PROVAL OF THE MINUTES
The Harnett County Board of Commissioners met in regular session on
Nbnday, November 7, 1977, in the Commissioners Roan, County Office Build-
ing, Lillington, North Carolina. Chairman Jesse Alphin and Commissioners
Brock, Cotton, Shaw, and Stewart were present. H. D. Carson, Jr., Clerk
to the Board, and Edward H. McCormick, County Attorney, were also present.
Chairman Jesse Alphin called the meeting to order at 9:10 a.m.
Commissioner Shaw led the morning prayer.
The minutes from the October 17 meeting were read and approved.
DUPREE, DISTRICT ENGINEER Don Dupree, District Engineer with the Department of Transportation,
appeared before the Board for a discussion on the road matters in Harnett
County.
PEED ZONE, MENTAL HEALTH
M. H. Brock, County Manager, informed Mr. Don Dupree that the Board had
received a letter from Lee - Harnett Mental Health Center requesting that
the 45 speed limit be extended eastward toward Dunn, passed the entrance
to the Mental Health Center. Mr. Dupree stated that he would relay this
information to the Traffic Engineer. He also stated that in order to cha
a speed limit zone, a request had to go before the Board of Transportatio
R 1111 Commissioner Brock presented a request to Mr. Dupree to upgrade the
maintenance on SR 1111.

Edgar R. Bain, Attorney at Law, appeared before the Board as a representa-
tive for Mr. and Mrs. Alvin McArtan. Mr. Bain informed the Commissioners
of the hazardous condition of SR 2045. Commissioner Cotton introduced
the following resolution and moved that it be adopted. Commissioner
Stewart seconded the motion and it passed unanimously.
At a regular meeting of the Harnett County Board of Commissioners
held on Monday, November 7, 1977, Commissioner Cotton introduced the
following resolution and moved that it be adopted:
THAT WHEREAS, a severe curve exists in State Road No. 2045 immediatel
in front of the residence of Alvin R. McArtan and Wife, Charlotte C.
McArtan; and
WHEREAS, numerous accidents have happened on the curve in this road,
the most recent having occurred on Sunday night, October 23, 1977, when
over $2,000 of damage was caused to the landscaping in the yard of the
residence of Alvin R. McArtan; and
WHEREAS, the curve in this road presents a real danger to the travel-
ing public and to the residence of Alvin R. McArtan; and
WHEREAS, Alvin R. McArtan owns the land on both sides of State Road
No. 2045 and has agreed to contribute whatever right -of -way is necessary
in order to straighten the curve in State Road No. 2045; and
WHEREAS, the Harnett County Board of Commissioners are of the
opinion that such road should be strightened or that guardrails should be
placed on such curve by the North Carolina Department of Transportation.
NOW, THEREFORE, in consideration of the premises, BE IT RESOLVED that
the Harnett County Board of Commissioners request the North Carolina
Department of Transportation to proceed as quickly as possible to straight
en the curve in State Road No. 2045 in Anderson Creek Township immediately
in front of the residence of Alvin McArtan and if such road cannot be
straightened within a reasonable time that North Carolina Department of
Transportation is requested to place guardrails at such curve in order to
protect the traveling public and the residence of Alvin McArtan.
John Sullivan, Spokesman for residences on SR 1294, presented a petition
to the Board requesting that this road be paved. Mr. Sullivan stated that
SR 1294 is traveled daily by a school bus and that frequently he carries
his child to school because the road is too slippery to be safely driven
on by a bus. Commissioner Cotton made a motion that the Board forward
this petition to the Department of Transportation and request that the roa
he upgraded and that a traffic count be conducted. Commissioner Stewart
seconded the motion and it carried with a unanimous vote.
R 1224 Johnie Thomas presented a petition to the Board to have SR 1224 paved. The
Board informed Mr. Thomas that Sr 1224 was No. 19 on the priority list.

Commissioner Brock delivered a request to the Board to have Pine and
Sycamore Streets in the Ponderosa Subdivision, Dunn, North Carolina, added
to the Secondary Road System for maintenance and moved that the Board
approve this request. Commissioner Shaw seconded the motion and it car-
ried with a unanimous vote.

