HomeMy WebLinkAbout08/02/1976MINUTES OF THE COMMISSIONERS MEETING HELD ON AUGUST 2, 1976 REGULAR MEETING The regular meeting of the Harnett County Board of Commissioners was convened on Monday, August 2, 1976, at 9:00 A.M., by the Chairman,Bob Etheridge. Commissioners Alphin, Cotton, Brock and Stewart were in attendance, also the Clerk and Marshall Woodall for the County Attorney. PRAYER Commissioner Alphin led the morninglrayer. MINUTES READ AND APPROVED The minutes of the previous meetings were read and approved. DON DUPREE, DOT Don Dupree, District Engineer, Department of Transportation, appear- ed before the Board and discussed Harnett County Road projects, and listened to questions presented to him from the Board. MUTUAL AGREEMENT BETWEEN BOARD OF EDUCATION AND COUNTY The Board was presented with an agreement that would, if executed, be an agreement between the County of Harnett and the Harnett County Board of Education, describing a mutual interest to provide adequate recreation programs for the county, and is made a part of this record as follows: COUNTY OF HARNETT NORTH CAROLINA THIS AGREEMENT, made and entered into this 2nd day of August, 1976, by and between the County of Harnett, hereinafter called "County ", and the Harnett County Board of Education, hereinafter called "Board ". WITNESSETH: WHEREAS, teh County and the Board are mutually interested in a adequate program of community recreation under the auspices of the County's Parks and Recreation Committee, and WHEREAS, said agencies are authorized to enter into an agreement to aid and cooperate in the cultivation of citizenship of providing for adequate programs of community recreation and WHEREAS, in the interest of providing the best service with the least possible expenditure of public funds, full cooperation between the County and the Board is necessary. NOW, THEREFORE, in consideration of these premises, said County and said Board do now agree to cooperate with each other in carrying out the purposes, and to that end to agree as follows: 1. The Board will make available to the County for community recreation activities all school facilities and areas which are suitable for community recreation activities. These areas are to be recommended by the Director of Parks and Recreation, subject to approval by the Harnett County Board of Commissioners, Superindendent of Harnett County School and the Board. 2. The County will make available to the Board for school events activities and /or programs County's recreation facilities which are suitable for said events, activities and /or programs, the facilities to be selected by the Superintendent of Schools, subject to the approval of the Director of Parks and Recreation. 3. It is hereby agreed that a schedule of the said facilities, school events and programs shall have first priority and recreation programs, establish by the Harnett County Parks and Recreation Department, shall have second priority and other events by other group or agencies shall have third priority. 4. It is further agreed that a schedule of dates for the use of the County' facilities will be worked out in advance by the Board and that this schedule will be arranged as to avoid conflict between recreatbn and school use; that in the scheduling of said facilities, recreation department activities shall first priority and school events and programs shall have second prioity and any other events by other groups or agencies shall have third priority. 5. The County agrees to provide adequate personnel to supervise the recreation activities which take plane on the selected school facilities. 6. The Board agrees to provide adequate personnel to supervise the school activities which take place on the selected recreation facilities. 7. It is understood and agreed that the personnel employed by the County in its Parks and Recreation Department shall be under the supervision of the Director of Parks and Recreation and further that the school principals shall be consulted in the planning and administering of a recreation program to be conducted by the Parks and Recreation Department of the County on or in the facilities which are normally under the jurisdiction of said principals. 8. It is recognized that school properties and facilities are intended primarily for school purposes and the benefit of children of school age. It is therefore agreed that, in planning programs and scheduling activities or grounds, the recreation needs and opportunities of such children will be well provided for and adequately protected. 9. It is further agreed that in the event of any dispute or difference arising as the result of the recreation program being conducted on the site jointly used and selected as above outlined or as to the use of recreation facility, said dispute of difference shall be settled and arbitrated by The have ction Board and the Harnett County Board of Commissioners. 10. It is further agredd taht the County Parks and Recreation Department will furnish and supply all expendable materials necessary for carryinn a community recreation program for all ages, in or on the facilities wider its supervision. 11. It is further agreed that the County may install sprinkler system, turfing, lighting, play equipment, fencing and additional equipment for recreation, not in conflict with school use, on area selected by the Director of Parks and Recreation, subject to the written approval by the Superintendent of schools and the Board. Any installations of equipment or construction on said premises, for community recreation purposes shall then be at the County's Parks and Recreation Department cost or proportionally shared by the County's Parks and Recreation Department and Board. 