HARNETT COUNTY BOARD OF COMMISSIONERSMEETING.APRIL 16, 1984
The Harnett County Board of Commissioners` met in regular session on Monday, April 16
1984, at 7 :30 p.m. in the Commissioners Room, County Office Building, Lillington,
North Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart,
Bill Shaw, Rudy Collins, and Chairman -Jesse Alphin presiding. Vanessa W. Young,
Clerk to the Board,'and Robert Morgan, County Attorney, were also present.
CALL TO ORDER Chairman Jesse A1phin called the meeting to order at 7:30 p.m
PRAYER Commissioner Bill Shaw led the evening prayer.
MINUTES APPROVED- The minutes from the Harnett County Board of Commissioners meeting of April 2, 1984
were approved as read.
AREA III PARK Commissioner Shaw made a motion that the Board adopt the following resolution
RESOLUTION authorizing the development of Area III County Park; Commissioner Stewart seconded
the motion and it carried', with a unanimous vote:

FLATVvOODS FIRE
DISTRICT
BOARD OF, COMMISSIONERS OF HARNETT COUNTY,
WHEREAS, the Land and Water Conservation` Fund Act of 1965 provides for the
making of grants by the Bureau of Outdoor Recreation, Department of Interior of the
United States Government' to States and to local municipalities in support of
Outdoor Recreation projects and such funds are available after approval of the
appropriate State Agency and the Bureau of Outdoor Recreation; and
WHEREAS, the State is' required to insure that there will be no discrimination
against any-person of any race, color, sex, creed, or political affiliation; and
WHEREAS, the Board of Commissioners of Harnett County realizes that recreation
facilities are not adequate to meet the minimum recreational needs of the people
of Harnett County;, and
WHEREAS, it` is believed that said Board with the assistance of the general
public is now in a position to lend full support to the development of a Harnett
County park.
NOW,., THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA:
1. That an application be made to the Bureau of Outdoor Recreation, Depart-
ment of Interior of the U. S. Government through the State of North Carolina for
a development grant of $50,000 which represents fifty percent (SO %) of all costs
($100,000) including preparation, plans, and construction of recreational facili-
ties to be completed in the fiscal year' 1985 -86.
2. That the County Manager, of Harnett County be authorized and directed to
file such application on behalf of Harnett County, to provide additional informa-
tion and to furnish such documents-as may be required by the Bureau of Outdoor
Recreation and the-State of North Carolina and .to act as the authorized correspon-
dent of Harnett County.
3. That the Director, Bureau of Outdoor Recreation, Department of Interior
of the United States Government be, and hereby is assured of full compliance by
the_ applicant with the regulations promulgated pursuant to Title VI of the Civil
Rights Act Of 1964.
Duly; adopted. this `16th day of April; 1984.

Commissioner Shaw reported to the Board that the Commissioners meeting of March
19, 1984, a resolution was brought before the Board concerning the division of
Flatwoods Fire District, -which "the Board tabled. Since that meeting, it was
determined thatcbefore a division of the district tax revenue could take place,
that the membership of the Flatwoods Community Fire Department, Inc;, would have-
to vote to accept the division of their fire department corporation and its
financial obligations.' On April 6, 1984, this division was voted on by the
membership of the Flatwoods Community Fire Department and it -was voted down.
The vote was 113 opposed to the division and 77 for the division.

DIRECTORY OF CO. Vanessa W. Young, Clerk to the Board, presented to the Commissioners a book which
COMM. /BOARDS she composed consisting of the members and bylaws of all the Committees /Boards for
PRESENTED TO BOARD Harnett County. The Board commended Mrs. Young on the preparation of this book and
stated that they felt it would be most beneficial to them and to the various agencies
of the County.
NATIONAL CONSUMERS Commissioner Collins made a motion that the Board adopt the following resolution
WEEK proclaiming the week of April 23 -29, 1984, as National Consumers Week in Harnett
County; Commissioner Brock seconded the motion and it carried:

RESOLUTION
WHEREAS, our President has proclaimed the week beginning April 23, 1984, as
"National Consumers Week:" and
WHEREAS, a major function of our competitive free market system is to satisfy
consumer demand; and
WHEREAS, everyone is a consumer but too often this role is the most neglected
in terms of preparation and training; and
WHEREAS, consumers should have access to a wide assortment of competitively
priced goods and services produced here and abroad, accurate information on product
content and care, on contractual agreements, on the cost of credit... essentially
whatever facts are needed to make an informed choice; and
WHEREAS, it is clear that the greatest fairness for consumers can be achieved
through the active cooperation of business, government, and consumers themselves
working together to insure equity, increased competition, and safety in our free
market economy; and
WHEREAS, National Consumers Week will promote dissemination of sound consumer
information by both public and private sectors, including the media, on subjects
such as complaint handling and on public policy issues which affect consumers;
encourage dialogue and cooperation among consumers, business and government; and
broaden the scope of consumer and economic education by heightening consumer
awareness that we function in a world market- that our interdependence extends far
beyond the boundaries of the United States;
NOW, THEREFORE, I, Jessie Alphin, County Commissioner Chairman, do hereby
designate April 23 -29, 1984 in the County of Harnett NATIONAL CONSUMERS WEEK.

Erwin Dobson, Director of Planning, presented for the Board several subdivision
plats.
Commissioner Stewart made a motion that the subdivision plat for Alton J. Harrington
Subdivision, 3 lots, located in Barbecue Township, off U. S. Highway 87 and SR 1205
be approved; Commissioner Shaw seconded the motion and it carried.
Commissioner Brock made a motion that subdivision plat for Phil Williford and wife,
Diane T. Williford, 1 lot, located in Grove Township, off SR 1546 be approved;
Commissioner Collins seconded the motion and it carried.
Commissioner Stewart made a motion that the subdivision plat for David H. Robertson,
and wife, Jacqueline M. Robertson, 1 lot, located in Barbecue Township, off SR 1139
be approved; Commissioner Shaw seconded the motion and it carried.
Commissioner Stewart made a motion that the subdivision plat for James V. Stancil,
located in Upper Little River Township, off SR 1234, be approved, Commissioner
Brock seconded the motion and it carried. Buyer for this lot is Kenny Byrd.
Commissioner Collins made a motion that the subdivision plat for Jesse C. Campbell,
located in Black River Township, off NC 210, be approved; Commissioner Shaw
seconded the motion and it carried.
Commissioner Collins made a motion that the subdivision plat for Alvin C. and Iva W.
Newton, located in Neills Creek Township, off SR 1535, be approved; Commissioner
Brock seconded the motion and it carried.
The Statement of Investments and Expenditure Reports for the period ending March 30,
1984, were filed with the Board.
M. H. Brock, County Manager, informed the Baord that Tom Lanier, Emergency Manage-
ment Coordinator, plans to retire on April 30, 1984. The Board appointed a commit-
tee consisting of M. H. Brock, County Manager; Lloyd G. Stewart, and Rudy Collins
to advertise for this position and bring their recommendation back to the Board.

