The Harnett County Board of Commissioners met in regular session on Monday, October 17, 1988, at the County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins, Mack Reid Hudson, Mayo Smith, and Vice - Chairman Bill Shaw presiding. Chairman Lloyd G. Stewart was absent. Others present were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary. Vice - Chairman Shaw called the meeting to order at 7:50 p.m. Vice - Chairman Shaw offered the invocation. The minutes from the regular meeting, October 3, 1988, were approved. Ms. Nancy Myatt, Ms. Susette Windsor, and Ms. Jean Smith appeared before the Board to express their concerns regarding a septage disposal site located on SR 1535. Ms. Windsor presented a petition with fifty signatures of citizens who reside in the area requesting that the site be closed and that the County provide regulations regarding septage disposal. Henry Thompson, Director, Health Department, rently in the process of developing rules or disposal firms and disposal sites. stated that the County is cur - an ordinance dealing with septage Vice - Chairman Shaw directed the County Manager to work with the Health Depart- ment and the County Attorney to correct the situation and to provide a pro- gress report to the Board of Commissioners in one week. Dallas H. Pope, County Manager, presented an Ordinance to Implement Map Size Specification for Harnett County. Commissioner Hudson made a motion to adopt the ordinance. Commissioner Collins seconded the motion and it passed with a unanimous vote. The ordinance is copied in full at the end of these minutes dated October 17, 1988, as document No. 1. Dallas H. Pope, County Manager, presented a Subdivision Ordinance Amendment. Commissioner Smith made a motion to adopt the amendment. Commissioner Collins seconded the motion and it passed with a unanimous vote. The ordinance amend- ment is copied in full at the end of these minutes dated October 17, 1988, as document No. 2. John M. Phelps, II, Public Utilities Attorney, presented a resolution con- cerning creation of Southwest Water and Sewer District. Commissioner Smith made a motion to adopt the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated October 17, 1988, as document No. 3. Dallas H. Pope, County Manager presented request from Extension Homemakers and Friends of the Library for use of Harnett County Seal on a Historical Quilt. Commissioner Smith made a motion to honor the request. Motion died from lack of second. Commissioner Hudson made a motion to appoint Chairman Stewart as voting delegate for Legislative Goals Conference, December 8 -9, 1988. Commissioner Smith seconded the motion and it passed with a unanimous vote. Reports for the month of September were filed with the Board from the Sheriff's Department, Health Department, Emergency Medical Services, Veterans' Service, Library, Inspections, and Department of Social Services. Dallas H. Pope, County Manager, requested a budget amendment for Youth Ser- vices, Code 10- 7730 -056, One -on -One Advisory Board, $2,000. increase, proceeds from fund raising project. Commissioner Collins made a motion to approve the budget amendment. Commissioner Hudson seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Planning and Development, Code 10- 7200 -073, Capital Outlay -Other Improvements, $70,000. increase, for renovation of old Library building for office space. Commis- sioner Hudson made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Special Appropriations, Code 10- 8700 -167, West Central Water & Sewer, $104,000. increase, for West Central line extension to Western Harnett High School. Commissioner Collins made a motion to approve the budget amendment. Commis- sioner Hudson seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Data Pro- cessing, Code 10-4450 -074, Capital Outlay- Equipment, $2,050. increase, for purchase of desks, chairs, and bookcase. Commissioner Smith made a motion to approve the budget amendment. Commissioner Collins seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Department of Social Services, Code 10- 7700 -074, Capital Outlay- Equipment, $6,258. increase, •and Code 10- 7700 -002, Salaries & Wages, $6,258. decrease. Budget Amendment Was needed to purchase computer equipment for tie to tax office mainframe. Commissioner Collins made a motion to approve the budget amendment. Commis- sioner Smith seconded the motion and it passed with a unanimous vote. SUBDIVISION PLAT Carla Stephens, Planning Supervisor, presented a subdivision plat for Hunter's HUNTER'S POINTE Pointe, 7 lots, owned by AGA Corporation, located in Barbecue Township on SR 1224, not zoned. Commissioner Hudson made a motion to approve the sub- division plat. Commissioner Smith seconded the motion and it passed with ,a unanimous vote. ROADNAME CHANGE SR 1700 CONTRACT AGREE, FOR POSITION AT LEE - HARNETT MENTAL HEALTH WANDA BETHUNE APPOINTED TO MENTAL HEALTH BOARD BRIEFING RE: INTERNSHIP PROG. AT CAMPBELL U. ADJOURNMENT . DOCUMENT NO. 1. Commissioner Hudson made a motion to approve a request from residents to change name of SR 1700 from J. W. Sorrell Road to be renamed Cane Mill Road. Commissioner Collins seconded the motion and it passed with a unanimous vote. Jadk Bryan, Director, Department of Social Services, presented a Contract Agreement between Lee-Harnett Mental Health and Harnett County Department of Social Services, for the employment of a position to be located in the Harnett County Mental Health Department on a full time basis to assist with the determining of eligibility for public assistance of patients of said depart - ment.Commissioner Smith made a motion to approve -the contract