2nd READING AMEND.
The Harnett County Board of Commissioners' met in regular session on Monday, Decem-
ber 19, 1983, in the Commissioners Room, County Office Building, Lillington, North
Carolina, with the following members present: Lloyd G. Stewart, M. FL Brock, Bill
Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk,
to the Board, and Robert Morgan, County Attorney, were also present.
Chairman Jesse Alphin called the meeting to
order at 7:30 p.m.
Delmore Williamson led the evening prayer.
The minutes from the Harnett County Board of Commissioners meeting of December, 5,
1983, were approved as read.
Alvis George, Architect with Moore, Gardner F, Associates, presented to the Board
a summary on the bids received December 13, 1983, on the.Industrial Training
Center. Mr. George stated that the base bids' totaled $288,856,_�and this price
does not include any of the alternates.' Mr. Brock informed the Board that the - total cost for the base bids was approximately $3,500 above the budgeted amount
for this fiscal year Following a discussion of the bids and comments from the
Advisory Board for the Industrial Training Center, Commissioner Collins made a
motion that the County award the contract for the General Base Bid to the low
bidder,:Tri- State. Consultant, Inc., 3B Terrace Way, Suite 106, Greensboro, NC
27403, in the amount of $209,498;, award' the base bid for the plumbing contract to
Acme Plumbing 4 Heating Company, Inc., 326 West Geer Street, Durham, NC 27702, in
the amount of $21,447, award the base bid for -the electrical contract to D. L.
Johnson Electric Company, :Inc., Rt. 5,- Box -114D, Wilson, NC 27893, in the amount,
of $37,911; and the base bid for the HVAC Contract to Comfort Contractors, Inc.;
T. O. Box 2206, Salisbury, NC 28144, in the amount of $20,000; Commissioner
Shaw seconded the motion and it carried.` It was explained that these awards for
the contracts were only for the base bids and did not include any alternates. It
was. also_-:` discussed that the County would construct the septic tank and wastewater
system (Alternate G 2), and this alternate would not be put back out for bids.
Commissioner Brock made a motion -that the Harnett County Board of Commissioners
INSPECTION ORDIN. does hereby pass on its second reading the amendment to the Harnett County
Ordince entitled: "An Ordinance Establishing the Adoption, Administration,
and Enforcement of the Hereinafter Described Codes and Ordinances along with the
Authority -and Duties of the Inspection Officials" which was passed on its first
reading by the Board at its meeting of December 5, 1983, and is duly recorded in
Book 15, Rages 348-350; Commissioner Shaw seconded the motion and it
carried.
PINES SUBDIVISION
PLAT
AMENDMENT TO
CONTRACT RE: APRON
EXPANSION
Commissioner Shaw made .a Motion that the Pines Subdivision .Plat, Section I, located
off SR 2027 in Stewarts Creek Township, be approved, Commissioner Collins seconded
the motion and it carried.
Commissioner Collins made a motion that the following amendment to the Contract
with Talbert, Cox '$ Associates, regarding the Apron Expansion be approved;
Commissioner Shaw seconded the motion and it - carried:

AMENDMENT NO 1
This- Agreement Made and entered into the 15th day, of September, 1982, by
and between Harnett County, North Carolina, OWNER, and Talbert, Cox F; Associates,
Inc., hereinafter referred to as the ENGINEER; is hereby amended as follows:`
I. on Page 1 Project Description, Item C is revised to -read "Apron
Expansion and Stub Taxiway - Provide-services under Project Development
Design Phase and Construction Phase for the expansion of the aircraft
parking apron and connecting taxiway from the- apron to the runway. Provide
for updating of plans and specifications for Federal participation and
provide for separate bidding and negotiation due to change of funding
II. Page 2 - Schedule of Fees, Item C is revised to read:

Commissioner Collins made a motion that Gordon Springle, 101 Derrick Dr., Angier, NC
27501, be reappointed to a four -year term on the Library Board, and Margaret
McDougald, Lillington, NC 27546, Faye Etheridge, Box 295, Lillington, NC 27546;
and Gail Cogdail, Box 215, Buies Creek, NC 27506, be appointed to a four -year term
on the Library Board; Commissioner Shaw seconded the motion and it carried.
CERTIFICATION RE: Commissioner Brock moved that the Board adopt the following certification concerning
DUNN FIRE DEPT. the Dunn Fire Department, Commissioner Stewart seconded the motion and it carried.
CERTIFICATION OF THE FIRE DEPARTMENT
BY ITS GOVERNING BODY
WHEREAS, G.S. 118 -23 requires certification to the North Carolina Commissioner
of Insurance as to firemen and fire departments in compliance with minimum condition
precedent to the eligibility of firemen and volunteer firemen for benefits under
the North Carolina Firemen's Pension Fund Act, the undersigned certifies to the
North Carolina Commissioner of Insurance that:
(1) Averasboro Fire District, North Carolina, is a Municipality ( ), County
Fire District ( ), or Sanitary District ( ), of this state having a bona fide fire
department which operates fire apparatus and equipment of the value of the value of
five thousand dollars ($5,000.00) or more, and said fire department holds drills
and meetings not less than four hours monthly:
(2) The persons names on the attached roster are regular and /or volunteer
firemen of the fire department described in (1) above, and said firemen attend at
least thirty six hours of all drills and meetings of said fire department in each
calendar year.
(3) This certification was duly approved and adopted by the governing body of
Harnett County, North Carolina at a meeting held on the 13th day of December, 1983,
and the undersigned was directed to execute and forward a copy of same to the North
Carolina Commissioner of Insurance.

RESOLUTION TO Mr. Brock reported that the County and the City of Dunn held a parade Saturday,
SERVICEMEN WHO December 17, 1983, in honor of the service men from Harnett County who have served
SERVED IN BEIRUT in Beirut. Mr. Brock stated that the County presented a resolution to Corporals
McLean & Thompson in their recognition. Commissioner Collins made a motion that
this resolution be adopted by the Board and made a part of these minutes; Commis-
sioner Stewart seconded the motion and it carried.

NORTH CAROLINA NORTH CAROLINA
RESOLUTION
We, the people of this County would like to take this opportunity to express
our appreciation and gratitude to you, Lance Corporal Rupert McLean and Lance
Corporal Earl Thompson, for the services you have rendered to our Nation during
this time of conflict in Beirut.
You and the others who are serving or have just come back from Beirut are
among our most recent heroes, and we are proud of you and the manner in which you
carried on with the same dedication and valor as your colleagues before you.
May we remember that the dedicated service of these men is in defense of our
freedom: and if we understand that they put their lives on the line so we might
enjoy justice and liberty, then their sacrifices are not in vain. This is our
obligation, and this has been the spirit of America since its beginning.
It is both fitting and proper that a special day be set aside to pay tribute to
their deeds as well as to honor them. Today, this special day of commemoration
provides not only an occasion for expression of patriotic unity, but also a rededi-
cation of our efforts to achieve the ultimate goal of honorable world peace.
Now, Therefore, we the citizens of Harnett County and the City of Dunn do
hereby thank you for proving there are young men who feel so strongly about this
nation that they are willing to risk their lives in its defense. We applaud the
example you have set and the dedication you have shown.
We further recognize this day in your honor, and we call upon all citizens
to observe it in recognition of Lance Corporal McLean and Lance Corporal Thompson
for their services in the U. S. Military Forces and in protecting the freedom of
every American.