Informal bids were placed for three overhead doors. Commissioner Brock
presented these bids to the Board.

The low bidder for the three doors was Overdoors of the Carolinas, Inc.
Commissioner Shaw highly recommended this firm and made a motion that this
bid be approved. Commissioner Cotton seconded the motion and it passed
unanimously.
The following informal bids for the furnishing of a 200' x 130' x 6' fence
and a 16' gate were presented to the Board by Commissioner Brock:

Commissioner Cotton made a motion to award the bid to the lowest bidder
which met all the required specifications. Commissioner Stewart seconded
the motion and it passed with a unanimous vote.
M. H. Brock, County Manager, presented an agreement between Mr. and Mrs.
H. L. West and the County of Harnett to release the Rohnsonville Landfill
site property without any obligation on either party. Commissioner Stew-
made a motion that the Board approve this mutual release. Commissioner
Shaw seconded the motion and the issue carried. A copy of this mutual
release is filed in the County Manager's office.
The Glenn Acres Subdivision and the Fannie Jordan Subdivision plats,
located in the Black River Township, were presented to the Board for fina
approval. Before these subdivisions were presented to the Board, the
Health Department evaluated the lotsaand determine which lots were accept
able for subsurface disposal systems The Harnett County Planning Board
also approved these plats. Commissioner Cotton made a motion that the
Harnett County Board of Commissioners give the final approval on these
subdivisions. Commissioner Stewart seconded the motion and the issue_:
carried.
The following resolution stated the County's intention to reconvey withou
consideration certain described property to the Erwin Sand & Gravel Comp
Inc. Commissioner Stewart made a motion that the Board adopt this
resolution. Commissioner Shaw seconded the motion and it passed with a

unanimous vote.
THAT, WHEREAS, Erwin Sand and Gravel Company, Inc. conveyed to the County
of Harnett, the lands hereinafter described "... so long as the property
is used as a public garbage disposal area for all types of rubbish,
garbage and waste "; and
WHERE, no consideration was actually paid for such rights; and
WHEREAS, gravel pits below the water table level were and are located on
the property and it has been determined by the State of North Carolina
that the property is not suitable for waste disposal; and
WHEREAS, the property is of no value to the County of Harnett since the
County has no usable right in and to the property.
NOW, THEREFORE, pursuant to N.C.G.S. 153A -177, the County Manager is
authorized to cause publication of this resolution as notice of the
County's intention to reconvey without consideration, the following
described property by Quitclaim Deed to Erwin Sand and Gravel Company,Inc
BEGINNING at a point in the eastern boundary line of the lot herein
conveyed at a distance of 259.62 feet South 12 degrees West from the
Northeast corner of a 5 acre tract; thence South 12 degrees West alo
the eastern boundary line of the lot herein conveyed; a distance of
495.38 feet to a stake corner, in the eastern boundary line of the
lot herein conveyed; then South 28 degrees 30 minutes East, a dis-
tance of 800 feet to another stake, corner in the eastern boundary
line of the lot herein conveyed; thence South 4 degrees 45 minutes
West a distance of 246 feet to a stake, the southeastern corner of
the lot herein conveyed; thence North 85 degrees 30 minutes West
along the southern boundary line of the lot herein conveyed, a dis-
tance of 1062.6 feet to a stake the Southwest corner of the lot
herein conveyed; thence North 4 degrees East along the western bound
ary line of the lot herein conveyed, a distance of 1215,81 feet to a
stake, the Northwestern corner of the lot herin conveyed; thence
along the Northern boundary line of the lot herein conveyed North
79 degrees 07 minutes East a distance of 812.90 feet to the BEGIN-
NING.
The foregoing described lot of land is the southern portion of that
certain tract of land conveyed by Warranty Deed dated January 3,
1948, by Jesse L. Lockamy and wife, Rosa Lockany, grantors to John
T. West of Cumberland County, North Carolina, as shown recored in
Book 310, Page 137, in the office of the Register of Deeds for
Harnett County, North Carolina.
For further reference see deed from John T. West and wife, Lalon G.
West to Erwin Sand and Gravel Company, Inc., dated December 22, 1965
and recorded on December 30, 1965 in Book 478, Page 47, Harnett
County Registry.
This resolution shall be published once a week for two consecutive weeks
prior to reconveyance of said property.
The Chairman of the Board of Commissioners of Harnett County, Jesse C.
Alphin be and he is hereby authorized to execute said deed on behalf of
the County and H. D. Carson, Jr., Clerk to the Board, be and he is hereby
authorized to attest the same and affix thereto the corporate seal of
the County of Harnett.
Passed by the Board of Commissioners of Harnett County this the 7th day
of November, 1977, by the following vote: Ayes 5; Noes None.
OLICY GOVERNING THE M. H. Brock, County Manager, presented the policy governing
OMMUNITY SCHOOLS PROGRAM the Community Schools Program. It was the Board's decision
to study this policy and discuss it at the mid -month meeting.
ASTER FACILITIES STUDY The engineering study on the wastewater facilities for the
Town of Coats, which was prepared under the Community Develo
ment Grant, was presented to the Board. The Board will stud
this report and bring it back to the mid -month meeting.

