The Harnett County Board of Commissioners met in regular session on Monday,
April 18, 1988, at the County Office Building, Lillington, North Carolina,
with the following members present: Bill Shaw, Rudy Collins, Mack Reid
Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present
were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa
W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary.
Chairman Stewart called the meeting to order at 7:20 p.m.
Commissioner Collins offered the invocation.
Minutes from the regular meeting of April 4, 1988, and the special meeting of
April 14, 1988, were approved.
April Coble, World Class Water Skier from Angier, briefed the Board on her
recent trip to Australia where she participated in the Jr. World Water Ski
Championships. Miss Coble is part of the four - person U. S. Jr. World Team who
is now the 1988 Jr. World Champions.
Dallas H. Pope, County Manager, presented an ordinance amending the subdi-
vision regulations for Harnett County which included changes to sections
involving water and sewer, the size of subdivision plats to be recorded, and
subdivision easements. Two changes were recommended to the ordinance amending
the subdivision regulations for the county involving the water and sewer
section and the easement section. Commissioner Hudson made a motion to adopt
the ordinance with the two changes made. Commissioner Collins seconded the
motion and it passed with a unanimous vote. The ordinance with recommended
changes is copied in full at the end of these minutes dated April 18, 1988, as
document No. 1.
Dallas H. Pope, County Manager, presented a report of intra - departmental
budget amendments for period July 1, 1987 to arch 31, 1988. Commissioner
Collins made a motion to approve the budget amendments. Commissioner Shaw
seconded the motion and it passed with a unanimous vote. The list is copied
in full at the end of these minutes dated April 18, 1988, as document No. 2.
Vanessa W. Young, Finance Officer, reported to the Board on list of 1977 taxes
to be charged off. Commissioner Smith made a motion to approve the list
of taxes to be charged off. Commissioner Collins seconded the motion and it
passed with a unanimous vote.
Gayle Holder, Register of Deeds, requested by letter the authorization to
dispose of records in her office which are so recorded at the end of these
minutes dated April 18, 1988, as document No. 3, Commissioner Hudson made a
motion that in accordance with General Statutes 121 -5(b) that Gayle Holder,
Register of Deeds, be and she is hereby authorized to destroy the listed
records. Commissioner Smith seconded the motion and it passed with a unani-
mous vote.
CARNELL ROBINSON Commissioner Smith made a motion to reappoint Carnell Robinson to Lee- Harnett
APPOINTED TO LEE- Mental Health Board. Commissioner Hudson seconded the motion and it passed
HARNETT MENTAL HEALTHwith a unanimous vote.
SARAH POPE TITCHENER Commissioner Smith made a motion to appoint Sarah Pope Titchener to fill the
APPOINTED TO AVERS. vacancy on the Averasboro Tourism Development Authority. Commissioner Shaw
TOURISM DEV. ATHOR. seconded the motion and it passed with a unanimous vote. Mrs. Titchener is
appointed for the replacement of Tom Wise.
CABLEVISION APPLI.
FOR FRANCHISE
BUDGET AMENDMENTS
Ronald L. Peters appeared before the Board and requested a cable television
franchise for areas of Harnett County that are not already receiving cable
television. The matter will be addressed at the next Board meeting.
Departmental reports for the month of March, 1988, from the Library, Sheriff's
Department, Emergency Medical Services, Social Services, and the Health
Department were filed with the Board.
Dallas H. Pope, County Manager, requested the following budget amendment for
the Landfill:
Code 10- 6600 -002 Salaries & Wages $3,000. Decrease
Code 10- 6600 -003 Salaries & Wages -P.T. 3,000. Increase
Code 10- 6600 -031 Automobile Supplies 5,000. Increase
Code 10- 6600 -033 Materials & Supplies 5,000. Decrease
Code 10 -6600 -073 Capital Outlay -Other Imp. 2,000. Decrease
Code 10- 6600 -074 Capital Outlay - Equipment 2,000 Increase
The budget amendment is needed to purchase portable welding rig to support
landfill heavy equipment and also salaries & wages needs an increase due to
sickness of two full -time employees and the landfill has had to work more
part -time employees. The estimated expenses for off road fuels was too low
and additional work is being done on new landfill grounds. Commissioner
Hudson made a motion to approve the budget amendment. Commissioner Smith
seconded the motion and it passed with a unanimous vote.

