The Harnett County Board of Commissioners met in regular session on Monday,
October 3, 1988, at the County Office Building, Lillington, North Carolina,
with the following members present: Bill Shaw, Rudy Collins, Mack Reid
Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present
were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa
W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary.
Chairman Stewart called the meeting to order at 9 a.m.
Commissioner Collins offered the invocation.
The minutes from the regular meeting, September 19, 1988, and special meeting,
September 20, 1988, were approved.
Ray Stone, Highway Maintenance Engineer, North Carolina Department of Trans-
portation, appeared before the Board to discuss road matters and situations in
Harnett County.
Glenn Johnson, County Attorney, presented a resolution calling for a special
property tax referendum concerning Dunn - Averasboro Emergency Ambulance and
Rescue Service District. Commissioner Smith moved for the adoption of the
resolution. Commissioner Hudson seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated October 3, 1988, as document No. 1.
Miss Evelyn Byrd, Chairman of Cultural Arts, Harnett County Extension Home-
makers, appeared before the Board and requested permission for the County
Extension Homemakers and Friends of the Library to use the Harnett Coat of
Arms and the Harnett County Seal on a historical quilt being made jointly by
the two organizations as a fund - raising project. The Board accepted the
request for consideration.
Gayle Holder, Register of Deeds, briefed the Board on problem of the sizes of
maps being recorded and requested that a maximum size of 21" by 30 ", and a
minimum size of 8 1/2" by 11" be adopted so that all maps recorded in the
Register of Deeds will fit into the existing map cabinet. The matter will be
addressed by the Board at the midmonth meeting.
RESOL. TO ESTAB. Glenn Johnson, County Attorney, presented a resolution to establish Coats -
COATS- GROVE AMB. Grove Ambulance and Rescue Service District. Commissioner Hudson moved for
$ RES. SERV. DIS.the adoption of the resolution. Commissioner Collins seconded the motion and
it passed with a unanimous vote. The resolution is copied in full at the end
of these minutes dated October 3, 1988, as document No. 2.
AGREEMENTS WITH Commissioner Smith made a motion that the agreements between Harnett County
RESCUE DISTRICTS and three rescue districts and one emergency service district all located
within the county be approved in accordance with the provisions in N. C. Gen.
Statute 69. Commissioner Hudson seconded the motion and it passed with a
unanimous vote.
TAX REFUND
DEE BRYSON
Bobby Wicker, Tax Administrator, reported on activities of the Tax Department
for the month of September and plans for the month of October.
Commissioner Smith made a motion to approve a tax refund to Dee Bryson, 4560
Calm Lake Road, Julian, North Carolina, in the amount of $52.55. Commissioner
Shaw seconded the motion and it passed with a unanimous vote.
SUBDIVISION PLAT Carla Stephens, Planner /Developer, presented a subdivision plat for The
THE TOWNSHIP- Township -Phase III, 5 lots owned by JMC Properties, Inc., RA 30, located in
PHASE III Black River Township on SR 1440. Commissioner Collins moved for the approval
of the subdivision plat. Commissioner Smith seconded the motion and it passed
with a unanimous vote.
DEFENSE ECONOMIC Dallas H. Pope, County Manager, briefed the Board on proposed Defense Economic
ADJUST. PROGRAM Adjustment Program by N.C. Department of Natural Resources and Community
Development. The Board will be briefed further as information becomes avail-
able.

Funds allocated from the Division of Health Services for Maternal Health,
Health Promotion /Disease Prevention and Adolescent Pregnancy /Prematurity
Prevention for FY 1988 -89. Commissioner Smith made a motion to approve the
budget amendment. Commissioner Shaw seconded the motion and it passed with a
unanimous vote.
Dallas H. Pope, County Manager, requested a budget amendment for Public
Utilities, Code 37- 4100 -020, Legal & Administration, $1,800. increase; and
Code 37- 4100 -080, Contingencies, $1,800. decrease. The budget amendment is
needed to re- allocate monies so project can be closed out. Commissioner Smith
made a motion to approve the budget amendment. Commissioner Collins seconded
the motion and it passed with a unanimous vote.
Dallas H. Pope, County Manager, requested a budget amendment for Transpor-
tation /Procurement, Code 10 -5550 -074, Capital Outlay - Equipment, $5,325.
increase. The budget amendment is needed to carry forward purchase order from
last year's budget for software in Transportation Office.
Commissioner Smith made a motion to approve the budget amendment. Commis-
sioner Shaw seconded the motion and it passed with a unanimous vote.
RESOL. RE: John M. Phelps, II, Public Utilities Attorney, presented a resolution re-
FmHA DISCOUNT garding reinstatement of Farmers Home Administration Discount Purchase Program
PURCHASE PROGRAM for community program borrowers. Commissioner Smith moved for the adoption of
the resolution. Commissioner Collins seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated October 3, 1988, as document No. 3.

