HomeMy WebLinkAbout11151982HARNETT COUNTY BOARD OF COMMISSIONERS MEETING - NOVEMBER 15, 1982 CALL TO ORDER PRAYER READING OF The Harnett County -Board of Commissioners met in regular session on Monday, November 15, 1982, in the Commissioners Room, County Office Building, Lillington, North Carolina with the following members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the Board and Edward H. McCormick, County Attorney were also present. Chairman Jesse Alphin called the meeting to order at 7 :30 p.m. Commissioner, Rudy Collins led the evening prayer. MINUTESThe minutes from the Harnett County Board of Commissioners of November 1, 1982, were approved as read. Commissioner Brock made a motion that the Board pass a resolution, to add the access road to the Coats Recreation Park to the State Highway Secondary Road System and pave said road. Commissioner Collins' seconded the motion and it carried. COATS RECREATION PARK ROAD meeting BE IT RESOLVED BY THE HARNETT COUNTY BOARD OP COMMISSIONERS, that North Carolina Department of Transportation be and is hereby requested, by the proper execution of this document, to add the access road to the Coats Recreation Park to the State Highway Secondary Road System and pave said road. Board of Commissioners SALE OF REAL 'PRO- 'Commissioner Stewart made a motion to approve the sale of the PERTY IN COATS following list of real property in Coats which is described in a resolution that was adopted at the September 20, 1982, Harnett County Board of Commissioners meeting and recorded in Minute Book 15, page 121. Commissioner Collins seconded the motion and it carried. SUBDIVISIONS ORDINANCE Commissioner Shaw made a motion to pass a Resolution Authorizing Execution of an Annual ContriLution Contract with the Department of Housing and Urban Development. Commissioner Brock seconded the motion and it carried. WHEREAS, THE COUNTY OF HARNETT (herein called "PHA ") proposes to enter into an Annual Contributions Contract (herein called the "Contract ") with the United States of America, Department of Housing and Urban Development (herein called the "Government "). NOW, THEREFORE, BE IT RESOLVED by the PHA as follows: Section 1. The Contract, numbered Contract No. A- 3351 -E, is hereby approved and accepted both as to form and substance and the Chairman of the Board is hereby authorized and directed to execute said Contract in triplicate on behalf of the PHA, and the Clerk to the Board is hereby authorized and directed to impress and attest the official seal of the PHA on each such counterpart and to forward said executed counterparts to the Government together with such other documents evidencing the approval and authorizing the execution thereof as may be required by the Government. Section 2. The Chairman of the Board is hereby authorized to file with the Government from time to time, as monies are required requisitions together with the necessary supporting document, for payment under the Contract. Young Clerk to the Board Commissioner Shaw made a motion to adopt the following Ordinance Amending the Original Ordinance entitled "Harnett County, North Carolina, Subdivision Regulations, April 1977 ". Commissioner Stewart seconded the motion and it passed. ORDINANCE AMENDING AN ORDINANCE ENTITLED "HARNETT COUNTY, NORTH CAROLINA, SUBDIVISION REGULATIONS, APRIL, 1977" WHEREAS, this Board adopted on the 4th day of April, 1977, an ordinance entitled, "Harnett County, North Carolina, Subdivision Regulations, April, 1977 "; and WHEREAS, this Board adopted certain amendments to the ordinance on the 1st day of November, 1982; and WHEREAS, this Board is of the opinion that certain additional amendments are necessary to the clear and efficient working of the Ordinance. NOW THEREFORE, BE IT ORDAINED that Section 3.0 of the Ordinance be amended to read as follows: SECTION 3.0 GENERAL A. All subdivision of land except those described in Subsection B. below within the subdivision jurisdiction of Harnett County shall hereafter conform to the procedure contained within the articles of this Ordinance. This Subdivision Regulation Ordinance requires that a plat be prepared, approved, and recorded pursuant to the provisions of this Ordinance whenever a subdivision of land takes place. If the subdivision contains one to five lots, it qualifies as a minor subdivision. The discussion of minor subdivisions is found in Article 3, Section 3.4. B. That there shall be excepted from the procedures contained in the Articles of this Ordinance subdivisions of tracts of land having frontage either on private streets, when the private streets existed prior to the 15th day of November, 1982, and when disclosure statements are given as required by North Carolina General Statute 136 -102.6 (f), or on neighborhood public roads as defined by North Carolina General Statute 136 -67 where disclosure statements are given as requested by North Carolina General Statute 136- 102.6(f); said exception is to apply only when the seller files with the County an affidavit that he does not contem- 110 AIRPORT APRON EXPANSION PROJECT EXPENDITURE' REPORT AVERASBORO FIRE DISTRICT plate that the particular private street or neighborhood ; pub lic road will serve more than three, dwelling units and no com- mercial or industrial sites. H. Brock filed, the October, Expenditure Report with the Board. County Manager M. H. Brock asked the Board to approve the maps which are duly filed in the office of the County, Manager and adopt the following boundaries for Averasboro Fire District and the portion of Banner Fire District in Harnett County for insurance rating purposes. Commissioner Brock made a motion to approve the maps and adopt the boundaries in accordance with General Statute 153A -233. Commissioner` Collins seconded the motion and, it carried. McCormick,; County Attorney, appeared before theBoard and made a formal request that the Board appoint another, County Attor- ney on Monday, December 6, 1982, when they reorganize the Board and appoint County officials. The Board accepted his request with regrets. Mr. McCormick made a report to the Board in regard to past and future legal services for Harnett County. The Board members expressed appreciation to Mr. McCormick for his services to the County and gave him their best wishes for the future. There being no further business the Harnett County Board of Commissioners duly adjourned at 9 :00 p.
