HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, SEPTEMBER 5, 1978
The Harnett County Board of Commissioner met in regular session
on Tuesday, September 5, 1978, in the Commissioners Room, County
Office Building, Lillington, North Carolina, with the following
commissioners present: M. H. Brock, W. J. Cotton, Jr., Bill
Shaw, and Chairman Jesse Alphin presiding. H. D. Carson, Jr.,
Clerk to the Board, and Edward H. McCormick, County Attorney, wer
also present. Commissioner Lloyd G. Stewart was absent
CALL TO ORDER Chairman Jesse Alphin called the meeting to order at 9 a.m.
PRAYER Commissioner M. H. Brock led the morning prayer.
APPROVAL OF MINUTES The minutes from the previous meeting were read and approved.
DOT - -DON DUPREE Don Dupree, District Engineer with the Department of Transporta-
tion, appeared before the Board to discuss road matters and situ-
ations in Harnett County.
MAINTENANCE CREWS
6 -Day WORKWEEK
Commissioner Shaw made a motion that a letter be written to
Thomas Bradshaw, Secretary with the Department of Transportation,
recommending that a plan be studied and implemented whereas the
maintenance crews in Harnett County, and possibly other counties,
be operational six days a week. Commissioner Brock seconded the
motion and the issue carried.
RESOLUTION - -JUDGE Commissioner Brock presented the following resolution of apprecia
ROBERT B. MORGAN, SR. tion to Judge Robert B. Morgan, Sr., and moved for its adoption.
Commissioner Shaw seconded the motion and it passed with a
unanimous vote.
THAT, WHEREAS, Judge Robert B. Morgan, Sr., served for twelve years
as County Judge for Harnett County and served ten years as Chief Judge for the
Eleventh District; and
WHEREAS, he retired from office on September 1, 1978, after 22 years of
brilliant and courageous leadership in the courts of North Carolina; and
WHEREAS, Judge Morgan combined his experience, his training, and his
knowledge in order to base his decisions on facts without regard to his own
personal feelings; and
WHEREAS, his dedication and devotion to the well -being of his fellowman
as well as his just and impartial judgments has touched the lives of the
poor, the affluent, the elderly, the young, and the oppressed citizens of the
eleventh district; and
WHEREAS, Judge Morgan will always be remembered for his fairness,
patience, and outstanding sense of justice in foreseeing to the rights and
dignity of individuals; and
WHEREAS, Judge Robert Morgan contributed significantly toward the better
ment of the judicial system in the eleventh district of North Carolina.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett
County:
1. That Judge Robert B. Morgan, Sr., be and he is hereby thanked on
behalf of all the citizens of Harnett County for his service to them and for
his example in showing all of us that right decisions are born of a good heart
a free spirit, and an open mind.
2. That the citizens of Harnett County and all its officials be and the
are hereby asked to honor him by emulating his dedication to justice, truth,
and humulity.
3. That a copy of this resolution be given to Judge Robert B. Morgan,
Sr., a copy to the media, and a copy spread upon the minutes of this Board.
Done This Fifth Day of September, Nineteen Hundred and Seventy - Eight.
CHARGE TO EARL JONES, Commissioner Cotton made a motion that the following order be
TAX COLLECTOR issued to the Tax Collector authorizing him to collect the taxes
for prior years. Commissioner Brock seconded the motion and the
issue carried.

JUVENILE DETENTION
FACILITY
TO: W. EARL JONES, TAX COLLECTOR FOR HARNETT COUNTY
You are hereby authorized, empowered and commanded to collect the
taxes set forth in the tax books filed in the receipts herewith delivered
to you, and in the amount and from the taxpayers therein set forth (and also
all other taxpayers and taxes represented by official tax receipts for years
other than the current year) and such taxes are hereby declared to be a
first lien on all real property of the respective taxpayers in Harnett County
and this order shall be a full and sufficient authority to direct, require,
and enable you to levy on and sell any real or personal property of said
taxpayers for and on account thereof in accordance with law.