R E S O L U T I O N
THAT WHEREAS, the Harnett County Board of Commissioners has .
heretofore received information regarding a proposal to establish
an. Emergency Ambulance and Rescue Service District within a
portion of Harnett County which encompasses all of the existing
Averasboro Fire District, including the Town of Dunn, North
Carolina; and
WHEREAS, the Harnett County Board of Commissioners has
determined that there is support for the establishment of such an
Emergency Ambulance and Rescue Service District pursuant to the
provisions of Article 16, Chapter 153A of the General Statutes of
the State of North Carolina; and
WHEREAS, it has heretofore been the policy of the Harnett
County Board of Commissioners to submit to the qualified voters
of such a proposed district the issue of whether or not a
property tax should be imposed pursuant to the provisions of said
statute for the support of emergency ambulance and rescue service
within said district; and
WHEREAS, the Harnett County Board of Commissioners has
determined that a referendum on such issue should be held at
which the qualified voters of such proposed district should vote
upon the following question, to wit: "Should Harnett County be
authorized to levy annually a property tax at an effective rate
not in excess of five cents ($.05) on the One Hundred Dollars
($100.00) valuation in the proposed Dunn - Averasboro. Emergency
Ambulance and Rescue Service District for the purpose of .
providing emergency ambulance and rescue service ? ", and
WHEREAS, in order to conduct such a referendum the
boundaries of such proposed district must be verified, those
owning property therein must be determined froni the tax records
maintained by the County of Harnett, proper notice must be given
and other requirements must be met;
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board
of Commissioners that the County of Harnett, and its officials
and employees, shall be and they are hereby duly authorized and
directed to take all action necessary in order to verify the
boundaries of the proposed Dunn - Averasboro Emergency Ambulance
and Rescue Service District, to determine the identities of
individuals owning property therein as appear from the tax
records maintained by the County of Harnett, and to conduct a
special property tax referendum at which the above set forth
issue shall be submitted to the qualified voters of said district
as required and provided by law.

DOCUMENT NO. 2.
RESOLUTION ESTABLISHING THE COATS -GROVE EMERGENCY
AMBULANCE AND RESCUE SERVICE DISTRICT
THAT WHEREAS, a report concerning a proposed Emergency
Ambulance and Rescue Service District for the area therein
described was filed with the Harnett County Board of
Commissioners on the 22nd day of August, 1988; and
WHEREAS, the Town of Coats, North Carolina has consented to
be a part of such district by resolution duly adopted; and
WHEREAS, a referendum was conducted on May 3, 1988 at which
the establishment of such district and the levying of an annual
property tax at an effective rate not in excess of eight
cents ($.08) on the One Hundred Dollar ($100.00) valuation was
approved; and
WHEREAS, the Harnett County Board of Commissioners conducted
a public hearing on the 19th day of September, 1988 at 7:00 P.M. '
in the Commmissioner's Room, Harnett County Office Building, 102
East Front Street, Lillington, North Carolina, after the giving
of notice as required by law; and
WHEREAS, at said public hearing support for the
establishment of said district was demonstrated and no opposition
thereto was presented; and
WHEREAS, the Harnett County Board of Commissioners has fully
considered the views of all those who appeared at said public
hearing and the results of said referendum, together with the
content of the above referenced report filed on August 22, 1988;
Therefore, the Board of Commissioners of Harnett County
finds and concludes that:
1. There is a demonstrable need for the providing of
emergency ambulance and rescue service in the area of Harnett
County described in the report to the Harnett County Board of
Commissioners dated August 22, 1988.
2. It is impossible or impracticable to provide emergency
ambulance and rescue service on a county wide basis.
3. It is economically feasible to provide the proposed
services in the subject district without unreasonable or
burdensome annual tax levies;
4. There is a demonstrable demand for the proposed services
by persons residing in the proposed district.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of Harnett County that:
1. An Emergency Ambulance and Rescue Service District is
hereby established and defined as follows:
(A) Area to be served. The area to be included in the
Emergency and Ambulance Rescue Service District shall be that
area of Harnett County described and defined in the report to the
Harnett County Board of Commissioners dated August 22, 1988.
Such area shall include the Town of Coats, North Carolina.

