HomeMy WebLinkAbout122019767 MINUTES OF THE MID-MONTH MEETING HELD ON DECEMBER 20, 1976 DECEMBER MEETING PRAYER The December mid -month meeting convened on December 20, 1976, in the County Office Building. Chairman Jesse Alphin called tI meeting to order at 7 :30 P.M. with Commissioners Shaw, Cotton, Brock and Stewart present. H. D. Carson, Jr., and Edward H. McCormick were also present. Robert Coats led the evening prayer. MINUTES READ AND APPROVED The minutes from the previous meetins were read and approved. REPORT FROM TITLE 4 -D, PATERNITY SUPPORT Robert Coats, Department of Social Services Title 4 -D, Pater- nity Support Program, fil -d a report with the Commissioners. PUBLIC HEARING RE: COMMUNITY DEVELOPMENT APPLICATION The Chairman then called the meeting into a public hearing for the purpose of considering the Community Development Application, which is due from the county on January 7, 1977. Susan Cheek, Regional Planner from the Fayetteville Office of Region *M ", made a presentation of the points that,:ard-vital to the applicationsand points that would validate the applic- ation. These points included the objectives of the applicatior uses of the grant if obtained, and general information nec- essary to the planning and preparation of the application. A question and answer discussion time followed, and the foll- owing persons entered into the discussion. Shawtown, entered a request for items to be included in the application for recreation, street paving and draining, and renovation and development of housing. Dunn, spoke in behalf of Shawtown in'that there needed to be plans for proper layout of the streets in the Shawtown area. Ernest Harrington G. D. McNeill Fred Jones Bob Nicholl, Manager G. D. McNeill Town of Lillington Town of Coats Town of Erwinf' Town of Angier Commissioner Shaw Chairman Alphin REGULAR MEETING CONVENES AFTER BRIEF RECESS Erwin, stated that East Erwin badly needed a water system. City of Dunn, presented the following written information from the City of Dunn, and stated that this request was directed and confined to low income area. Storm drainage project 95,900.00 Water Distribution 78,600.00 Street Resurfacing 40,000.00 Housing Rehabilitation 72,000.00 Engineering & Contingency 28,500.00 Total 315,000.00 Mr. Nicholl stated that the preference of the projects by need and necessity was for storm drainage. spoke again saying that the no blighted area in the city was Pope's Bottom, leading from City Hall East to Harnett Elementary School, but that storm drainage was the most impor- tant goal at this time. submitted by letter a request for $100,000. to grade; drain, pave, curb and gutter Tenth Street and a portion of Harnett Street, also Front Street from Tenth to Main. This is a substandard area of town. submitted written request for 32 units of substandard housing to be upgraded, 6100' of streets to be paved and funds for a mini -park to be located in substandard housing area. submitted a request for the extending of water lines in the amount of $80,000.00. submitted.a written request detailing the need for thepaving of Cross Street. suggested that a need existed in the rural area of the County. expressed appreciation to those attending the hearing and to those who took part in the discussion. He officially closed the public hearing at 8:35 P.M. CONTRACT RE: FLATWOODS, ANDERSON CREEK, AND SPOUT SPRING FIRE DEPARTMENTS e f 75` RESOLUTIONS AUTHORIZING EXECUTION OF THE DOCUMENTS Resolutions: Flatwoods Anderson Creek Spout Springs The County Attorney presented contracts from Flatwoods Fire Department, Inc., Anderson Creek Volunteer Fire Department, Inc., and Spout Springs Rural Fire Department, Inc., for execution by the Board of Commissioners. Commissioner Cotton moved to adopt the following resolutions authorizing the execution of the Chairman for the Board of Commissioners, of the contracts from the above mentioned fire districts, Commissioner Brock seconded the motion and the issue carried. RESOLVED, That the Chairman of the Board of Commissioners of Harnett County, Jesse Alphin and the Clerk to the Board, H. D. Carson, Jr., be and they are hereby authorized to execute a "Contract and Agreement" dated December 20, 1976 by and between the County of Harnett and Flatwoods Comm- unity Fire Department, Inc., that said contract is hereby authorized as a binding contract of the County of Harnett. RESOLVED, That the Chairman of the Board of Commissioners of Harnett County, Jesse Alphin and the Clerk to the Board, H. D. Carson, Jr., be and they are hereby authorized to execute a "Contract and Agreement" dated December 20, 1976 by and between the County of Harnett and Anderson Creek Volunteer Fire Department, Inc., that said contract is hereby authorized as a binding contract of the County of Harnett. RESOLVED, That the Chairman of the Board of Commissioners of Harnett County, Jesse Alphin and the Clerk to the Board, H. D. Carson, Jr., be and they are hereby authorized to execute a "Contract and Agreement" dated December 