HomeMy WebLinkAbout05201985HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, MAY 20, 1985 CALL TO ORDER PRAYER MINUTES APPROVED id The Harnett County Board of Commissioners met in regular session on Monday, May 20, 1985, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart, Rudy Collins, Bill Shaw, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the Board; Bob Jones, representing the County Attorney's Office; and Hollie J. Wade, Recording Secretary, were also present. Chairman Jesse Alphin called the meeting to order at 7:17 p.m. Commissioner Rudy Collins led the evening prayer. The minutes from the Harnett County Board of Commissioners meeting of May 6, 1985, were approved as read. IND. TR. CENTER Wayne Faircloth, Director of the Harnett County Department of Human Resources -- BIDS TO MOVE EQUIP. Manpower informed the Board that his office had requested informal bids for the purpose of moving the machine shop equipment from its present location to the new industrial training center. He reported that he had recieved the following three bids: 1) Tryon Moving & Storage, Inc., 315 South Moore Street, Sanford, NC, in the amount of $12,866; 2) Inco, P. O. Box 2705, Rocky Mount, NC 27802, in the amount of $10,350; and 3) Tom O'Quinn Rigging Service, Inc., 816 Purser Drive, Raleigh, NC 27603 in the amount of $7,550. Following a discussion, Commissioner Shaw made a motion that the informal bid for the moving of the equipment to the Industrial Training Center be awarded to the low bidder, Tom O'Quinn Rigging Services, Inc., in the amount of $7,550; Commissioner Brock seconded the motion and it carried with a unanimous vote. N.E. METRO DISTRICT Mr. Brock reported to the Board that the County has received an agreement for EXTEN. -- ENGINEERING engineering services from Black & Veatch, Inc., in the amount not to exceed $2,500 CONTRACT for engineering services for the extension of the Northeast Metropolitan Water Dis- trict west of Lillington and down old wire road (SR 1769). Commissioner Brock made a motion that the Board approve the agreement with Black and Veatch, Inc., for engineering services for the extension of the Northeast Metropolitan Water District in the amount not to exceed $2,500; Commissioner Stewart seconded the motion and it carried with a unanimous vote. EMPLOYMENT SEC. COMM. RELOCATED Commissioner Shaw reported to the Board that the Employment Security Commission has relocated its office from the County's mobile unit on E. Cumberland Street to their new quarters on North Magnolia Avenue unit. Mrs. Bruckner with the Employment Security Commission has turned the keys to the building back over to the County, and the City of Dunn has indicated that they would like for the County to move this unit from the property its present location as soon as possible. Mr. Brock reported that the county has two options -- either sell the mobile unit or relocate it onto property belonging to the County. Following a discussion, Commissioner Collins made a motion that Commissioner Shaw and M. H. Brock, County Manager, are hereby author- ized to handle any transactions concerning the relocation or selling of the mobile unit formerly used by Employment Security Commission; Commissioner Stewart seconded the motion and it passed with a unanimous vote. QUITCLAIM DEED John Phelps, Attorney, presented to the Commissioners the following quitclaim deed RE: EFFIE MCLEAN concerning the Effie McLean Jackson property to be fully recorded in the minutes: JACKSON PROPERTY NORTH CAROLINA QUITCLAIM DEED HARNETT COUNTY This deed, made and entered into this 7th day of May, 1985, by and between the County of Harnett, a body politic and corporation under the laws and acts of the General Assembly of North Carolina, party of the first part, and Andrew R. Jackson, Sr., as Administrator, C.T.A. of the Estate of Effie McLean Jackson, party of the second part; W I T N E S SET H: THAT WHEREAS, through a series of mean conveyances, decedent Effie McLean Jackson held title to certain lands which at one time had belonged to her mother Jeanette A. McLean and which lands are described in a deed to decedent from her brother -in -law, L.H. Coley, her nephew, L.H. Coley, Jr., and her daughter, Ann Jackson Collins, and their respective spouses which deed appears of record in the Harnett County Registry at Book 408, page 604; and WHEREAS, decedent and her predecessors in title have always burin possession of and exercised dominion and control over said lands and have listed said lands for taxes according to the acreages shown in their deeds and have always paid taxes according to their listings; and WHEREAS, the County of Harnett received a deed on April 6, 1931, for a part of the same lands by deed of record in the Harnett County Registry in Book 247, at page 38; and WHEREAS,. County's Deed was