MEETING RECESSED
There being no further business, Chairman Jesse Alphin recessed the regular
meeting of the Board to be reconvened on Thursday, April 19, 1984, at 10:00 a.m.
for the purpose of holding a public hearing concerning the approval of the issuance
of revenue bonds to finance an industrial project in Harnett County.
RECOVENED MEETING
The.Harnett County Board of Commissioners met in a reconvened session of the
Board in the Commissioners Room,, County Office Building, Lillington, North Carolina
with the - following members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy
Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clark to the
Baord, and Dwight Snow representing the 'County Attorney's office, were also present
Chairman Jesse Alphin reconvened the meeting at 10:00 a.m. from the April 16, 1984;
meeting.
PRAYER
PUBLIC - HEARING
INDUSTRIAL REVENUE:
BONDS; N.W.D. PRO-
JECT
Commissioner Shaw led the morning prayer.
Chairman Alphin then recognized M. H. Brock, County Manager. Mr-. Brock stated
that pursuant to Chapter 159C of the General Statutes of North- Carolina and the
regulations thereunder, he had been advised that. The Harnett County Industrial
Facilities and Pollution Control Financing Authority (the "Authority ") intends to
file shortly with the Secretary of the Department of Commerce of North Carolina an
application fax of an industrial project in Harnett County, North Carolina
consisting of the acquisition of a manufacturing facility, together with related
equipment for the processing and canning of food' products (the "Project ") located
at 1000 South Fayetteville Avenue in Dunn, North Carolina., to be used by N.W.D.
Associates, Incorporated, a North 'Carolina corporation (the "Company"), a wholly
owned subsidiary of Moody Dunbar, Inc., a Tennessee corporation headquartered in
Limestone, Tennessee, and to be financed for the compnay by the issuance of
approximately $2,500,000 aggregate principal amount of bonds of the Authority.'
Since such "application fax approval cannot, under regulations of the Department
of Commerce, be officially received until, among other things the Board of County
Commissioners has, by a resolution after having -held a public hearing, approved
the issuance of the bonds for the proposed Project and approved the Project in
principle,` the Authority has recommended and requested that the Board adopt such
resolution, Copies of the Authority's resolution. evidencing its intent to finance
the Project with an issue of its revenue bonds and the. Memorandum o£ Inducement
between the Authority and the Company were presented to the Commissioners. Mr.
Brock then stated that a notice had been published by the Clerk to the Board of
- County Commissioners on the 3rd day of April, 1984, stating that the Board would
hold a- public hearing on April 19,'1984,.at 10 o'clock a.m. or as -soon thereafter'
as the matter might be heard on the proposed revenue bond issue and the Project
(the "Notice ").
Chairman'Jesse Alphin closed the regular meeting of the Board and called to order
the public hearing. He announced that the Board would hear anyone who wished to
be heard on the advisability of issuing the revenue bonds and the Project at this
time The names and addresses of the persons who were. present and summaries of
their comments are follows:
Dwight Snow of the Dunn office of Morgan, Bryan, Jones and Johnson,. attorneys for
the Authority, explained that before the Application can be filed with the Depart-
ment of Commerce the Board of Commissioners must hold a public hearing and
approve the Project in principle,
Nancy Bartlett of the.Rocky Mount office of Spruill, Lane, Carlton, McCottex, and
Jolly explained the average weekly manufacturing wage test as. it applies to indus
trial revenue bond financing and. informed the Board that the operation of the
project may pay an average weekly manufacturing wage which is below the average
weekly manufacturing wage paid in Harnett County. She informed the Board that
the Secretary of 'the Department of Commerce can approve the- project notwithstanding
the fact that the operator, will pay an average weekly manufacturing wage which is
below the. average weekly manufacturing wage paid in the County if the governing
board of the county passes a resolution' requesting that the Project be approved
notwithstanding the fact that the operator may not pay ;a wage above the average
weekly manufacturing wage. paid in.the.county and if the county has experienced
especially severe' unemployment which is defined as unemployment which exceeds 8 %.
The unemployment rate for Harnett County for the calendar year ended December 31,

