FOR BUIES CREEK -
COATS PROJECT
The Harnett County Board of Commissioners met in regular session
on Monday, July 19, 1982, in the Commissioners Room, County
Office Building, Lillington, North Carolina, with the following
members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy
Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young,
Clerk to the Board, and Edward H. McCormick, County Attorney, were
also present.
Chairman Jesse Alphin called the meeting to order at 7:30 p.m.
Commissioner Rudy Collins led the evening prayer.
The minutes from previous board meetings were approved as read.
Marshall Woodall appeared before the Board and presented a resolution
for consideration regarding the selection of Moore, Gardner &
Associates as the engineering firm for the Buies Creek -Coats water
project. This resolution was received by the Board for study at
its meeting of July 6, 1982, Mr. Woodall explained that since that
time, meetings have been held with representatives from Moore, Gard-
ner & Associates and other engineering firms concerning this project}
However, after talking with the other firms, it was the unanimous
recommendation of the local advisory group for the Buies Creek -Coats
Water project that Moore, Gardner be chosen as the engineering firm;
mainly, because of the time element involved. Moore, Gardner had
prepared the preliminary report on the project; therefore, were
familiar with it and could proceed at a faster pace. Upon motion
of Commissioner Bill Shaw, seconded by Commissioner Collins, the
following resolution was unanimously adopted:
RESOLUTION
BUIES CREEK -COATS WATER $ SEWER PROJECT
THAT, WHEREAS, the Harnett County Board of Commissioners is the governing
body of the Buies Creek -Coats Water and Sewer District of Harnett County,
North Carolina; and
WHEREAS, more than thirty (30) days have past since the publication of
the notice of the results of the special referendum wherein the qualified voters
of the Buies Creek -Coats Water and Sewer District of Harnett County, North
Carolina, overwhelmingly approved the issuance of an "Order Authorizing Two
and One -Half Million Dollars of Sanitary Sewer Bonds" and further that no
objection has been received thereto; and
WHEREAS, the Advisory Council for said district has advised and
requested the Board of Commissioners to enter a contract with an engineering firm
to design, inspect construction and otherwise consult and perform engineering
services relative to the district's sewer project, and to proceed with design
planning immediately; and
WHEREAS, the Advisory Council for said district does recommend that the
Board of Commissioners enter into a services contract with Moore, Gardner $
Associates, Inc., to serve as the district's engineer; and
WHEREAS, it appears to the Board of Commissioners that it is in the best
interest of the district to cause said design planning to be completed as soon
as possible, and that it would be reasonable to expect that the engineer could
adequately design the district's system and have plans and specifications ready
for submission to governmental agencies and contract bidding not later than
180 days after authorization to proceed with the engineering work; and
WHEREAS, the Farmers Home Administration (FmHA) has agreed to loan funds
to the district to finance construction of the district's system and that the
provisions and form of the engineering service contract is suggested and furnished
by FmHA; and
WHEREAS, the compensation of the engineer for his services is based, on a
percentage of the construction cost as has been and will be approved by FmHA
and specifically set forth in the aforementioned form contract provided by FmHA.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
FIRST: That Moore, Gardner and Associates, Inc., be and said firm is
selected as the consulting engineering firm to design the
sewerage collection system and the necessary design work on the
County's existing sewer treatment plant on Buies Creek, to serve
as inspection engineer for the construction work and to serve as
consulting engineer in such other aspects as may be necessary for

the purpose of implementing and construction the waste water
facilities anticipated and shown in the Moore, Gardner, and
Associates, Inc., report on engineering study and subsequent
amendments thereto for .the Buies Creek -Coats Water and Sewer
District of Harnett County, North Carolina, subject to the
provisions hereinafter set forth.
SECOND: That the county officials be and they are hereby fully
authorized and directed to enter into a contract for and on
behalf of said district with said engineering firm to serve
as engineer as aforesaid subject to the following conditions'
and terms, to wits

(1)` -That the contract form be the form provided by the
Farmers. Home Administration for such engineering services

That the compensation to be paid to the engineering firm;
be as provided and approved by the Farmers Home Administ
ration' in the addendum attachment for said contract.
(3) That the contract contain a' provision that the - engineer
agrees to have the design work and plans and specifica
tions ready for approval and submission to the district,
Farmers Home Administration and necessary regulatory
agencies within 180 days after notice to proceed there-
with is given to the engineering firm and further that
upon failure to. so do, the engineering firm shall pay
unto the district a liquidate damage of $100.00 per day
for each day over 180 days.
(4) That the contract contain a provision `that Hiram J.
Marziano of Moore, Gardner Ti Associates, Inc., be assigne
as the chief design engineer of said project and
that William-P. Bizzell be assigned as lead engineer
or project manager.
(5) That the contract contain such provision(s)-as deemed
necessary by the district's attorney and /or the County
Manager to fully carryout the intent and purpose herein`
set forth or to fully carry out the project as proposed
in the preliminary reports and amendments thereto for
the district's project;.
That .the County Manager be and he is authorized and directed
to give notice to said engineering firm to proceed with
design planning as soon as contractual matters are completed.
That should any matter arise during the preparation of contrac
requiring Board action, the County Manager is directed to
schedule the matter on the agenda of the, next Board meeting..

