The Harnett County Board of Commissioners met in regular session on Monday,
October 2, 1989, in the County Office Building, Lillington, North Carolina,
with the following members present: Rudy Collins, Bill Shaw, Mayo Smith, Mack
Reid Hudson, andChaiiman Lloyd G. Stewart presiding. Others present were
Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W.
Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary.
Chairman Lloyd G. Stewart called the meeting to order at 9 a.m.
Commissioner Mack Reid Hudson offered the invocation.
Commissioner Smith moved for the approval of
meeting, September 18, 1989, and the special

Commissioner Collins moved for the adoption of a resolution of appreciation
for Margaret R. Randall, retiring librarian. Commissioner Smith seconded the
motion and it passed with a unanimous vote. The resolution is copied in full
at the end of these minutes dated October 2, 1989, as document no. 1.
Chairman Stewart presented the resolution of appreciation to Mrs. Randall and
Commissioner Collins presented a plaque which read "Presented to Margaret R.
Randall in honor and appreciation of her outstanding service and contributions
to Harnett County for thirty years ".
Commissioner Shaw made a motion that Ms. Janet Boone, Rt. 4, Box 288 -A,
Lillington, be reappointed to the Domiciliary Home Community Advisory
Committee for a three -year term expiring June 30, 1992. Commissioner Hudson
seconded the motion and it passed with a unanimous vote.
W. Glenn Johnson, County Attorney, presented a resolution concerning
Community Alternative Program for disabled adults. Commissioner Hudson moved
for the adoption of the. resolution. Commissioner Smith seconded the motion
and it passed with a unanimous vote. The resolution is copied in full at the
end of these minutes dated October, 1989, as document no. 2.
Commissioner Shaw made a motion to approve a maintenance agreement with Telxon
for hand -held meter readers in Public Utilities Department. Conuuissioner
Collins seconded the motion and it passed with a unanimous vote.
W. Glenn Johnson, County Attorney, provided an update briefing to the Board on
his findings to date associated with the complaint from citizen property
owners on Hwy. 27 involving a mobile home park.
Henry S. Thompson, Health Department Director, requested that uncollected
bills totaling $1,285.00 for Family Planning fees be written off.
Commissioner Smith made a motion to approved Mr. Thompson's request to write
off uncollected Family Planning fees. Commissioner Hudson seconded the motion
and it passed with a unanimous vote.
Henry S. Thompson, Health Department Director, requested approval to dispose
of records in the Health Department. Commissioner Smith made a motion to
approve request for disposal of listed records of the Health Department in
accordance with instructions from the North Carolina Division of Archives and
History. Commissioner Hudson seconded the motion and it passed with a
unanimous vote. The list of records is copied in full at the end of these
minutes dated October 2, 1989, as document no. 3.
Henry S. Thompson, Health Department Director, presented a recommendation from
the Board of Health to increase charges for pneumonia vaccine from five
dollars to eight dollars per dose due to increase in cost of pneumonia vaccine
this year. Commissioner Collins moved to increase the fee for pneumonia
vaccine to eight dollars per dose. Commissioner Smith seconded the motion and
it passed with a unanimous vote.
Dallas H. Pope, County Manager, presented a proposed resolution associated
with request from Carolina Lakes Property Owners' Association for adoption of
uniform waterway marking system. Mr. Harvey Lebarron, representing Carolina
Lakes Property Owners' Association provided comments concerning the proposed
resolution. Commissioner Shaw moved that the Board table the matter.
Commissioner Hudson seconded the motion and it passed with a unanimous vote.
Dallas H. Pope, County Manager, reported on Intra- Departmental Budget
Amendments for the quarter ending September 30, 1989. The report is copied in
full at the end of these minutes dated October 2, 1989, as document no. 4.
Reports for the month of September were filed with the Board from Veteran's
Service and Tax Department.
The Tax Attorney's report for the month of September was filed with the Board
and is copied in full at the end of these minutes dated October 2, 1989, as
document no. 5.