(B) Name of the Service District.. The service district
shall be known. as "Coats-Grove Emergency Ambulance and Rescue
Service. District."
(C) Specific services to be provided. The services to be.
.:provided shall be limited to the following:
1.. Emergency ambulance service.
2 Rescue service.
(D) Plan. The plan for providing such services shall be in .
accordance with the plan set forth in the report heretofore filed
with the Clerk to the Board of Commissioners by W. Glenn Johnson,
'County Attorney.
2.. .This resolution shall be effective as of July 1, 1989,
and the above named special service district shall be established

RESOLUTION REGARDING
REINSTATEMENT OF FARMERS HOME
ADMINISTRATION DISCOUNT PURCHASE
PROGRAM FOR COMMUNITY PROGRAM BORROWERS
The Farmers Home
W I T N E S S E. T H:
Administration of the United States Department.
of Agriculture (FmHA), among other things, makes loans to local
governments for the construction of various facilities, water
production and supply systems and wastewater disposal systems. Under
the terms of the Omnibus Budget Reconciliation Act of 1986, (OBRA)
FmHA was directed by Congress to sell a portion of its loan portfolio.
The first sales of portions of the portfolio were consumated in 1987
through two programs: the discount purchase program (which permitted
many borrowers to purchase their owns loans at a discount) and the
"securitized sale" in .which FmHA sold a package of loans to the
Community Program Loan Trust 1987 A(Trust).
In the early .part of 1988, the OBRA was amended by the.
Agricultural. Credit Act of 1987. This amendment required FmHA to
provide certain Community Program borrowers the right to purchase
their loan(s) before such loan(s) could be sold to other parties.
Consequently, FmHA conducted a new Discount Purchase Program, often
called the "buy- back" program, during 1988 which was available for
Community Facility and Water and Wastewater Disposal loans.

At the time of the passage of the amendment to OBRA, a number of
local governments and bodies within Harnett County had existing
Community Facility or Water or Wastewater Disposal loans with FmHA and
were eligible to, and did, participate in the program. Two of the
most significant loans in Harnett County were those previously made to
the Northeast Metropolitan Water District of Harnett County (Northeast
Metro). The District Board of Northeast Metro (the governing body of
that District) in joint cooperation with Harnett County, (operator and
lessee of the Northeast Metro water production and supply facilities)
participated in the program.
Prior to the "buy- back ", which involved purchasing the existing
loans at an amount significantly less than the outstanding
indebtedness thereof and refinancing the cost of the purchase, the
outstanding indebtedness of Northeast Metro totaled approximately 3.6
million dollars. After the discounted purchase and closing of the
refinance package, Northeast Metro's indebtedness decreased to just
over 2 million dollars, realizing a debt reduction of almost 1.6
million dollars. Considering that the new refinance loan is amortized
over twenty years (as opposed to the forty year original loans with
FmHA), it is estimated that Northeast Metro will save about 1.9
million dollars over the life of the loan. Thus, the Discount
Purchase Program of 1988 proved to be an excellent method of affording
tremendous savings to Harnett County and its residents.
Since the time of the completion of the 1988 Discount Purchase
Program, the South Central Water and Sewer District of Harnett County
has closed a loan with FmHA and several other water and sewer
districts in the County are in the process of closing or applying for
additional loans. The Harnett County Board of Commissioners, as
governing body of the referenced water and sewer districts desire to
have the opportunity to participate in the Discount Purchase Program
in 1989 and subsequent years.
However, it has come to the attention of the Harnett County Board
of Commissioners, (through documentation provided to it by FmHA
pursuant to the provisions to the Freedom of Information Act) that
even though FmHA will conduct loan portfolio sales during 1989 as
required by OBRA, there are no plans to conduct a Discount Purchase
Program for Community Facility and Water and Wastewater Disposal
loans. Thus, no such program will available for the South Central
Water and Sewer District or other such districts in the County.
Therefore, the Harnett County Board of Commissioners wishes to
take actions to let it be known that the Board favors the
reinstatement of the Discount Purchase Program. The Board believes
that the program is obviously workable and desirable to FmHA as the
full fiscal year 1988 sales target was achieved through the program in
1988. Further, the program offers excellent savings benefits for
local governments throughout the nation. In addition, to reinstate
the program would enable local governments who were unable (for
various reasons) to participate in the program in 1988 to take
advantage of the plan in 1989. Lastly, it seems fundamentally unfair
to sell the loans, as will be done as directed by Congress, without
first giving the borrower the opportunity to purchase the same.

NOW THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS .THAT:
1. Harnett County very much appreciates the Farmers Home
Administration and its Community Loan Program and recognizes that the
citizens and residents of Harnett County have benefitted tremendously
from said program.
2. For the reasons stated herein, the Board hereby resolves
that it favors the continuation of the FmHA Discount Purchase Program;..
3. The Board hereby recommends that the Program be reinstated
and continued as it was applied in fiscal year 1988.
4. The Board directs that copies of this Resolution along with
appropriate documentation, be transmitted forthwith to:
a. United States Senator Terry Sanford of North Carolina
b. United States Senator Jesse Helms of North Carolina
c. United States Representative Martin Lancaster of the
Third Congressional District of North Carolina
d The State Director of Farmers Home Administration
e. The District Director of Farmers Home Administration
f. Such other individuals as may be appropriate as
determined by the members - oftheBoard or the County
Manager
