The mid -month meeting of July 19, 1976, was convened at 7:30
P. M., by the Chairman, Bobby R. Etheridge, in the Commission-
ers Room. Because of the size of the people attending the
meeting, the meeting was moved to the multi - purpose Loom in
the same building.
The Rev. John Steele, pastor of Leaflet Church, led the
evening prayer.
The minutes of the previous meeting were read and approved.
INSURANCE
In accordance with legal advertisement for bids for furnish-
ing of Special Multiperil Insurance, the Chairman declared
the bid opening to begin and the following is a list of the
bidders:

The Chairman accepted the bids for the Board and indicated that
they would be turned over to a committee composed of the County
Attorney as ex officio, Commissioners Brock and Alphin. They
will review the bids and determine that bid that best serves
the needs of the County.
POINTMENTS - ERWIN PLANNING
D ZONING BOARD The commissioners had received recommendations from the Mayor
and Town Commissioners for the Town of Erwin regarding the foll-
owing persons to be appointed to the Erwin Planning and Zoning
Adjustments Boards:
PLANNING BOARD: J. W. Suggs, W. N. Porter, J. Edward Pope
BOARD OF ZONING ADJUSTMENT: Ed Rogers, Mrs. Luther Colville, Jr.
Commissioner Brock moved that the above named be appointed to
serve on the respective boards, Commissioner Alphin seconded and
the issue passed.
HENRY THOMPSON RE: HOME
HEALTH AGENCY Henry Thompson, Health Director, appeared before the Board in
regards to Home Health Services, and asked that authority be granted
to enter into the contract with the State to provide these
services. The commissioners tabled action pending further
reformation.
LANDFILL SITE PROGRESS
REPORT Commissioner Alphin reported on the progress of the landfill
site in the Dunn -Erwin -Coats area. He indicated that he would
like to see the program get off to a good start. He pre -
sented proposals for construction from the firm of Williams &
Works, a sanford based architectural firm. He reported that
the contract would call for $4,000. for the development of the
program. Commissioner Alphin moved, on behalf of the Landfill
Search Committee, that this firm of Williams & Works be employed
to dev.op the site for an estimated $4,000. Commissioner
Brock seconded the motion and indicated that this motion also
allow for the due execution of the contract by the Chairman
and Clerk. The vote was unanimous.
NORTHEAST METROPOLITAN WATER
DISTRICT Regarding the progress of the Northeast Metropolitan Water Dis-
trict, the report was that the county attorney had advised the
New York Bonding attorneys and the Local Government Commission
of the action taken by the citizens of the County in the refer-
endum, and that the water supply grant had been extended through
January, 1977.

ORDINANCE OF THE COUNTY OF HARNETT
TITLE: AN ORDINANCE RESTRICTING THE MASSAGE OF PERSONS OF THE OPPOSITE
X FOR HIRE
It is the intent of the Board of Commissioners of Harnett County,
by this Ordinance, to prohibit massage of persons of the opposite sex for
hire, for the purpose of protecting the public morals, public health,
safety and general welfare of the citizens of Harnett County.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA:
SECTION 1. Definitions.
(a) "Massage" means the manipulation of body muscle or
tissue by rubbing, stroking, kneading, or tapping,
by hand or mechanical device.
(b) "Massagist" (either male or female) means one who
offers to massage another for a salary or fee.
(c) "Massage Parlor" means any place of business where
massagists are employed to offer a massage for a
salary or fee.
SECTION 2. Massage of a Person of the Opposite Sex for Hire Unlawful.
It shall be unlawful for any person licensed as a massagist
or holding a massage parlor license issued by Harnett County
to massage a person of the opposite sex for a salary or fee
except under the signed order of a licensed health profes-
sional.
SECTION 3. Violation, a Misdemeanor.
Violation of this Ordinance is punishable by a fine of not
more than Fifty Dollars ($50.00) or imprisonment for not
more than thirty (301 days.

