HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, AUGUST 21, 1989
The Harnett County Board of Commissioners met in regular session on Monday,
August 21, 1989, at 7 p.m. in the County Office Building, Lillington, North
Carolina, with the following members present: Rudy Collins, Bill Shaw, Mayo
Smith, and Chairman Lloyd G. Stewart presiding. Commissioner Mack Reid Hudson
was absent. Others present were Dallas H. Pope, County Manager; W. Glenn
Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S.
Blanchard, Recording Secretary.
Chairman Lloyd G. Stewart called the meeting to order at 7 p.m.
Commissioner Rudy Collins offered the invocation.
Commissioner Shaw moved for the approval of the minutes of the regular
meeting, August 7, 1989. Commissioner Smith seconded the motion and it passed
with a unanimous vote.
W. Glenn Johnson, County Attorney, briefed the group, including approximately
150 citizens, on status of issue presented at the August 7, 1989, regular
Board meeting concerning spotlighting and dog hunting of deer in Harnett
County.
RESOLUTION RE: W. Glenn Johnson, County Attorney presented a resolution involving spot -
SPOTLIGHTING lighting in Harnett County and stated if approved that the resolution would be
forwarded to the N.C. Wildlife Resources Commission for their consideration.
The resolution is copied in full in Minute Book 17, page 529.
Chairman Stewart asked for questions or comments concerning the proposed
resolution from the Board and from citizens present at the meeting. Mr.
Johnson, County Attorney answered questions from citizens concerning the
proposed resolution. Chairman Stewart asked for a show of hands for and
against spotlighting in Harnett County. The show of hands was about equal for
and against spotlighting.
Commissioner Smith moved for the approval of the resolution. The motion
received no second.
RESOLUTION RE: W. Glenn Johnson, County Attorney, presented a resolution involving dog
DOG HUNTING OF hunting of deer in Harnett County and stated if approved that the resolution
DEER would be forwarded to the N. C. Wildlife Resources Commission for their
consideration. The resolution is copied in full in Minute Book 17, page 530.
Chairman Stewart asked for questions or comments concerning the proposed
resolution from the Board and from citizens present at the meeting. Repre-
sentatives from various hunting clubs in the County provided comments in favor
of hunting deer with use of dogs. Chairman Stewart asked for a show of hands
for and against dog hunting of deer in Harnett County. The show of hands was
in favor of dog hunting of deer.
There was no motion from the Board to approve the resolution involving dog
hunting of deer in Harnett County.
W. Glenn Johnson, County Attorney, explained to the group that the Harnett
County Board of Commissioners is not empowered to enforce hunting regulations,
but had the resolutions concerning deer hunting been approved, they would have
been forwarded to the North Carolina Wildlife Commission, which would investi-
gate and possibly hold a public hearing concerning the deer hunting issues.
The Board of Commissioners having not approved the resolutions, no further
actions will be taken on the two resolutions.
FORESTRY PROGRAM Marty Blackmon, County Forest Ranger, reported on forestry programs currently
REPORT being exercised in Harnett County and introduced two new assistant county
rangers, John Mewborn and Mark Faircloth.
Harold G. Grady, District Forester, briefed the Board concerning funding
requirements for Harnett County's Forestry Program and requested additional
funding support. The Board advised his request would be evaluated.
PUBLIC HEARINGS Carla Stephens, Planning Supervisor, briefed the group that there would be

CONSIDERATION The Board considered the following applications for zoning district change:

Board recommended disapproval of the application. Commissioner Smith

Commissioner Shaw seconded the motion and it passed with a unanimous
vote.
2. Cordelia Frye, from RA -30 Zoning District to RA -20M Zoning District,
located in Johnsonville Township, on S.R. 1105. The Planning Board
recommended approval of the application. Commissioner Shaw moved that
the zoning district change application request be approved.
Commissioner Collins seconded the motion and it passed with a
unanimous vote.
3. Rupert Stewart, from RA -40 Zoning District to RA -30 Zoning District,
located in Averasboro Township, on N.C. 27. The Planning Board
recommended approval of the application. Commissioner Smith moved
that the zoning district change application request be approved.
Commissioner Shaw seconded the motion and it passed with a unanimous
vote.
4. Ricky Lane Temple, from RA -30 Zoning District to RA -20M Zoning
District, located in Hector's Creek Township, on S.R. 1403. The
Planning Board recommended disapproval of the application.

