HARNETT COUNTY BOARD OF COMMISSIONERS MEETING OF APRIL 6, 1987 CALL TO ORDER INVOCATION RAY STONE, DOT CABLEVISION The Harnett County Board of Commissioners met in regular session on Monday, April 6, 1987, in the Commissioners Board Room, Lillington, North Carolina, with the following members present: Bill Shaw, Rudy Collins, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present included: Dallas H. Pope, County Manager; Vanessa W. Young, Clerk to the Board; Glenn Johnson, County Attorney, and Kay Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 9:25 a.m. Commissioner Rudy Collins led the morning prayer. Ray Stone, Highway Maintenance Engineer, with the N. C. Department of Transpor- tation, appeared before the Board to discuss road matters and situations in Harnett County. Terry Brown, General Manager, with Southern Cablevision, appeared before the Board to report on the progress of the construction of cablevision in the County. JOHN GOODWIN John Goodwin, a property owner on SR 1403, appeared before the Board to express REFUSE CONTAINER SITE his concern about the possibility of a refuse container site being located near his property. County Manager Dallas Pope stated that the site Mr. Goodwin referred to was not currently under consideration. REROOFING LEE - HARNETT After a discussion concerning bids received for reroofing the Lee - Harnett Mental MENTAL & DUNN HEALTH Health Building and Dunn Health Department building, a motion was made by DEPARTMENT Commissioner Smith to authorize County Manager Dallas Pope to negotiate with bidders and appropriately award to lowest bidder. Commissioner Shaw seconded the motion and it passed with a unanimous vote. LIBRARY PROJECT Dallas H. Pope, County Manager, gave an update on the Library project and re- ported the architect's recommendations regarding bids received for construc- tion of the new Library. Commissioner Bill Shaw made a motion to table this item allowing further study of bid alternates. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The Commissioners decided to hold a special called Board meeting on April 13, at 6:00 p.m. to consider this matter. BUDGET AMENDMENT: Dallas Pope, County Manager requested a budget amendment for Emergency Manage - EMERGENCY MANAGEMENT ment to increase line item 5250 -011 Telephone & Postage $550. Commissioner Shaw made a motion to approve the requested budget amendment. Commissioner Collins seconded the motion and it passed unanimously. BUDGET AMENDMENT: PUBLIC ASSISTANCE BUDGET AMENDMENT: PUBLIC UTILITIES HEALTH DEPT. REPORT INSPECTIONS REPORT AMBULANCE REPORT TAX DEPARTMENT Dallas Pope, County Manager, requested a budget amendment to increase Public Assistance Department line item 10- 7710 -151 Crisis Intervention by $1,000. Mr. Pope explained that this increase was due to additional revenues received from Carolina Power & Light. Upon motion by Commissioner Collins and seconded by Commissioner Smith, the budget amendment was approved with a unanimous vote. Dallas Pope, County Manager, explained that due to rising insurance costs, budget amendments are needed in Public Utilities Sewer Fund line item 32- 8300 -0 Insurance & Bonds increase $3,000 and Public Utilities Water Fund line item 30- 8100 -054 Insurance & Bonds increase $12,000. Commissioner Hudson made a motion to approve the budget amendment. Commissioner Collins seconded the motio and it passed unanimously. A Health Department report was filed with the Board. A report from the Inspections Department was filed with the Board. A monthly report from the Ambulance Service was filed with the Board. Bobby Wicker, Tax Administrator, reported to the Board on the activities of the Tax Supervisor's and Tax Collector's office for the month of March and his plans for the month of April. Mr. Wicker also requested the following tax refunds: 1. Corbin Concrete Products, Route 4, Box 30, Dunn, NC - refund in the amount of $4.80. A 1972 2 -ton Chevrolet truck valued at $500 was double listed in Stewarts Creek township to Mrs. Inez Corbin. 2. Yvonne Tripp South, 1005 Merry Street, Dunn, NC - refund in the amount of $54.32. Two houses charged in error. One house valued $2,830 was moved out of the County and one house valued $2,840 was transferred to Henry Paul Tripp. Total value of both houses and building site is $5,970. 3. China P. (Alonzo) Williams, Route 1, Bunnlevel, NC - refund in the amour{ of $115.46. In Stewarts Creek township a 30 acre tract of land was listed as 46 acres, value 19,800 since 1959. By deed 30 acres in tract valued $14,230. Refund for 1985 & 1986. 258 SHERIFF'S REPORT ADJOURNMENT Delitha P. Godwin, Route 5, Box 326, Dunn, NC - refund in the amount of $619.19. Deferred tax on 35.92 acres sold to Ronnie West was double charged in deferred tax on 82.11 acres. Deferred value $13,470 Refund for 1983, 1984, 1985, and 1986. 5. Mrs. Ola Maxine Raynor, Route 1, in the amount of $5.88. A 17.49 Creek has been listed as a 19.59 it is 17.49. Difference in value Box 391, Spring Lake, NC - refund acre tract of land in Anderson acre tract since 1979. By deed is $330. Refund for 1985 & 1986. 6. Lillington Baptist Church Missionary Home, P. 0. Box 297, Lillington, NC - .refund in the amount of $142.54. The Missionary Home is exempt from property taxes due to not being rented on January 1, 1986. 7. Johnny Lee and Gladys Williams, 201 Moulton. Springs Road, Erwin, NC - refund in the amount of $52.33. A 1982 Chevrolet pick -up registered and listed in the state of Florida. 8. Jerry Watson, Route 3, Box 197, Cameron,.; NC - refund in the amount of $25.68. Double listing of 1 lot tract #10 in Johnsonville town- ship. 9. Jerry R. & Myrtle Blake, Route 1, Box 98 -1 Marlin Ave., Coats, NC - refund in the amount of $21.04. One lot #19 Hunter's Run II was charged in Erwin Fire District in error. 10. John P. Garvey, Route 1, Box 190 -G, Bunnlevel, NC - refund in the amount of $94.54. Mr. Garvey is in service and a legal resident of Pennsylvania. 