20, 1976 by and between the County of Harnett and Spout Springs Rural Fire Department, Inc., that said contract is hereby authorized as a binding contract of the County of Harnett. ORDINANCE ENTITLED "AN ORDINANCE PROVIDING FOR THE ANNUAL REGISTRATION OF HOUSE TRAILERS, MOVILE HOMES, AND SIMILAR VEHICULAR STRUCTURES AND THE ISSUANCE OF EVIDENCE OF REGISTRATION BE BE EXHIBITED UPON SAID VEHICLES" The County Attorney introduced an ordinance entitled "AN ORDINANCE PROVIDING FOR THE ANNUAL REGISTRATION OF HOUSE TRAILERS, MOBILE HOMES, AND SIMILAR VEHICULAR STRUCTURES AND THE ISSUANCE OF EVIDENCE OF REGISTRATION TO BE EXHIB- ITED UPON SAID VEHICLES" He informed the Board that this particular kind of ordinance could be adopted without a public hearing, and would be in force whenever the ordinance was passed and recorded properly in the Official County Ordinance Book. Commissioner Cotton moved that the ordinance as proposed by the Attorney, be adopted, Commissioner Stewart seconded and those voting for the issue were: Commissioner W. A. Shaw Commissioner W. J. Cotton, Jr. Commissioner Lloyd G. Stewart Commissioner Brock Chairman Jesse Alphin Those voting against the issue were none. The ordinance is placed in the County Ordinance Book, at page 217. APPOINTMENT TO COMPREHENSIVE FAMILY PLANNING Commissioner Brock recommended that Mrs. Sadie Lyle, Route 3, Lillington, and Mrs. Evonne Morrison, Route 4, Dunn, be appointed to the Region "M" Comprehensive Family Planning Committee, due to the vacancies of two in the Consumer category for the County. Commissioner Stewart moved these named be appointed, Commissioner Shaw seconded and the issue passed unanimously. SHERIFF OFFICE EXTENSION Commissioner Brock reported that the building project for the extension to the Sheriff's Office would not be attempted at this time without the use of an architect, and the pro- ject be placed on formal bid, according to the General Statutes of the State of North Carolina. Commissioner Cotton moved that the project be deferred until the January 3rd meeting, Commissioner Stewart seconded and the issue passed. GF REPORT The Report of the General Fund Expenditures was filed with the Board. CONTRACT OF EMPLOYMENT Title 4 -d The following Contract of Employment was presented for the action of the Board, as a mandate under the Title 4 -D Paternity Support Program. Commissioner Brock moved to approve the Contract, Commissioner Cotton seconded and the issue carried: CONTRACT OF EMPLOYMENT THIS CONTRACT, Made and entered into this the 20th day of December, 1976, by and between the Harnett County Commissioners, party of the first part, and Edward H. McCormick, party of the second part; W I T N E S S E T H THAT WHEREAS, the party of the first part desires to employ said party of the second part as its attorney and counsellor at law, upon the following terms; 1. This contract shall begin effective July 1, 1976, and unless sooner terminated by mutual consent of the parties herein, shall exist and continue through June 30, 1977. 2. Said party of the second part, upon reasonable notice, is to be available for consultation, legal advice and representation on all legal matters arising from the duties of the party of the first part under sections 128 through 140 of Chapter 110 of the North Carolina General Statutes and United States Public Law 93 -647. 3. Said party of the second part agrees to maintain such records as are required by the party of the first part and to make financial, statistical, and program progress reports as is required. 4. For his services under this agreement, the party of the first part agrees to pay the party of the second part Forty Dollars $40.00) per hour for each hour spent by the party of the second part providing legal services under the Child Support Enforcement Program. Such hourly rate shall include all salary, expenses, supplies, office space, heating and maintenance for office space, telephone service, long distance telephone calls and travel. The party of the second part is not to be reimbursed for any extraordinary expense incident to performing the services included under this agreement; except, that the party of the first part agrees to pay all court costs and filing fees which are required to be paid in conjunction with ser- vices provided by the Attorney under this agreement. IN TESTIMONY WHEREOF said parties have executed this con- tract in triplicate originals, one of which is to be retained by the party of the first part, one of which is to be retained by the party of the second part, and one of which is to be filed with the Child Support Enforcement Section, Division of Social Services, Department of Human Resources, Raleigh, North Carolina. JOYCE ANDREWS NAME TO REPLACE SUE ANDREWS NAME Commissioner Cotton stated that the minutes should reflect that Mrs. Joyce P. Andrews was named to serve on the Har- nett County Health Board, Rotate 2, Fuquay Varina, NC, instead of Mrs. Sue Andrews. ADJOURNED Adjourned by motia by Commissioner Cotton, time 9:30 P.M.
