The Harnett County Board of Commissioners met in regular session on Monday, February
18, 1985, in the Commissioners Room, County Office Building, Lillington, North
Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart, Bill
Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk
to the Board; Robert Morgan, County Attorney, and Hollie J. Wade, Recording Secre-
tary, were also present.

Chairman Jesse Alphin at 7:10 p.m. called-to order the public hearing to obtain
citizens input in reference to Harnett County submitting an application for Community
Development Funds for the Riverside Community Project. Chairman Alphin then recog-
nized M. H. Brock, for comments in reference to the County submitting this applicatior
M. H. Brock; County Manager, informed the public that the purpose of the public
hearing tonight was to obtain citizens input in reference to Harnett County making
application for a community development block grant for the Riverside Community.
Mr. Brock explained that the County submitted an application for funding last year
and had a good project, but the County oversized the project in planning for the
future and this hurt the application. He explained that this would be the first of
two public hearings to be held in reference to making application. Mr. Brock then
recognized Ervin Dobon.
Ervin Dobson, Director of Planning and Community Development, appeared before the
Board and recognized the members of the Planning Board and the residents of the
Riverside Community who were present tonight for the public hearing. Mr. Dobson
explained to the group that the County intends to prepare a small cities community
development block grant of the community revitalization category to be submitted to
the Department of Natural Resources in April for water improvements in the Riverside
Community. Mr. Dobson summarized to the group the project, its financing, the in
come level in the Riverside area, and various other points of interest regarding
this project.
Mr. Brock thanked Mr. Dobson for, his comments and then asked that anyone present who
wished to comment pro or con on Harnett County submitting an application for com-
munity development funding for the Riverside Project to feel free to do so at this
time
Joseph Smith representing the residents of the Riverside Community appeared before
the Board and stressed the need for water in this Community_ He stated that 90
percent of the wells in this area had been condemned, drinking water had to be haulec
in by the residents, the water when used is full of rust, and it just cannot be
used. He stated that he felt poor quality of water in the community is causing
health problems to the residents and he pledged the support of the citizens in the
Riverside Community to help in developing this project.
Mr. Brock thanked Mr. Smith for his comments and asked if anyone else would like to
speak pro or con to this project. After no one else appeared to- comment, Mr. Brock
asked that everyone present who is in favor of the county preparing an application
for community development funds for the Riverside Project to please indicate their
support by raising their hands. Mr. Brock asked that the record show that everyone
present (eighteen persons) raised their hand in support of this project. Mr. Brock
asked that anyone who opposed the project to raise their hand. Mr. Brock asked that
the record show that no one raised their hand in opposition of the project.
M. H. Brock closed the public hearing at 7:30 p.m.
Chairman Jesse Alphin called to order the regular session of the Board at 7:30 p.
Commissioner Shaw made a motion that Harnett County submit an application for a
Community Development Block Grant -- Community Revitilization Category for water
improvements for the Riverside Community, Commissioner Collins seconded the motion
and it carried with a unanimous vote.
Robert Morgan, County Attorney, appeared before the Board and reported that he has
met with J.D. Foust, Director of the Local Government Commission, officials with the
Institute of Government, as well'as representatives from the Association of County
Commissioners in reference to the financing of the County's law enforcement center.
He explained that they have come up with a plan whereby the County can proceed with
the advertisement for bids on the construction of the law enforcement center on a
lease- purchase arrangement utilitizing the plans and specifications that have been
drafted. He stated that the lease would be for a period of not more than ten years.
Mr.' Morgan presented toite Board the following outline in reference to'the financ-
ing of the law enforcement center:
PROPOSAL FOR FINANCING OF LAW ENFORCEMENT CENTER
I. Conveyance of Real Property.
A. Secure passage of a Local Bill by the North Carolina General Assembly
authorizing the sale of Harnett County's real property on which the Law
Enforcement Center is to be constructed.
II. Obtaining approval of the North Carolina Local Government Commission of method
of lease - purchase of Law Enforcement Center.
A. Completion and filing of application.
B. Justification - both necessary and expedient.
III. Locate an interested builder for the Law Enforcement Center.
A. Must have lease with terms and provisions agreeable to both the builder
and the Local Government Commission.
1. Term of lease not less than ten (10) years.
2. Not a debt of the County.
3. Nonappropriation clause.
IV. Competitive bidding.
A. Advertisement required to allow other interested parties to bid.
V. N.C.G.S. 160A -20.
A. Two party transaction contemplated rather than usual three party.
1. County is not borrowing money.
2. Lease - purchase with builder.
A. Discount and assignment of security.
3. Lease - purchase with bank as assignee of bid and as successor in
ownership of property.
The Board asked several questions of Mr. Morgan concerning the financing and con-
struction of the law enforcement center. Mr. Brock explained that the County has
appropriated $250,000 from the one -half cents sales tax funds for the construction of
the law enforcement center this year and anticipates appropriating an additional
$250,000 next year to be generated from the one -half cents sales tax. The Division of
Motor Vehicles has also committed $100,000 for the construction of the law enforce-
ment center. Mr. Brock explained further that when the one -half cents sales tax law
was approved, it required that forty percent is to go to the Board of Education and
the Commissioners committed the remaining sixty percent for the construction of the
law enforcement center. The County plans to finance the lease - purchase of the law
enforcement center from the revenues generated from the one -half cents sales tax.
Following a discussion, Commissioner Shaw made a motion that (1) the county is here-
by authorized to advertise and accept bids for the construction of the law enforce-
ment center and (2) the county is authorized to request our State Representatives to
introduce a local bill authorizing the sale of the County's real property on which
the Law Enforcement Center is to be constructed; Commissioner Collins seconded the
motion and it carried with a unanimous vote.
SUBDIVISION PLAT Ervin Dobson, Director of Planning, presented to the Board a plat for a one -lot sub -
CHARLES D. JOHNSON sivision owned by Charles D. Johnson located in Hector's Creek Township on SR 1427
and SR 1428. He explained that the subdivision plat has been approved by the Plan-
ning Board and the Health Department. Commissioner Collins made a motion that the
afore - described subdivision plat be approved; Commissioner Shaw seconded the motion
and it carried with a unanimous vote.

Commissioner Brock made a motion that the minutes from the Harnett County Board of
Commissioners meeting of February 4, 1985, be approved as were mailed to the Commis-
sioners; Commissioner Shaw seconded the motion and it carried with a unanimous vote.
John Phelps with the County Attorney's Office presented to the Board a resolution
asking that a public hearing be held concerning the creation of the South Central
Water and Sewer District of Harnett County. Mr. Brock stated that, contingent upon
the approval of this resolution by the Board, the public hearing would be held on
March 13, 1985, at 7:30 p.m. in the Assembly Room of the County Office Building in
Lillington. Following a discussion, Commissioner Shaw made a motion that the follow-
ing resolution calling for the public hearing be approved; Commissioner Stewart
seconded the motion and it passed with a unanimous vote:

RESOLUTION AUTHORIZING PUBLIC HEARING CONCERNING
CREATION OP THE SOUTH CENTRAL WATER AND SEWER DISTRICT'
OF HARNETT COUNTY
W I T N E S S E T H
The Harnett County Board of Commissioners (hereinafter "the Board ") has been -
advised by citizens and residents of an area of the County which is described herein
that there is a need for public water and /or sewer facilities therein.
The area of -the County is fully described below and is referred to as the South
Central Water and Sewer District of Harnett County;
BEGINNING at a point in the southern boundary of the Town of Lillington
where the western right of way of the Norfolk and Southern Railway intersects
the said boundary of the Town of Lillington; and runs thence with the western
boundary of the Norfolk and Southern Railway right of way in a southeasterly
direction 29,400 feet, more or less, to a point, said point being located on
said Norfolk and Southern Railway right of way and 1,500 feet, more or less,
Northwest of -and at aright angle to S.R. 1779; and runs thence from said
point in an easterly direction and at a right angle to the Norfolk and Southern
Railway right; of way 1,900 feet, more or less, to a point, said point being
700 feet, more or less, Northwest of-and at a right angle to the centerline
of S.R. ' 1779; thence in southeasterly direction 200 feet, more or less, to a
point, said point being located 500 feet, more.or less, Northwest of and at
a right angle to S.R. 1779; and runs thence in a northeasterly direction
4,400 feet, more or less, along a line which is 500 feet, more or less,

Lower Little River; and runs thence down the courses and distances of the said Lower Little River and
the Harnett - Cumberland county line a distnace of 44,000 feet, more or less, to the point where the
county line leaves the natural boundary of the Lower Little River; and runs thence with the Harnett -
Cumberland county line in a southwesterly direction 12,600 feet, more or less, to the point where
Jumping Run Creek intersects the Harnett - Cumberland county line; and runs thence from said inter-
section of Jumping Run Creek and the said county line in a northwesterly direction, along the eastern
margin of the said creek 20,500 feet, more or less, to the point where the eastern right of way of a
Carolina Power and Light Company right of way crosses the eastern margin of the Jumping Run Creek; and
runs thence in a northerly direction along the Eastern boundary of said power line easement 25,300
feet, more or less, to a point on an unnumbered dead end road; and runs thence in an easterly direction
1,100 feet, more or less, to the centerline of S.R. 1116; and runs thence from the centerline of S.R.

angle to an unnumbered road, and runs thence in a southwesterly direction 1,800 feet, more or less, to
a point; and runs thence in a Northwesterly direction 1,000 feet, more or. less, - along' a line which is
500 feet, more or less, Southwest of and perpendicular to the dead end point of said unnumbered road
to a point; and -runs thence -from said - point in a northeasterly direction 2,100 feet, more or less, to a
point along a line which is southeast of N.C. Highway 210, and 500.feet, more or less, Southwest of
and at a right angle to U.S. Highway 401; and runs thence form said point in a northerly direction
1,800 feet, more or less, crossing N.C. Highway 210 to a point in'the southern boundary of the Town of
Lillington; and runs thence form said point on the Lillington boundary along the- southern boundary of
the Town of Lillington 2,600 -feet, more or less, to a point in the western margin of -the Norfolk and
Southern Railway right of way, which is the point and. place of beginning.
In an effort to satisfy the needs and .desires of the people of the area, the-Board wishes to
consider creation of a water and sewer district to provide water and /or sewer facilities therin.
The Board now desires to hold a public hearing, pursuant to N.C.` Gen. Stat. 162A-86 et.
consider creation of the South Central Water and Sewer District of Harnett County.
NOW THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS THAT:
1. ''A public hearing be held pursuant to. N.C. Gen. Stat'. 162A- 86 :et. seq, to consider creation of
the South Central Water and Sewer- District °of Harnett - County.,
2, The County, and its officers, agents and attorneys are hereby directed to -take such actions
of whatsoever nature and execute such documents as necessary to hold the public hearing herein
described.

Mr. Brock reported to the Board that a committee consisting of Rodney Tart, Director
of Public - Utilities; Hollie Wade, Secretary with the County Manager's Office; as
well as himself received and opened formal bids for the purchase of a hydraulic
sewer cleaning jet for the Utility Department. The following two bids were received
for the bid opening: Cities Supply Company in the amount of $15,978.05 :and jet Vac
Systems in the amount of $18,708.77. Mr. Brock explained that the County received
a third bid from Public Works Equipment and Supply in the - amount of $16,590, but
this bid was received in the mail the day after the bid opening so the County could
not accept it Mr.' Brock reported that after the bids were opened, Mr.'Tart
reviewed them and recommended that.the bid be awarded to Cities Supply Company, Inc.
in the amount of $15,978.05 (Base Bid in the amount of $15,290 plus tax in the
amount of $688.05). The Commissioners questioned whether or not the County had to
pay tax to South Carolina. They stated that this tax should not be paid to South