agreement. Hudson seconded the motion and it passed with a unanimous vote. Commissioner Hudson made a motion to reappoint Wanda Bethune to Lee - Harnett Mental Health Board for a four -year term. Commissioner Collins seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, briefed the Board concerning an Internship Program at Campbell University. Commissioner Smith made a motion to authorize Dallas H. Pope, County Manager to enter into agreement with Campbell University to participate in the Internship Program. Commissioner Hudson seconded the motion and it passed with a unanimous vote. Young, Clerk 4o th 'Board AN ORDINANCE TO IMPLEMENT MAP SIZE SPECIFICATION FOR HARNETT COUNTY WHEREAS, General Laws of North Carolina through the Session Laws of 1975, amended G.S. 47 -30 to add the Uniform Map Law, effective July 1, 1975. WHEREAS, Harnett County was brought in under the provisions of G.47 -30 Uniform Map Law by Chapter 192 (H 469). G.S. 47 -30 (a) Size Requirements - "All land maps presented to the Register of Deeds for recording in the registry of a county in North Carolina, shall have an outside marginal size of not more than 21 inches by 30 inches nor less than eight and one -half inches by 11 inches, including one and one -half inches for binding on the left margin and one -half inch border on each of the other sides." WHEREAS, Harnett County, complied with the provisions of G.S. 47 -30, Uniform Map Law, and used the required map specifications of an outside marginal size of not more than 21 inches by 30 inches nor less than eight and one -half inches by 11 inches, including one and one -half inches for binding on the left margin, and one -half inch border on each of the other sides. WHEREAS, The 1983 Sessions Laws, Chapter 473(H 663) G.S.47 -30(a) was amended effective January 1, 1984. " (a) Size Requirements- All land plats presented to the register of deeds for recording in the registry of a county in North Carolina after January 1, 1984, shall have an outside marginal size of not more than 24 inches by 36 inches, nor less than eight and one -half inches by 14 inches, and shall include a one - half inch border on each side. Registers of deeds may require a one and one -half inch border on one side for binding. Where size of land areas, or suitable scale to assure legibility require, plats may be placed on two or more sheets with appropriate match lines. Counties may specify a specific size within the limits of these requirements: Provided, that all registers of deeds where a specific size is specified shall be required to submit said size specifications to the North Carolina Association of Register of Deeds for inclusion on a master list of all such counties. These size specifications should be adopted by resolution of County Commissioners. The list shall be posted in each register of deeds office. WHEREAS, Harnett County Register of Deeds , adopted the size 'specifications of an outside marginal size of not more than 21 . inches by 30 inches nor less than eight and one -half inches by 11 inches, including one and one -half inches for binding on the left margin and one -half inch border on each of the other sides. Harnett County submitted said size specifications to the North Carolina Association of Register of Deeds for inclusion on a master list of all such counties. The list was posted in each Register of Deeds office in the State. " WHEREAS, the size specifications were not adopted in a resolution by the Harnett County Board of Commissioners, to be effective on January 1, 1984. WHEREAS, the current Register of Deeds, feels it is necessary to have map specification size adopted in a resolution by the Harnett County Board of Commissioners and respectively requests the following map and size specification to be adopted. NOW, THEREFORE, BE IT ORDAINED: That the Harnett County Register of Deeds shall not accept for registration any map or plat unless it has an outside marginal size of not more than 21 inches by 30 inches nor less than eight and one -half inches by 11 inches including one and one -half inches for binding on the left margin and one -half inch border on each of the other sides. Duly adopted this 17th day of October . 1988 46 DOCUMENT NO. 2. DOCUMENT NO. 3. ORDINANCE AMENDING AN ORDINANCE ENTITLED SUBDIVISION REGULATIONS FOR HARNETT COUNTY, NORTH CAROLINA ADOPTED APRIL 4, 1977 WHEREAS -; this. Board adopted an Ordinance on April 4, 1977, entitled "Subdivision Regulations for Harnett County, North Carolina "; and WHEREAS, this Board is of the opinion that the amendments set forth below are necessary to the clear and efficient working of the Ordinance; and WHEREAS, as provided by Section 6.2 of the Ordinance, the said amendments have been submitted to, the Harnett County Planning Board for review and recommendation, where they have been favorably reported; and WHEREAS, pursuant to N. C. General Statutes 153A -323, after notice as by law provided, a public hearing has been held concerning adoption of the amend- ments;- NOW, THEREFORE, BE IT ORDAINED that Article III, Section 3.3 read as follows: Final plats shall be no larger than 21 inches by 30 inches and no smaller than 8 -1/2 inches by 11 inches including 1 -1/2 inches for binding on the left margin and 1/2 inch border on each of the other sides. Duly adopted this 17th day of October, 1988. HARNETT COUNTY BOARD OF COMMISSIONERS. RESOLUTION CREATING THE SOUTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, the Harnett County Board of Commissioners (hereinafter "the Board ") at its regular meeting on September 19, 1988, resolved that a public hearing be held, pursuant to. N. C. Gen. Stat. §.162A -86 et. seq., to consider creation of the Southwest Water and Sewer District of Harnett County; and WHEREAS, the Board further resolved that the said Public Hearing should be held on Monday, October 17, 1988 and directed the appropriate . representatives of the County to take the necessary actions to hold the Public Hearing; and WHEREAS, pursuant to N. C. Gen. Stat. § 162A -86, a Notice of Public Hearing was prepared stating the date, hour and place of the hearing and its subject and setting forth a description of the territory to be included within the proposed Southwest Water and Sewer District of Harnett County; and, WHEREAS, pursuant to said N. C. Gen. Stat. §. 