11. Mayme P. Morrison, Route 2, Lillington, NC - refund in the amount of $123.76. After property was sold to Betty Johnson from a 70.17 acre tract in land -use, the market value was charged instead of the land - use value for 1986. Following the presentation of these refunds, Commissioner Smith made a motion that the above - described refunds be approved; Commissioner Shaw seconded the motion and it carried with a unanimous vote. Larry Knott, Chief Detective, appeared before the Board and reported on the activities of the Sheriff's Department for the month of March. Stewart presiding. Others present included: Dallas H. Pope, County Manager; Vanessa W. Young, Clerk to the Board; Glenn Johnson, County Attorney, Kay Blanchard, Recording Secretary and John Phelps Public Utilities Attorney. Chairman Lloyd Stewart called the meeting to order at 10:55 a.m. Public Utilities Attorney John Phelps appeared before the Board and presented for the Board's consideration a resolution regarding a Legal Services Agree- ment. This resolution is copied in full at the end of these minutes dated April 6, 1987, as Document No. 1. Commissioner Collins moved for the adoption of the resolution; Commissioner Smith seconded the motion and it passed unanimously. Phelps, II, Attorney, attached hereto as Exhibit "A "; and WHEREAS, District desires to enter Into said contract as provided; NOW, TIIEREFORE, DE IT RESOLVED by the Ilarnett County Board of Commissioners, sitting as the governing body of the West Central Water and Sewer District of Ilarnett County, that: 1. West Central Water and Sewer Dlstrlct of Ilarnett County Is hereby authorized to and shall enter Into the Legal Services Agreement attached hereto as Exhibit "A ". 2. The West Central Water and Sewer District of Ilarnett County and its officers and agents are hereby directed to execute said Legal Services Agreement. Phelps, II, Attorney at Law, of LilIington, North Carolina, hereinafter referred to as "Attorney ": WHEREAS, Owners have formed In Harnett County, North Carolina a water and sewer district pursuant to the provisions of N.C. Gen. Stat. §162A -86 et. seq. known as the West Central Water and Sewer District of Harnett County (hereinafter "District"); and WHEREAS, the Attorney agrees to perform all legal services necessary under the provisions of the applicable statutes and to perform all other customary legal services necessary to the organization, financing, construction and initial operation of a water distribution system; W 1 T N E SSE T H: That for and in consideration of the mutual covenants and promises between the parties hereto, it is hereby agreed: SECTION A - LEGAL SERVICES That the Attorney will perform such services as are necessary to accomplish the above recited objectives including, but not limited to, the following: 1. Preparation and .filing of the necessary documents and supervision and assistance in the taking of such other actions as may be necessary or incidental to cause the Owners to become duly organized and incorporated and to be authorized to undertake the proposed system. 2. Furnish advice and assistance to the governing body of the West Centeral Water and Sewer District of Harnett County in connection with (a) the notice for and conduct of meetings; (b) the preparation of minutes of meetings; (c) the preparation and enactment of such resolutions as may be necessary In connection with the authorization, financing, construction, and initial operation of the system; (d) 'the preparation- of such affidavits, publication notices, bnllots, reports, certifications, and other Instruments and advice as may be needed in the conduct of such bond elections as may be necessary; (e) the preparation and completion of such bonds or other obligations as may be necessary to finance the. system; (f) the completion and execution of documents for obtaining a loan made or insured or a grant made by the United States of America, acting through the Farmers Home Administration, U.S. Department of Agriculture; (g) entering into construction contracts; (h) preparation and adoption of. By -Laws, Rules and Regulations, and rate schedules; (I) such other corporate action ns may be necessary In connection with the financing, construction, and Initial operation of the system. 3. Review of construction contracts, bid - letting procedure, and surety and contractual bonds In connection therewith. 4. Preparation, negotiation, or review of contract with a source of water supply when necessary. 5. Preparation, where necessary, and review of deeds, easements and other rights -of -way documents, and. other Instruments for sites for source of water supply, pumping stations, treatment plants, and other facilities necessary to the system and to provide continuous rights -of -way therefore; rendering - title opinions with reference .thereto; and providing for the recordation thereof. 6. Obtain necessary permits and certificates from county and municipal bodies, from State regulatory agencies, and from other public or private sources with respect to the approval of the system, the construction and operation thereof, pipeline crossings, and the like. 7. Cooperate with the engineer employed by Owners in connection with preparation of tract sheets, easements, and other necessary title documents, construction contracts, water supply contracts, health permits, crossing permits, and other Instruments. 8. When applicable, secure assistance of and cooperate with recognized bond counsel in the preparation of the documents necessary for the financing aspects of the system. Where bond counsel is retained, the Attorney will not be responsible for the preparation and approval of those documents pertaining to the Issuance of the Owner's obligations, 261. SECTION U - COMPENSATION 1. Owners will pay to the Attorney for professional services rendered In accordance herewith, fees in the amount of $45.00 per hour.