SECTION 4. Injunctive Relief Available.
This Ordinance may be enforced by any appropriate remedy authorized
by General Statute 153A -123.
SECTION 5. Conviction Ground for License Revocation.
A conviction for violation of this Ordinance is hereby made grounds
for zevoking a massagist's or massage parlor license after a due
process hearing as the County may otherwise provide by Ordinance.
SECTION 6. Severability.
If any provision of this Ordinance or its application to any person
or circumstances is held invalid, such invalidity shall not affect
other provisions of spplications of the Ordinance which can be
given effect without the invalid provision or application, and to this
end the provisions of this Ordinance are declared to be severable.
SECTION 7. Effective Date.
This Ordinance shall become effective upon its adoption.

Following the reading of the ordinance, the Chairman called for
general discussion, asking that each person come to the podium,
state his or her name and address, and make their statement free
from interuption or debate. The following people addressed the
commissioners and group.
1. Charles R. Malley, 5507 Ray Road, Spring Lake, NC., owner of a
massage parlor.
2. Steve Hulsey, Box 462 A, Spring Lake, NC ... a citizen of Harnett
County, North Carolina and of heaven, bad influence for young
people and that the citizens had a responsibility as Americans
to uphold high moral codes ... the sites of operation were an
eyesore to the community, and that violators should receive more
severe fines.
3. John Steele, pastor Leaflet. He said these establishments made
sin attractive, agreed with the former speaker and said enough
evil abounded in this nation.
4. Mr. Gale Gneizak, employed in one of the massage parlors, Route 2,
Cameron, NC, stated she saw nothing wrong with her employment,
saw no reason to close the businesses, and that only adults were
allowed to visit the massage parlors.
5. Ernest Wester, Kipling, presented a document stating that the
Kipling Church wished to go on record as opposing any massage
parlors in Harnett County.
6. Vince DeAngelis, Route 2, Cameron, NC, owner of a Health Club,
said they were sold licenses, given a set of codes and rules, and
that now changes are being made. He indicated that homosexuals
had applied for employment.
7. Rev. Tom Jackson, Christian Light and Pleasant Union Christian
Churches, expressed appreciation to the Chairman and Board for
allowing him to express opinions and statements regarding these
businesses.
8. Shirley Lynch, Highway 87, owner of Shirley's Health Club, said
she will not close her club, but will hire employees that will
not conflict with the ordinance.
ACTION:
. Elsie Rapp, Gourd Springs Church, spoke against these
parlors.
10. Donna DeAngelis, wife of Vince DeAngelis, spoke.
11. Bynum Mauney, Anderson Creek, said we must preserve this
sulture for the young generations so they would not have
to live as if in garbage cans.
Commissioner Cotton moved to adopt the foregoing ordinance
entitled "An Ordinance restricting the Massage of Persons
of the Opposite Sex for Hire ", Commissioner Alphin seconded a
and the Chairman ordered that the vote be tabulated according
to name and nature of vote as follows:
Those voting for adoption of the ordinance: Commissioners
Brock, Alphin, Cotton, Stewart, and Chairman Etheridge.
Those voting against the adoption of the ordinance: None
Commissioner Cotton introduced the following ordinance entit-
led "An Ordinance Regulating the Business of Massage and
Massage Parlors ". The Coun.tyAAttorncyddlsdassed the ordi-

The ordinance follows:
ORDINANCE OF THE COUNTY OF HARNETT
TITLE: AN ORDINANCE REGULATING THE BUSINESS OF MASSAGE AND MASSAGE
PARLORS
1. Definitions. (a) '"Massagist" (either male or female). One
who offers to massage another for a salary or fee.
(b) "Massage parlor." Any place of business where massagists are
employed to offer massage for a salary or fee.
4e) Licensed health professional excluded. Licensed health
professionals acting in the ordinary course of their profession are
neither "massagists" as defined in paragraph 1(a) nor owners of "massage
parlors" as defined in paragraph 1(b).
3. License required. A person may not (a) work as a massagist,
or (b) operate a massage parlor unless licensed.
4. Issuing of licenses, fee required. The Sheriff shall issue
a license to any eligible person who pays an annual fee of $50.00,
( FIFTY Dollars) for a massagist's license or of
$500.00 ( FIVE HUNDRED Dollars) for a massage parlor license.
Such licenses shall be valid for one year only and must be renewed
annually.
5. 5. Persons ineligible for licenses. The following persons may
not be licensed to work as a massagist or to hold a massage parlor lic-
ense:

(a) A person who has been convicted of a crime involving sexual
misconduct including bur not limited to those covered by
G.S. 14, Article 26 (Offenses Against Public Morality and
Decency) and G.S. 14, Article 26 (Prostitution)/
(b) A person under 18.
(c) A person convicted of violating this ordinance.
6. Posting required. (a) The Sheriff shall provide a copy of
this ordinance for posting to each massage parlor licensee upon licensing
(b) Each massage parlor licensee shall display in a prominent place the
license issued pursuant to this-ordinance together with a copy of this
ordinance. (c) Each massagist shall post his license in his work area.
7. Fingerprinting required. An applicant for a license shall
submit to fingerprinting. The fingerprints may be sent to the S.B.I.,
F.B.I., or other appropriate law enforcement agencies.
8. Prohibitions and limitations. (a) Minimum Age.
(1) No person in the business of massage may massage a
person under 18 execpt under the direction of or by
order of a licensed health professional.
(2) No person may employ one under 18 to work as a massagist.
(b) Limitation on hours of operation. Massage parlors may operate only between
the hours of 8 o'clock a.m. and 10 o'clock p.m.
(c) Limitation on scope of massage. No massagist may in the course of business
massage the penis, scrotum, mons veneris, vulva, or vaginal area of another.
(d) Inducement to violate ordinances or provisions of General Statutes relating
to sexual misconduct. No person may induce a licensee or employee or agent
thereof to violate this ordinance or any provision of the General Statutes of
North Carolina pertaining to sexual misconduct including but not limited to that
covered by G.S. 14, Article 26 (Offenses Against Public Morality and Decency), and
G.S. 14, Article 27 (Prostitution).
(e) Licensee required to supervise. Massage parlor licensees shall supervise the
conduct of massagists in their employ. Failure to suppress illegal activity is
grounds for revocation of a license.
9. Massage parlors subject to inspection. The Sheriff or any member of
his department may inspect massage business premises during the hours that they
are open for business.
10. REVOCATION. DUE PROCESS HEARING.
(a) The Board of Commissioners of Harnett Couty shall revoke the license
of any licensee who has been convicted of: (1) a crime involving sexual miscon-
duct including but not limited to those covered by G.S. 14, Article 26 (Offenses
Against Public Morality and Decency) and G.S. 14, Article 27 (Prostitution), or
(2) this ordinance.
(b) Any revocation shall be made only after written notice of the grounds
for revocation has been given to the licensee and he has had an opportunity to
answer the charges in a hearing before the Board of Commissioners.
(c) At a license revocation hearing conducted pursuant to 10(a) the
Board shall consider only a licensee's final conviction of (1) a crime involving
sexual misconduct including but not limited to those covered by G.S. 14, Article
26 (Offenses Against Public Morality and Decency) and G.S. 14, Article 27 (Prosti-
tution), or (2) this ordinance.
(d) The Board of Commissioners may revoke the license of any licensee who
is found to have failed to supervise the conduct of massagists in his employ as
provided for in 8(e).
(e) At a license revocation hearing conducted pursuant to 10(d) the
Board shall consider any competent evidence.
11. Violation a Misdemeanor. Violation of this ordinance is punishable
by a fine of not more than $50.00 (Fifty Dollars) or imprisonment for not more than
30 (thirty) days.
12. Injunctive relief available. This ordinance may be enforced by any
appropriate equitable remedy as authorized by G.S. 153A -123.
13. SEVERABILITY.
If any provision of this ordinance or its application to any person
or circumstances is held invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect without the invalid pro-
vision or application, and to this end the provisions of this ordinance are declared
to be severable.
14. EFFECTIVE DATE.
This ordinance is effective from its adoption.