1983, was 9.3 percent.
Wayne Dail of Dunn, the plant manager for the Project discussed the project in
detail and described Moody Dunbar, Inc. He stated that the current employees are
pleased that Moody Dunbar, Inc., the parent of N.W.D. Associates, Incorporated, is
purchasing the facility. He pointed out the considerable secondary economic impact
which the project has on the surrounding area and in response to a question from the
commissioners stated the purchase of local produce will continue on the same basis
as past purchases.
After no one else appeared to speak concerning this project, Chairman Jesse Alphin
closed the public hearing and called the regular meeting of the Board back to order.
RESOLUTION Commissioner Rudy Collins introduced the following resolution which was read:
INDUSTRIAL REVENUE RESOLUTION APPROVING THE ISSUANCE BY THE HARNETT COUNTY INDUSTRIAL FACILITIES AND
BONDS, N.W.D. POLLUTION CONTROL FINANCING AUTHORITY OF ITS TWO MILLION FIVE HUNDRED THOUSAND
PROJECT DOLLAR INDUSTRIAL REVENUE BONDS (N.W.D. ASSOCIATES, INCORPORATED, A WHOLLY OWNED
SUBSIDIARY OF MOODY DUNBAR, INC.) TO FINANCE AN INDUSTRIAL PROJECT IN HARNETT COUNTY,
NORTH CAROLINA, FOR N.W.D. ASSOCIATES, INCORPORATED AND APPROVING SUCH PROJECT IN
PRINCIPLE.
WHEREAS, the Board of Commissioners of the County of Harnett has created a
political subdivision and body corporate and politic of the State of North Carolina
known as The Harnett County Industrial Facilities and Pollution Control Financing
Authority (the "Authority "); and
WHEREAS, the Authority is authorized under the Industrial and Pollution
Control Facilities Financing Act, Chapter 159C of the General Statutes of North
Carolina (the "Act "), to issue revenue bonds for the purpose, among others, of
paying all or any part of the costs of any industrial or pollution control project
for industry; to acquire, construct, improve and equip any such project; and to
make and execute financing agreements, security documents and other contracts and
instruments necessary or convenient in the exercise of such powers; and
WHEREAS, the Authority is determined to issue its revenue bonds to pay all or
a portion of the costs of the acquisition of an industrial project in Harnett County
to be used for the processing of food products by N.W.D. Associates, Incorporated,
a wholly owned subsidiary of Moody Dunbar, Inc.; and
WHEREAS, the Authority intends to file an application for approval of the pro-
ject with the Secretary of the Department of Commerce (the "Department "), as required
by the Act; and
WHEREAS; the Department has, by regulation, provided that no application for
approval of a project will be officially received until the governing body of the
county from which the application is made has, by resolution after having held a
public hearing, approved the issue of revenue bonds and approved in principle the
Project and a certified copy of such resolution has been provided to the Department;
and
WHEREAS, the Board of County Commissioners, pursuant to public notice duly
given, has held a public hearing on the proposed revenue bond issue and the Project
and has considered the comments of persons who requested to be heard; and
WHEREAS, the Board of County Commissioners desires to approve the issuance of
revenue bonds and approve the project in principle; and
WHEREAS, the North Carolina Administrative Code Section .0303(d) (1) provides
that the governing body of the county may submit a resolution approving a Project
notwithstanding the fact that the operator may not pay an average weekly manufactur-
ing wage which is above the average weekly manufacturing wage paid in the county
if the county has experienced especially severe unemployment for the most recent
calendar year; and
WHEREAS, unemployment in Harnett County for the calendar year ending December
31, 1983 averaged 9.3 percent;
NOW THEREFORE, be it resolved by the Board of Commissioners of the County of
Harnett as follows:
1. The issuance of revenue bonds by the Authority to finance the project is
hereby approved;
2. The Project is hereby approved in principle;
3. The Board hereby requests and recommends that the Project be approved by
the Secretary of the Department notwithstanding the fact that operator may not pay
an average weekly manufacturing wage which is above the average weekly manufacturing
wage paid in Harnett County;
ADJOURNMENT
4.' The Clerk of the Board of Commissioners is hereby authorized and directed
provide a certified copy of this resolution to the Department; and

5. This resolution shall take effect immediately upon its passage.
Commissioner Bill Shaw moved the passage of the foregoing resolution and Commis-
sioner Lloyd G. Stewart seconded the motion. The resolution was passed by the
following vote: -Ayes: Alphin, Brock, Stewart, Collins, and Shaw
Noes: None
There being no further business, the Harnett County Board of Commissioners meeting
of April 19, 1984, duly adjourned at 11:00 a.m.:
