The Harnett County Board of Commissioners met in regular ses-
sion on Monday, October 2, 1978, in the Commissioners' Room,
County Office Building, Lillington, North Carolina, with the
following members present: M. H. Brock, W. J. Cotton, Jr.,
Lloyd G. Stewart, Bill Shaw, and Chairman Jesse Alphin presidir
Edward H. McCormick, County Attorney, and 11:: D:c Carson, Jr, ,
County Auditor and Clerk to the Board, were also present.
Chairman. Jesse Alphin called the meeting to order at 9:15 a.m.
Commissioner M. H. Brock led the morning prayer.
Don Dupree, District Engineer with the Department of Transport-
ation, appeared before the Board to discuss road matters and
situations in Harnett County.

Commissioner Shaw moved for the adoption of the following New
Horizons Memorandum of Understanding between the County of
Harnett and the HUD Office of Fair Housing and Equal Opportuni-
ty Office of Voluntary Compliance. Commissioner Stewart
seconded the motion and it carried with a unanimous vote.
WHEREAS, the county of Harnett, hereinafter referred to as the community,
is receiving or applying for Federal subsidies administered by HUD for
the purpose of improving housing and services of the community, including
community development, for its lowaand moderate income residents;
WHEREAS, the community is required in receiving Federal subsidies to meet
certain conditions to provide fair housing for people of all races, colors,
creeds, national origins and both sexes;
WHEREAS, the community recognizes that'it could take steps to improve the
status of fair housing and fair lending above and beyond those actions
required of it under the Federal Fair Housing Law, Title VIII of the Civil
Rights Act of 1968, and Section 109 of the Housing and Community Develop -
ment Act of 1974.
WHEREAS, the community has determined that the HUD sponsored New Horizons
Fair Housing Assistance Project and its activities can enable the community
to go beyond the basic requirements in promoting fair housing and fair
lending;
THEREFORE, BE IT RESOLVED that the community agrees to enter into a
voluntary relationship with the office of Voluntary Compliance to partici-
pate in the New Horizons Fair Housing Assistance Project.
BE IT FURTHER RESOLVED, the community agrees to establish a community -wide
fair housing strategy board or task force composed of influential citizens
and other affected by fair housing programs. This group will develop
an areawide fair housing strategy and action program. The community furthe
agrees, after approval of the strategy and program, to designate an agency
of government to implement the strategy and program.
BE IT FURTHER RESOLVED that the board or task force members will be selecte
and the first meeting held within three months after the signing of this
agreement and that the board will meet at least on a quarterly basis after
its first meeting. This board will also monitor implementation of the
program, in accordance with our guidelines on reporting, and provide period
is reports to the HUD Office of Voluntary Compliance, with a copy to the
local HUD office.
BE IT FINALLY RESOLVED that the Office of Voluntary Compliance, FHEO, HUD
will provide the community continuing technical as sistance in this project,.
DONE THIS SECOND DAY OF OCTOBER, NINETEEN HUNDRED AND SEVENTY -EIGHT
Commissioner Brock moved for the adoption of the following
resolution authorizing Sam Sally, Director of Community Deve-
lopment, to countersign all documents of expenditures on behal
of the Harnett County Section "8" Housing Program. Commission
Cotton seconded the motion and the issue carried.
WHEREAS, the County of Harnett, (herein called the "PHA ") entered into
an Annual Contribution Contract (herein called the "Contract ") with the
United States of America, Department of Housing and Urban Development
(herein called the "Government ").
Now, therefore, be it Resolved by the PHA as follows:
SECTION 1. The Director of Community Development is hereby authorized and
directed to countersign all documents of expenditures on behalf of the PHA.
SECTION 2. This Resolution shall take effective immediately.

TAX COLLECTOR REPORT Earl Jones, Tax Collector, appeared before the Board to report
on the activities of his department for the month of September
1978, and his plans for the month of October, 1978.
Ted Honeycutt, Chairman of the Harnett County Soil and Water
Conservation District prepared and submitted a report of his
program to the Board.
Thomas Allen, Tax Supervisor, appeared before the Board and
reported on the activities of his department for the month of
September, 1978.
The Statement of Investments for the month of September, 1978,
were filed with the Board.