Dallas H. Pope, County Manager, requested the following budget amendment for
the Health Department:
Code 10- 7600 -017 Maintenance /Repair - Auto $ 800. increase
10- 7600 -036 Uniforms 1,500. increase
10- 7600 -074 Capital Outlay - Equipment 800. increase
Commissioner Smith moved for the approval of the budget amendment.
Commissioner Hudson seconded the motion and it passed with a unanimous vote.
John M. Phelps, II, Public Utilities Attorney, presented a Resolution
Authorizing Execution of Water Purchase Contract with Southeast Water and
Sewer District of Harnett County. Commissioner Shaw moved for the adoption of
the resolution. Commissioner Collins seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated October 2, 1989, as document no. 6.
Landon Barefoot, General Manager, Southern Cablevision, reported on the
progress of the construction of cablevision in Harnett County.
W. Glenn Johnson, County Attorney, presented a letter of credit associated
with Tanning Ridge Subdivision. Commissioner Smith moved that the letter of
credit be approved and accepted. Commissioner Collins seconded the motion and
it passed with a unanimous vote.

Commissioner Hudson made a motion that the following members of the Central

for three -year terms expiring September 30, 1992:

RESOLUTION RE: John M. Phelps, II, Public Utilities Attorney, presented a Resolution Making
BUNNLEVEL /RIVER. Tentative Award of Contract for Wastewater Facilities Project Division III
(Bunnlevel- Riverside Wastewater Facilities Project). Commissioner Hudson
moved for the adoption of the resolution. Commissioner Shaw seconded the
motion and it passed with a unanimous vote. The resolution is copied in full
at the end of these minutes dated October 2, 1989, as document no. 7.

HARNETT COUNTY, R E S O L U T I O N
NORTH CAROLINA.
THAT WHEREAS, Margaret R. Randall began her services to Harnett County in
1953 as Home Economics Extension Agent; and
WHEREAS, in 1962, Margaret R. Randall accepted the position of Harnett
County Librarian and thereafter faithfully served that office for twenty -seven
years of employment; undertaking and discharging her responsibilities in both .
an exemplary and inspirational manner; and
WHEREAS, Margaret R. Randall graduated from Appalachian State. University
and the University of North Carolina at Chapel Hill, where she earned her
master's degree; and
WHEREAS, Margaret R. Randall, through her active participation in
professional library associations, civic, religious, and community affairs,
has gained recognition and support for the Harnett County Library, reflecting
credit on the department and the people of Harnett County; and
WHEREAS,' Margaret R. Randall, through numerous personal efforts, was
instrumental in the development of a new Harnett County Library facility,
which is left as an exemplary example of her service to the citizens of Harnett
County; and
WHEREAS, Margaret R. Randall's high morals, kind spirit, and just manner
exemplified in the daily execution of her administrative responsibilities and
decision making will continue to be an inspiration to those who follow her; and
WHEREAS, Margaret R. Randall left the service of the Harnett County Library
on June 30, 1989.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
that Margaret R. Randall retired from her loyal and dedicated service to Harnett
County with great honor and distinction; that Margaret R. Randall be and she is
hereby commended on behalf of all the citizens of Harnett County for her invaluable
and immeasurable service to them which contributed significantly to the growth and
prosperity of the County; that a copy of this resolution shall be given to Margaret
R. Randall, a copy spread upon the minutes of this Board, and a copy given to the
media.

RESOLUTION
THAT WHEREAS, The County of Harnett operates a Department of
Social Services as a part of its governmental function; and
WHEREAS, the Harnett County Department of Social Services
has the responsibility to provide certain services to Disabled
Adults within said County; and
WHEREAS, the Harnett County Department of Social Services
desires to enter into an agreement with St. Joseph Hospital Home
Health Agency for the providing of certain services to such
adults; and
WHEREAS, a copy of the agreement into which the Harnett
County Department of Social Services wishes to enter is attached
hereto and hereby referenced; and
WHEREAS, the County of Harnett has reviewed such agreement
and has determined that it is a lawful and proper exercise of its
governmental authority and function to authorize the execution of
such agreement by the Harnett County Department of Social
Services, and that such would promote the best interests of the
Disabled Adults to which services would be thereunder provided;
and

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of Harnett County that the Harnett County Department of Social
Services shall be and it is hereby authorized to execute and
enter into the attached agreement for services to Disabled Adults
within the jurisdiction of such agency.

