HomeMy WebLinkAbout05021983 (2)SPECIAL MEETING, MAY 2, 1983, ANDERSON CREEK AMBULANCE AND RESCUE SERVICE DISTRICT PRAYER PUBLIC HEARING CALLED TO ORDER REPORT ON DISTRICT PERSONS ASKED TO SPEAK PRO OR CON PERSONS APPEARED BEFORE THE BOARD PUBLIC HEARING CLOSED CERTIFICATION THAT NOTICE OF SPECIAL MEETING WAS ADVER- TISED AFFIDAVIT THAT PUBLIC HEARING WAS ADVERTISED CERTIFICATION FROM TAX SUPERVISOR THAT NOTICE OF PUBLIC HEARING WAS MAIL TO PROPERTY OWNERS The Harnett County Board of Commissioners met in special session on Monday, May 2, 1983, at the Anderson Creek Fire Station for the purpose of holding a public hearing regarding the establishing of the Anderson Creek Rescue Service District. The following Commissioners were present: Jesse Alphin, Lloyd G. Stewart, M. H. Brock, Bill Shaw, and Rudy Collins. Vanessa W. Young, Clerk to the Board, and Robert Morgan, County Attorney, were also present. Rev. George Fitzpatrick led the evening prayer. Chairman Jesse Alphin called the public hearing to order at 8:00 p.m. and asked Bucky Barbour to give a summary of the Report on the Anderson Creek Rescue Service District. Following the presentation by Mr. Barbour, Chairman Alphin asked that any one present who would like to speak pro or con to the establishment of this district to feel free to do so at this time. The following persons appeared before the Board and spoke in favor of the district: Mr. McKoy, Alice Richardson, George Fitzpatrick, Faye Dempsey, Faye Griffin, Bucky Barbour, Max Miller, Floyd Hines, Thomas Young, Vicky West, Betty Strickland Rhonda Derrell, Janice Parker, Eddie Derrell, Jim Richardson, and Grady Thomas. No one spoke against the creation of the District. After giving everyone present, an opportunity to speak, Chairman Jesse Alphin closed the public hearing at 8:30 p.m. and called the special meeting of the Board to order. M. H. Brock, County Manager, presented a certification that notice of the special meeting of the Harnett County Board of Commissioners held tonight -- Monday, May 2, 1983 -- concerning the proposed Anderson Creek Rescue Service District was duly advertised in the Harnett County News on April 27, 1983 and posted in the Courthouse. M. H. Brock, County Manager, presented to the Board the publisher's affidavit that notice of the public hearing on the Anderson Creek Rescue Service District was duly given. The following certification was presented on behalf of the Tax Supervisor: "I, Thomas Allen, Tax Supervisor for the County of Harnett, do hereby certify that to the best of my knowledge notices were mailed by Friday, April 1, 1983, to the owners of property within the boundaries of the proposed Anderson Creek Rescue District stating that a public hearing will be held on May 2, 1983, at 8:00 p.m. for the purpose of hearing matters relevant to the creation of the Anderson Creek Rescue District. Presented to the Harnett County Board of Commissioners, this the Second Day of May, Nineteen Hundred and Eighty- three." RESOLUTION ESTABLISH- M. H. Brock, County Manager, presented the following resolution establishing ING ANDERSON CREEK the Anderson Creek Rescue District: RESCUE DISTRICT RESOLUTION ESTABLISHING ANDERSON CREEK RESCUE DISTRICT THAT, WHEREAS, a report concerning a proposed Anderson Creek Rescue Service District which is comprised of the entire Anderson Creek Township was filed with the Board of Commissioners of Harnett County on February 21, 1983 and WHEREAS, the Board of Commissioners of Harnett County called a public hearing to be held on March 24, 1983, and it having been cancelled by reason of inclement weather; and WHEREAS, the Board of Commissioner of Harnett County on March 31, 1983, reset a public hearing to be held on May 2, 1983, at 8:00 p.m. at the Anderson Creek Fire Station on S. R. #1121 in the Anderson Creek Community, in Anderson Creek township, Harnett County, North Carolina; and WHEREAS, the Commissioners directed the Clerk to publish a copy of the Notice of such hearing in the Harnett County News at least one week prior to the hearing date; that an affidavit from the editor of the Harnett County News has been filed with the Clerk to the Board of Commissioners showing that such notice was duly given; and WHEREAS, the tax supervisor was directed to mail a copy to all property owners within the boundaries of the proposed district as shown on the county tax records as of January 1, 1983 and said supervisor has filed his Certificate of Service with the Board; and WHEREAS, the hearing was held at the stated time and place and the following persons appeared and spoke for the proposed district: Mr. McKoy, Alice Richardson George Fitzpatrick, Faye Dempsey, Faye Griffin, Bucky Barbour, Max Miller, Floyd Hines, Thomas Young, Vicky West, Betty Strickland, Rhonda Derrell, Janice Parker, Eddie Derrell, Jim Richardson, and Grady Thomas;and ACTION RESOLUTION CALLING FOR REFERENDUM ON SAID DISTRICT WHEREAS,, there was no opposition' voiced to the proposal; and WHEREAS, the Commissioners' having fully considered the views Of those who appeared at the hearing and having duly considered the facts presented in the report filed with the Board on February 21, 1983, regarding the establishment of .a proposed Anderson Creek Rescue District and having specifically considered those facts set forth in Part II of the report regarding standards, the Board ', finds and concludes that ▪ There.is a demonstrable need for providing emergency ambulance and rescue services in the area of Harnett County known and defined as the Anderson Creek Rescue District. . is impossible or impractical to provide such services on a county wide basis. It is economically feasible to provide the proposed services for the proposed district without unreasonable or burdensome annual tax levies. 4' There is a demonstrable demand for the special district by persons residing in the district. NOW, THEREFORE, be it resolved by the Board of Commissioners of Harnett County that Anderson Creek Rescue District is hereby established and defined, as follows: A. Boundary or Area to be Served: The area to be served by -the Anderson Creek Rescue District shall be that area of Harnett-County-no described and defined as the Anderson Creek Township. B. "Name of the Service District. The service district 'shall be known as "Anderson Creek Rescue District ". C. :Specific Services to be Provided. The services -shall be limited to the following: Ambulance and Rescue Services. D. Plan. The plan for providing such services shall be in accordance with plan set forth in the report dated February 21, 1983, heretofore filed with the Clerk to the Board of Commissioners by Grady Thomas, President, Anderson "Creek Fire and Rescue, Inc. There upon motion of Commissioner Brock, seconded by Commissioner Shaw, the foregoing resolution passed Upon the following vote -Ayes: Commissioners Alphin, Stewart, Brock, Shaw and Collins. Noes: None, Absent: None. Abstained: None. M. H. Brock, County Manager, presented the following resolution calling for a referendum on -a special tax levy for the Anderson Creek Rescue Service District.; BE IT RESOLVED by the Board of Commissioners for the County of Harnett : Section 1: A special property tax referendum is hereby called to be held between 6 :30 p.m. and 7:30 p.m, on Tuesday, June 21, 1983, at whichtime there shall be submitted to the qualified voters of the Anderson Creek Rescue District comprised of the entrie Anderson Creek Township, the question stated in the Notice of Special Property Tax Referendum set forth in Section 3 of this resolution: Section 2: For said referendum, (i) the regular registration books for. elections in the precinct or precincts identified in Section 3 of this Resolution shall be used and the registration books, process or records shall be used and the registration books, process or records shall be open for the registration of qualified persons and for public inspection in the manner, under the conditions and at the times and places as provided in said notice set forth in Section 3 of this resolution, (ii) the registrars, judges, and other officers, of elections appointed by the County Board of Elections of Harnett County for said precincts and voting places, and (iii) the precinct and voting places shall be the ones fixed'by said County Board of Elections'as'.provided in said notice set forth in Section 3 of this resolution, subject to- change as provided by law. The County Board of Elections is hereby requested to conduct said referendum and to have all necessary. steps to that end in accordance with the provisions of this section. Section 3: The County Auditor and ex- officio Clerk shall cause a notice to be published in the Harnett County News once at least fourteen days before Monday, May 23, 1983, (being thelast day in which persons may register for said referendum) and once again not less than seven days before said day, such notice to read substantially as follows: NOTICE OF SPECIAL PROPERTY TAX REFERENDUM IN THE ANDERSON CREEK RESCUE DISTRICT (the boundaries of which are the entire area of the Anderson Creek township) A special property tax referendum will be held in the Anderson Creek Ambulance and Rescue Service District (the boundaries of which are the entire Anderson Creek Township), Harnett County, North Carolina, between 6:30 a.m. and 7:30 p.m. on Tuesday, June 21, 1983, at which