RELEASE OF TURLINGTON
PROPERTY
Commissioner Cotton made a motion that M. H. Brock, County Mana-
ger, be and he is hereby authorized to exercise the release of
the Turlington property and that this release be made a part of
this record. Commissioner Shaw seconded the motion and it passe
with a unanimous vote.
THIS RELEASE, made and entered into this 2nd day of October, 1978, by and
between the COUNTY OF HARNETT, a body politic and corporate, party of the
first part; and REBECCA M. TURLINGTON, widow; EDWARD S. TURLINGTON and wife,
PAULA R. TURLINGTON, FRANK TURLINGTON, and wife, BRENDA S. TURLINGTON, all of
the County of Harnett, parties of the second part;
W I T N E S S E T H:
That, whereas, the parties entered into a lease agreement on or about the
24th day of February, 1976, which lease is recorded in Deed Book 637, Page
916, Harnett County Registry; and
Whereas, the demised premises are described as follows:
BEGINNING AT the corner in the center of the road, it being a new
dividing corner between Carl F. Turlington and Harold S. Turlington, salt
corner being a pin 8 feet West of culvert and runs thence as a new dividl
ing line between Carl F. Turlington and Harold S. Turlington South 50
degrees 50 minutes West 990.5 feet to an iron stake; thence North 32
degrees West 273.6 feet to a concrete corner; thence North 35 degrees
East 2,435 feet to an iron stake; thence South 51 degrees East 1,028
feet to an iron stake, a new corner between Carl F. and Harold S. Turlin
gton; thence as a dividing line between the said parties South 32 degree
7 minutes West 817 feet to an iron stake; thence another dividing line
between said parties South 54 degrees 40 minutes West 859.5 feet to a
corner in the center of the road; thence along the center of the road
North 25 degrees 24 minutes West 290 feet to the BEGINNING, containing
41 acres more or less, not including that part in the right -of -way of
Durham and Southern Railroad.

Whereas, the County of Harnett, inconsideration of the sum of $1,500. per
acre, has agreed to release from the terms of said premises a portion con-
taining 9.889 acres.
Now, Therefore, in consideration of the premises and the sum of $14,833.50,
the County of Harnett does hereby release from the terms of said lease and
does hereby quitclaim, remise and release unto the parties of the second
part all their rieght, title and interest in and to the following described
tract of land:
Being a 9.889 acre tract, more or less, in Grove Township, Harnett
County, North Carolina, situate West of S.R. 1725 and bounded , now or
formerly, on the North by C. P. Johnson land; on the West by Maynard
land; and on the South by other Turlington land; and being a portion
of that 41 acre tract called "Firts Tract" in a deed from Harold S.
Turlington and wife to Carl F. Turlington dated March 22, 1961, and
recorded in Book 398, Page 553, Harnett County Registry; and is more
fully described according to a plat of survey by L. T. Turlington,
Route 3, Dunn, North Carolina, dated August 31, 1978, as follows:
BEGINNING at a corner with C. P. Johnson land (Map Book 7, Page 111;
Deed Book 356, Page 402), a corner of the 41 acre tract of which this
is a part (Book 398, Page 553), said corner marked by an existing
iron pin; and runs, thence South 31 degrees 49 minutes 06 seconds
East 273.96 feet to a corner (also a corner of said 41 acre tract) marke
by an existing iron pin, a point in the line of Maynard; thence North
SO degrees 52 minutes 23 seconds East 992.11 feet along a line of the 41
acre tract to a corner in S. R. #1725 marked by an existing iron pin,
also a corner of said 41 acre tract; thence a new line with the center
of S. R. #1725 the following calls: North 25 degrees 33 minutes 52

seconds West 364.30 feet; and North 25 degrees 31 minutes 10 seconds
West 231.12 feet to a corner in the center of the road, a point in the
line of said 41 acre tract South 35 degrees 14 minutes 15 seconds West
1139.22 feet with C. P. Johnson lands to the point of BEGINNING, and
being 9.889 acres, more or less.

