THE HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, MARCH 6, 1978
CALL TO ORDER
The Harnett County Board of Commissioners met in regular session on
March 6, 1978, in the Commissioners Room, County Office Building,
Lillington, North Carolina. Chairman Jesse Alphin called the meeting
to order at 9 a.m. Chairman Jesse Alphin and Commissioners Brock,
Cotton, Shaw, and Stewart were present. H. D. Carson, Jr., Clerk to
the Board, and Edward H. McCormick, County Attorney, were also
present.
PRAYER Mr. Bob Etheridge led the morning prayer.
APPROVAL OF The minutes from the February 20, 1978, meeting were read and approved
MINUTES
DOT - PAVING OF Mr. Arthur Williamson, Member of the Board of Transportation; Mr. E.
SECONDARY ROADS J. Butler, District Engineer; and Mr. Don Dupree, Resident Engineer;
appeared before the Board to discuss which secondary roads should
be paved and improved with the bond money which was allocated Harnett
County in the State Highway Bond Act of 1977. Mr Arthur Williamson
presented and recommended a list of secondary roads to the Board of
Commissioners which he had studied and felt needed to be improved.
Several citizens of Harnett County appeared before the delegation
from the Department of Transportation and expressed their concern in
regards to the condition of their roads. The representatives present
were Mary Jernigan, SR 1252; Milton Moore, SR1139; Calvin McNeill,
SR 1210; and Sam McArtan, SR 1227. Mr. Williamson informed these
residents that even though their roads were not on the recommended
list, that they might have a chance of being paved and upgraded if
the Department of Transportation was unable to obtain right of ways.
Commissioner Brock made a motion that the Board adopt the following
resolution to accept Mr. Williamson proposal, Commissioner Stewart
seconded the motion, and it carried unanimously.
At the regular meeting of the Board of County Commissioners of Harnett
County, North Carolina, March 6, 1978, the Commissioners reviewed and accepted the
road improvement program for 1978 -1979.
BE IT RESOLVED THAT the Harnett County Board of Commissioners approved the

RESOLUTION RE: LOCAL Edward H. McCormick, County Attorney, appeared before the Board
INSULATION CODE FOR and discussed the following resolution. Commissioner Cotton
HARNETT COUNTY introduced and moved that the ordinance to License Insulation
Contractors and Others Who Install Materials and Equipment
Designed to Meet the Energy Conservation Standards of the State
Building Code and To Regulate All Persons, Firms, and Corporation
Installing Such Materials and Equipment be adopted. Commissioner
Shaw seconded the motion and it passed with the following
unanimous vote:

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF HARNETT COUNTY.
Section 1. Authority.
This ordinance is adopted pursuant to Chapter 703, North Carolina Session
Laws of 1977, and G.S. 153A -134.
Section 2. License Required.
On\and after January 1, 1978, no person, firm, or corporation may for a
consideration install, alter, or restore, within any unincorporated part of
Harnett County and within any city which adopts this ordinance pursuant to the
authority granted in G.S. 153A -122, any insulation or other materials or
energy utilization equipment designed or intended to meet the State Building
Code requirements for insulation and energy utilization standards who is not
either: (a) licensed as a contractor to do the proposed work under Chapter 87
of the General Statutes; (b) working under the supervision of a registered
architect or professional enginner; (c) an owner working upon his own
building; or (d) license4,under this ordinance.
Section 3. Applications
Every person desiring a license under this ordinance shall submit an
application for such license to the building inspector conforming to the
following requirements:
(1) Form of Application. Each application shall be a written statement
upon forms provided by the building inspector.
(2) Contents of Application. Each application shall contain the follow-
ing information:
(a) Name and home address of the applicant, if an individual, or
home office address, if a corporation or partnership;
(b) Names and home addresses of the partners, if a partnership;
(c) Names and home addresses of the officers and directors, if a
corporation;
(D) Place where the proposed business is to be located;
(e) Complete record of all convictions of felonies or acts involv-
ing dishonesty, fraud, or deceit by the applicant or any employ-
ee, partner, officer, or director of the applicant, whether in
this or any other state or jurisdiction;
(f) Complete record of all licenses held by the applicant or any
employee, partner, officer, or director of the applicant
authorizing activities of the type regulated by this ordinance
or other activities involving construction, alteration, or
modification of buildings and structures;
(g) Information as to the circumstances in which any local, state,
or federal government or agency has refused, suspended, or
revoked a license of the type described in paragraph (f) to
applicant or any employee, partner, officer, or director of
the applicant.