COMMUNITY ALTERNATIVES PROGRAM FOR DISABLED ADULTS
NORTH CAROLINA MEDICAL ASSISTANCE PROGRAM
MEDICAID - TITLE XIX
This Agreement made on September 19, 1989, by end betwe n St. Jos4001i,Hospital Home Health Agency,
590 Central Drive, Southern Pines. N. C. 28387, hereinafter referred to as the "Contractor ", and
Harnett County Department of Social Services.," 01 Box 669r- LfIlington, N. C. 27546, hereinafter
referred to as the "Lead Administrative Agency ", is to provide for the administration of the
Community Alternatives Program for Disabled Adult; 4CAP /QA) within Harnett County.
The Agreement must be approved by the North Caroline'Divlsion of Medical Assistance. hereinafter
referred to as the "Division", prior to its implementatidnf.
•
1. The Contractor agrees to:
a. Provide case management services, and screening to CAP /DA applicants and participants in
accordance with policies and procedures issued by the Division.
b. Insure that case management:
(1) Operates with independence within its organization so that the case manager can freely
select and order the most cost - effective, quality services required by the CAP /DA
participant. The case management function will be a separate function within the
organization from any entity that provides services to CAP /DA participants. A copy
of the Contractor's organization chart showing the location of the case management
function is attached as a part of this Agreement.
(2) Utilizes and develops free and low -cost resources available within the community and
home to meet the needs of the CAP /DA participant.
(3) Orders services approved by the Division in the Plan of Care to insure the participant's
health, safety, and well- being.
(4) Provides for the participant's freedom of choice in- selection -of service providers.
c. Maintain records of screening and case management services provided to CAP /DA applicants and
participants as well as the services ordered foi the participants. Accounting records will
be in accordance with generally accepted accoenting principles, and program records will con-
form to specifications provided by the Lead Administrative Agency. and Division requirements.
Records will be retained for five (5) years from date of service by the Contractor.
d. Allow authorized representatives of the Lead Administrative Agency, the Division, the North
Carolina Department of Human Resources. the State Auditor, and appropriate Federal officials
to examine all records related to the performance of this Agreement and reimbursement tor the
services provided.
e. Insure that services are provided to CAP /DA applicants and participants without regard to race.
color, religion, or national origin.
f. Comply with the terms of Section 504 of the Rehabilitation Act of 1973 and all requirements
imposed by or pursuant to the regulations of the Department of Health and Human Services
pursuant to that Section, which prohibit discrimination against handicapped persons in em-
ployment and in the operation of programs and activities receiving Federal funds.