It is specifically understood and agreed between the parties, that the lease
dated the 24th day of Febryary, 1976, shall remain in full force and effect with
respect to the remainder of said lands not released herein.
It is further understood and agreed between the parties that the party-of the
first part owes no further obligations to the party of the first part under said
lease with respect to the premises released herein.
IN WITNESS WHEREOF the undersigned officers of the County have executed this
release by authority duly given-by the Board of Commissioners of Harnett County
and in witness whereof the undersigned parties of the second part has signed
their names and affixed their seals on the day and year first above written.

Pat Cameron with the Social Services Child Support Enforcement IV -D
Program made a presentation of the activities of his program to the
Board.
WASTEWATER DISTRICT Leonore D. Tuck, Chairperson, appeared before the Board on behalf
BUIES CREEK of the Concerned Citizens' Committee for the Establishment of a
Wastewater System in Buies Creek and petitioned the Harnett County
Board of Commissioners to establish a special wastewater district
called the Buies Creek Wastewater District of Harnett County, North
Carolina, located in Neill's Creek Township in and around the Com-
munity of Buies Creek, North Carolina, in accordance with Article
16 of Chapter 153 -A of the General Statutes of North Carolina and
to provide for the support of such wastewater service by special
tax only when deemed necessary. The Board accepted this petition
and instructed the County Manager to meet with Edward H. McCormick,
County Attorney, and Commissioner W. J. Cotton, Jr., to act on this
petition and bring it back to the Board with the proper documents
for consideration.

Ray Hamilton, Engineer with Moore, Gardner & Associates presented
the following resolution to the Board authorizing and directing
Jesse Alphin to execute the engineering contact with Moore, Gardner
& Associates for the Western Harnett Wastewater Collection Project.
Commissioner Shaw moved for the adoption of this resolution, Commis
sioner Stewart seconded the motion and it passed with a unanimous
vote.
WHEREAS, The Western Harnett area is growning at a rapid rate and has sustained
a substantial growth rate over a period of the past 10 to 12 years and,
WHEREAS, due to the large and growing concentration of population in the
Western Harnett area many problems have been experienced with wastewater disposal
and,
WHEREAS, the Board of Commissioners has authorized a 201 Facilities Plan to be
provided for the area and in addition a Wastewater Collection Engineering
Report is needed to document the problems and provide a means where -y a waste-
water collection system may be financed and installed.
THEREFORE, BE IT RESOLVED by the Board of Commissioners that Jesse Alphin, and

successors so titled, is hereby authorized and directed to execute engineer-
ing contracts with the Engineers, Moore, Gardner and Associates, Inc. for
said report and other documentation required in order to accomplish the
project documentation phase.
The foregoing Resolution after presentation was approved on a vote of
Ayes: Chairman Jesse Alphin, Commissioners M. H. Brock, Lloyd G. Stewart
and Bill Shaw. Absent: Commissioner W. J. Cotton, Jr., retired from the
Board of Commissioners Meeting at 10 a.m. Against: None. Certified as a
true and valid copy of the Resolution as presented to the Board of Commis-
sioners on the 2nd day of October, 1978.

AGREEMENT FOR Mr. Hamilton presented an agreement for engineering services
ENGINEERING SERVICES between the County of Harnett as owners and Moore, Gardner &
Associates for the construction of a Wastewater Collection
System for Western Harnett County. Commissioner Shaw made a
motion that Jesse Alphin, Chairman, be authorized to execute thi
agreement which is duly filed in the County Manager's Office.
Commissioner Stewart seconded the motion and the issue carried
unanimously.
APPLICATION FOR
PALMISTRY - -Rosie
Marie Johnson
Rosie Marie Johnson, Route 4, Box 309, Dunn, North Carolina,
filed an application for license for the practice of palmistry
with the Board of Commissioners as in accordance with Section I
of Chapter 314 Session Laws of 1951. Commissioner Brock made
a motion that Rosie Marie Johnson's application be given consid-
eration and studied by the County Manager, County Attorney, and
Sheriff to make sure the application is in compliance with the
Laws of Harnett County, North Carolina.