Dallas H. Pope, County Manager, requested a budget amendment for the Airport,
Code 10- 6500 -075, Land Acquisition ADAP -01, $8,400. increase; and Code
10- 6500 -079, Powerline Relocation, $8,400. decrease. Commissioner Hudson made
a motion to approve the budget amendment. Commissioner Smith seconded the
motion and it passed with a unanimous vote.
Dallas H. Pope, County Manager, requested the following budget amendment for
the Register of Deeds:
Code 10- 4800 -016 Maintenance & Repair - Equip. $1,000. Increase
Code 10- 4800 -074 Capital Outlay - Equip. 200. Increase
Code 10- 4800 -033 Materials & Supplies 1,200. Decrease
The budget amendment is needed due to an increase in volume of work and
re- creation. Commissioner Hudson made a motion to approve the budget amend-
ment. Commissioner Smith seconded the motion and it passed with a unanimous
vote.

Public Assistance:
Code 10- 7710 -146 Unemployed Parents Program $103,000. Decrease

The budget amendment is needed due to reallocation of funds in A.F.D.C., A.A.,
and A.D. and Medicaid. Commissioner Hudson made a motion to approve the
budget amendment. Commissioner Smith seconded the motion and it passed with a
unanimous vote.

Code 10- 4550 -014, Revaluation - Travel & Meetings, $2,000. decrease. Commis-
sioner Hudson made a motion to approve the budget amendment. Commissioner
Smith seconded the motion and it passed with a unanimous vote.

RESOLUTION RE: Rodney Tart, Director, Public Utilities, presented a resolution awarding
CONTRACT TO REPAIR contract for repairs to water storage tank. Commissioner Shaw made a motion
to adopt the resolution. Commissioner Collins seconded the motion and it
passed with a unanimous vote. The resolution is copied in full at the end of
these minutes dated April 18, 1988, as document No. 4.

vote.

ORDINANCE. AMENDING AN ORDINANCE ENTITLED
SUBDI VISION REGULATIONS FOR HARNETT COUNTY, NORTH CAROLINA
ADOPTED APRIL 4, 1977
WHEREAS, this Board adopted an Ordinance on April 4, 1977
entitled "Subdivision Regulations for Harnett County, North
Carolina "; and
WHEREAS, this Board is of the opinion that the amendments
set forth below are necessaryito the clear and efficient working
of the Ordinance; :and
WHEREAS, as provided by Section 6.2 of the Ordinance, the
said amendments have been submitted to the Harnett County
Planning Board for review and recommendation, where they have
been favorably reported; and
WHEREAS, pursuant to. N. C. Gen. Stat. 153A -323, after notice
as by law provided, a public hearing has been held concerning
adoption of the amendments;
NOW, THEREFORE, BE IT ORDAINED:
1. That Article II, Section 2.0, - #17 (a) read as follows:
17. Subdivision Minor:
(a) Any subdivision which creates a maximum of three
(3) additional lots which front on an existing
public road or have permanent access or egress by
at least.a 30' easement or other approved .means.
2. That Article III. Section 3.3 read as follows:
The subdivider shall submit ten (10) black or blue line
copies of a final plat, and one (1) reproducible drawing to
the Planning Board through the Administrator of the
Ordinance seven (7) working days prior to the regular
meeting of the Planning Board at which the plat is to be
considered. The final plat shall be prepared by a licensed
surveyor. Such plat shall be drawn on sheets not larger
than twenty -four (24) inches by thirty -six (36) inches, nor .
smaller than eight and one -half (8-1/2) .inches by fourteen
(14) inches.
3. That Section 4.3 of the Ordinance be amended to read as
follows:

Section 4.3 Water and Sewer
Installation and provision for water supply and sewage
disposal shall be according to the standards of the Harnett
County Department of Public Utilities Comprehensive Water
and Sewer Plans and the Harnett County Health Department.

A. Connection Requirement: As to any subdivision which is
created after the adoption of this section, as amended,
(April 18, 1988) and is located within that number of
feet of an existing county owned or operated water
supply and distribution system as is specified in
Subsection B below, whether the subdivision is located
within or without the service area of an existing
county owned or operated public water supply and
distribution system, the developer or subdivider shall
cause a water distribution system, meeting the
standards herein specified, to be constructed and
installed in such subdivision and shall further cause
said water distribution system to be connected to the
existing county owned or operated public water supply
and distribution system which is located as specified
in said Subsection B. This requirement also applies to
new phases of existing subdivisions when these phases
have not been previously approved by the Harnett County
Planning Board.
Consideration shall be given to the acreage of an
entire tract and the number of potential lots therein,
taking into account topography, feasibility of the land
for further subdivision development, and other factors,
Where, in the opinion of the Planning Board and Utility
Department, a subdivision cannot be economically
connected to a county owned or operated water
distribution system, the subdivision must contain
adequate area (based on information concerning the soil
survey, water table, type of sewage disposal, etc.) for
the installation of private water supply systems, and
must be approved in writing by the County Health
Department. In addition, where, in the opinion of the
Planning Board and Utility Department, a subdivision
cannot be economically connected to a county owned or
operated water distribution system, the developer or
subdivider may establish and create a public water
supply system or connect the subdivision to an existing
public water supply system. However, such created
public water supply system or such water distribution
system to be connected to an existing system shall be
approved by and meet the requirements of all federal,
state, and local governments, including but not limited
to the Division of Health Services, Department of Human
Resources of the State of North Carolina and the North
Carolina Utilities Commission.
B. Distance Specification: A subdivision shall be
required to meet the conditions of this section when
the subdivision is located within that number of feet
of an existing county owned or operated water supply
and distribution system which equals the product of the
number of lots within the subdivision (including lots
to be developed in the future) multiplied by 100;
PROVIDED HOWEVER, that the maximum distance required
for connection shall be 5000 feet.
C. Subject to Capacity Suf£iciencyL In the event that a
subdivision should meet the distance specification
requirements of Subsection B and the county owned or
operated water supply and distribution system to which
the subdivision would connect shall be of insufficient
capacity to permit the delivery of water to said
subdivision, the subject subdivision shall be relieved
of the requirement to connect to such county system.
D. Review Requirements: When a developer or subdivider is
required to install a water distribution system
pursuant to this section, prior to final approval of
the record plat, the plans for the water distribution
system to be so installed shall be submitted to the
County Director of Public Utilities. The location,
size and specifications of the water distribution
system shall be placed upon said plat for review and
approval. The County Director of Public Utilities
shall review the information supplied and determine
whether the plans meet the requirements of this
section.
E. Plan Specification: The plans for a water distribution
system to be installed pursuant to this section shall
show and /or state thereon such information as will
indicate that the system planned will meet, when
constructed and installed, the requirements of this
section.
F. Water Distribution System Specifications. A water
distribution system to be constructed within a
subdivision pursuant to this section and /or connected
to the county owned or operated system shall:
1. Be properly connected in such a manner as to
adequately serve all lots shown on the subdivision
plat (including both present and future lots) for
domestic use and fire protection.