time there will be submitted to the qualified voters of said district the following questions: "Shall Harnett County be authorized to levy annually a property tax at an effective rate not in excess of six cents ($.06) on the One Hundred Dollars ($100.00) value in the Anderson Creek Rescue District for the purpose of providing emergency medical and rescue services ?" For said referendum the regular registration books for elections in the Anderson Creek precinct, County of Harnett will be used and the registrations books, process or records will continue to be open for the acceptance of registration applications and the registration of qualified persons between the hours of 8:00 a.m. and 5:00 p.m. on Monday to Friday, inclusive, of each week at the Office of the County Board of Elections of Harnett County located at the Agriculture Building, 19 East Front Street, in Lillington, North Carolina. In addition, registration applications will be accepted and qualified persons may register with the registrar and judges for said precinct of Anderson Creek in Harnett County at their homes and qualified persons may also contact the County Board of Elections at the office of said Board mentioned above, telephone number (919) 893 -4495. Furthermore, certain persons in the armed forces and their spouses, certain veterans, certain civilians working with the armed forces, and members of the Peace Corps may register by mail at any time prior to said referendum in the manner provided in Article 21 of Chapter 163 of the General Statutes of North Carolina and in person at any time, including the day of said referendum. Those residents of the county who are presently registered under Harnett County's permanent registration system and who have not changed residence from one precinct to another since their registration will be permitted to vote in the special property tax referendum, provided that removal from one precinct to another shall not deprive any person of the right to vote in the precinct from which he has removed until 30 days after his removal. The last day for new registration of those not now registered under Harnett County's permanent registration system is Monday, May 23, 1983. The last day on which registered voters who have changed residence from one precinct to another may transfer registration is Monday, May 23, 1983. Any qualified voter of the District who is qualified to vote by absentee ballot in said special property tax referendum may apply to the County Board of Elections for an absentee ballot. Any qualified voter who is qualified to vote by military absentee ballot pursuant to Section 163 -245 of the General Statutes of North Carolina may also apply for an absentee ballot as provided by Section 163 -247 of the General Statutes of North Carolina. Persons who are not certain whether they are registered to vote or qualifie to vote by absentee ballot should contact the County Board of Elections at the office of said Board mentioned above. ACTION MEETING ADJOURNED arman The registration books for elections an Harnett County will be open to inspection" by any registered voter of the County during the normal business hours of the County Board of Elections on the days when the office of said Board is open, and such days are Challenge Days. The registrars,-judges and other-officers of elections appointed by the County Board of Elections will serve as the election officers for said referendum. The County Board of Elections will conduct said referendum. The precinct and the voting places for said property tax referendum, subject to change as provided by° law, -are as follows: Precinct Voting Place Anderson Creek Anderson Creek School s/ W. H. Randall, Chairman, Board of Elections s/ Vanessa W. Young County Finance - Officer and Clerk to the Board of Commissioners for the County of Harnett, North- Carolina; Section 4: The form of the paper ballots to be used for said referendum shall be substantially as follows: YES Na OFFICIAL' BALLOT SPECIAL PROPERTY TAX REFERENDUM ANDERSON CREEK RESCUE DISTRICT (the boundaries of which are the entire area of the Anderson Creek Township), COUNTY OF HARNETT, NORTH CAROLINA, June 21 1983 Instructions -To vote in favor of the Property Tax authorization, make a cross (X) mark in the square to the right of the word "YES ". To vote against the Property Tax authorization, make 'a cross (X) mark in the square to the right of the word "NO". Section 6: This resolution shall take "effect upon its passage. There upon motion of Commissioner Brock, seconded by Commissioner Shaw, the foregoing resolution passed upon the following vote: - Ayes:' Commissioners Alphin, Stewart, Brock, Shaw and Collins.
