MINUTES OF THE MID MONTH MEETING OF THE HARNETT COUNTY BOARD OF COMMISSIONERS

PROGRESS REPORT
Action
The Harnett County Board of Commissioners met in regular mid -
month session on June 20, 1977. Chairman Jesse Alphin called
the meeting to order at 7:30 p.m., with the following members
present: Commissioners Bill Shaw, W. J. Cotton, Jr., M. H. Brock
and Lloyd G. Stewart. The Clerk and Attorney were present.
Commissioner Bill Shaw led the evening prayer.
The minutes of the previous meeting were read and approved.
Milton Moore, James Hall, Mrs. Tom Smith and Mrs. Larry Holt
were present at the meeting to discuss SR 1139. They indicated
that the road was 2.6 miles in length and 30 families were
living beside it. Their request was that the road be paved.
The Chairman informed Mr. Moore who was the speaker for the
group, that the Department of Transportation had scheduled
a public hearing for June 27, 1977. Mr. Moore presented a
petition duly signed by all the property owners along the road.
Commissioner Cotton made a motion that the Board accept the
petitnn and submit it to the Fayetteville Office, along with
a request for an investigational study of the road and a
report of the findings. Commissioner Shaw seconded the motion
and the issue passed.
Dan Spangler, accompanied by Parks Blake, Director of Soil
Conservation Service, presented a progress report for the inform-
ation of the Board, in accordance with the agreement made prev-
iously between the Board of Commissioners and the United States
Soil Conservation Service. He reported that 29% of the county
had been surveyed and that the county was made up of 5 differ-
ent soil regions. The Board was at liberty to discust the
project.
Commissioner Brock reported that $14,000. had been appropriated
for the purpose of carrying on this service and that it was nec-
essary to execute the agreement between the county and the Soil
Conservation Service. Commissioner Cotton moved that the Chair-
man and the Clerk be and they are hereby authorized to execute
the Contract described above. Commissioner Brock seconded the
motion and it carried.
REQUEST BY JOHN E. INGRAHAM
TO AUDIT RECORDS Written request was presented to the Board by John Ingraham
and Associates for the contract to audit the accounts and
records of the county for the fiscal period, July 1, 1976
through June 30, 1977, for an amount not to exceed $2,100.
Commissioner Brock moved the contract be awarded to John In-
graham and Associates, Commissioner Cotton seconded and the
issue passed.
R. E. ATKINS RE:
LATE LISTING PENALTY R. E. Atkins appeared before the Board regarding a penalty for
late listing of property. He reported that he was not familiar
with the tax listing procedures of the county, but he had
gone to the tax office as soon as he had received a notice that
he had not listed his taxes. He asked that the penalty for
late listing be released. Commissioner Shaw made a motion that
the request be taken under advisement until the Board could
discuss the matter with the Tax Supervisor. Commissioner Brock
seconded the motion and the issue passed.
RES. CAPE FEAR CHRIS- The following resolution was presented for the pleasure of the
TIAN ACADEMY Board and was adopted by a motion made by Commissioner Brock,
a second by Commissioner Cotton and a unanimous vote:
WHEREAS, CAPE FEAR CHRISTIAN ACADEMY,an outstanding
instution of learning in Harnett County, excels both in
academic standing and in athletic accomplishments, and
WHEREAS, the golf team of Cape Fear Christian Academy
has brought recognition to the instituion and to Harnett
County this golf season by displaying exemplary sportsmanship
and conduct in their competition, and
WHEREAS, this team has been vistorious in 19 matches, and
WHEREAS, the team is composed of John Daniel, David Pittman,
Vernon Stewart, Jr., Al Bain, Marc Hutaff, Rusty Godwin, and
Charles Bradshaw, and was led to successful competition by their
able coach, Edgar R. Bain, and