(3) License Fees. Each application shall be accompanied by a license
fee in the amount of $10 for such license such amount to be for
the calendar year and prorated by quarters to the end of such year.
(4) False Statements. False statements on any application for a license
shall be grounds for immediate revocation or denial of such license.
Section 4. Procedure for Issuance.
(1) Review by County Officers. Each application received by the building
inspector shall be promptly forwarded to the sheriff's office for review.
Such officers shall promptly make any comments and recommendations per-
taining to the application and forward them to the building inspector.
(2) Licensing Agency. The application and any comments and recommendations
relating thereto shall be considered by the building inspector which
shall then issue or deny the license pursuant to the following standards.
Standards. The building inspector shall issue the license unless it shall
find that the applicant or any employee, partner, officer, or director of
the applicant:
(a) Has been convicted within the last three years of a felony or an act
act involving dishonesty, fraud, or deceit, whether in this or any
other state or jurisdication;
(3)
(b) Has been regused a license to do the type of work authorized herein
or has had such a license suspended or revoked by any local, state,
or federal government or agency and such government or agency has
not subsequently granted or restored such license;
(c) Has knowingly made a false statement in the application;
(d) Has failed to post the bond or other security required by Section 9.
(4) Appeal from Denial. Any applicant whose license is denied may appeal the
denial to the Harnett County Board of Commissioners. After reasonable
notice to the applicant, the Board shall afford the applicant an opportu-
nity to show why its license should not be denied.
Section 5. Termination and Renewal of Licenses.
All licenses issued hereunder shall terminate on the last day of the
calendar year for which issued. Renewal of such licenses shall be pursuant to
the same procedures and requirements set forth for initial issuance.
Section 6. Suspension; Revocation; Appeal.
(1) The building inspector may suspend or revoke any license issued here-
under at any time upon a showing that the applicant or any employee,
partner, officer, or director of the applicant has:
(a) Knowlingly made a false statement in the application for a licens
(b) Violated the State Building Code requirements as to insulation or
energy utilization equipment or materials, whether in this or any
other jurisdiction; or
(c) Been convicted of an act involving dishonesty, fraud, or deceit
with respect to any contract entered into for work requiring this
license.
(2) Any licensee whose license is suspended or revoked may appeal the
suspension or revocation to the Harnett County Board of Commissioners
After reasonable notice to the licensee, the Board shall afford the
licensee an opportunity to show why its license should not be
suspended or revoked.
Section 7. Change of Location.
The location of any licensed business may be changed, provided 10 days'
notice thereof is given to the building inspector and operation at such new
location does not violate any applicable State or Local law ordinance or
regulation.
Section 8. Permit Required: "Insulation and Energy Utilizatiort'Permit Fee;
Persons Exempted.
(1) On and after January 1, 1978, no person, firm, or corporation may for
a consideration install, alter, or restore, within any unincorporated
part of Harnett County and within any city which adopts this ordinance
pursuant to the authority granted in G. S. 153A -122, any insulation or
other materials or energy utilization equipment designed or intended
to meet the State Building Code requirements for insulation and
energy utilization standards without first securing apermit for the
work to be done. Such permit shall be either:
(a) A general building permit, secured from the Harnett County inspect
ion department and evidencing full compliance with all applicable
requirements of the State Building Code and other State and local
laws; or,

CAPITAL RESERVE FUND
(b) An "Insulation and energy utilization" permit, secured from
the energy and insulation inspector or County inspection
department and evidencing full compliance with the insulat-
ion and energy utilization standards in the State Building
Code. Foreeach such "insulation and energy utilization"
permit issued, there shall be a fee of $5.
(2) The following are exempted from the requirement of obtaining
a permit:
(a) An owner working upon his own building; and,
(b) Any person working under the supervision of a registered
architect or professional engineer.
Section 9. Bond Required.
(1)
Before a license shall be issued to any applicant, the applicant
shall post a bond with Harnett County in the amount of $1,000.
In lieu of posting a bond, the applicant may deposit a cashier's
check or cash in the same amount.
(2) The security required by subsection (1) shall be available to
indemnify any person for any damage which may accrue by reason
of the applicant's failure property to provide or install
insulation, energy utilization equipment or other materials .t
designed or intended to meet the State Building Code standars
for insulation and energy utilization.
Section 10. Penalties.
Any person, firm, or corporation violating the provisions of this
ordinance shall be subject to all the applicable punishment, penalties;
and equitable relief provided for by Chapter 703, North Carolina Session
Laws of 1977, and G. S. 153A -123.
Section 11. Effective Date.
This ordinance shall become effective on March 6, 1978.
Commissioner Brock made a motion that the Board adopt the fol
lowing resolution amending and restating the provisions of th
Capital Reserve Fund for Harnett County. Commissioner Stewar
seconded the motion and it passed with a unanimous vote.
THAT., WHEREAS, The Board of Commissioners of Harnett County
established a Capital Reserve Fund on the 20th day of January, 1975,
pursuant to Chapter 159, Article 3, Part 2 of the General Statute of
North Carolina; and
WHEREAS, the Resolution establishing the Cppital Reserve Fund relate
solely to school construction outlay; and
WHEREAS, The Board of Commissioners desire to amend the resolution b
providing a reserve for construction of Library facilities;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of
Harnett County that the resolution of the Board of Commissioners of Harnet
County dated January 20, 1975, establishing a Capital Reserve Fund be and
the same is hereby amended by substituting the following,provisions:
1. PURPOSE. The purpose of this Capital Reserve Fund is to provide
funds for:
(a) School building construction.
(b) Library facilities construction.
2. TIME.
(a) School purposes. The monies in this fund may be accumulate
for school purposes for as long as ten (10) years after Jua'ly 1,
1975.
(b) Library purposes. The monies in this fund may be accumulate
for library purposes for as long as five years from July 1, 1977.
3. AMOUNT.
(a) School purposes. The approximate amount accumulated and. to
be accumulated for school building construction and other school
capital outlay is Ten Million Dollars.
(b) Library purposes. The approximate amount to be accumulated
for library facilities construction is Five Hundred Thousand

4. SOURCES.
(a) School purposes. The funds for school purposes will be derived
from ad valorem taxes and other sources available to the Commissioners
(b) Library purposes. The funds for Library purposes will be derived
from contributions and may be derived from other sources available to
the Commissioners.
This the 6th day of March, 1978.
Commissioner Brock made a motion that the Board adopt the following
resolution for the retention of directional signs, displays, and devices
on I -95. If these signs were removed, it would have a substantial hard-
ship on the County. Commissioner Cotton seconded the motion and it
passed unanimously
At the regular meeting of the Board of County Commissioners of
Harnett County, North Carolina, March 6, 1978, the Commissioners
reviewed Senate Bill No. 769. Senate Bill No. 769 was adopted during
the 1977 North Carolina legislature. After reviewing this legislation,
and after listening to statements and petitions by various interested
persons, the Board determined that in the interestof the traveling
public, and the economic welfare and prosperity of Harnett County, that
certain billboards and advertising signs should he declared to be
tourist - related advertising devices without which certain areas within
Harnett County would suffer a substantial economic hardship.
The Board of County Commissioners determines and declares by these
premises and this resolution that the signs listed in the attached
"INDIVIDUAL BUSINESS SURVEYS" and in the attached "PETITIONS FOR
RETENTION OF DIRECTIONAL SIGNS, DISPLAYS, AND DEVICES" and summarized in
the attached "DEFINED AREA CONSOLIDATED BUSINESS SURVEYS ", are tourist
related and with the removal of these signs the welfare of Harnett
County would suffer a substantial economic hardship.