POLICY RE Commissioner Brock made a motion that it be the policy of Harnett
ENGINEERING County that when any future engineering, architectural, or profes-
SERVICES .sional services are needed by the County that the County receive
three proposals before awarding the contract. Commissioner Shaw
seconded the motion and it carried
PROCLAMATION RE: Commissioner Stewart moved for the adoption of the following
IMMUNIZATION,. proclamation, Commissioner Collins seconded the motion and it

Whereas, there is a national campaign for the elimination of indigenous
measles in the United States by October, 1982.
Whereas, local industries, agencies and organizations of Harnett County
have been contacted by the Harnett County Health Department and are working
in the interest of eradicating the deadly diseases such as diptheria, polio,
tetanus and measles and have a right to be proud of what they are doing by
increasing knowledge and awareness of the problems with preventable diseases and
are helping to decrease the number of disabilities and deaths...
Whereas, since 1979 North Carolina General Statute 130 -87, mandating that
school age children be up to date with immunizations, had increased public
knowledge of the need to be immunized...
Whereas, 99% of school age children in North Carolina are meeting immunization
requirements for the school enterer...
Whereas, North Carolina reported two cases of tetanus in 1980 -81 with one
related death...
Whereas, 71.8% of North Carolina children were immunized with completed
basic series by 1980 -81 (Three diptheria, tetanus, polio, and one measles, rubella
and mumps) by recommended age ...
Whereas, many North Carolina adults are not protected against these childhood
diseases that can have irreparable damage (death /disability) to adults...
Whereas, hundreds of health agencies in the health care system are working
together to promote immunization programs, and as they continue to make progress
in helping North Carolina residents become protected by immunizations, they
deserve recognition and support.
Now, Therefore, Be It Resolved by the Harnett County Board of Commissioners
that the month of August be and it is hereby proclaimed as "Immunization Month"
and the week of August 2 - 6 be and it is hereby proclaimed as "Measles
Eradication Week" in Harnett County.
We strongly urge all civic, scientific, medical, education, voluntary and
health care organizations and professionals to join us in using this month and
months and years to come to educate and immunize the public against preventable
diseases.

REPORT ON As in accordance with Section 11 of Harnett County's F. Y. 1981 -82
BUDGET TRANS- Budget Ordinance, M. H. Brock, Budget Officer, presented the
FERS following report to the Board:
Section 11 of Harnett County's F. Y. 1981 -82 Budget Ordinance authorizes the
Budget Officer to transfer appropriations less than $500 within a fund with
the condition that an official report of such transfers is presented to the

Commissioner Brock made a motion that the Social Services Budget,
Code 610 -002, Salaries & Wages, be decreased by $11,364 and the
Contingency Fund, Code 559 -057, be increased by $11,364. This is
the result of an error that was made when the Budget was prepared.
Commissioner Stewart seconded the motion and it carried.
Commissioner Shaw informed those present that for several months the
County had been seeking the appropriate site for the location of
the Harnett County Industrial Training Center. He stated that the
Board had visited several sites and felt the site of Barbara J.
Brown is the most feasible for the location of the industrial
training center. Commissioner Collins made a motion that the County
Manager, M. H. Brock, be and he is hereby authorized to exercise an
option on the Barbara J. Brown site which is part of the D. W.
Johnson Division, located between Lillington and Buies Creek on
U. S. No. 421, and consists of 16.40 acres. Commissioner Shaw second-
ed the motion and it carried.
M. H. Brock, County Manager, informed the Board that the Harnett Count,
Board of Commissioners will be meeting with the Development Commission
Ruritan Clubs, Mayors, Chamber Members, and other officials on Monday,
July 26, 1982, at 12 Noon at Campbell University for a dutch lunch
to discuss the joining together of the different sources in the
County to attract industry to Harnett County.
The expenditure and revenue reports for the period ending June 30,
1982, were filed with the Board.
Jerry Bullock, Director of Harnett County's Community Development
Office, appeared before the Board and informed the Commissioners that
he would like to make application for two Community Development grants
for the coming year. One to extend a water line into the Riverside
Community which would serve an estimated 500 low- income persons; and
the other application to rehabilitate approximately 47 low- income
homes in the Town of Coats. Commissioner Brock made a motion that
Jerry Bullock be authorized to submit these applications to the North
Carolina Department of Natural Resources and Community Development.
Commissioner Shaw seconded the motion and it carried.
Mr. Bullock informed the Board that Talbert, Cox & Associates has
offered to assist in the preparation of the County's application for
FY 1982 Community Development funding at no cost or obligation to the
County. Commissioner Shaw made a motion that the following letter
be sent to Talbert, Cox & Associates. Commissioner Collins seconded
the motion and it carried:

Dear Mr. Talbert:
On July 19, 1982, at its regularly scheduled meeting, the Harnett County Board of
Commissioners voted to request Talbert, Cox & Associates, Inc., to assist in the
preparation of the County's application for F.Y. 1982 Community Development funding.
If the application is funded, the County intends to employ a qualified engineer to
provide design services. Talbert, Cox & Associates will be considered for the
provision of engineering services.
The Board of Commissioners also adopted, at its meeting of July 19, 1982, a
policy concerning the hiring of engineering firms on future projects of the County
which states that when any future engineering, architectural, or professional
services are needed by the County, the County will receive three proposals before
awarding the contract.
The following selection criteria will be utilized to award the engineering contact
on the F. Y. 1982 Community Development project:
Familiarity with and understanding of the proposed engineering project.
Previous engineering experience in Community Development projects and
demonstrated success in previously closing out Community Development projects.

Experience of the firm's proposed project manager in previous Community
Development projects.
Price will not be the sole or most important factor in making a selection.
The County's selection process will be administered in keeping with the A -102
procurement standards which have been adopted by the State of North Carolina. If
this is acceptable, please execute the acceptance block and return a copy for our
files.