Thomas Allen, Tax Supervisor, presented a report of his de-
partment to the Commissioners and made the following request
for refunds or releases:

Mrs. Estelle Bayles, Duke Township, elderly with
limited income in the amount of $56.50.

Commissioner Cotton moved that the Board grant these releases
and refunds on the recommendation of the Tax Supervisor.
Commissioner Shaw seconded the motion and the issue carried.
The Board of Commissioners held a brief disscussion concern-
ing the release for Vira Mae Whittington Tew in the amount
of $3.78. Mr. Allen had received a letter from Mr. Tew
stating that his wife had listed her taxes on time last
year but for some reason the abstract did not reach the of-
fice. Commissioner Stewart made a motion that the Board
relieve Mrs. Tew of this penalty. Commissioner Cotton
seconded the motion and it passed.
M. H. Brock, County Manager, presented his expenditure and
revenue report for the month of October to the Board.
M. H. Brock, County Manager, requested a budget amendment
in the amount of $15, 521.00 (Fifteen Thousand Five Hundred
Twenty -One dollars) to Code 36 -190 for the Anti - Recession
Fiscal Assistance Grant. Commissioner Cotton seconded the
motion and the issue carried.
RESOLUTION RE: PINE AND Commissioner Brock made a motion that the Board adopt the
SYCAMORE STREETS ADDITION following resolution, seconded by Commissioner Shaw, and
TO SECONDARY ROAD SYSTEM passed unanimously.
WHEREAS, all the property owners on Pine and Sycamore Streets in the
Ponderosa Subdivision, Averasboro Township, have presented a request
to the Harnett County Board of Commissioners to add the above described
roads to the Secondary Road System for maintenance, and
WHEREAS, all the property owners agree to dedicate to the State Highway
Commission a right -of -way sixty (60) feet in width extending the entire
length of the road that is requested along with the..aecessary areas for
cut and fill slopes and drainage, and
WHEREAS, all the property owners also agree to dedicate additional
right-of-way in the .publicroad intersections for sight distance and
design purposes and to execute the right -of -way agreement forms that
will be submitted to us by forces of the Highway Commission in order
that the Highway Commission fulfills the requirements of Chapter 1244,
1959 Session of the General Assembly of North Carolina, and
WHEREAS, all streets have been paved and have curbs and cutters in
accordance with the Dunn City Ordinance,
NOW THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMIS-
SIONERS, that:
1. The Harnett County Board of Commissioners approve this request that
the aforementioned streets be added to the State Secondary Road
System for maintenance.
2. The Department of Transportation be and is hereby petitioned and
requested by the proper execution of this document, to add the Pine
and Sycamore Streets in the Ponderosa Subdivision, Averasboro
Township, to the North Carolina Secondary Road System for mainte-
nance.
ADJOURNMENT The meeting adjourned at 11:15 a.m.