12. It is further agreed that the cost of maintaining said improved a eas shall be borne proportionately by the relative use of said areas, and further the County's Parks and Recreation Department and Board agree to maintain such areas in good condition during the periods of their respective responsibility. 13. It is furhter agreed that any permanent improvements or eq4pment installed or erected on school premises by the County's Parks and Recreation Department shall remain the property of the County's Parks and Recreation Department and may be removed if use of area is terminated. 14. In the event any or all of the improved school premises be require for exclusive use by the Board, the County's Parks and Recreation Department shall be reimbursed for actual cost in installation of any permanent improve- ments where it will not be practical to remove such or where they must be removed for exclusive use by the Board. 15. It is further understood and agreed that either party of this agreement at any time may terminate this agreement upon giving in writing to either party ninety days notice of its intention to terminate same. Commissioner Cotton moved that the county extend authority to the Chairman and the Clerk to properly execute the agreement and there- by enter into a contract with the Board of Education to provide adequate recreational programs for the community under the auspices of the County Parks and Recreation Committee. Commiss- ioner Alphin seconded and the issue passed. STATEMENT OF ASSURANCE OF INTENDED USE OF CENTRAL HARNETT AND WESTERN HARNETT COUNTY PARKS The following documents entitled Statement of Assurance of In- tended Use of Central Harnett County Park, and Statement of Assurance of Intended Use of Western Harnett County Park were presented to the commissioneffs for consideration and they are individually recorded as follows: Statement of Assurance of Intended Use of Western Harnett County Park The County of Harnett does hereby state that the proprietary function of all facilities of Western Harnett County Park is to service to all residents of the County of Harnett. Facilities of Western Harnett Park will be available to the Harnett County residents during stated hours of Park Operation. Due to the County's use of the Board of Education's indoor and outdoor fac- ilities, the County will allow the Board of Education to use the Park facilities on a limited detailed scale, as described in the following paragraph. The Board of Education will be able to use the following facilities at the prescribed quantities and times. This will pertain only furing normal operation school days and months. The County offers the use of some Park facilities to the Board of Education due to the fact that the Board of Education has offered use of its in- door and outdoor facilities to the County. Some of the facilities which the Board of Education will offer to the County at the new school site which are presently under construction are a football sta- dium, parking facilities, a gymnasium, and an outdoor track. Commissioner Cotton moved to adopt the two foregoing statements of assurance relating to Western Harnett County Park and to Central Harnett County Park, Commissioner Stewart seconded the motion and all the commissioners voted aye. The Board meeting was recessed to accomodate the public hearing scheduled for this time and date, for the purpose of hearing persons speak for or against the issue of whether or not to extend the boundaries of the Flatwoods Fire Districg; It was noted that 80% of those to be in the annexed district had signed a petition indicating their being favorable toward the issue. Edgar R. Bain, the attorney for Flatwoods, was present and spoke to the issue briefly, saying that to his knowledge, no one was present to speak against the issue. He indicated that there was a great amount of interest in the extension of the boundaries because the prople realized that this would allow for more fire protection. Commissioner Cotton moved to grant the request for the extension of Flatwoods Fire District, Commissioner Alphin seconded the motion and the commissioners all voted affirmatively, Commissioners Alphin, Cotton,Brock and Stewart. Glenn Tart, living in the district to be annexed, said everyone was in favor of this move. Fred Rambeaut, said he felt this was a good move - the people needed the protection. Kenneth Phelps, Fire Chief for Flatwoods said that they would set up a second fire station, temporarily in Billy Byrd's garage, and if that did not work efficiently, they would build a building. Robert Coats reported to the Commissioners on the Title IV -D Program, handled through the Social Services Department. He reported on the program, its objectives, its goals and pointed out some of its fund saving features. The Board express their appreciation to Mr. Coats and to Mrs. Crews for the fine job that is being done through this project. Commissioner Alphin made a motion that the Commissioners bring this information as presented by Mr. Coats and Mrs. Crews to the attention of the Region "M" Council of Governments, as to the total report, its results and the public assistance funds that could be more efficiently employed and the fraudalent acts that can be curtailed or avoided. He indicated that this information could be sent to our Legislators so that some nation wide benefits could be derived from the proper implementation of such programs. Commissioner Cotton seconded and the issue passed. W. Earl Jones gave the report for his department for the month of July and the plans for August. Tom Allen, Tax Supervisor;, reported on the activities of his department and of the jq �{72✓%/Jn plans for the finishing of the tax receipts. E. Nicholl, City Manager of Dunn, wrote to request that the commissioners Rc; 7 o Oh recs. consider anamendment to the agreement that exists between the City of Dunn, the To of Benson and the County of Harnett, that would extend the time limit for tap -ons a fee of $4,00 to continue on until December 31, 1976. Commissioner Alphin moved that the time for the tap -ons ht $4.0obhe continued until December 31, 1976, Commissioner Cotton seconded the motion and the "commissioners all voted aye. *me Pel Henry Thompson, Director of Harnett County Health Department, requested authority to enter into an agreement with the State Department to accept and expend funds in the amount of $18,239.70 for salaries, throughta program known as the Home Health Agency. Staff would consist of one Public Health nurse and one Accounting Clerk I After general discussion, Commissioner Alphin moved to grant the authority to ente into such an agreement with the Department of Health Services, State of NC, so tha service- can be prukrided to the people of the County. Commissioner Cotton seconded the motion and the issue passed. Mr. Thompson introduced the following contract relating to immunization of influen for children and adults, as follows: CONTRACT BETWEEN THE NORTH CAROLINA DEPARTMENT OF HUMAN RESOURCES DIVISION OF HEALTH SERVICES AND HARNETT COUNTY HEALTH DEPARTMENT A. SUMMARY This contract betweentthe Immunization Program, Communicable Disease Control Branch, Division of Health Services and the Harnett County Health Depart- ment exists for the purpose of ensuring influenza immunization for children and adults of Harnett County. B. AGREEMENT OF THE DIVISION OF HEALTH SERVICES The Division of Health Services agrees: 1. To provide $775.00 for payment of overtime wages and related fringe bene- fits and travel for county health department staff to work in influenza immunization programs, and 2. To provide $1900.00 for contract jet gun operators and clerks and travel to work in mass influenza immunization programs. C. AGREEMENT OF THE LOCAL HEALTH DEPARTMENT The local health department agrees: 1. That the health department's fiscal officer will make overtime payments based on the employee's present hourly wage scale with any benefits deemed necessary. All overtime payments to health department staff shall be only for work performed in actual influenza immunization clincs after normal weekday working hours, or on Saturdays, Sundays, and holidays. 2. Travel for staff overtime is to be reimbursed at the established county rates, which shall not exceed the State's travel policy. 3. That they may employ one (1) jet gun operator and one (1) clerk for each jet gun assigned to the county for mass influenza immunization, not to include back -up jet guns, and such wages shall not exceed $5.S0 per hour for a jet gun operator, $3.50 per hour for a clerk, including anyynec- essary benefits. 4. Travel for the contract employees is to be reimbursed at the established county rates, which shall not exceed the State's travel policy. 5. To provide the appfoved informed consent statement to each person to be immunized, to receive the signed statement from each vaccinee, and to retain the signatures for a minimum peroid of three years. 6. To provide informed consent statements to all private physicians who re- ceive influenza vaccine from county health departments. 7. To provide weekly influenza immunization reports to the regional office by telephone. 8. To submit monthly influenza immunization reports to the Immunization Pro- gram in Raleigh on forms provided by the Division of Health Services. 9. To retain of file at the health department all private physician certi- fication statements 66r influenza vaccine furnished to industrial and private physicians. t a Je sne 19\ 10. To retain all employee time records and financial records for review by Federal and /or Department of Human Resources auditors. D. GENERAL PROVISIONS Upon receipt of the signed contract, a sum of money may be advanced which will represent one fourth of the staff overtime wages, or no less than $50.00. A detailed monthly Contract Expenditure Report (name, position, hourly rate, social security number, number of hours worked, miles traveled and rate of travel) will be submitted to the Division of Health Services. Payment of funds will be made to the county health department's fiscal officer upon receipt of Contract Expenditure Report. The effective date of this contract is July 1, 1976 and the termination date is December 31, 1976. The award of this contract is dependent upon receipt of federal influenza pro- gram funds and, should federal funds be partially reduced, county awards shall be reduced on a pro rata basis. All activities under this agreement will be conducted in accordance with Title VI, Civil Rights Act of 1964. This agreement may be terminated at any given time by mutual consent of both parties or by one party giving thirty days notice. ACTION Commissioner Cotton moved to enter into the contract between the State Department and the County of Harnett, Commissioner Alphin seconded and the issue passed. Commissioner Alphin presented the USA, New County Award, as received in Salt Lake City, to the Commissioners. He indicated that the award had been received in Salt Lake City at the National Convention of Counties, and that in the absence of the Chairman he had accepted the awards for the achievements of Harnett County, and that he now wanted all to see the awards. avenue dKiti'. ksc- H. D. Carson, Jr., County Auditor, informed the Board of the expenditures and Ke/m t- revenues disbursed and received for the past fiscal year. The total amount of the expenditures was $889,377. The Chairman announced that on August 8, 1976, from 3 to 4 p.m., open house would be held at the Pineview Health Facility and that the public was invited to attend the event.