Earl Jones, Tax Collector, presented the report of his depart-
ment for the month of August and his plans for the months of
September.
Thomas Allen, Tax Supervisor, appeared before the Board and
presented the report of his department.
Commissioner Cotton moved for the adoption of the following con-
tract whereby the County of Harnett enters into a contractual
agreement with the Department of Human Resources to utilize the
regional Juvenile detention facility located in Fayetteville,
North Carolina. Commissioner Shaw seconded the motion and it
carried with a unanimous vote.
DETENTION SUBSIDY REPAYMENT AGREEMENT
This contract is hereby executed between the Department of Human Resourc
es, herein called Department, and Harnett County, hereinafter called County.
WITNESSETH:
THAT WHEREAS, Harnett County is eligible for juvenile detention services
in a facility operated by the Department located at 2089 Draughone Street,
Fayetteville, North Carolina which is known as the Juvenile Services Center,
and
WHEREAS, North Carolina General Statute 134A -3B provides that any
county placing a child in a regional detention home shall pay fifty percent
(50 %) of the per capita daily cost of caring for the child to the Department,
NOW, THEREFORE, for and inconsideration of the mutual promises to each
other, as hereinafter set out, the Department and the above mentioned County
do mutually agree as follows:
SECTION ONE, PAYMENT TO DEPARTMENT
A. The County agrees to pay the Department $15. per childcare day for
which the regional detention facility keeps a child from said County in its
detention facility. For the purposes of -this contract, "child care day" is
defined as any calendar day or portion thereof during which a child from
said County is detained in the regional detention facility.
SECTION TWO, USE OF DETENTION FACILITY
A.
Harnett County shall have the righ subject to the conditions set
out in this section to place in the detention home operated by the Departmen
children from said County who are alleged or adjudicated to be delinquent as
defined by Article 23, Chapter 7A of the North Carolina General Statutes and
who require secure custody for the protection of the community or in the
best interest of the child.
B. Prior to the placement of a child from Harnett County in the
regional detention facility, said County shall telephone the detention
facility. If there is space available for such a child, the County shall
notify the detention facility as to when the child will arrive at the
detention facility.
C. No child may be placed in the detention facility without a copy of
the petition and court order committing the child to the detention facility.
D. If the regional detention facility does not have space for a child,
said County must make other arrangements for the placement of the child.
The County should notify the Chief of Detention of the Division of Youth
Services of the Department of Human Resources of the lack of space for the
child.

A. Harnett County shall pay the Department for money due under this
contract at the rate set out in Section One, Paragraph A of this contract on
a monthly basis. Said payments shall be due ten days after receipt from the
Department of the bill for the number of child care days provided by the said
detention facility to children from said County.
SECTION FOUR, TERM OF AGREEMENT
A. This contract shall be effective upon the signature of all the parties
to this contract. This contract shall continue until 30 June 1979 unless sooner
terminated. At the termination of this contract all monies due under the terms
of this contract shall be made to the Department within ten days of receipt
by Harnett County of a final bill from the Department.
B. Either party to this contract may withdraw from the contract upon
thirty (30) days written notice to the other party and payment in full of all
monies due under this contract.

Commissioner Shaw moved for the approval of the subdivision plat for
Section Seven, Rolling Springs Subdivision, Anderson Creek Township,
the subdivision plat for Section Three, Happy Acres Subdivision,
Anderson Creek Township, and the subdivision plat for the revisions
of Lots 32 -40, Section Three, Happy Acres Subdivision, Anderson Creek
Township. Commissioner Cotton seconded the motion and the issue
carried.
Joe Lucas, Director with the Department of Human Resources -- Manpower
in Harnett County, presented the August "CETA" employment Training
Report to the Board.
The sealed bids for the Landfill Compactor were publicly opened at
10 a.m. as in accordance with the specifications established by the
Board of Commissioners. A bid was received from E. F. Craven
Company, Greensboro, NC, with the base price including tax in the
amount of $113,037.35. Lease Purchase price for 36 months at
$3,048.12 a month totaling $109,745.00. Lease Purchase Price for
48 months at $2,286.35 a month totaling $109,745. Payments with
interest, taxes, etc., for 36 months at $3,780.12 totaling
$136,084.32. Payments with interest, taxes, etc., for 48 months
at $2,995.13 per month totaling $143,766.24. A bid was also received.
from Road Machinery, Inc., Doraville, Georgia in the amount of
$126,262.50, this price included the tax. A bid bond was not re-
ceived with this bid. These bids were referred to the bid committee
for study. The Board authorized this committee to let the bid to
the lowest bidder which meets all the required specifications.