g. Follow Division policies and procedures to be reimbursed for case management and screening.
h. Accept reimbursement from the Division as payment in full for the services provided. and will
not charge Medicaid recipients.
i. Provide fiscal and program reports to the Lead Administrative Agency as required to demon-
strate the proper delivery and appropriate utilization of services.
j. Handle third party recovery in the following manner:
(1) Determine responsibility and bill all appropriate third parties, except for casualty
claims, prior to billing Medicaid.
(2) Notify the Division of Medical Assistance, Third Party Recovery, of casualty claims
billed to Medicaid by use of the appropriate form.
(3) Refund Medicaid within sixty (60) days of receipt of third party payment of claims
paid by Medicaid.
(4) Stamp or type on all bills and /or reports related to casualty claims sent to insurance
companies or attorneys, "Medicaid Recipient- Benefits Assigned ". Failure to do so may
jeopardize payment by Medicaid.
k. Restrict the use or disclosure of information about recipients and providers obtained in
connection with the administration of CAP /DA to purposes directly connected to the services
provided under this Agreement.
1. Develop referral procedures with the Harnett County Department of Social Services, and other
appropriate agencies to insure that a Medicaid recipient who requires the level of care pro -
vided by an intermediate care facility or a skilled nursing facility is given the choice of
CAP /DA services or institutional care.
m. Accept fiscal responsibility for deviations from the terms of this Agreement as a result of
the acts of its officers, employees. agents, or representatives.
2. The Lead Administrative Agency will:
a. Apply to the Division for enrollment of service providers, including the Contractor, in the
Community Alternatives Program, and give a list of those providers to the Contractor.
b. Keep the Contractor informed of any changes in the policies and procedures governing or
directly related to the provision of case management or screening.
c. Provide or arrange technical assistance required for the provision of services or reimburse-
ment for services.
d. Accept fiscal responsibility for deviations from the terms of this Agreement as a result of
the acts of its officers, employees, agents, or representatives.
e. Organize an advisory committee to provide guidance on the administration of CAP.DA within the
county.
3. The Lead Administrative Agency may delegate the administrative functions stated in 02, above,
to the Contractor provided the Contractor agrees to the specific delegation(s).
4. The Contractor will not sub - contract for any of the services provided under this Agreement
without obtaining prior written approval from the Lead Administrative Agency. Any approved
sub- contract shall be subject to all conditions of the Agreement. The Contractor will be
responsible for the performance of any sub - contractor.
5. If any part of this Agreement is found to be in conflict with any Federal or State Laws or
Regulations having equal weight of law or. if any part is placed in conflict by amendment of
such laws or regulations. this agreement is so amended.
6. This Agreement may be amended only by written amendments executed by both parties to this Agree-
ment and approved by the Division.
7. Each party to this Agreement agrees to be responsible for its own liabilities and that of its
officers, employees, agents, or representatives arising out of this Contract.
8. This Agreement may be terminated by either party upon giving thirty(30) days prior written
notice to the other party and the Division.

9. This agreement may be terminated by the Division upon giving thirty (30) days prior written
notice to all parties.
10. The terms of this Agreement shall be from year to year, without necessity of renewal, and this
Agreement shall terminate only upon substitution of a new agreement or by act of the parties or
the Division, as herein provided, or by operation of law.
11. The parties acknowledge that payment of claims is from State and Federal funds and any false
claims, statements or documents. misrepresentation or concealment of materiel fact may be pro-
secuted by applicable State and /or Federal Law.
12. The Division may immediately terminate this Agreement due to violations of the rules or regu-
lations that govern the program or this Contract.
13. Payment for services under this Agreement may be withheld if necessary because of irregularity
from whatever cause until such irregularity or difference can be resolved or adjusted.

WHEREAS, the Harnett County Board

EXHIBIT A
WATER PURCHASE CONTRACT
THIS CONTRACT for the sale and purchase of water is entered into as of
the _ day of , 19_, between the NORTHEAST 'METROPOLITAN
WATER DISTRICT OF HARNETT COUNTY (hereinafter "Northeast Metro "), and the
COUNTY OF HARNETT (hereinafter "County "), said Northeast Metro and County
shall be collectively referred to herein as "Seller" and the SOUTHEAST
WATER AND SEWER DISTRICT OF HARNETT, (hereinafter "Purchaser ")
W I T N E S S E T Hs
THAT WHEREAS, the Purchaser is a County and Water and Sewer District,
duly organized and existing pursuant to the provisions of Article 6,
Chapter 162A of the North Carolina General Statutes and by that certain
Resolution dated August 15, 1988 and adopted by the Harnett County Board of
Commissioners entitled "Resolution Creating the Southeast Water and Sewer
District of Harnett County "; and
WHEREAS, Northeast Metro is a metropolitan water district organized
and existing under the laws of the State of North Carolina; and
WHEREAS, County is a body politic organized and existing under the
laws of the State of North Carolina; and
WHEREAS, the Purchaser is organized and established for the purpose of
constructing and operating a water supply distribution system serving water
users within the area described in plans now on file in the Office of the
Purchaser and to accomplish this purpose, the Purchaser will require a
supply of treated water; and
WHEREAS, Northeast Metro owns a water production system and a water
supply distribution system, and County is operator thereof under that
certain Lease dated May 30, 1980, entered into between Northeast Metro and
County; and
WHEREAS, the water production system and water supply distribution
system of Seller (Northeast Metro and County as described above) has a
capacity currently capable of serving the present customers of the Seller's
system, the estimated number of water users to be served by the said
Purchaser as shown in the plans of the system now on file in the office of
the Purchaser; and

WHEREAS, by Resolution entitled "Resolution Authorizing Execution of
Water Purchase Contract with the Southeast Water and Sewer District of
Harnett County ", duly adopted by the District Board of the Northeast
Metropolitan Water District of Harnett County at its meeting on
, the sale of said water to 'the Purchaser as provided herein
was approved, and the execution of this contract by Northeast Metro was
duly authorized; and
WHEREAS, by Resolution entitled "Resolution Authorizing Execution of
Water Purchase Contract with the Southeast Water and Sewer District of
Harnett County ", duly adopted by the Harnett County Board of Commissioners
at its meeting on , the sale of said water to the Purchaser as
provided herein was approved, and the execution of this contract by County
was duly authorized; and
WHEREAS, by Resolution entitled "Resolution Authorizing Execution of
Water Purchase Contract with the Northeast Metropolitan Water District of
Harnett County and the County of Harnett ", duly adopted by the Harnett
County Board of Commissioners, sitting as the governing body of the
Southeast Water and Sewer District of Harnett County at its meeting on
, the purchase of said water from the Seller as provided herein
was approved, and the execution of this contract by Purchaser was duly
authorized;
NOW THEREFORE, in consideration of the foregoing and the mutual
agreements hereinafter set forth,
A. THE SELLER AGREES;
1. (Quality and Quantity) To furnish the Purchaser at the point
of delivery hereinafter specified, during the term of this contract or any
renewal or extension thereof, potable treated water meeting applicable
purity standards of the Division of Health Services, Department of Human
Resources of the State of North Carolina, in such quantity as may be
required by the Purchaser not to exceed 'nine million (9,000,000) gallons
per month.
2. (Point of Delivery and Pressure) That water will be
furnished at a reasonable constant pressure calculated at fifty (50) pounds
per square inch from an existing twelve (12) inch main supply at a point
located at or near the intersection of State Road 1723 and N. C. Highway 55
within a waterline and /or related appurtenance easement to be acquired by
Purchaser. If a greater pressure than that normally available at the point
of delivery is required by the Purchaser, the cost of providing such
greater pressure shall be borne by the Purchaser. Emergency failures of
pressure or supply due to main supply line breaks, power failure, flood,
fire and use of water to fight fire, earthquake or other catastrophe shall
excuse the Seller from this provision for such reasonable period of time as
may be necessary to restore service.
3. (Metering Equipment) To furnish, install, operate, and
maintain at its own expense at point of delivery, the necessary metering
equipment, including a meter house or pit, and required devices of standard
type for properly measuring the quantity of water delivered to the
Purchaser and to calibrate such metering equipment whenever requested by
the Purchaser but not more frequently than once every twelve (12) months.
A meter registering not more than two percent (2%) above or below the test
result shall be deemed to be accurate. The previous readings of any meter

disclosed by test to be inaccurate shall be corrected for the three (3)
months previous to such test in accordance with the percentage of
inaccuracy found by such tests. If any meter fails to register for any
period, the amount of water furnished during such period shall be deemed to
be the amount of water delivered in the corresponding period immediately
prior to the failure, unless Seller and Purchaser shall agree upon a
different amount. The metering equipment shall be read on the first day of
each month. An appropriate official of the Purchaser at all reasonable
times shall have access to the meter for the purpose of verifying its
readings.
4. (Billing Procedure) To furnish the Purchaser not later than
the fifth (5) day of each month, with an itemized statement of the amount
of water furnished the Purchaser during the preceding month.
B. THE PURCHASER AGREES:
1. (Rates and Payment Date) To pay the Seller, not later than
the tenth (10) day of each month, for water delivered in accordance with
the following schedule of rates:
a. One thousand five hundred seventy -five dollars
($1,575.00) for the first one million five hundred (1,500,000) gallons,
which amount shall also be the minimum rate per month.
b. One dollar and five cents ($1.05) per one thousand
(1000) gallons for water in excess. of one million five hundred thousand
(1,500,000) gallons.
c. It is agreed that the minimum rate per month as stated
in (a) above shall not be applicable until six (6) months after the last
notices for connection have been mailed to potential water customers of the
Purchaser by the Harnett County Department of Public Utilities; and up to
said time the minimun rate per month becomes applicable, Purchaser shall
pay only for such water as is delivered to Purchaser at the rate of $1.05
(one Dollar and five cents) per 1000 (one thousand) gallons.
2. (Connection Fee) To pay as an agreed cost, a connection fee
to connect the Seller's system with the system of the Purchaser, a sum
equal to the amount of the cost of the installation of the meter, meter
vault and related appurtenances and the cost of the laying and installation
of the necessary pipeline or pipelines to connect the system of the Seller
to the system of the Purchaser at the boundary of the Southeast Water and
Sewer District

C. It is further mutually agreed between the Seller and the
Purchaser as follows:
1. (Term of Contract) That this contract shall extend for a
term of forty (40) years from the date of the initial delivery of any water
as shown by the first bill submitted by the Seller to the Purchaser and,
thereafter may be renewed or extended for such term, or terms, as may be
agreed upon by the Seller and Purchaser.
2. (Delivery of Water) That thirty (30) days prior to the
estimated date of completion of construction of the Purchaser's water
supply distribution system, the Purchaser will notify the Seller in writing
the date for the initial delivery of water.

3. (Water for Testing) When requested by the Purchaser, the
Seller will make available to the contractor at the point of delivery, or
other point reasonable close thereto, water sufficient for testing,
flushing, and trench filling the system of the Purchaser during
construction, irrespective of whether the metering equipment has been
installed at that time, at a flat charge of one dollar and five cents
($1.05) per one thousand (1000) gallons which will be paid by the
contractor or, on his failure to pay, by the Purchaser.
4. (Failure to Deliver) That the Seller will, at all times,
operate and maintain its system in an efficient manner and will take such
action as may be necessary to furnish the Purchaser with quantities of
water required by the Purchaser. Temporary or partial failures to deliver
water shall be remedied with all possible dispatch. In the event of an
extended shortage of water, or the supply of water available to the Seller
is otherwise diminished over an extended period of time, the supply of
water to Purchaser's consumers shall be reduced or diminished in the same
ratio or proportion as the supply to Seller's consumers is reduced or
diminished.
5. (Modification of Contract) That the provisions of this
contract pertaining to the schedule of rates to be paid by the Purchaser
for water delivered are subject to modification at the end of every one
(1) year period. Any increase or decrease in rates shall be based on a
demonstrable increase or decrease in the costs of performance hereunder.
Such costs shall not include increased capitalization of the Seller's water
distribution system except as such costs relate directly to increasing the
capacity of services to the Purchaser. Such costs may include increased
capitalization of the Seller's water production facility system. Other
provisions of this contract may be modified or altered by mutual agreement.
6: (Future Water Transmission and Connection) In the event
County and /or Northeast Metro elect to supply and sell water to any
customers or other water distribution systems located outside of the
boundaries of the Southeast Water and Sewer District of Harnett County and
desire to do so by connecting to and transporting water through the water
distribution system of Purchaser, it is agreed that County and /or Northeast
Metro may, at no cost to either, connect to and transport water through the
water distribution system of Purchasert for the purpose of suppling and
selling water to customers or other water distribution systems outside of
the Southeast Water and Sewer District, whether within the County of
Harnett or otherwise. In the event County and /or Northeast Metro should
elect to supply and sell water as stated herein, County and /or Northeast
Metro shall cause a meter to be installed at the connection point and the
cost thereof shall not be borne by Purchaser.
7. (Regulatory Agencies) That this contract is subject to such
rules, regulations, or laws as may be applicable to similar agreements in
this State and the Seller and Purchaser will collaborate in obtaining such
permits, certificates, or the like, as may be required to comply therewith.
8. (Miscellaneous) That the construction of the water supply
distribution system by the Purchaser is being financed by a loan made or
insured by, and /or a grant from the United States of America, acting
through the Farmers Home Administration of the United States Department of
Agriculture, and the provisions hereof pertaining to the undertakings of
the Purchaser are conditioned upon the approval, in writing, of the State
Director of the Farmers Home Administration.