Commissioner Smith moved that the zoning district change application
request be denied. Commissioner Shaw seconded the motion and it
passed with a unanimous vote.
Chairman Stewart called to order a public hearing concerning proposed changes
to the Harnett County Zoning Ordinance.
Carla Stephens, Planning Supervisor, briefed the group on each proposed
change. A list of the proposed changes is copied in full at the end of these
minutes dated August 21, 1989, as document no. 1.

Chairman Stewart closed the public hearing concerning proposed changes

CONSIDERATION OF Carla Stephens, Planning Supervisor, presented an Ordinance Amending an
ZONING ORD. AMEND. Ordinance Entitled Zoning Ordinance for Harnett County, North Carolina adopted
July 18, 1988, which includes two of the proposed changes presented in public
hearing. Commissioner Shaw moved for the adoption of the ordinance. Commis-
sioner Collins seconded the motion and it passed with a unanimous vote. The
ordinance is copied in full in the Harnett County Ordinance Book 1, page_.

Commissioner Smith moved for the approval of the tax refunds. Commissioner
Shaw seconded the motion and it passed with a unanimous vote.

the motion was seconded by Commissioner Hudson and was passed with a
unanimous vote.
Commissioner Shaw seconded the motion and it passed with a unanimous vote.
Commissioner Smith made a motion to change the meeting date of the first
regular meeting in September to September 5, 1989, because of the Labor Day
holiday. Commissioner Collins seconded the motion and it passed with a
unanimous vote.

There being no further business, the Harnett County Board of Commissioners
regular meeting of August 21, 1989, duly adjourned at 10:30 p.m.
PROPOSED CHANGES TO ZONING ORDINANCE
Uses designated as permitted uses in the Industrial Zoning
District (not including outdoor advertising signs) shall be
designated as conditional uses in the Commercial, RA -30, and
RA -20R Zoning Districts unless otherwise already addressed
in those districts.
2. Uses designated as permitted uses in the Commercial Zoning
District (not including outdoor advertising signs) shall be
designated as conditional uses in the Industrial, RA -30, and
RA -20R Zoning Districts unless otherwise already addressed
in those districts.
3. Existing commercial uses located in areas zoned RA -30, RA-
20R, RA -20M and Industrial Zoning Districts and applying for
permits to expand shall be designated as conditional uses in
those respective zoning district.
4. Existing industrial uses located in areas zoned RA -30, RA-
20R, RA -20M and Commercial Zoning Districts and applying for
permits to expand shall be designated as conditional ases in
those respective zoning districts.

5. THAT Article IV be amended as follows:
21.0 Public Utility Structures
Structures that are installed by public utilities for
the purpose of supplying, extending, or enhancing
public utility services may be a permitted use in all
zoning districts, provided that the structure does not
create any enclosed area which can be wholly or
partially occupied by an individual for any appreciable
period of time, other than for the normal and customary
construction, repair, and /or maintenance of such
structure. The structure and any associated concrete
slab shall be required to meet the front, side, and
rear yard setback requirements of the respective zoning
districts.
6. That Article VI, 1.3 Minimum Lot Area, be revised to read as
follows:
Minimum Lot Area - 1 acre - 43,560 square feet including
any North Carolina Department of Transportation right-
of-way
7. That Article VI, 2.3 Minimum Lot Area, be revised to read as

1.1. The Board of Adjustment is hereby created which
shall consist of five (5) members and two (2)
alternates, who shall all be citizens of Harnett
County, North Carolina. These members shall be
appointed by the Board of County Commissioners for
staggered, three -year terms. Alternates shall
also be appointed to three -year terms.

13. That Article XII, 1.0 (1.3) be revised to read as follows:
1.3 The Board of Adjustment shall elect one of its
members as chairman and another as vice - chairman
and shall appoint a secretary to keep minutes of
its proceedings. The Board shall adopt such rules
and regulations as it may deem necessary to carry
into affect the provisions of this section. These
rules and regulations shall be designated in the
Harnett County Board of Adjustment By -Laws, which
shall be kept on file in the County Planning
Office.
14. That Article XV, Underpinning, be revised to read as
follows:

a good workmanship -like manner along the entire base of
a manufactured home, except for ventilation and crawl
space requirements, and consisting of the following:
metal with a baked -on finish of uniform color; a
uniform design and color vinyl; or brick, cinder
block, and stone masonry, as well as artificial stone
masonry
15 THAT Article IX, Section 10.0 (B) be revised to read as
follows:
B. Business signs shall be permitted on the premises of
the business in districts in which the "principal.use is
permitted and in districts in which the principal use
is conditional. Conditional Use permit applications
shall include information as to sign type and
placement. All business signs shall be subject to the
following limitations:
10.1 Signs for customary home occupations shall
not exceed six (6) square feet in display
area.
10.2 Business signs shall not project more than
one (1) foot from any building wall or
canopy.
10.3 If suspended from a canopy, the sign must be
at least eight (8) feet above the sidewalk,
pavement or ground level.
10.4 Signs shall have a total display area in
square feet per establishment no greater than
one -half square foot for each linear foot of
building lot frontage, but in no case greater
than 300 square feet.
10.5 Freestanding business signs shall not be
located in a required side yard or within 10
feet of the right -of -way line or any property
line.
16. That Article IX, Section 11.3 be revised to read as follows:
11.3 Setback Requirements - No outdoor advertising sign
shall be erected or maintained within 600 feet of the
nearest edge of the right -of -way of the interstate or
primary highways in Harnett County, except as allowed
by the North Carolina General Statutes. No sign shall
be located in a required side yard or within ten (10)
feet of any right -of -way line or any property line.
17. THAT Article IX, Section 10.0, be added to read as follows:
10.6 No business establishment shall have more than one sign
greater than 100 square feet. Provided, however, that a
shopping complex consisting of five or more businesses
located in a unified building or group of buildings may have
business and identification signs as permitted by the
Harnett County Zoning Ordinance and in addition, the center
as a whole may have one detached sign per street front not
to exceed 300 square feet in area per street front.

PROPOSED CHANGES TO SUBDIVISION REGULATIONS
1. Review Process of Minor Subdivisions
Minor subdivisions, as defined in Section 2.0 Item 17,
shall be reviewed and approved by- the following
process:
a. Consultation with County Planning Staff - Any
person who proposes a minor subdivision should
first consult with the County Planner or
designated staff to ensure that he understands the
requirements for the approval of a record plat.
b. Recording /Approval
(1) After consultation with the Planner or
staff, the subdivider shall file a record
plat with the County Planning Office and
after complying with Sections 3.4, (2) (b)
(2) (5) herein shall' file said plat with
the Register of Deeds prior to obtaining any
permit issued by a county or state agency.
(2) The record plat shall be in the form and
shall include the information required by
Sections 3.3 -1 and 2 of the Harnett County
Subdivision Regulations.
(3) Accessways for minor subdivisions . which allow
three or more lots to be created on any
easement shall be required to meet the
following road construction standards:
a. There shall be an access travelway of

unsure the plat meets the requirements of

c. Final Approval - If the Planning Director or his
designated agent approve the record plat, he
shall enter the following certificate thereon:
I hereby certify that this record plat complies with
the Subdivision Regulations of Harnett County, North
Carolina; and that this plat has been approved for
recording in the Register of Deeds of Harnett County.

d. Development Limitation - There shall be a maximum
of one minor subdivision per property owner except
when any of the following apply: (Amended
4/17/89)
(1) All the lots of any additional minor
subdivisions are located on a state -
maintained road or U.S. highway and have the
required road frontage.

an a different state road, U.S. highway, or
in a different township than the previous
minor subdivision.

(3) The Harnett County Planning' Board reviews the •
map and determines that the additional mino r
subdivision is in keeping with the spirit of

six (6) lots to be created on any easement.
2. THAT Article IV, Section 4.2 (2) be revised to read as
follows:

The advertisement for bids for the above referenced projects was
published on June 15, 1989. Bids were received until 2:00 pm on
July 26, 1989, by the Harnett County Board of Commissioners.
Present at the bid opening were Mr. Willard Dean, FIRMA; Mr. John
Phelps, Legal Counsel for Harnett County; Mr. William Conner,
Ragsdale Consultants, P.A. and Mr. Randy Rambeau, Ragsdale
Consultants, P.A. and the bidders. Division I bids were

Inc., Central Builders, Inc. and Wright & Lopez, Inc. Division
II bids were submitted by R. H. Moore Co., Inc. and McDonald
Plumbing Co. One Division III bid was submitted by Hogue
Electric Co., Inc. Division I bids were opened and read aloud.
The low bidder was R. H. Moore Co., Inc. in the amount of
$1,593,529.00. Bids for Division II and III were not opened
because three (3) bids were not received.
Re- advertisement for bids for Divisions II and III was published
on July 29, 1989. Bids were received by the Harnett County Board
of Commissioners until 2:00 pm on August 14, 1989 and at that
time opened and read aloud. Present at the bid opening were Mr.
Rodney Tart, Harnett County Public Utilities, Mr. William P.
Conner, Ragsdale Consultants, P.A. and the bidders. One bid was
submitted for Division II by McDonald Plumbing Co. in the amount
of $5,630.00. One bid was submitted for Division III, by Hogue
Electric Co., Inc. in the amount of $74,260.00.
We have reviewed the bids submitted and prepared a bid
tabulation, a copy of which is enclosed. We recommend tentative
award of the Division I contract to R. H. Moore Company, Inc. and
the Division II contract to McDonald Plumbing Co., both subject
to approval by EPA, NC Division of Environmental Management and
Farmers Home Administration. We recommend that the Division III
contract either be re -bid or negotiated with Hogue Electric Co.,
Inc. If there are any questions, please give me a call.

WASTEWATER FACILITIES PROJECT
DIVISIONS I and II
(Bunnlevel- Riverside Wastewater Facilities Project)
WHEREAS, the Harnett County Board of Commissioners,
(hereinafter the "Board ") has received from the Consulting
Engineers the results from the public bids on the Division I and
Division II contracts for the Bunnlevel- Riverside Wastewater
Facilities Project; and
WHEREAS, the Engineers' Discussion of Bids has recommended
tentative award of the contracts to the lowest responsible bidders
which have presented legally sufficient bids based on acceptance
of the proposals that will result in the best pricing available to
the County; and
WHEREAS, the Board considers it in the best interest of the
County to proceed with acceptance of the lowest contract proposals
recommended by the Consulting Engineers for the Division I and
Division II contracts so as to commence the processing of the
required documentation related thereto; and
WHEREAS, such acceptance shall be subject to the receipt of
all revenue funding commitments for the project, approval of such
awards by the Environmental Protection Agency of the United States
of America together with the North Carolina Division of
Environmental Management, approval of such awards by the Farmers
Home Administration and final review by the Harnett County Public
Utilities attorney; and
WHEREAS, the Board now desires to make provisions for the
anticipated execution of contract documents and other related
matters with respect thereto.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners as follows:
1. That the Division I and Division II Contracts
for the Bunnlevel- Riverside Wastewater
Facilities Project are hereby tentatively
awarded to the following contractors at the
amount shown, contingent upon receipt of all
revenue funding commitments for the project,
approval by the Environmental Protection
Agency of the United States of America
together with the North Carolina Division of
Environmental Management, approval by the
Farmers Home Administration and final review
by the Harnett County Public Utilities

Award to: R. H. Moore Co., Inc.

For the total bid amount of $1,593,529.00, subject
to adjustment as provided by the contract documents.

