HARNETT COUNTY BOARD OF COMMISSIONERS SPECIAL MEETING, APRIL 13, 1987
CALL TO ORDER
ROOF COVERING FOR
LIBRARY BUILDING
The Harnett County Board of Commissioners met in special session on Monday, April
13, 1987, in the Commissioners Board Room, County Office Building, Lillington,
North Carolina, with the following members present: Rudy Collins, Mack Reid Hudson
Mayo Smith, and Vice - Chairman Bill Shaw presiding. Chairman Lloyd Stewart was
absent. Others present were: Vanessa W. Young, Clerk to the Board; Dallas H. Pope
County Manager; Glenn Johnson, County Attorney; and Kay Blanchard, Recording
Secretary.
Vice - Chairman Bill Shaw called the meeting to order at 6:00 p.m.
Dallas Pope, County Manager, appeared before the Board and explained items to be
considered. After a discussion regarding the type of roof covering to use on the
new library building, Commissioner Collins made a motion that they use Timberline
self - sealing, class A, fiberglass asphalt roof shingles with a 30 -year limited
warranty. Commissioner Smith seconded the motion and it passed with a unanimous
vote.
BIDS AWARDED FOR Glenn Johnson, County Attorney, appeared before the Board and read a resolution
LIBRARY PROJECT regarding the awarding of bids for the library project. Commissioner Smith made
a motion to approve the resolution. Commissioner Collins seconded the motion and
it passed unanimously. The resolution is copied in full at the end of these minute
dated April 13, 1987, as document No. 1.
Dallas H. Pope, County Manager, presented for the Board's approval, .a budget amend-
ment for Public Buildings increasing line item 10 -5000 -074 by $9,981. The increase
is needed to purchase a diesel tractor. Commissioner Hudson made a motion that the
budget amendment be approved. Commissioner Collins seconded the motion and it
passed unanimously.

Dallas H. Pope, County Manager, presented for the Board's consideration an agreemen
between Food Lion and Harnett County. Commissioner Smith made a motion to approve
the agreement. Commissioner Hudson seconded the motion and it carried with a
unanimous vote. The agreement is copied in full at the end of these minutes dated
April 13, 1987, as document No. 2.
There being no further business, the Harnett County Board of Commissioners special
meeting of April 13, 1987, duly adjourned at 6:30 p.m.

R E S O L U T I O N
THAT WHEREAS, the Harnett County Board of Commissioners has
heretofore advertised for bids in connection with the Harnett
County Library Project which relates to improvements and addi-
tions to be made to an existing structure located at the
intersection of Main Street and Harnett Street in the Town of
Lillington; and
WHEREAS, the Harnett County Board of Commissioners has
solicited bids in connection with such project as required by
law; and
WHEREAS, certain bids were received by the Harnett County
Board of Commissioners pursuant to such advertising and solicita-
tion; and
WHEREAS, said bids were opened and read aloud at a formal
bid opening held at 3:00 p.m. on March 31, 1987 in the County
Commissioner's Meeting Room, Harnett County Office Building,
Front Street, Lillington, North Carolina; and
WHEREAS, said bide so received have been considered and
reviewed by Team Architects, Inc., the County's architect in
connection with such project, and by the Board of Commissioners
of the County of Harnett; and
WHEREAS, Team Architects, Inc. has recommended that con-
tracts be awarded to the low bidder in each of the bid categories
and that construction be allowed to commence; and
WHEREAS, the Harnett County Board of Commissioners has
determined that the lowest bid in each bid category meets the
requirements for the submission of bide previously established by
the County of Harnett and the provisions of North Carolina law;
and
WHEREAS, the Harnett County Board of Commissioners has
determined that the requirements of N.C.G.S. 143 -129 and other
applicable provisions of law have been met in connection with the
bid process herein referenced and in regard to the lowest bid for
each bid category;
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board
of Commissioners that bide in connection with the Harnett County
Library Project as above set forth shall be awarded to the lowest
bidder in each category as shown on Exhibit A which is attached
hereto and incorporated herein by reference, that written con-
tracts shall be entered into between the County of Harnett and
New South Construction, Inc., for a total bid amount of Five
Hundred Three Thousand Five Hundred Dollars ($503,500.), the
County of Harnett and Acme Plumbing 6 Heating Company, Inc. for a
total bid amount of Sixteen Thousand Three Hundred Sixty Dollars
($16,360.), the County of Harnett and Lee Air Conditioners, Inc.
for a total bid amount of Thirty -Five Thousand Seven Hundred
Eighty -Three Dollars ($35,783.), and the County of Harnett and
Patrick 6 Burgess Electric Company, Inc. for a total bid amount
of Fifty -One Thousand Eight Hundred Forty -Nine Dollars
($51,849.), and the appropriate officials of the County of
Harnett shall be and they are hereby authorized to execute such
written contracts on behalf of said County.

