HomeMy WebLinkAbout11021987423 HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, NOVEMBER 2, 1987 ALL TO ORDER PRAYER The Harnett County Board of Commissoners met in regular session on Monday, November 2, 1987, at the County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager; Vanessa W. Young, Clerk to the Board; Glenn Johnson, County Attorney, and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 9:00 a.m. Commissioner Collins led the morning prayer. INUTES APPROVED The minutes from the Board of Commissioners meeting of October 19, 1987 were approved. DOT RESOL. RE: SECONDARY ROAD FUNDING CABLEVISION REPORT CABLEVISION REQUEST -KEITH HILLS HARGE TO TAX OLLECTOR 1988 REVAL. SCHEDULE RESOL. RE: REGION "M" •EAPPOINTMENT �F AGING ADV. FOR 4IRPORT Ray Stone, Highway Maintenance Engineer with the North Carolina Department of Trans- portation appeared before the Board to discuss road mattters and situations in Harnett County. Dallas H. Pope, County Manager, presented a resolution concerning secondary road fund- ing. Commissioner Shaw made a motion to approve the resolution. Commissioner Collins seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated November 2, 1987, as document No. 1. Terry Brown, General Manager, Southern Cablevision, reported on the progress of the construction of cablevision in the County. Mr. Phil Juby, residnet of Keith Hills, appeared before the Board and requested support for acquiring cablevision service for his community. Mr. Juby was advised by the Boarc to work with Mrs. Terry Brown, General Manager, Southern Cablevision, in working out an approach for the installation of cablevision service in Keith Hills Community. Vanessa W. Young, Clerk to the Board, charged Bobby Wicker, Tax Collector, for collec- tion of 1987, taxes. Commissioner Collins made a motion that the follwoing charge be approved. Commissioner Shaw seconded the motion and it passed with a uananimous vote. TO: THE TAX COLLECTOR OF HARNETTT COUNTY You ar hereby authorized, empowered, and commanded to collect the taxes set for it the tax records filed in the Office of the Tax Assessor and in the tax receipts herewit delivered to you, in the amounts and from the taxpayers likewise therin set forth. Such taxes are hereby declared to be a first lien upon all real property of the respec- tive taxpayers in the County of Harnett, and this order shall be a full and sufficient authority to direct, require, and enable you to levy and sell any real or personal property of such taxpayers, for and on account thereof, in accordance with law. HARNfr T COUNTY BOARD OF COMMISSIONERS Bobby Wicker, Tax Collector, presented for consideration the 1988 Revaluation Schedule of Values for Harnett County. Commissioner Collins made a motion that the Schedule of Values be adopted. Commissioner Hudson seconded the motion and it passed with a unanimous vote. A copy of the Schedule of Values is filed in the County Manager's Office. Dallas H. Pope, County Manager, presented a resolution requesting release of funds to Region "M ". Commissioner Smith made a motion to approve the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated November 2, 1987, as document No. 2. Dallas H. Pope, County Manager, requested that the following members of Region "M" Aging Advisory Board be reappointed for a one -year term that will expire September 30, 1988: Mr. Mack Reid Hudson, Ms. Virginia Marshall, Mr. L. Marvin Johnson, Ms. Berline Kelly, and Mrs. Erthalene Clark. Commissioner Collins made a motion for the reappoint- ments. Commissioner Smith seconded the motion and it passed with a unanimous vote. Glenn Johnson, County Attorney, presented a contract and agreement concerning Anderson Creek Fire & Rescue, Inc. Commissioner Shaw made a motion to approve the contract and agreement. Commissioner Collins seconded the motion and it passed with a unanimous vote. The contract and agreement is copied in full at the end of these minutes dated November 2, 1987, as document No. 3. Dallas H. Pope, County Manager, briefed the Board on discussions regarding designs for wastewater system expansion. Dallas H. Pope, County Manager, briefed the Board on procurement of fire equipment to be installed on vehicle used at the airport. k 424 LEASE AGREEMENT SEXTON BUILDING REQUEST TO EX- TEND AUDIT CONTRACT Dallas H. Pope, County Manager, presented for approval a lease agreement concerning Department of Social Services' food stamp operation. Commissioner Smith made a motion to approve the lease agreeemnt. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The lease agreement is copied in full at the end of these minutes dated November 2, 1987, as document No. 4. Dallas H. Pope, County Manager, presented to extend the audit contract for 30 days. the contract for 30 days from October 31, Collins seconded the motion and it passed a request from Oscar N. Harris & Associates Commissioner Hudson made a motion to extend 1987,. to November. 