the result of a tax suit. against Mrs. J.A. McLean and husband, John A. McLean, which was instituted in the year 1930 to recover a $23.32 tax obligation for the year 1927 and which suit appears of record in tax suit file A074 in the Office of the Clerk of Superior Court of Harnett County; and WHEREAS, prior to 1930 foreclosure, Jeanette A. McLean had acquired an interest in two tracts of land by inheritance from her first husband, Duncan A.C. McLean, which are described in Division Book 2 at page 19 and in Book Z, pages 77 -79 of the Harnett County Registry and had purchased two additional tracts described in Book 170, page 1 and Book 186, page 173 of the Harnett County Registry; and WHEREAS, the two tracts described in the deed to the County of. Harnett in Book 247, at page 38, are the same two tracts described in Book 170, paged and Book 186, page 173; and WHEREAS, on the 7th day of March, 1925, Jeanette A. McLean a widow, and her son, Duncan McLean, Jr., executed an indenture to The Federal Land Bank of Columbia, South Carolina, mortgaging a parcel of land, the metes and bounds description of which, covers all four tracts listed above, in which four tracts Jeanette A. McLean held an interest; and WHEREAS, said indenture was foreclosed upon and a deed given from Neil McKay Salmon, Commissioner, to the Federal Land Bank of Columbia, South Carolina, which deed is dated November 27, 1929 and which deed appears of record in Book 229, page 474, of the Harnett County Registry; and WHEREAS, the Federal Land Bank of Columbia South Carolina held title to said lands until the lands were deeded to the late Effie McLean Jackson's. sister and predecessor in title, Katherine McLean, on June 23, 1937, by deed which appears of record in the Harnett County Registry in Book 263, at page 171; and WHEREAS, the County of Harnett failed to join the title holder, The Federal Land Bank of Columbia, South Carolina, in its tax suit of record in tax suit file A074 in the Office of the Clerk of Superior Court of Harnett County; and WHEREAS, the County of Harnett has never attempted to take possession of the lands described in its deed of record in Book 247, at page 38 and the party of the second part and its predecessors in title have possessed the lands and claimed them as their own at all times, and; WHEREAS, the party of the second part contends that the County has acquired no interest in the 147 acres described in County's deed of record in Book 247, at page 38, because of County's failure to join the true land owner and the decedent's predecessor in title, The Federal Land Bank of Columbia, South Carolina in'its tax suit; and WHEREAS, the party of the second part and those under whom he claims title have been in adverse possession of the below described lands for more than thirty years as required under N.C.G.S. 1 -35 (1); and WHEREAS, the party of the second part and those under whom he claims title have been in adverse possession of the below described land under color of title for more than twenty one years as required by N.C.G.S. 1 -35 (2); and WHEREAS, party of the second part, to induce party of the first part to settle all matters and things in controversy, has offered to pay to party of the first part the differential in the last six years ad valorem taxes which were levied on the lands aforesaid, as listed by decedent, and the amount of taxes which would have been levied based upon the acreage as will be shown by an accurate survey of the entire tract owned by decedent and further in the the future to list all of said property in accordance with the amount of acreage disclosed by a new and accurate survey; and WHEREAS, party of the -first part desires to settle all things and matters in controversy by reason of the matters and things set out above; and NOW, THEREFORE, party of the first part, for and in consideration of payment of the taxes as aforesaid in the amount of $1,243.05, to them in hand paid, the receipt of which is hereby acknowledged, have remised and released and by these presents do remise, release, and forever quitclaim unto the party of the sencond part and his heirs and assigns all right, title, claim, and interest of the said party of the first part in and to a certain tract or parcel of land lying and being in the County of Harnett and State of North Carolina, in Upper Little River Township, and more particularly described as follows: 1 FIRST TRACT: Beginning at the North Bank of Upper Little River and runs North 42° West 37 chains to D.A.C. McLean's corner; thence North 224° East 224 chains to the rock corner in Squirrel Island; thence South 450 East 14 chains to a stake; thence South 13° East 2 chains to the river; then up the various courses of the river to the beginning, containing 107 acres, more or less. SECOND TRACT: Beginning at a white oak on the North bank of the river D.A.C. McLean's corner, and runs thence North 200 West 12 chains to another of D.A.C. McLean's corners; thence North 224° East 24 chains to a stake and pointers, a corner of the dividing line with the line of Eliza McLean, deceased; thence with said line South 32° East 27 chains and 50 links to a stake and pointers; thence to the beginning, containing 40 acres, more or less. TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges thereunto belonging to him the said party of the second part and his heirs and assigns free and discharged from all right, title, claim, or interest of the said party of the first part or anyone claiming by, through, or under them. Young, Clerk to Board RESOLUTION RE: Commissioner Brock moved for the adoption of the following resolution requesting SEABOARD RAILROAD the State and Seaboard System Railroad not to abandon the spur line from the City ABANDONMENT of Dunn to the Town of Erwin and Burlington Industries, which he read in full; Commissioner Shaw seconded the motion and it carried with a unanimous vote: HARNETT COUNTY, NORTH CAROLINA. RESOLUTION WHEREAS, Harnett County has received notice that Seaboard System Railroad is considering the possible abandonment of the spur line from the City of Dunn to the Town of Erwin and Burlington Industries; and WHEREAS, Burlington Industries is one of the major industries in Harnett County and is vital to our economy, providing over 1,300 jobs to our citizens and produced $559,514 as tax revenue to the County in 1984; and rail service is essential to the operation of the Burlington Plant, shipping coal and cotton to its site; and WHEREAS, the abandonment of this spur line could not only have an adverse effect on our present industry; but would also have a tremendous impact on Harnett County's overall development plan to attract industry into this area. NOW, THEREFORE, BE IT RESOLVED THAT THE HARNETT COUNTY BOARD OF COMMISSIONERS do hereby express its strong opposition to the abandonment of the spur line from the City of Dunn to the Town of Erwin and Burlington Industries; and FURTHER requests the assistance of the North Carolina Department of Transpor- tation to support the continuation of this rail service and requests that Seaboard System Railroad not abandon this stretch of rail. A copy of this resolution shall be forwarded to the Department of Transporta- tion and to Seaboard System Railroad. Duly adopted this the Twentieth Day of May, Nineteen Hundred and Eighty -five. Commissioner Shaw.reported to the Board .. that he had contacted three surveyors to -. survey theoutside- boundar'iesof the property the County is considering leasing for the expansion of the Dunn-Erwin Landfill. Ragsdale Engineering subnntted a proposal in the amount of $4, 750; Eldridge Barefoot submitted a proposal in the amount of $4,200, and another surveyor submitted the price of 25 cents per foot but stated that he would not be able to get to the job for several months. Commissioner Shaw recommended that the County obtain the services of Mr Barefoot to perform this survey. Followinga discussion, Commissioner Stewart made a motion the Mr. Brock and Commissioner Shaw obtain addational proposals for this work and that they are hereby authorized to award the bid for the surveying services to the lowest bidder; Commissioner Collins seconded the motion and it carned with a unanimous vote.` Commissioner Shaw requested to be excused frora the meeting at 8:00 p.m. due to another meeting`heneeded to attend. Commissioner Collins made a motion that the budget for. the Sheriff's Department be amended as follows: Code '.5100- 014,Travel & Meetings, be increased by $2,459 and` Code 5100 -047, Food & Provisions, be increased by $5,400; Commissioner Stewart secondedthe motion and it carried with. a unanimous '.vote. Commissioner Brock made a'motion that.. the Board adopt the following- resolution reappointing Hoover Adams to Serve on the Eastern Carolina Regional Housing Authority;�.'Commissioner Collins seconded the motion and itcarried -with a unanimous vote: CERTIFICATE OF APPOINTMENT OF COMMISSIONER TO THE EASTERN CAROLINA REGIONAL- HOUSING AUTHORITY BY THE BOARD OF COUNTY COMMISSIONERS OF HARNETT COUNTY WHEREAS, the_Board of County. Commissioners of Harnett ;.County,. North Carolina, held a duly authorized meeting on the 20th 1985; and the term of Hoover: Adams, as Commissioner of the East ern Carolina RegionalHousing .Authority ` expireson June 30, 1985; NOW, THEREFORE, pursuant to the provisions of the Housing Authorities Law of the State of North Carolina, and, by virtue of my office as Chairman of the Board of Commissioners, 1Ioover Adams, Dunn, North Carolina, is hereby appointed as Commis- sioner for Harnett County, to serve for the term of five years beginning with the 1st day of July, 1985.
