PUBLIC HEARING CONCERNING CONDITIONAL USE APPLICATIONS AND ZONING CHANGE APPLICATIONS, SEPTEMBER, 20, 1988
On September 20, 1988, the Harnett County Commissioners held a
series of public hearings to solicit the views of the citizens on
various conditional use permits and zoning.. changes.
Chairman Lloyd Stewart called the meetings to order and the -
county manager, Dallas Pope, explained the procedure and purpose
of the hearings.
CONDITIONAL USE PERMTT HEARINGS:
1. Baker,-Agnes - Manufactured Home in RA -30 District, Grove
Township, S.R. 2006 - Mr. Stewart called the Baker hearing
to order and Carla Stephens discussed the facts of the
application and the planning board recommendation. Ms.
Baker spoke on her own behalf explaining that she was
requesting the conditional use permit to put an underpinned
manufactured home on her lot for extra protection since she
.lived alone. No one spoke in opposition. Mr. Stewart
closed the Baker public hearing.
2. Barefoot, Gloria - Manufactured Home in RA -30 District,
Grove Township, S.R. 2011 - Mr. Stewart called the Barefoot
hearing to order and Carla Stephens discussed the facts of
the application and the planning board recommendation. Ms.
Barefoot spoke on her own behalf. No one spoke in
opposition. Mr. Stewart closed the Barefoot public hearing.
3. Beasley, Jerry - Manufactured Home in RA -30 District, Grove
Township, S.R. 1552 - Mr. Stewart called the Beasley public
hearing to order and Carla Stephens discussed the facts of
the application and the planning board recommendation. Mr.
Beasley spoke on his own behalf. Carsie Denning, Jr. and
Carsie Denning, Sr. requested that the manufactured home be
occupied only by the applicant and that the manufactured
home be moved if the applicant vacated the property. Carla
Stephens informed the board that the conditional use permit
runs with the land itself and not with the applicant's
ownership of the land. Glenn Johnson, county attorney,
affirmed this statement. No further comments were made.
Mr. Stewart closed the Beasley public hearing.
Bledsoe, Cleo - Manufactured Some in RA -30 District, Grove
Township, S.R. 1769 - Mr. Stewart called the Bledsoe public
hearing to order and Carla Stephens discussed the facts of
the application and the planning board recommendation.
Mr.Bledsoe _spoke on his own behalf. No one spoke in
opposition. Mr. Stewart closed the Bledsoe public hearing.
Currin, Grady - Conditional Use Permits to place
manufactured homes in the- -Old Stage Point Subdivision in RA-
30 District, Grove Township, S.R. 1006 - Mr. Stewart called
the Currin public hearing to order and Carla Stephens
discussed the facts of. the application and the planning
board recommendation. Mr. Currin spoke on his own behalf.
No one spoke in opposition. Mr. Stewart closed the Currin
public hearing.
6. D & M Lands, Inc. - Conditional Use Permits to place
manufactured homes in the Scotts Creek Subdivision in RA -30
District, Neill's Creek Township, corner of S.R. 1403 and
S.R. 1513,- Mr. Stewart called the D & M Lands, Inc. public
hearing to order and Carla Stephens discussed the facts of
the application and the planning board recommendation. Mr.
Richard Akins, attorney, represented D & M Lands, Inca Mr..
Akins stated - everything required by the county prior to
developing the subdivision had been done by the developer.
Glenn Johnson, county attorney, clarified that approval of a
subdivision by the planning board does not approve the land
`use; it approves only the subdivision of the land. Mr.
Lester Stancil, registered surveyor of the property, felt,
that the land's present use should be grounds to continue
similar development. Several citizens and adjoining
property owners from the Scott's Creek community made
statements in opposition to manufactured homes being placed.-
in the subdivision. Following is a list of those citizens:

Marshall Woodall, attorney for the citizens of the Scott's
Creek area, requested that the application for the
conditional use permit be denied on the grounds that it
failed to comply with Article VII, Section 4.0 through 4.7
of the Harnett County Zoning Ordinance. Mr. Woodall
presented to the commissioners a petition of 96 names who
were opposing the conditional use permit for D & M Lands,
Inc. The petition is filed in the planning office. Mr.