of Agriculture, and authorization of the

(Bunnlevel- Riverside Wastewater Facilities Project)
WHEREAS, Harnett County, (hereinafter sometimes referred to
as the "County ") for itself and as contracting agent for the South
Central Water and Sewer District of Harnett County is planning to
construct wastewater collection and disposal facilities to serve
the Bunnlevel and Riverside Communities within the County; and
WHEREAS, in order to construct said facilities, it is
necessary for the County to obtain certain parcels of land upon
which pump stations will be located and to obtain certain easements
and rights of way under which collection pipelines will be
constructed; and
WHEREAS, pursuant to the direction of the Board of
Commissioners of Harnett County, the Harnett County Department of
Public Utilities has proceeded to make provision for the
acquisition of said lands or rights in land and in connection .
therewith has obtained appraisals of such properties, as required,
from a competent appraiser and obtained review appraisals of the
same, all in accordance with the provisions of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act.
of 1970, 42 U.S.C. 54601 et.seq., (hereinafter "the Act "); and
WHEREAS, as provided by the Act, the County has determined
that the amount of the just compensation to be offered for .
acquisition of the land or rights in land desired for use in
connection with the Bunnlevel- Riverside Wastewater Facilities
Project shall be the amount determined by the described appraisals
and review appraisals; and
WHEREAS, one of the parcels of property desired by the County
is a 1,537 square foot parcel located along SR #2055 in Stewart's
Creek Township, the same being owned by Bunnlevel Industrial
Development Corporation; and
WHEREAS, in accordance with the Act, an offer has been made
to the aforesaid owner to acquire the described parcel for the sum
of Three Hundred Seven Dollars ($307.00) which said sum is the
appraised value thereof as determined by the appraisal and review
appraisal mentioned above; and
WHEREAS, said owner has accepted the offer of the County and
desires to sell and convey the described land to it; and
WHEREAS, attached hereto as Exhibit 1 is a Contract of
Purchase and Sale which sets forth the terms of the described
purchase and sale; and
WHEREAS, it is the desire of the County for itself and as
contracting agent for the South Central Water and Sewer District
of Harnett County to enter into said Contract of Purchase and Sale
and to authorize the purchase of the lands or rights in land
therein described.

NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners in its capacity as the governing body of the County
of Harnett and in its capacity as the governing body of the South

CONTRACT,OF PURCHASE
HARNETT COUNTY AND SALE
THIS CONTRACT OF PURCHASE AND SALE is made and entered into this
day of , 1989 by and between Bunnlevel
Industrial Development Corporation, a corporation of Harnett County,
North Carolina (hereinafter "Seller"); and the County of Harnett and
the South Central Water and Sewer District of Harnett County
(hereinafter "Purchaser ").
W I T N E S S E T
THAT WHEREAS, the County of Harnett is a body politic organized
• and existing under the laws of the State of North Carolina; and
WHEREAS, the South Central Water and Sewer District of Harnett
County is a County Water and Sewer District, duly organized and
existing pursuant to the provisions of Article 6, Chapter 162A of the
North Carolina General Statutes and by that certain Resolution dated
March 13, 1985 and adopted by the Harnett County Board of
Commissioners, entitled "Resolution Creating the South Central Water
and Sewer District of Harnett County "; and
WHEREAS, Seller is the owner of that certain tract of land lying
and being in Stewart, Creek Township, Harnett County, North Carolina,
the same being the land conveyed to :Bunnlevel Industrial Development
Corporation by the Harnett County Board of Education by deed recorded
in Book 452, page 57 in the office of the Register of Deeds of said
County; and
WHEREAS, the County of Harnett for itself and as contracting
agent for the South Central Water and Sewer District of Harnett County
intends to construct wastewater collection facilities to serve the
Bunnlevel and Riverside Communities of Harnett County; and
WHEREAS, Purchaser is in need of a portion of the tract of land
described in the above mentioned Deed for the purpose of locating a
wastewater pump station thereon and to carry out one of its
governmental functions; and
WHEREAS, Seller desires to sell to Purchaser the property needed
by said Purchaser; and
WHEREAS, Seller and Purchaser desire to enter into this Contract
of Purchase and Sale to set forth the details of their agreement;
NOW, THEREFORE, in consideration of the mutual representations,
warranties, covenants, and agreements contained herein, and for good
and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, Seller and Purchaser agree as follows;
1. Purchase and Sale. Purchaser hereby agrees to purchase and
Seller hereby agrees to sell and convey unto Purchaser all of that
plot, piece or parcel of land described in Paragraph 2 below
(hereinafter "property ") in accordance with the terms conditions
herein set forth.
2. Property. The property to be purchased by Purchaser and
sold and conveyed unto Purchaser by Seller is located in Stewarts
Creek Township, Harnett County, North Carolina and is more
particularly described as follows:
Beginning at a new iron pipe (control corner)
located at the intersection of the southern margin of
the right of way of N.C.S.R. 1779 and the western
margin of the right of way of N.C.S.R. 2055, and runs
thence from said beginning point along, with and as the
western margin of the right of way of said N.C.S.R.
2055 South 14° 30' 00" East 40 feet to a new iron pipe;
and runs thence South 64° 15' 00" West 40 feet to a new
iron pipe; and runs thence North' 14° 30' 00" West 40
feet to a new iron pipe in the southern margin of the
right of way of N.C.S.R. 1779; and'runs thence along,
with and as said southern margin of the right of way of
N.C.S.R. 1779 North 64° 15' 00" East 40 feet to the
point and place of beginning containing 1,537 square
feet and is designated as Pump Station No. 3 on a plat
entitled "Bunnlevel- Riverside Pump Station Sites and
Easements" prepared by Ragsdale Consultants, P.A. dated
July 29, 1988.
3. Purchase Price. The purchase price for the property is
$307.00 and shall be paid to Seller at the time of closing upon
delivery of a good and sufficient deed to said property to Purchaser
by Seller.
4. No Restrictions. It is agreed that there must be no
restrictions or easements upon the property that would prevent the
reasonable use of the property for purposes of construction and
maintenance of a wastewater pump station and sewer collection
pipelines and related appurtenances.
5. Prorations and Adjustments. Unless otherwise provided, the
following items shall be prorated and adjusted between the parties or
paid at closing:
a. Ad valorem taxes on real property shall be prorated on
a calendar year basis to the date of closing.
b. All late listing penalties, if any, shall be paid by
Sellers.

