HomeMy WebLinkAbout03231987NORTHWEST WATER AND SEWER DISTRICT PUBLIC HEARING, MARCH 23, 1987 251 On March 23, 1987, the Harnett County Board of Commissioners held a public hearing concerning the creation of the Northwest Water and Sewer District with the following persons present: Bill Shaw, Rudy Collins, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present included Glenn Johnson, County Attorney; John Phelps, Public Utilities Attorney; Vanessa W. Young, Clerk to the Board; Dallas H. Pope, County Manager; Rodney Tart, Director of Public Utilities; Joe Hardee with Black a Veatch, Inc., engineer on the project, and approximately forty citizens interested in the project. Chairman Stewart welcomed the group to the public hearing and then called on Commissioner Shaw who led the evening prayer. Rodney Tart, Public Utilities Director explained to the group the purpose of the public hearing stating that there are certain provisions set forth regarding the creation of a water and sewer district and the public hearing tonight is in compliance with these laws. CALL TO ORDER Commissioner Stewart called the public hearing to order at 7:30 p.m. OPENING COMMENTS SCOPE OF PROJECT PUBLIC COMMENTS PUBLIC HEARING CLOSED RESOLUTION Opening comments by Commissioner Rudy Collins stressed the need for a water and sewer district in the northwest section of the county. He mentioned that numerous residents have various water problems, and having a water and sewer system would promote a healthy environment and would encourage progress in the community. Mr. Joe Hardee, engineer on the project presented the scope of the pro- posed project explaining in detail where the water and sewer lines would run, the cost and funding of the project, the size of the lines, antici- pated users and growth of the population of the district. Chairman Stewart then opened the meeting for public comments, pro or con regarding the creation of this district. Kent Jefferies, Kipling 14. Virginia Currin, Calybate Springs 15. Vernon Howell, Route 2, Fuquay - Varina 16. Sue Anderson, Fuquay - Varina 17. W.N. Harper 18. Joyce Andrews, Route 2, Fuquay - Varina Chairman Stewart closed the public hearing at 8:30 p.m. and called to order a meeting of the Harnett County Board of Commissioners. Public Utilities Attorney John Phelps presented to the Board a resolution creating the Northwest Water and Sewer District of Harnett County. Upon motion by Commissioner Collins and seconded by Commissioner Smith, the resolution entitled "Resolution Creating The Northwest Water And Sewer District Of Harnett County" was adopted unanimously. This resolution is copied in full at the end of minutes dated March 23, 1987 as document number 1. ADJOURNMENT There being no further business, Chairman Stewart adjourned the meeting at 8:40 p.m. f/ CLERK .DOCUMENT NUMBER 1. RESOLUTION CREATING THE NORTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY. • WHEREAS, the Harnett County Board of Commissioners (hereinafter "the Board ") at its regular meeting on January 5,1987, resolved that a public hearing be held, pursuant to N. C. Gen Stat. 4 162A -86 et. seq., to consider creation of the Northwest Water and Sewer District of Harnett County; and, WHEREAS, the Board further resolved that the said Public Hearing should be held on Monday, February 16, 1987 and directed the appropriate representative of the County to take the necessary actions to hold the Pub-lie Hearing; and WHEREAS, the Attorney for the County Department of Public Utilities caused the appropriate actions to take place to notice and advertise. the Public Hearing and the said Public Hearing was scheduled as directed by the Board; and WHEREAS, on Monday, February 18, 1987, the weather conditions were of such .a severe nature that the Public Hearing was cancelled; and WHEREAS, the Board at its meeting on February 23, 1987 resolved that the said Public Hearing be rescheduled and be held on Monday, March 23, 1987 at 7:00 o'clock P.M. in the County Office Building, Lillington, Lillington, North Carolina; and WHEREAS, the Board further resolved that the appropriate representatives of the County take the necessary actions to properly notice said Public Hearing as provided by law; and WHEREAS, pursuant to N. C. Gen. Stat. 4 162A -86, a Notice of Public Hearing was prepared stating the date, hour and place of the hearing and its subject and setting forth a description of the territory to be included within the proposed Northwest Water and Sewer District of Harnett County; and, WHEREAS, pursuant to said N. C. Gen. Stat. 162A -86, the Notice of Public Hearing was published once a week for three weeks in newspapers that circulate in the proposed district and posted in at least three public places in the district. The Notices of Public Hearing were posted and published the first time not less that twenty days before the hearing; and, WHEREAS, a public hearing was held at 7:00 p.m. on March 23, 1987, in the Assembly Room at the County Offlee Building, Lillington, North Carolina at which time taxpayers and all other interested persons appeared and were heard concerning the question of creating the Northwest Water and Sewer District of Harnett County; and WHEREAS, the Board, following the public hearing, finds that: (1) There is a demonstrable need for providing in the district water services, or sewer services, or both; (2) The residents of all the territory to be included in the district will benefit from the district's creation; and (3) It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies; and, WHEREAS, the Board recognizes that vital matters to be considered in creating the district are the availability of federal funding and the successful issuance of bonds and /or notes for the purpose of providing funding to provide water and /or sewer to the district, or . portions - thereof,and the number of users who contract to purchase water and /or sewer; and, 25;3 1 WHEREAS, the Board finds that the district shall be defined as set forth In the Notices of Public Hearing and, WHEREAS, the Board now desires to create the Northwest Water and Sewer District of Harnett County. NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners, as follows: 1. It is hereby found that: (a) There is a demonstrable need for providing In the district water services, or sewer services, or both; (b) The residents of all the territory to be Included In the district will benefit from the district's creation; and (c) It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies; and, 2. The Northwest Water and Sewer District of Harnett County Is hereby created as provided above and the said District Is hereby described as follows: BEGINNING at the point where the Harnett County - Chatham County line meets the Wake County line and runs thence from said beginning point along and with the Harnett County - Wake County line in an east, southeasterly direction to the point where the western bank of Neill's Creek crosses said county line; and runs thence along and with the western bank of Neill's Creek the courses and distances of said creek In a south, southwesterly direction to the point where the western bank of said Neill's Creek meets the northern bank of the Cape Fear River; and runs thence along and with the courses and distances of the northern bank of the Cape Fear River in a northwesterly direction to the point where the Harnett County -Lee County - Chatham County lines Intersect; and runs thence along and with the Harnett County - Chatham County line in a northeasterly direction to the point and place of BEGINNING. 9. The Clerk to the Board is hereby authorised and directed to cause this Resolution to be published once in each of two successive weeks In the newspapers in which the Notices of Public Hearing were published, and in addition thereto cause to be published with the resolution a notice as provided in N. C. Gen. Stat. 4 162A -87 (b). The County, and its officers, agents and attorneys are hereby directed to take any further actions as may be required by the laws of the State of North Carolina to perform the matters and things directed by this Resolution.