County Department of Public Utilities as provided
by said Department and conform to the accepted
standards of good practice for water system
construction, as ,specified by the Division of
Health Services, Department of Human Resources, of
the State of North Carolina (or any successor
agency thereof) and as specified in the Harnett
County water system extension policy.
3. Be approved by the necessary federal and /or state
agencies prior to or at the time of completion.
4. Conform to all state and /or local
ordinances, rules and regulations relating thereto
and any license and /or permits required thereby
shall be. obtained.
5. Be constructed pursuant to the necessary
contractual agreements required by the policies,
rules and - regulations of the Harnett County
Department of Public Utilities..
G. Fire Protection:. In major subdivisions with new roads
where an adequate public water supply system is
available, the developer or .subdivider shall install
fire hydrants in such a manner that the subdivision is
afforded adequate fire protection or as provided in the
local government water system extension policy.. Fire
hydrants shall be located in such a manner that no lot
is further than one thousand (1,000) feet from a
hydrant. Water lines on which fire hydrants are to be
installed shall be not less than six (6) inches in
diameter. There shall be no closed or dead end lines
servicing the fire hydrant locations in the
subdivision, unless an alternate method is approved.
H. Subdivisions Where Section Not Applicable: When
located outside the service area of a county owned or
operated water supply and distribution system and /or
outside the distance specifications, lot sizes within a
subdivision may be allowed to be reduced, provided
adequate water is available for domestic use from a
community water system to be installed by the
developer; and provided six (6) inch water lines are
installed to service fire hydrant locations such that
no lot is farther than 1,000 feet from such a location,
and stub outs with gate valves are provided at said
fire hydrant locations. If the subdivision does not
meet these provisions, it shall be considered under the
regulations specified herein for property not having
public water available.
I. Construction Period: When a subdivision is to be
developed in phases, the water distribution system
required hereunder may be constructed in steps
simultaneous with the development of each phase of the
subdivision.
Due to changes brought about by amending Section 4.3 above,
the following amendments are also deemed necessary and
desirable at this time:
(1) That Article III, Section. 3.3 B, Item lib of the
Ordinance be amended to read as follows:
Certificate of Approval of Water Supply and Sewage
Disposal Systems, signed by the County Health Director
or his authorized agent. A Certificate of Approval
signed by the County Utilities Director is required
when county owned or operated public water and /or
public sewage is to be utilized. The subdivider shall
install these facilities in accordance with the
approved plans.
(2) That Article IV, Section 4.2 B (as amended) of the
Ordinance be amended to read as follows:
Cul -de -sacs shall not exceed two thousand. (2,000) feet
in length. A minimum of six (6) inch water lines shall
be provided on all cul -de -sacs longer than one thousand
(1,000) feet in length.
(3) That Article V, Section 5.2 C of the Ordinance be
amended to read as follows: _
Sewage Disposal and Water Supply:
The subdivider shall submit to the Planning Board along
with the final plat, a Certificate of Approval of Water
Supply and Sewage Disposal System signed by the County
Health Director or his authorized agent. A Certificate
of Approval signed by the County Utilities. Director is
required when county owned or operated public water
and /or public sewage is to be utilized. The subdivider
shall install these facilities in accordance with the
approved plans.

WHEREAS, pursuant to an Invitation for Bids dated March 1, 1988,
the County of Harnett offered interested parties the opportunity to
submit bids for certain painting and repair work necessary to maintain
a 500,000 gallon elevated water storage tank known as Metro Tank 1,
which tank is located on U.S. Highway #421 approximately one mile east
of the intersection of said highway and U.S. Highway #401; and
WHEREAS, pursuant to said Invitation for Bids, the County of
Harnett received three (3) bids for the said work and upon - review of
the same, the County Director of Public Utilities and the County
Director of Procurement have recommended that the contract for said
work be awarded to the lowest responsible bidder which has presented a
legally sufficient bid and
WHEREAS, the lowest responsible bidder, Charlotte Tank Lining
Co., Inc. submitted a total lump sum bid of Thirty -one Thousand, Two.
Hundred Dollars (31,.200.00); and
WHEREAS, the County was able to make provisions with said bidder
for a contract change order modifying and increasing certain
requirements relating to the exterior cleaning and painting of said
tank and the replacement of a water level indicator at an increased
cost of Seven Thousand Seven Hundred Dollars ($7,700.00); and
WHEREAS, the County of Harnett, as lessee and operator of the
system of the Northeast Metropolitan Water District of Harnett County
finds it necessary to have the said work performed; and

WHEREAS, the Harnett County Board of Commissioners considers it
is in the beet interest of the County to accept said recommendation
and award the contract as specified below.
NOW, THEREFORE, BE IT RESOLVED that the contract for the painting
and repair work described to maintain said water storage tank
including the work specified in the contract change order is hereby
awarded to Charlotte Tank Lining Co., Inc. Mt. Pleasant, NC for the
adjusted lump sum contract price of Thirty Eight Thousand Nine Hundred
Dollars (538,900.00).
BE IT FURTHER RESOLVED that the Chairman of the Harnett County
Board of Commissioners and Clerk of the Board are authorized to
execute said contract on behalf of the County.