Following a discussion, Commissioner Stewart made a motion that the County award the
bid to the low bidder -- Cities Supply Company, Inc., for the base price of $15,290
and'that the County Manager be authorized' to negotiate the tax in the amount of
$688.05; Commissioner Shaw seconded the motion and it carried with a unanimous vote.

budget amendments for their consideration. Mr. Brock also presented to the Board
for their consideration a budget amendment to the Central Maintenance Department.
Following the presentation of these amendments, Commissioner Brock made a motion

the motion and it carried with a unanimous vote:

M. H. Brock, County Manager, reported to the Board that Bill Strickland, Captain of
Detectives with the Harnett County Sheriff's Department, appeared before the
Commissioners at its meeting of November 5, 1985, concerning the illegal operations
of pawn shops within the County. Pawn Shops are authorized to operate legally in
the municipalities but not in the County. Mr. Brock explained further that two or
three pawn shops are now operating illegally in the County and the Board at its
meeting of November 5, 1984, stated that when the General Assembly went into session
that the County would need to contact its state representatives requesting them to
amend General Statute 91 -2 whereby Pawn Shops will be allowed to legally operate in
Harnett County. Following a discussion, Commissioner Stewart made a motion that
the County Manager be and he is hereby authorized to send a letter to our State
Representatives asking them to amend G.S. 91 -2 whereby Pawn Shops can operate legal-
ly in Harnett County; Commissioner Collins seconded the motion and it carried with
a unanimous vote.
POLICY RE: USE OF M. H. Brock, County Manager, presented to the Commissioners for their consideration
EMPLOYER PROVIDED Policy Number 85 -4 for Harnett County concerning county employees driving county -
VEHICLE owned vehicles to their place of residence. Mr. Brock explained that this policy
is a result of the recent changes in the IRS travel regulations. Following a
discussion, Commissioner Brock made a motion that the Board adopt the following
policy; Commissioner Shaw seconded the motion and it carried with a unanimous vote:

REFERENCE: USE OF AN EMPLOYER PROVIDED VEHICLE
Section I. - Effective, February 18, 1985, it shall be the policy of Harnett County
that some county departments will allow employees that are on call 24 hours a day,
weekends, and holidays to drive county -owned vehicles to their place of residence
in Harnett County. No employee shall use a county vehicle for personal use.
Section II. - The Department Head shall get the approval from the County Manager for
employees to drive county vehicles to and from their place of employment. The
departments that will comply with this policy are:

POLICY RE: TRAVEL M. H. Brock, County Manager, presented to the Board for their consideration Policy
Number 85 -5 concerning travel for Harnett County employees. Mr. Brock explained'
-that
one of the main differences in the proposed policy and the County's current policy
is that travel - reimbursement for the county employees will be set at 20.5 cents per
mile rather than 20-cents per mile. Mr. Brock explained that the recent ruling of
the IRS only allows the 20.5 cnets per mile reimbursement or if the County pays an
employee anything above this rate, it has to be reported on the employee's W -2 form.
Following a discussion, Commissioner Shaw made a motion that the Board approve the
following Policy Number 85 -5 regarding Travel; Commissioner Stewart seconded the
motion and it carried with a unanimous vote:

Section I. - Travel on-official business'by county officers and employees shall be
reimbursed at the following rates:
(a) for transportation by- privately -owned automobile twenty and one -half
cents (20.5¢) per mile of travel and'the actual costs:of` tolls paid;
(b) for bus, railroad, pullman, -or other conveyance actual- fare
(c)
for subsistence' (the actual amount expended for room, meals and reason --
able gratuities)_ not to exceed a total of forty -five dollars ($45.00)
per day when traveling in -state or a'total'of fifty -five dollars - ($55.00)
per day when traveling out of state
(d) for convention registration fees not to exceed seve
($75.00)
For out-of-state-travel and other travel when anticipated costs can be documented
in advance -by brochures and other reliable sources, the officer or employee may
apply for, prior approval through the department head to the County Manager for an
increase in the allowance specified in the above- paragraph.
Section II_ - A- voucher setting forth itemized expenses on a form approved by the
Finance Officer `shall be completed' and signed byrofficers and employees who apply
for reimbursement' of expenses; this voucher must be approved -by the department head
and submitted to the Finance Office no Later than the 18th of the month. This
travel voucher form must also be approved by the County Manager. County employees'
are responsible each month for keeping a copy of their travel vouchers for tax
purposes.

Section III. - Travel and other expenses will be approved for reimbursement only in
cases where such expenses are incurred at the supervisor's /department head's
approval, and are appropriately documented (i.e., receipts for food, lodging, regis-
tration fees, etc.). Receipts must include name(s), date(s), and amount(s). It is
imperative that each employee maintain accurate records and attach all receipts to
the Travel Voucher when submitted for payment. Payments requested for subsistence
without receipts will not be paid.
Section IV. - Each employee is assigned a duty station. Travel to and from the
employee's home to that duty station will not be reimbursed. Travel from that sta-
tion to any other assigned work station(s), workshop(s), convention(s), etc., will
be paid from assigned duty station to the destination and the return.
Section V. - Subsistence expense is not reimbursable when incurred within Harnett
County unless authorized by the County Manager or the Chairperson of the Board of
Commissioners.
Section VI. The County has no provisions for advance payment for travel unless a
bill from a travel agency, air line, or other responsible agency is submitted.
Section VII. - This policy shall be retroactive to January 15, 1985.

RESOLUTION IN MEMORIAM
WHEREAS, life came to a sudden close for our friend and former commissioner,
William A. " Bill" Warren on November 29, 1984, ending a career which had been
devoted to his fellow man, community, and his county; and
WHEREAS, his service took many forms in many fields, as a distinguished busi-
nessman, as a member of the Summerville Presbyterian Church, as past Master of the
Neil S. Stewart Masonic Lodge, and as a leader and member of many other civic,
county, state, and political organizations and as an individual always interested
in and anxious to work for the betterment of his fellow man and his community; and
WHEREAS, during his long and fruitful life he has always been an active and
loyal Democrat serving his party and his community in many worthwhile activities;
and
WHEREAS, in his passing, the County has lost a valuable and productive citizen
and his community has lost a valued neighbor and his family, a devoted member.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners
in regular session assembled, on this the Eighteenth Day of February, 1985, wish to
express their sense of sorrow and personal loss in the death of Bill Warren, an
esteemed and loved associate; and
BE IT FURTHER RESOLVED that a copy of this resolution be spread upon the min-
utes of this meeting and a copy forwarded to the family of Bill Warren with the
expressed sympathy of the members of this Board.

FIRST MARCH ME ETING Mr. Brock reported to the Board that the NACo Legislative Conference is to be held
POSTPONED in Washington, D.C. on March 2.- 5, 1985. -Mr. Brock informed the Board that he is
planning to attend this Conference and that. the Counties need a lot of support in
order to save Revenue Sharing. Chairman.Alphin- stressed the importance of this
Legislative Conference and encouraged every member of the Board who could to attend
the Conference and help in the fight to-save Revenue Sharing Commissioner Collins
made a motion -that the March 4, 1985, meeting be postponed until March 13, 1985, to
be held after the public hearing scheduled for that night so that any Commissioner
who could attend the NACo Legislative Conference would feel free to do so; Commis-
sioner Shaw seconded the motion and it carried with a unanimous vote.