Therefore, in accordance with said Senate Bill No. 769, the Board
of County Commissioners does hereby determine that because arbitary
removal of those billboard signs now located in Harnett County would
result in a substantial economic hardship to the economy of Harnett
County, State of North Carolina, it is therefore resolved that the North
Carolina Department of Transportation is requested and directed to
suspend the removal of these signs; and further, that the North Carolina
Department of Transportation is requested and directed to forward this
resolution to the Secretary of Transportation for inclusion as a defined
hardship area qualifying for exemption pursuant to 23 U.S.C. 131 (0).
This resolution was adopted on March 6, 1978.
Commissioner Brock explained to the Board members that an error had been
made in the appointments for the Social Services Board and that Mr. Clyde
Adams was appointed when Mr. Alphin should have been appointed. Commis-
sioner Brock made a motion that Mr. Jesse Alphin be appointed to the
Social Services Board and that this appointment be retroactive to July 1,
1977, and that Mr. Adams' appointment which was made last year be
rescinded. Mr. Adams' appointment is in effect until June 30, 1978.
Commissioner Cotton seconded the motion and it passed with a unanimous
vote.
Commissioner Shaw made a motion that the Invitations for Bwds for one
Metal Type Building, 40' wide X 75' length X 14' eave height for the
County of Harnett be advertised and distributed to all possible
bidders. This building will be used to house the newly created County
Ambulance Service in Buies Creek, North Carolina. Commissioner Brock
seconded the motion and it passed unanimously.
Commissioner Cotton made a motion that the following resolution proclaim-
ing the week of March 13, through March 17, 1978, as Special Olympics
Week in Harnett County be adopted. Commissioner Shaw seconded the motior
and it passed with a unanimous vote.

the Special Olympics program was developed to provide athletic
and competition for mentally handicapped individuals; and
through such athletic endeavors our mentally handicapped

WHEREAS, the highly improtatnt task of aiding these special young people
of Harnett County to help themselves can belong to each of us through
Special Olympics; and
WHEREAS, the Parks and Recreation Department of Harnett County is
sponsoring the 1978 Special Olympics Meet;
NOW, THEREFORE, WE, the Board of Commissioners of the County of Harnett
do hereby proclaim the week of March thirteenth through the seventeenth,
nineteen seventy -eight as SPECIAL OLYMPICS WEEK IN HARNETT COUNTY and do
command this observance to all of the citizens of Harnett County.
Earl Jones, Tax Collector, filed the report of the activities of his
department forthemonth of February and his plans for the month of March,
1978.
Thomas Allen, Tax Supervisor, appeared before the Board and requested
the following refunds or releases:
1. Johnson Farms, Inc. Neill's Creek Township, in the amount of $1,150
for error in listing combine.
2. Chester Byrd, Upper Little River, in the amount of $36.82 for
damage of house in fire.
3. Buies Creek Development, Neill's Creek Township, in the amount of
$52.62 for being listed to Buies Creek Development but sold to
Martha Layton, Lot #4.
4. Margaret Lasaster, Erwin, North Carolina, in the amount of $17.06
for listing of automobile and paid in Wakd County.
5. Wanda J. Hardison, Neill's Creek Township, in the amount of $30,68
for double listing of automobile.
6. J. A. Senter, Anderson Creek Township, in the amount of $430.02 for
double charge.
7. Buies Creek Development, Neills' Creek Township, in the amount of
$34.20 for being listed to Buies Creek Development but sold to
Martha .Layton, Lot #1.
8. C. B. Bryant, Averasboro Township, exemption for the elderly with
limited income in the amount of $55.50.
Commissioner Cotton made a motion that the foregoing refunds and release
be approved on the recommendation of the Tax Supervisor. Commissioner
Stewart seconded the motion and the issue carried.
M. H. Brock, County Manager, filed the expenditures and revenues report
with the Board.
Commissioner Cotton presented the report of the Harnett County Ambulanc
Service for the month of January, 1978, to the Board.
Commissioner Shaw made a motion that the proposed Central Harnett Rescu
District vote notebe called because of the opposition particularly in
the fringe area of the proposed district and that Mr. Tom Lanier work
With Mayor Frank Lewis and the people that presented the petition to
check on the feasibility of redrawing the district boundaries for furth
consideration. Commissioner Stewart seconded the motion and it passed
with a unanimous vote.
The meeting adjourned at 12 noon.