WHEREAS, this team was declared to be the state champions
of the North Carolina Independent High School Athletic Association,
and
WHEREAS, the 'All State' trophy was awarded to
Vernon Stewart, Jr., and Al Bain, and
WHEREAS, Charles Bradshaw was named to the All
John Daniel,
Conference,
NOW, THEREFORE BE IT RESOLVED that the Harnett County
Board of.Commissbners does hereby pay tribute to and honors each
effort expended toward the achievement of this distinction, both
individually and collectively, and.
FURTHER, BE IT RESOLVED that this resolution be spread upon
the face of the permanent record of Harnett County, so that those
in the future may read, see,a nd know of the accomplishment of
this team composed of those named above, and that copies of this
document be sent to each member of the team, their coach, the
school authorities and to the news media.
TATEMENT OF INVESTMENTS
County Manager Brock presented the Commissioners with a State-
ment of Investments.
VOTING. DELEGATE TO NACO
Commissioner Cotton moved that Chairman Alphin be named voting
delegate to the NACo Convention, Commissioner Shaw amended the
motion to declare W. J. Cotton, Jr. the alternate delegate. Comm
issioner Stewart seconded the motion and it passed.

A quit -claim deed from Harnett County, favoring Kathering Taylor
White, Emma Ann Taylor Ruark was presented and an explanation
thereto made saying that the county had taken possession of the
property and when the lien was pail, the title was not cleared.
Commissioner Brock made a motion that the Chairman be author-
ized to execute the deed and the the Clerk be authorized to
attest it, and the title therefore be transferred from the county
to the above named recipeints. Commissioner Cotton seconded and
the issue passed.

SAFE COMMITTEE

DISCUSSION OF PUBLIC HEALTH
& SAFETY COMMITTEE- The Public Health & Safety Committee subject was brought
to the floor for discussion. The attorney presented cop-
ies of his opinion on issues raised by the Board. A
lenghty discussion was held, after which plans were made
that would cause a definite plan of action to be brought to the Board
of Commissioners from the Public Health and Safety
Committee.
OPENING FOR LANDFILL SITE A tentative date for the opening of the new Dunn Erwn
landfill was set for July 20, 1977.
ANGIER PARADE Notice was given the Commissioners that they were invited
to the Angier parade to be held on July 4, 1977.

RESOLUTION RE: ATTORNEY FEES
ETWEEN THE TAX ATTORNEY AND DELINQUENT
TAXPAYERS SUITS Attorney McCormick presented the following resolution for
the pleasure of the Board:
Due to the next regular meeting date falling on a Nationl
Holiday, the meeting was set for Tuesday, July 5th, 1977
at the regular meeting place and time.
The meeting adjourned at 9:30 p.
RESOLUTION
THAT WHEREAS, the attorney's fees to the Harnett County Tax Attorney
are paid by the various delinquent taxpayers who are defendants in
tax foreclosure suits as a part of the court costs taxed by the
Court as provided by General Statute 105 -374 (i); and
WHEREAS, the Board of Commissioners did approximately ten (10) year s
ago recommend to the the Court that the Board considered a reasonable
attorney's fee for preparing and filing a tax foreclosure suit to
be $30.; and
WHEREAS, the Board of Commissioners is of the opinion that the present
fee of $30. being charged is insufficient as a reasonable fee to
properly cover the attorney's time and cost of his office; and
WHEREAS, the Board of Commissioners acknowledges that the establish-
ment and setting of a reasonable attorney's fee for tax foreclosure'
suits is the duty and responsibility of the Court as provided by
the General Statutes and said fees can best be set by the Court.
NOW, THEREFORE, BE IT RESOLVED THAT:
First: The setting of a reasonable attorney's fee for the Harnett
County Tax Attorney is and should be the duty and responsibility of.
the Court's pursuant to the General Statutes and further that the
establishment of a reasonable fee should be made on an individual case
basis according to the time and work caused to be expended to
collect the taxes due unto the County of Harnett.
Second: That the Board of Commissioners is of the opinion that a
reasonable attorney's fee for the preparation and initial filing of
complaint and summons to commence a tax foreclosure suit should be
not less than $50.00.
Third: That a copy of this resolution be forwarded to the Clerk of
Superior Court.
Adopted this 20th day of June, 1977.
ACTION: Commissioner Cotton moved to adopt the foregoing resolution, Commissioner Brock seconded the
move and when put to vote, the following voted affirmatively: Commissioners Cotton, Brock, Stewart
and the Chairman.