30, 1987. Commissioner with a unanimous vote. BUDGET AMEND. Dallas H. Pope, County Manager, requested a budget amendment for the. Register of Deeds REGISTER OF DEEDS to increase code 10- 4800 -009, Other Fringe Benefits, $8,000. to provide supplemental pension for Register of Deeds. Commissioner Hudson made a motion to approve the bud- get amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. BUDGET AMEND. LIBRARY BUDGET AMEND. PLANNING BUDGET AMEND. LANDFILL BUDGET AMEND. SPEC. APPRO. PROPOSED COATS RESCUE DIST. SUB. PLAT E.W. BENNETT TRUST REROUTING OF HWY. 27 Dallas H. Pope, County Manager, requested a budget amendment for the Library to increa code 10- 6600 -074, Capital Outlay - Equipment, $29,000., . and to decrease code 10 -8700- 153, Special Appropriations - Capital Reserve- Library, $29,000.. This budget amendment is required for telephone system and equipment for new library building. Commissioner Collins made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Planning Department to increase code 10- 7200 -074, Capital Outlay- Equipment, $3,200. This budget amendment is needed to purchase equipment for the Planning Department including a drafting table and personal computer. Commissioner Smith made a motion to approve the budget amend- ment. Commissioner Hudson seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Landfill to increase cond 10- 6600 -074, Capital Outlay- Equipment, $25,900. The budget amendment is needed for lease-purchase of replacement payscraper. Commissioner Shaw made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Special Appropriation to increase code 10- 8700 -164, Johnsonville Community Center, Inc., $1,200. to provide support requested by the Center. Commissioner Smith made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unani- mous vote. Glenn Johnson, County Attorney, briefed the Baord on update for proposed Coats -Grove Rescue District. Hal Owen, Planner /Developer, presented for consideration a subdivision plat for E.W. Bennett Trust located in Buckhorn Township. Based on lot number 6 not being in compliance with sibdivision ordinance, Commissioner Collins made a motion that the plat be revised in order to meet Harnett County's regulations and then can be resub- mitted for consideration. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, briefed the Board on letter received form James E. Harrington, Secretary, NC State Dept. of Transportation regarding resolution that Harnett County Baord of Commissioners adopted October 5, 1987, concerning rerouting of Highway 27. A copy of the letter will be forwarded to Mayor of Coats. TAX ATT. REPORT The Tax Attorney's report for month of October, 1987 was filed with the Board and is copied in full at the end of these minutes dated November 2, 1987, as document No. 5. CONTRACT AND AGREEMENT THIS CONTRACT AND AGREEMENT, Made and entered into this the. 30th day of October, 1987, by and between COUNTY OF HARNETT, party of the first part, also referred to as County, and ANDERSON CREEK FIRE & RESCUE, INC., party of the second part, also referred to as Department or Corporation; W I T N E S S E T H : THAT WHEREAS, N.C.G.S. 69 -25.5 and other applicable provisions -of law provide that counties may provide for fire protection and rescue services in fire and and rescue districts by contracting with any incorporated nonprofit volunteer or community emergency service departments; and WHEREAS, the new N.C.G.S. 159 -13 (a) (8), which became effective July 1, 1973, provides that the budget ordinance "may be in any form that the Board (of Commissioners of Harnett. County) deems most efficient in enabling it to make the fiscal policy decisions embodied therein, but it shall be so organized that the accounting system will show appropriations and revenues by line items within at least the following funds: . "(8) a fund for each special district whose taxes are collected by ." the County of Harnett; and WHEREAS, the party of the second part is a nonprofit corporation organized for the providing of fire protection and rescue service; and WHEREAS, it serves a special tax district created by a vote of the people; and WHEREAS, it is desirous to make application to the United States of America, acting through the Farmers Home Administration, United States Department of Agriculture, hereinafter referred to as the Farmers Home Administration for a loan in the amount of One Hundred Thousand Dollars ($100,000.); and WHEREAS, the County of Harnett levies and collects the taxes and is responsible for appropriating said funds for the use and benefit of the citizens in the subject districts; and WHEREAS, the County desires to grant a long -term contract to enable party of the second part to make long -range plans; and WHEREAS, the County of Harnett desires to standardize all its arrangements with fire protection and rescue providers in the County; NOW, THEREFORE, in consideration of the premises and the consideration of TEN DOLLARS ($10.00) to each by the other in hand paid, the parties hereto contract and agree as follows:. 