6. Conditions.
a. All deeds of trust, liens and other charges against the
Property must be paid and cancelled by Seller prior to or at closing.
b. Title must be delivered at closing by general warranty
deed and must be a fee simple marketable title, free of all
encumbrances except ad valorem taxes for the current year (prorated to
date of closing), utility easements and unviolated restrictive
covenants that do not materially affect the value of property and such
other encumbrances as may be assumed or specially approved by
Purchaser. The subject Property must.have legal access to a public
right of way.
7. Closing Expenses. Purchaser shall pay for the preparation
of a deed and for the revenue stamps required by law. Purchaser shall
pay for recording the deed.
8. Assignments. This contract may not be assigned without the
written agreement of all parties, but if the same is assigned by
agreement, then the same shall be binding on the Assignee and his
heirs, successors or assigns.
9. Parties. This contract shall be binding and shall inure to
the benefit of the parties and their heirs, successors, and assigns.
10. Entire Agreement. This contract contains the entire
agreement of the parties and there are, no representations,
inducements, or to other provisions other than those expressed in
writing. All changes, additions or deletions hereto must be in
writing and signed by all parties.
11. Closing. All parties agree to execute and and all documents
and papers necessary in connection with closing and transfer of title
on or before October 18, 1989, at a place mutually agreed upon by the
parties. Deed is to be made to Purchaser.
12. Possession. Possession shall be delivered at the time of
closing.
13. Counterparts. This Contract of Purchase and Sale shall
become a binding contract when signed by both Seller and Purchaser and
is executed in duplicate counterparts with an executed counterpart
being retained by each party hereto.
14. Subject to Uniform Act. This Contract of Purchase and Sale
shall be subject to the provisions of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970.
15. Gender. The singular as used herein shall include the
plural and any reference to gender shall include masculine, feminine
and neuter.

as an easement and right of way is adjacent to the aforesaid 1,600
square foot parcel, contains 10,000 square feet, and is also owned
by Moses McCants and wife, Dessie Mae McNeill McCants and Cynthia
Edwina McCants; and
WHEREAS, in accordance with the Act,an offer has been made to
said owners to acquire the referenced easement and right of way for
the sum of Four Hundred Dollars ($400.00), which said sum is the
appraised value thereof as determined by the appraisal and review

and desire to sell and convey the described land and
to it; and

Bunnlevel and Riverside Communities of Harnett County; and
WHEREAS, Purchaser is in need of a portion of the tract of land
described in the above mentioned Deed for the purpose of locating a
wastewater pump station thereon and to carry out one of its
governmental functions; and
WHEREAS, Seller desires to sell to Purchaser the property needed
by said Purchaser; and
WHEREAS, Seller and Purchaser desire to enter into this Contract
of Purchase and Sale to set forth the details of their agreement;
NOW, THEREFORE, in consideration of the mutual representations,'
warranties, covenants, and agreements contained herein, and for good
and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, Seller and Purchaser agree as follows:
1. Purchase and Sale. Purchaser hereby agrees to purchase and
Seller hereby agrees to sell and convey unto Purchaser all of that
plot, piece or parcel of land described in Paragraph 2 below
(hereinafter "property ") in accordance with the terms conditions
herein set forth.

