The Harnett County Board of Commissioners met in regular ses-
sion on February 20, 1978, in the Commissioners Room, County
Office Building, Lillington, North Carolina. Chairman Jesse
Alphin called the meeting to order at 7 p.m. Chairman Jesse
Alphin and Commissioners Stewart, Shaw, Brock, and Cotton were
present. H. D. Carson, Jr., Clerk to the Board, and Edward H.
McCormick, County Attorney, were also present.
Commissioner Jack Brock led the evening prayer.
The minutes of the February 6, 1978, meeting were read and
approved.
The following delegation of concerned citizens petj_tioned the
Board -5s assistance in establishing a sewage system in the Buies
Creek area.
Bob King, member of the Campbell College faculty, appeared
before the Board and expressed his appreciation to the Commise
sioners for taking this opportunity to share the concerns of
the people in the Buies Creek area. Mr. King stated that this
meeting is largely a results of Mrs. Tuck efforts. He said tha
the Board's authorization and help was needed to establish a
sewage- disposal sanitation district in Buies Crrek, He stated
that he had discussed the proposed district with several
residents in his area and also with the college and that he has
heard no opposition.
L. T. Easley, Jr., from. the Lake Small neighborhood, said that
he had contacted all. the people in his area and that only a
few people had any reservations at all about some type of
sewage system.
Gladys Dixon, from. the Parkwood area, stated that 50 percent of
the residents in her area has experienced serious sewage
problems. These residents have installed the finest sewage
systems available, but they continue to have difficulty. Mrs.
Dixon stated that the reason for this was that the ground table
is naturally high.
Marshall Woodall, Attorney and spokesman for James Kinton,
Adams and Kinton Nursing Home, said that even though Mr. James
Kinton's place of business was not in the Buies Creek area
that he would like to be included inthis sanitation district,
if it is created. Approximately 227 people occupy Mr. Kinton's
premises during a day, and he has to employ rental services
and carry his laundry to Fuquay in order to handle his sewage
needs. Although Mr..Kinton is currently handling these
problems, he is concerned that he will not be able to take care
of the future requirements placed on his facilities by EPA.
Mr.. Woodall requested on_behalf of Mr. Kinton and the people in
the greater Buies Creek area that a feasibility study be con-
ducted and lines running to Mr. Kinton's place of business be
included.
James Walker, from the west side of Blies Creek, stated briefly
that the water table is too high and that a sanitation district
is desperately needed.
Bruce Blackmon Dr. Bruce Blackmon from Buies Creek, who was unable to attend
the meeting because of a conflict in his schedule, submitted
the following request by letter: "I do want to say that I am
very much interested in efforts to establish a sewer system in
and around Buies Creek, My interest is based on concern about
health hazards which will be increased unless we take some
definite steps to prevent them.
ACTION Commissioner Cotton made a motion that a spokesman be selected
from the Buies Creek area to meet with the County Manager to
discuss what possible alternatives are available to the people.
The County Manager will work with these citizens to determine
what actions can and should be taken. Commissioner Stewart
seconded the motion, and it passed unanimously.
HOUSING ELEMENT AND
LAND USE PLAN
The Harnett County Housing Element and the Land Use Plan which
was introduced at the last meeting was brought back before the
Board. Commissioner Shaw made a motion that the Board adopt
the Land Use Plan and the Harnett County Housing Element.
Commissioner Stewart seconded the motion, and it carried
unanimously.
NEMPLOYMENT INSURANCE Under the Employment Security Law of North Carolina, effective
January 1, 1978, Harnett County was determined a liable employer
The county must, therefore, adopt an unemployment insurance.
Commissioner Brock recommended and made a motion that the Board
adopt the reimbursement basis. Commissioner Cotton seconded
the motion, and the issue carried. The county's account number
under the reimbursement basis is 99 -43 -992.
ESOLUTION RE: RESALE Marshall Woodall, Tax Attorney, presented the following resolu-
F AVERY PROPERTY tion requesting that a certain lot known as 508 East Edgerton
Street in Dunn, North Carolina, be conveyed back to Mr. W. H.
Avery and wife, Annie Ruth. Commissioner Cotton moved that the
Board execute this resolution, Commissioner Brock seconded the
motion and it carried unanimously.
THAT WHEREAS, The County Of Harnett became the purchaser of that certain
lot known as 508 East Edgerton Street in Dunn, North Carolina, as the
result of a tax foreclosure sale in 1960, said property having been deed
ed to the County by deed dated February 17, 1961, and recorded in Book
398 Page 521. Harnett County Registry; and
WHEREAS, W. H. Avery and wife, Annie Ruth Avery are the former owners of
said property and were specifically the owners of the property at the
time of said tax foreclosure; and
WHEREAS, W. H. Avery and wife, Annie Ruth Avery, desire to purchase said
porperty from the County of Harnett; and

Whereas, pursuant to North Carolina General Statue 105- 376(c), the stat-
ute authorizes and empowers the County of Harnett to resell said propert
to the former owners thereof for an amount not less than the interest
which the County of Harnett, as taxing unit has in said property; and
WHEREAS, THE Harnett County Tax Supervisor and Tax Collector have
represented to the Board of Commissioners that the sum of $712.29 fairly
and reasonably represents the interest which the County of Harnett has
in said property.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
First: That the Board of Commissioners does hereby exercise its
discretion pursuant to North Carolina General Statute 105 -376 (c) by
electing to resell the property mentioned above to the former owners, W.
H. Avery and wife, Annie Ruth Avery.
Second: That the sum of $712.29 fairly and reasonably represents the
interest of the County of Harnett in and to the aforesaid property.
Third: That upon payment of the sum of $712.29, the Chairman of the
Board of County Commissioners be and he is hereby authorized and
empowered to execute in the County's name a deed, without warranties,
conveying said properties as described in that deed heretofore made to
the County of Harnett and referred to above, unto W. H. Avery and wife,
Annie Ruth Avery; and further the Clerk to the Board is authorized and
empowered to attest said deed and affix the seal of Harnett County there
Fourth: That a copy of this resolution be attached to said deed.

HARNETT AND AMBULANCE hearing afar the Central Harnett Ambulance and Rescue Service District. The
DISTRICT purpose of the hearing was to hear the public's opinion to the creation of a
ambulance and rescue service district.
ADJOURNMENT The meeting adjourned at 9:30 p.m.