Commissioner Brock moved to adopt the foregoing ordinance entitled
"An Ordinance Regulating the Business of Massage and Massage Parlors ",
Commissioner Cotton seconded and those voting for the adoption of the

BE IT ORDAINED by the Board of Commissioners of Harnett County:
1. The Harnett County Board of Education is authorized to
undertake construction of a high school for the area desig-
nated by the Board of Education as the Area I High Sehool and
for completion of an area designated by the Board cf Educatio
as the Area II High School.
2. The following revenues will be used to finance the project:
a. Proceeds of a state bond issue
b. Revenue Sharing Funds
c. County Appropriation:

Commissioner Brock moved for the adoption of the foregoing '.-
Capital Project Ordinance, Commissioner Cotton seconded the
motion and those voting for the issue are Commissioners
Brock, Alphin, Stewart, Cotton and Chairman Etheridge.
Commissioner Brock moved that due to the fiscal control of
the Board of Education's budget became the responsibility of
the Harnett County Board of Education, on July 1, 1976, the
County Additor be authorized to make the appropriate contri-
butions to the appropriate funds so that the budget can be
balanced and a zero balance be reached as of 7 -1 -76.
Commissioner Alphin seconded the motion, and those voting fo
the issue were Commissioners Brock, Alphin, Cotton, Stewart,
and Chairman Etheridge.
The Commissioners considered the date to call an election fo
the Har -Lee Fire District. Commissioner Stewart made a moti
which was seconded by Commissioner Cotton, that September 14
1976, be set aside to hold the election regarding the Har -Le
Fire District and Commissioner Cotton seconded the motion, a
the issue passed.
The meeting adjourned at 9:05 P.M. by motion of Commissioner
Lloyd Stewart.

NORTH CAROLINA
WHEREAS, the Harnett County Board of Commissioners had previously
been petitioned to approve the creation of the Har -Lee Fire District to
include sections of both Harnett County and Lee County, and
WHEREAS, those names listed on the petition have been turned over
to the Board of Elections for verification, and to the Harnett County Tax
Supervisor for verification as to resident freeholder status, and
WHEREAS, it has been deemed feasible by the Board to call for an
election to determine the wishes of these freeholders, now
BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS THAT
an election will be held on the 14th day of September, 1976, in that
township(s) that will be included in this fire district on the issue
of whether or not to create such a fire district.

SPECIAL SESSION OF THE BOARD OF COMMISSIONERS HELD ON JULY 29, 1976.
The Chairman of the Board, Bobby R. Etheridge called the special session of the Board to order
on July 29, 1976, at 5:00 P.M. Commissioners Alphin, Stewart and Brock were present
and also the Clerk to the Board.
The Chairman informed the Board that the purpose of the meeting was to review bids
submitted for the furnishing of insurance coverage for the county, and to hear the
recommendations of the special committee.
Commissioner Brock told the Commissioners that Edward H. McCormick, County Attorney and ex
officio member of the insurance bid committee had analyzed the bids and furnished him with
a detailed analysis, that he and Commissioners Alphin and Stewart had met to discuss the
bids, and upon determining that the low bidder was Ellis Barbour & Sons, he and Commissioner
Alphin had discussed the bid issue with Mr. Ellis C. Barbour. He further stated that he and
Commissioner Alphin had satisfied themselves as to the extentof coverage, professional
ability of the agency and the capacity of the agency to service the police adequately.
Commissioner Alphin moved to award the bid contract to Ellis Barbour & Sons insurance company
with the effective date to be July 30, 1976, and with the furnishing of the insurance
coverage in keeping with the requirements as described in the instructions to bidders
portion of the Invitation for Bids for insurance coverage. Commissioner Stewart
seconded the motion and all commissioners voted affirmatively.
Commissioner Brock moved that authority be granted to transfer the appropriation for
"Other purchased services ", in the amount of $15,300. from the County Assistance for
code 52 -190 to the Social Services Administrative budget code 28 -190, as this
amount is funded at the rate of 75% by the federal government.
Commissioner Stewart seconded the motion andthe issue passed.