427 1. The party of the first part contracts and agrees that it will cause to be assessed or levied a special tax of up to fifteen cents for fire protection and for rescue services per one hundred dollar valuation of all real and personal property in the Anderson Creek fire district unless otherwise limited by law and /or vote of the people; and will collect said tax as a part of the ad valorem taxes of the County of Harnett; provided, however, beginning with the fiscal year 1987 -1988 the amount levied annually shall be based on the needs projected in the budget estimate submitted by the Department to the County and approved by the County Commissioners. 2. That a special or separate fund shall be maintained by the County for funds collected as a result of said special taxes. 3. That current taxes, as they are collected by the county, shall be paid to Anderson Creek Fire & Rescue, Inc. by the 30th day of each month as follows: As the same are collected by the County that delinquent taxes shall be remitted quarterly. 4. The party of the second part shall provide the necessary equipment and personnel for furnishing adequate fire protection and rescue services as determined by the North Carolina Department of Insurance, Fire and Rescue Service Division, for all property located within the subject district, and it will furnish said fire protection and rescue service free of charge to all persons and individuals located in said District in an efficient and workmanlike manner. 5. That all funds paid to the party of the second part by the party of the first part shall be used exclusively to provide fire protection and rescue service within such district, and to pay other legitimate fire protection and rescue service expenses including principal and interest on the aforementioned loan made by the Farmers Home Administration. 6. It is agreed that the party of the first part may inspect all books and accounts for the party of the second part at any time that it shall desire; it is further agreed that the Department will present to the County Commissioners an annual audit by a C.P.A. which audit shall be in conformity with existing audit policies of the County. 7. The party of second part agrees to comply with County budgeting procedures and other procedures provided for by State law and agrees to submit budget estimates to the Board of Commissioners on the standard forma used by county departments; the party of the second part also agrees to use standard line items for accounting devised or consented to by the County Accountant from time to time. 8. This contract shall extend for a term of Thirty (30) years from the date of the Farmers Home Administration loan closing and may be renewed or extended for such term or terms as may be agreed upon by the Department and the County, and may not be transferred or assigned without written consent of the County. 9. The party of the second part further agrees to file with the County Auditor a true copy of the Articles of Incorporation, existing Bylaws and any changes made thereto from time to time; further, the party of the second part agrees to adopt bylaws, which meet all minimum legal requirements and which bylaws, in addition thereto, have reasonable provisions enabling citizens of the community to participate in the affairs of the corporation at at least an annual meeting and vesting in a Board of Directors the authority to manage the affairs of the corporation without a vote of the membership to the extent permitted by N.C.G.S. 55A, the North Carolina Nonprofit Corporation Act. IN TESTIMONY WHEREOF, the party of the first part has caused this instrument to be executed by the Chairman of the Board of County Commissioners and attested by the Clerk of the County Board of Commissioners, and the party of the second part has caused this instrument to be signed in its naine by its president, attested by its secretary, and its corporate seal hereto affixed, all by order of its Board of Directors duly given. NORTH CAROLINA HARNETT COUNTY LEASE AGREEMENT THIS LEASE AGREEMENT, made and entered into this 1st day of November, 1987, by and between B. Fred Sexton and wife, Mary M. Sexton, parties of the first part, hereinafter called the Lessors; and the County of Harnett, a body politic and corporate, for and on behalf of the Harnett County Department of Social Services, Lillington, North Carolina, a duly recognized agency of Harnett County, party of the second part, hereinafter called "Lessee "; W I T N E S SETH : That the Lessors hereby demise, let and lease unto the Lessee and the Lessee does hereby accept as tenant of the Lessors for the terms and upon the conditions hereinafter set out the following described property located in the Town of Lillington, Harnett County, North Carolina: The front portion of that certain building located at 1024 Main Street, Town of Lillington, consisting of approximately 4,000 square feet, formerly occupied by Sexton's Department Store, together with the adjacent parking lot exclusive of the last four parking spaces, in front of the space currently occupied by Dr. Lynn Mann, which parking spaces are reserved for use by other tenants. Also included