Commissioner Collins made a motion that the Board adopt the following mutual Aid
agreement, which would be entered into by the Harnett County Sheriff's Department
with the Sheriff's Departments of the surrounding counties. Commissioner Stewart
seconded the motion and it carried:
'CONTRACT
THIS CONTRACT made and entered into this dya of
19 , by and between the Sheriff of Harnett County and the
WITNESSETH:
Pursuant to G. Sc 160A -288, as mended, the undersigned do hereby covenant and
agree to provide temporary assistnace to each other in enforcing the laws of the
State of North Carolina when requested in writing to do so and upon approval by the
Sheriff of Harnett County and Sheriff or Chief of the undersigned agency.
Both parties acknowledge mutual benefit in the form of enhanced law enforcement
capabilities and efficiency within the jurisdictions of both agencies which inures,
to the benefit of both, each signature affixed below in reliance upon the other.
The terms and conditions of this agreement shall be as follows:
1. As provided by G. S. 160A -288, either agency may request of the other the
temporary lending;of personnel, equipment, and - Supplies.
2. Such request shall be in writing and executed by the Chief or Sheriff of the
Requesting Agency or, in his absence, by such other person as has been desig-
nated to make or grant such requests. Provided further, that where a request
is made on an emergency basis, the execution of this contract shall be deemed
the; required written request': and the Requesting Agency- shall:furnish the`
specific request in writing as soon as practicable.
3. While on duty with the Requesting Agency, a late enforcement Officer shall be
subject to the lawful operational commands of the officer in charge of the
division to which he is temporarily assigned and shall operate under his
direct supervision.
4. The officer in charge of the division to which the Assisting Agency's officer
is temporarily assigned shall provide a weekly report to the officer in charge
of the division of the Assisting Agency to which the temporarily assigned
officer is permanently assigned. Such report shall contain a daily breakdown
of the numbers of hours worked and the assignments performed by the temporarily
assigned officer.
5. The borrowing agency shall furnish the temporarily assigned officer with the
money, equipment, and personnel reasonably necessary to perform his assigned
duties; however, the temporarily assigned officer shall report for work with
the equipment issued to him by his employer. The loaning agency may furnish
equipment and supplies to the borrowing agency.
6. For personnel and administrative purposes, the temporarily assigned officer
shall remain under the control of the Assisting Agency and shall be entitled
to Workman's Compensation and other benefits to which he would be entitled
wer he functioning within the normal course and scope of his duties with the
Assisting Agency.
7. Any disciplinary actions arising out of the temporary work assignment of
any loaned officer will remain the responsibility of the Assisting Agency.
At any time, the officer in charge of the division to which any temporarily
assigned officer is assigned may relieve such officer of his duties and such
officer shall immediately forward a written statement setting forth the reason
for such action to the officer in charge of the division to which that officer
is permanently assigned within the Assisting Agency.
8. The Requesting Agency specifically covenants and agrees to assume all
liability for any act committed by the temporarily assigned officer within
the course and scope of his temporary assignment, and further agrees to hold
harmless and indemnify the Assisting Agnecy for any damages, including the
payment of attorney's fees, incurred by the Assisting Agency pursuant to
such temporary assignment.

9. In addition, the Requesting Agency agrees to hold harmless the Assisting Agency
for any damage to the property of the Requesting Agency incurred in the course
and scope of the temporarily assigned officer's duties. Further, the
Assisting Agency agrees to hold the Requesting Agency harmless for any damage
to the property of the Assisting Agency occasioned by such act. This agreement
shall not be construed as a bar to any other rights or claims, either direct
or by subrogation, which either agency shall have against any other party.
10. While on duty with the Requesting Agency the temporarily assigned officer of
the Assisting Agency shall have the same jurisdiction, powers, rights, privi-
leges, benefits and immunities as the officers of the Requesting Agency in
addition to those which he normally possesses.

Agency
Robert Morgan, County Attorney, reported to the Board on the County's Public
Liability Insurance. He stated that in 1979, the County purchased public liability
coverage from the James F. Jackson company through an insurance program made
available by the N. C. Public Officers and Employees Liability Insurance Commission.
This commission was created by Governor Hunt, N. C. League of Municipalities,
and the North Carolina Association of County Commissioners to help municipalities
and counties obtain and keep professional liability insurance for law enforcement
officers and public officials, Prior to the creation of this Commission, the cost
of this insurance was prohibitive if counties could even find a company willing
to write the coverage. When the Commission first accepted bids for this coverage,
it awarded a three -year contract to James F. Jackson, agents for Republic Insurance.
After this first three -year contract, the Commission accepted new proposals for
the insurance eoverage and awarded the second three -year contract to The Hunt
Agency, agents for National Union Insurance. The main difference in the Republic
Insurance and the National Insurance is that the Republic had only claims -made
coverage, which means that a claim will only be covered if it is reported to
the company during the policy period whereas the National Union Insurance offered
through the Hunt Agency has the occurrence form which means it covers any act
transpiring during the policy period and there is no restriction for reporting the
claim to the company, even if discovered 30 years later from the date of occurrence,
it will still be covered. Mr. Morgan explained that the problem that has occurred
in the transition from the Republic claims made policy to the National Union
occurrence form is a gap in coverage for the years the County had the Republic claims
made policy. Mr. Morgan continued to explain thattheCounty can purchase a
retroactive coverage policy from the Hunt Agency which would provide complete
protection for Harnett County from all claims not barred by the Statute of Limita-
tions. Mr. Morgan stated that this would be a one time only purchase. Commissioner
Collins made a motion that the County purchase this retroactive coverage for
two years from the Hunt Agency at a one -time premium of $3,274.43; Commissioner Shaw
seconded the motion and it carried.
ADJOURNMENT There being no further business, the Harnett County Board of Commissioners meeting
of December 19, 1983, duly adjourned at 8:55 p.m.
