feet fronting on Ivey Street and 75.0 feet fronting on Second Street.
This is the same property conveyed to Charles M. Nobles and wife, Patsy H. Nobles, from Lucille
Spears Johnson and husband, Walter Lee Johnson, by deed dated July 8, 1977, and recorded at Book
657, Page 940, Harnett County Registry.
The terms and conditions of this option are as follows:
1. Price
The purchase price for the property described herein shall be Seventy Thousand Dollars ($70,000.00)
2. Term
The exclusive right to purchase under this option shall exist and continue from date until 9th day
ofLJuly, 71979.
3. Zoning - Possible Refund
The County's intended use for the above described property requires that it be reclassified as
commercial property bearing the zone classification designated as C -1 under the zoning code for the
Town of Lillington (see Town Ordinance 18 -4). Upon failure of either the County or the Owners to
obtain a re- classification to C -1 within the time period during which this option can be exercised, the
Owners• shall, without demand therefore, refund to the County the Sum of Four Thousand Five Hundred
ollars ($4,500.00) of the Five Thousand Dollars ($5,000.00) amount hereinabove referred to within thirty
(30) days following the expiration date of this option. The Owners will, upon request by the County,
join with the County in a petition or request for the Town to rezone the property from its present zone
designation to C -1.
4. Delivery of Deed
Upon the exercise of this option, Owners will execute and deliver to the County a good and sufficie
deed conveying marketable title to said lots or tracts of land in fee simple absolute to the-County
and free and clear from all encumbrances, but subject, of course, to valid ordinances of-the town and
country.
5. Possession
Owners shall be entitled to continue possession of the_premises for a period not to exceed ninety
(90) days after the County exercises its right to purchase under this option. Owners shall not be res-
ponsible for the payment of any rental during such period and agree to vacate the premises within such
ninety (90) day period.
6. Taxes
Owners shall be responsible for a prorata portion of County and City Taxes levied against said
premises for the calendar year in which deed is delivered to the County. The prorataportion of said
taxes shall be computed by multiplying the total taxes due for said year by a fraction, the numerator
of which equals the number of days during said year that the Owners owned said property prior to deliver
of the deed and the denominator of which is 365.

7. Exercise of Option
If the County does not exercise this option and tender the balance of the purchase price on or befo e
midnight of the expiration date as determined in Paragraph 2 above, then this option shall be null and
void and the County shall have no further rights hereunder and the Owners shall be entitled to retain
said Five Thousand Dollars ($5,000.00) for the purchase price of this option, subject, however, to pro-
visions of Paragraph 3 above.

AMBULANCE SERVICE Glenn Cox, Captain of the Harnett County Ambulance Service appearec
REPORT before the Board and presented a report of his department for the
Action on Accounts period of July through October, 1978. Commissioner Cotton made
a motion that the clients of the Harnett County Ambulance Service
be given a period of 90 days from the date of the services to pay
their accounts. If the client has not submitted payment at the
end of the initial 90 -day notice, personnel from the Ambulance
Service will personally contac the client and notify him that if
payment is not received within 30 days, the deliquent account will
be conveyed to the Tav Collector's Office for collection. Commis-
sioner Shaw seconded the motion, and it carried unanimously.
REFUND TO MRS.
MARVIN POOLE
Commissioner Brock made a motion that a refund in the amount of
$40 be granted to Mrs. Marvin Poole. N. Orange Avenue. Dunn, North
Carolina, for ambulance fees she had paid to the Harnett County
Ambulance Service. Medicare reimbursed the Ambulance Service for
the expenses accrued by Mrs. Poole. Commissioner Cotton seconded
the motion. and it carried with a unanimous vote.
INSULATION REPORT William Guy, Insulation Inspector for the County, appeared before
the Board and filed the report of his department for the month of
October, 1978, with the Board.
CD BLOCK GRANT Sam Sally, Director of the Harnett County Housing and Urban Develo
SAM SALLY'S RESIGN- ment Office appeared before the Board and announced the approval
ATION of the Harnett County Small Cities Community Development Block
Grant in the amount of $500,000. The Board was also informed that
Sam Sally will complete his tenure of service with the County on
the tenth of November, 1978. The Commissioners expressed their
appreciation to Mr. Sally for the fine work and many contributions
he had made toward the growth of the Community Development Program
in this County and wished Mr. Sally "Good Luck" with his new
endeavor. Sam Sally informed the Board that his association with
the County had been very beneficial and rewarding.

cussed the Tax Revaluation, the progress of programming the com-
puter. and other functions relating to his department.

and his plans for the month of November, 1978.

M. H. Brock, County Manager, presented the expenditure report and the
Statement of Investments to the Board.
The County Manager informed the Board that Harnett County was
investigating the possibilities of renting a building located on Main
Street in the Town of Lillington where the FCX was located. The
building has been renovated and constructed into office and storage
space. Mr. Brock explained to the Board that because of the
expansion of Harnett County and its departments there is a demandfor
additional space. Commissioner Cotton made a motion that M. H. Brock
and Bill Shaw be authorized the authority to negotiate the possibility
of renting this facility and having an option draw for a five -year lea
if the facility adequately meets the present needs of the County.
Commissioner Shaw seconded the motion and the issue carried.
The meeting adjourned at 11:30 a.m.