in the leased premises is the property known as the T. M. Stewart property at the rear of the demised building, which property shall be used by the Lessee as a parking area. TO HAVE AND TO HOLD the aforesaid premises together with all privileges and appurtenances thereunto belonging unto the Lessee upon the following terms and conditions: 1. The term of this lease shall commence on the fifteenth day of November, 1937 and shall continue for a period of one year thereafter. The lessee shall, at its option, have the right and privilege to renew this lease for up to five additional, consecutive periods of one year each upon the same terms and con- ditions herein set forth, including the amount of rental payable. The lessee in order to exercise such options for renewal shall give the lessors written notice of its desire to extend the lease for the next ensuing one -year period on or before, October 15 of the year for which this lease is then in effect. As rental for said premises, the Lessee shall pay to the Lessors the sum of $1,500.00 per month, which rent shall be due and payable on or before the tenth day of each month. Rent for the last half of the month of November, 1987 in the amount of $750.00 shall be due on or before November 25, 1987, and rent for the first half of the final month of November shall be in the amount of $750.00. In the event the Lessee fails for any reason whatever to pay any monthly installment of rent when due and such installment shall remain unpaid for a period of fifteen days or more, the Lessors, may, at their option, terminate this lease agreement and thereupon re -enter and take possession of said demised premises. 3 During the term of this lease, the Lessors shall pay all taxes and assessments levied upon the herein demised premises by any duly constituted governmental taxing authority. The Lessee shall be responsible for and will pay all taxes and assessments imposed upon any fixtures, equipment, goods, merchandise or other property which it shall place or cause to be placed upon the herein demised premises. 4. During the term of, this lease the Lessors shall keep the roof of the subject building in a leakproof condition; shall pay all real estate taxes to the County of Harnett and Town of Lillington; shall keep said building insured; shall insure that the building is amply heated and cooled and shall be responsible for all repairs to said heating and cooling unit. Lessee shall be responsible for personal property insurance; personal property tax, both County and Town; and shall furnish and pay for all public utilities. 5. Lessors agree to keep the outside of said building in a good state of repair. However, the inside of said building shall be maintained and kept in a good state of repair by Lessee. 6. Lessee shall be responsible for and shall pay all electric, heat and telephone charges imposed upon or in connection with the herein demised property. 7. Lessee covenants and agrees that it will not use, or permit to be used, any portion of said demised premises for any unlawful purposes and that it will at all times comply with all rules, regulations and requirements of the County, State and Federal Governments, or any'of the departments, bureaus or subdivisions thereof, which shall in any way be applicable to said demised premises and the use thereof. It is agreed and understood that upon the termination of this lease, the Lessee shall be entitled to remove from said premises all goods, merchandise, fixtures and equipment which it has placed in or upon said premises belonging to the Lessee, provided the Lessee shall not then be in default in the performance of any part of the terms and conditions of this agreement and provided further that such property can be removed without permanently injuring the premises. The Lessee covenants that it will promptly and properly repair any damage or dis- figurement caused by the removal of its property from said premises. However, any permanent improvements to the realty become the property of the Lessors and may only be removed with the written consent of the Lessors. 9. It is agreed and understood that if the subject building is destroyed by fire or other catastrophe that the rental herein charged shall cease. 10. It is further agreed and understood that if any difference should arise between the parties hereto as to the meaning or interpretation of this contract that the same will be resolved by arbitration in the usual manner. 11. It is agreed and understood that the stipulations, terms and con- ditions above set forth constitute the sole and entire contract and agreement between the parties hereto and that said agreement, and the terms thereof, shall not be changed, varied or modified, except in writing by and with the mutual consent of the parties hereto. This agreement, and every term and condition hereof, shall be binding upon the successors, assigns, and guarantors of the parties hereto as fully and to the same extent as if such successors, assigns, and guarantors had actually joined in the execution hereof.