9. (Successor to the Purchaser) That in the event of any
occurrence rendering the Purchaser incapable of performing under this
contract, any successor of the Purchaser, whether the result of legal
process, assignment, or otherwise, shall succeed to the rights of the
Purchaser hereunder.
IN WITNESS WHEREOF, the parties hereto, acting under authority of
their respective governing bodies, have caused this contract to be duly
executed in triple counterparts, each of which shall constitute an
original.

RESOLUTION MAKING TENTATIVE AWARD OF CONTRACT FOR
WASTEWATER FACILITIES PROJECT
DIVISION III
(Bunnlevel - Riverside Wastewater Facilities Project)
WHEREAS, the Harnett County Board of Commissioners (hereinafter
the Board) has previously been advised by the Consulting Engineers
for the Bunnlevel Riverside Wastewater Facilities Project that as a
result of the bidding procedure conducted with respect thereto, one
bid had been received for the Division III contract; and
WHEREAS, said bid had been presented by Hogue Electric Company,
Inc. pursuant to readvertisement after only one bid was received upon
first advertisement; and
WHEREAS, said bid was in an amount in excess of the engineers
estimates for the same; and
WHEREAS, the Board directed the appropriate representatives of
the County to negotiate with said Hogue Electric Company, Inc. with
respect to said Division III contract so as to obtain the best pricing
available to the County; and
WHEREAS, the Board now desires to make tentative award of said
Contract to Hogue Electric Company, Inc. as hereinafter provided; and
WHEREAS, such award shall be subject to the receipt of all
revenue funding commitments for the project, approval of such awards
by the Environmental Protection Agency of the United States of America
together with the North Carolina Division of Environmental Management,
approval of such awards by the Farmers Home Administration and final
review by the Harnett County Public Utilities attorney; and
WHEREAS, the Board now further desires to make provisions for the
anticipated execution of contract documents and other related matters
with respect thereto.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners as follows:
1. That the Division III Contract for the Bunnlevel -
Riverside Wastewater Facilities Project is hereby
tentatively awarded to Hogue Electric. Company, Inc.
for the negotiated price of $62,963.00, subject to
adjustment as provided by the Contract documents,
contingent upon receipt of all revenue funding
commitments for the project, approval by the
Environmental Protection Agency of the United States
of America together with the North Carolina Division
of Environmental Management, approval by the Farmers
Home Administration and final review by the Harnett
County Public Utilities Attorney.
2. That after the approvals and conditions as stated
above have been met, the Chairman of the Board and
the Clerk to the Board are authorized to execute the
contract documents pertaining to the above made
tentative award.
3. That upon completion of the proper execution of said
contract documents, and upon further authorization by
the Farmers Home Administration of the United States
Department of Agriculture, and authorization of the
Environmental Protection Agency of the United States
of America together with the North Carolina Division
of Environmental Management, Dallas H. Pope, Harnett
County Manager, is hereby authorized to issue Notices
to Proceed so as to cause the construction of the
aforementioned Project to commence.
4. That Dallas H. Pope is hereby authorized to execute
such other documents and take such actions as are necessary
to implement the directions of this Resolution.
Duly adopted this 2nd day of October, 1989 upon motion made by
commissioner Hudson, seconded by Commissioner Shaw, and adopted
unanimously.