2. Property. The property to be purchased by Purchaser and
sold and conveyed unto Purchaser by Seller is located in Stewarts
Creek Township, Harnett County, North Carolina and is more
particularly described as follows:
Beginning at a new iron pipe (control corner)
located at the westernmost corner of Lot No. 41 as
shown on plat recorded at Map. Book 19, page 13, Harnett
County Registry, said beginning point also being the
point of intersection of the northern margin of the
right of way of S.R. 1779 and the eastern margin of the
right of way of an unnamed soil roadway; and runs
thence from said beginning point North 40° 11' 00" East
40 feet to a new iron pipe; and runs thence South 50°
04' 00" East 40 feet to a new iron pipe; and runs
thence South 40° 11' 00" West 40 feet to a new iron
pipe in the northern margin of the right of way of S.R.
1779 and runs thence along, with and as said margin of
the right of way North 50° 04' 00" West 40 feet to the
point and place of beginning, containing 1,600 square
feet and is designated as Pump Station No. 6 on a plat
entitled "Bunnlevel- Riverside Pump Station Sites and
Easements" prepared by Ragsdale Consultants, P.A. and
dated July 29, 1989.

225, Harnett County Registry.
3. Purchase Price. The purchase price for the property is
$64.00 and shall be paid to Seller at the time of closing upon
delivery of a good and sufficient deed to said property to Purchaser
by Seller.
4. No Restrictions. It is agreed that there must be no
restrictions or easements upon the property that would prevent the
reasonable use of the property for purposes of construction and
maintenance of a wastewater pump station and sewer collection
pipelines and related appurtenances.
5. Prorations and Adjustments. Unless otherwise provided, the
following items shall be prorated and adjusted between the parties or
paid at closing:
a. Ad valorem taxes on real property shall be prorated on
a calendar year basis to the date of closing.
b. All late listing penalties, if any, shall be paid by
Sellers.
6. Conditions.
a. All deeds of trust, liens and other charges against the
Property must be paid and cancelled by Seller prior to or at closing.
b. Title must be delivered at closing by general warranty
deed and must be a fee simple marketable title, free of all
encumbrances except ad valorem taxes for the current year (prorated to
date of closing), utility easements and unviolated restrictive
covenants that do not materially affect the value of property and such
other encumbrances as may be assumed or specially approved by
Purchaser. The subject Property must have legal access to a public
right of way.
7. Closing Expenses. Purchaser shall pay for the preparation
of a deed and for the revenue stamps required by law. Purchaser shall
pay for recording the deed.
8. Assignments. This contract may not be assigned without the
written agreement of all parties, but if the same is assigned by
agreement, then the same shell be binding on the Assignee and his
heirs, successors or assigns.

9. Parties. This contract shall be binding and shall inure to
the benefit of the parties and their heirs, successors, and assigns.
10. Entire Agreement. This contract contains the entire
agreement of the parties and there are no representations,
inducements, or to other provisions other than those expressed in
writing. All changes, additions or deletions hereto must be in
writing and signed by all parties.
11. Closing. All parties agree to execute and and all documents
and papers necessary in connection with closing and transfer of title
on or before October 18, 1989, at a place mutually agreed upon by the
parties. Deed is to be made to Purchaser.
12. Possession. Possession shall be delivered at the time of
closing.
13. Counterparts. This Contract of Purchase and Sale shall
become a binding contract when signed by both Seller and Purchaser and
is executed in duplicate counterparts with an executed counterpart
being retained by each party hereto.