162A -86, the Notice of Public Hearing was'published once a week for three weeks (plus once during one additional week) in newspapers that circulate in the proposed district and posted in at least three public places.inthe - district. The Notices of Public Hearing were posted and published the first time not less that twenty days before the hearing;and, WHEREAS, a public hearing was held at 7:00 p.m. on. October 17, 1988, in the Harnett County Office Building in Lillington,.- North. Carolina at which time taxpayers and all other interested; persons appeared and were heard concerning the question of creating the Southwest Water Sewer District of Harnett. County; and 47 WHEREAS, the Board, following the public hearing, finds that: (1) There is a demonstrable need for providing in the district water services, or sewer services, or both; (2) The residents of all the territory to be included in the district will benefit from the district's creation; and (3) It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies; and, WHEREAS, the Board recognizes that vital matters to be considered in creating the district are the availability of federal funding and the successful issuance of bonds and /or notes for the purpose of providing funding to provide water and /or sewer to the district, or portions thereof, and the number of users who contract to purchase water and /or sewer; and, WHEREAS, the Board finds that the district shall be defined as set forth in the Notices of Public Hearing and, WHEREAS, the Board now desires to create the Southwest Water and Sewer District of Harnett County. NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners as follows: 1. It is hereby found that: (a) There is a demonstrable need for providing in the district water services, or sewer services, or both; (b) The residents of all the territory to be included in the district will benefit from the district's creation; and (c) It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies; and, 2. The Southwest Water and Sewer District of Harnett County is hereby created as provided above and the said District is hereby described as follows: Beginning at the point on the Harnett County -Lee County line where the southern bank of the Upper Little River intersects said county line and runs thence from said beginning point, along and with the courses and distances of the southern bank of the Upper Little River in an east and southeasterly direction, 59,000 feet, more or less, to a point on said southern bank of the Upper Little River, which is located 1,000 feet south, southeast of, perpendicular to and at right angles with NC Highway 27; and runs thence in a southwesterly direction along a line which is 500 feet east of and parallel to the centerline of State Road 1117 8,500 feet, more or less to a point, corner of the boundary of the South Central Water and Sewer District of Harnett County; and runs thence in a northwesterly direction crossing said State Road 1117 at right angles, 1,000 feet to a point; said point being located 500 feet northwest of and at a right angle to the centerline of said State Road 1117; and runs thence from said point in a westerly direction along a line which is 500 feet north of and parallel to the centerline of State Road 1117 and State Road 1141 8,500 feet, more or less to a point in the centerline of State Road 1116; and runs thence in a westerly direction 1,100 feet to a point on an unnumbered dead end road which point is also located on the eastern boundary of a Carolina Power and Light Company right of way; and runs thence in a southerly direction along and with the eastern boundary of said Carolina Power and Light Company right of way 25,300 feet, more or less to the point where the eastern boundary of said right of way crosses the eastern margin of Jumping Run Creek; and runs thence with the eastern margin of said creek in a southeasterly direction 20,500 feet, more or less, to the point where the eastern margin of said creek intersects the Harnett County - Cumberland County line; and runs thence in a southwesterly direction with the Harnett County - Cumberland County line and thence in a northwesterly direction with the Harnett County -Moore County line to the western most point of Harnett County, and runs thence along and with the Harnett County -Moore County line and the Harnett County -Lee County line in a northeasterly direction to the point and place of Beginning. 3. The Clerk to the Board is hereby authorized and directed to cause this Resolution to be published once in each of two successive weeks in the newspapers in which the Notices of Public Hearing were published, and in addition thereto cause to be published with the resolution a notice as provided in N. C. Gen. Stat. § 162A -87 (b). The County, and its officers, agents and attorneys are hereby directed to take any further action as may be required by the laws of the State of North Carolina to perform the matters and things directed by this Resolution.