Richard Akins, attorney for D & M Lands, Inc., made a
rebuttal asking that the subdivision be grandfathered.
After all discussion had been completed, Mr. Stewart closed
the D & M Lands, Inc. public hearing.
7. Giles, Donald - Manufactured Home in RA -30 District, Black
River Township, NC 210 - Mr. Stewart called the Giles public
hearing to order and Carla Stephens discussed the facts of
the application and the planning board recommendation. Mr.
Giles spoke on his own behalf explaining that he did not
intend to keep the manufactured home there permanently, but
he was not in the position to make an investment in a house
at this time. His brother, Richard Giles, also spoke on his
behalf. Stuart Matthews, who has recently built a home next
to the Giles' property, requested that Donald Giles move his
manufactured home to the site at the back of the property.
He also requested that Mr. Giles have a five year limitation
on the conditional use permit. Bob Smith, an adjoining
property owner, opposed the manufactured home being placed
on the rear site and requested that the home be placed
closer to the front property line. There being no further
discussion, Mr. Stewart closed the Giles public hearing.
8. Hardee, Louise - Manufactured Home in RA -30 District,
Averasboro Township, S.R. 1705 - Mr. Stewart called the
Hardee public hearing to order and Carla Stephens discussed
the facts of the application and the planning board
recommendation. Mr. & Mrs. Hardee spoke on their behalf.
No one spoke in opposition. Mr. Stewart closed the Hardee
public hearing.
9. Mabry, Johnny - Manufactured Home in RA -30 District, Black
River Township, S.R. 1538 - Mr. Stewart called the Mabry
public hearing to order and Carla Stephens discussed the
facts of the application and the planning board
recommendation. Mr. Mabry spoke on his own behalf. No one
spoke in opposition. Mr. Stewart closed the Mabry public
hearing.
10. SBS Limited Partnership - Conditional Use Permits to place
manufactured homes in Lake Pointe Subdivision, Hector's
Creek Township, S.R. 1414 - Mr. Stewart called the SBS
Limited Partnership public hearing to order and Carla
Stephens discussed the facts of the application and the
planning board recommendation. Richard Stockett
represented SBS Limited Partnership. Mr. Stockett explained
that he intended to continue with the same development he
began in 1985. He agreed not to rent the lots in the
subdivision. No one spoke in opposition. Mr. Stewart
closed the SBS Limited Partnership public hearing.
11. Secrest, Tom - Conditional Use Permit to place double -wide
manufactured homes in Carolina Estates Subdivision in RA -30
District, Black River Township, S.R. 1510 - Mr. Stewart
called the Secrest public hearing to order and Carla
Stephens discussed the facts of the application and the
planning board recommendation. Elaine Marshall, attorney,
represented Tom Secrest. Ms. Marshall read the covenants of
the subdivision and explained that Mr. Secrest intended to
develop a very nice double -wide subdivision. No one spoke
in opposition. Mr. Stewart closed the Secrest public
hearing.
12. Stancil, Jerry - Manufactured Home in RA -30 District,
Averasboro Township, S.R. 1708 - Mr. Stewart called the
Stancil public hearing to order and Carla Stephens discussed
the facts of the application and the planning board
recommendation. Mr. Stancil spoke on his own behalf. No on
spoke in opposition. Mr. Stewart closed the Stancil public
hearing.
13. Westbrook, Gene - Trade in RA -30 District, Grove Township,
S.R. 1559 - Mr. Stewart called the Westbrook public hearing
to order and Carla Stephens discussed the facts of the
application and the planning board recommendation. She also
presented -a letter from Tom Meece which requested that a
condition be placed on the conditional use permit
prohibiting junk automobiles from being on the property.
Mr. Westbrook spoke on his own behalf. Mr. Rudy Collins,
commissioner, vouched for Mr. Westbrook stating that he felt
Mr. Westbrook would run a respectable shop. No one spoke in
opposition. Mr. Stewart closed the Westbrook public
hearing.
There being no further business, the public hearings
adjourned -t 9:05 p.m.