DEVELOPMENT AGREEMENT
This agreement is entered panton by a and between Food Lion,
Inc., a corporation authorized to transact business within the
State of North Carolina, herein fter referred to as Corporation,
and the County of Harnett, a municipal corporation located In
Harnett County, North Carolina, referred to as the County. This
agreement will not become effective until all conditions placed
upon the County's funding approval are satisfied and funds are
released by the Department of Natural Resources and Community
Development (IWcD), hereinafter referred to as NRCD.

WHEREAS the County has received a Community Development
Block Grant,from the

to benefit low -and moderate - income persona by financing the economic
development of the County;
NOW, THEREFORE, In consideration of these premises and the
mutual covenants and promises set forth below, the parties to
this agreement hereby agree as follows:
ARTICLE ONE
1. Corporation shall execute its responsibilities as identified
in the County's CDBH application to NRCD (Exhibit A) and shall
carry out each activity within the time set forth in said
application and attachments, except as set out in Schedule 1 attached.
2. Corporation further\ agrees to ire employees into at least
�1 189 permanent full time or ermanent full -time equivalent
positions, as stated n the application. The Corporation
shall fill at least Vs- percent of these new positions with
low -and moderate - income persons. * Further, any additional
project- related positions * *shall be filled by low -and
moderate - Income persona in at least the same proportion as
presented above. With prior approval of NRCD, this commitment
may be partially waived by the County it the failure to meet
the commitment is determined to be due to events beyond the
control of the Corporation including an unfavorable,
unforeseeable occurrence of severe economic conditions and
where such waiver will not substantially affect the project
as described in the application.
"Low and moderate income persons" are those at or below the income limits set by the U.S.
Department of Housing and Urban Development for individual county involved. For county
here, applicable income limits range from $11,050 for a one person family to $19,700 for
an eight person family.

ARTICLE TWO
1. The County agrees to execute its responsibilities as defined
in the r^a' application (Exhibit Al and within the times
set forth�in said application..

ARTICLE THREE
1. Each party shall keep and maintain books, records, and other
documents relating directly to the receipt and disbursement
of grant funds and the fulfillment of this agreement.
2. Each party agrees that any duly

of Housing and Urban Development, and Comptroller General
of the United States shall, at all reasonable times, have
access to and the right to inspect," copy, audit, and examine
all of the booke, records, and other documents relating to
the grant and the fulfillment of this agreement for a period
of three years following the completion of all closeout
procedures respecting the Community Development funds, and
the final settlement and conclusion of all issues arising
out of the Community Development funds, *
3. Notwithstanding anything herein to the contrary, the parties
hereto acknowledge the due execution of the Community
Development Grant Agreement between the County and NRCD and
agree that any conflict between the provisions, requirements,
duties or obligations of this agreement and the Community
Development Grant Agreement shall be resolved in favor of
the Community Development Grant Agreement. **

4. If at the end of the approved project period the Corporation
has failed to create and /or retain the full number of job
positions and low -and moderate - income job positions presented
in Article 1, Section 2, as provided in the approved project
schedule or extension granted by the County, then the
Corporation will pay to the County an amount as determined
by NRCD based on the shortage in jobs. In determining the .
amount. due, NRCD will review actual project accomplishments
in comparison to project commitments, ratings criteria
(including, but not limited to, CDBG cost per job) and
regulatory requirements. * **
This development agreement constitutes a legally enforceable
contract and shall be governed by and construed in accordance
with the laws of the State of North Carolina.

the same as that attached as Schedule II herein.