mentioned Deed for the purpose of constructing sanitary sewer
collection lines thereunder and to carry out one of its governmental
functions; and
WHEREAS, Seller desires to sell to Purchaser the easement and
right of way needed by said Purchaser; and
WHEREAS, Seller and Purchaser desire to enter into this Contract
of Purchase and Sale to set forth -the details of their agreement;
NOW, THEREFORE, in consideration of the mutual representations,
1. Purchase and Sale. Purchaser hereby agrees to purchase and
Seller hereby agrees to sell and convey unto Purchaser that easement
and right of way under and across that plot, piece or parcel of land
all as described in Paragraph 2 below (hereinafter "property ") in
accordance with the terms conditions herein set forth.
2. Property. The easement and right of way under and across
the property to be purchased by Purchaser and sold and conveyed unto
Purchaser by Seller is located in Stewarts Creek Township, Harnett
County, North Carolina and is more particularly described as follows:
A perpetual easement and right of way with the right to erect,
construct, install and lay, and thereafter use, operate, inspect,
repair, maintain, replace, remove, change the size of or protect a
pipeline or pipelines and appurtenances for sanitary sewer collection
purposes, together with the right of ingress and egress to and from
the same over the adjacent lands of the Seller, his successors and
assigns, for the purposes aforesaid, over, under, through and across
the land hereinafter described, which land, is situated in Stewart's
Creek Township, in Harnett County, State of North Carolina, and more
particularly described as follows:

Beginning at new iron pipe located at the southernmost
corner of Lot No. 21 as shown on plat recorded at Map Book
19, page 3, Harnett County Registry, said beginning point
also being the point of intersection of the northern margin
of the right of way of S.R. 1779, and the western margin of

beginning point along, with and as the northern margin of

RESOLUTION AUTHORIZING PURCHASE
OF EASEMENT AND PUMP STATION SITE
(Bayles Property)
(Bunnlevel- Riverside Wastewater Facilities Project)
WHEREAS, Harnett County, (hereinafter sometimes referred to
as the "County ") for itself and as contracting agent for the South
Central Water and Sewer District of Harnett County is planning to
construct wastewater collection and disposal facilities to serve
the Bunnlevel and Riverside Communities within the County; and
WHEREAS, in order to construct said facilities, it is
necessary for the County to obtain certain parcels of land upon
which pump stations will be located and to obtain certain easements
and rights of way under which collection pipelines will be
constructed; and
WHEREAS, pursuant to the direction of the Board of
Commissioners of Harnett County, the Harnett County Department of
Public Utilities has proceeded to make provision for the
acquisition of said lands or rights in land and in connection
therewith has obtained appraisals of such properties, as required,
from a competent appraiser and obtained review appraisals of the
same, all in accordance with the provisions of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act
of 1970, 42 U.S.C. 54601 et.seq., (hereinafter "the Act "); and
WHEREAS, as provided by the Act, the County has determined
that the amount of the just compensation to be offered for
acquisition of the land or rights in land desired for use in
connection with the Bunnlevel- Riverside Wastewater Facilities
Project shall be the amount determined by the described appraisals
and review appraisals; and
WHEREAS, one of the parcels of property desired by the County
is a 2,507 square foot parcel located along the right of way of the
Norfolk and Southern Railroad, in Stewart's Creek Township, the
same being owned by William P. Bayles and wife, Janet Daphine
Bayles; and
WHEREAS, in accordance with the Act, an offer has been made
to the aforesaid owners to acquire the described parcel for the sum
of One Hundred Dollars ($100.00) which said sum is the appraised
value thereof as determined by the appraisal and review appraisal
mentioned above; and
WHEREAS, one of the parcels of property desired by the County
as an easement and right of way is adjacent to the aforementioned
2,507 square foot parcel, contains 4,998 square feet, and is also
owned by William P. Bayles and wife, Janet Daphine Bayles; and
WHEREAS, in accordance with the Act, an offer has been made
to said owners to acquire the referenced easement and right of way
for the sum of Two Hundred Dollars ($200.00), which said sum is the
appraised value thereof as determined by the appraisal and review
appraisal mentioned above; and
WHEREAS, said owners have accepted the offers
and desire to sell and convey the described land and
to it; and
WHEREAS, attached hereto as Exhibit 1 is
Purchase and gale which sets forth the terms of
purchase and sale of the 2,507 square foot parcel;

Commissioners in its capacity as the governing body of the County
of Harnett and in its capacity as the governing body of the South
Central Water and Sewer District of Harnett County that:
1. The County and the South Central Water and
Sewer District of Harnett County are hereby
authorized to execute and enter into the
Contracts of Purchase and Sale attached hereto
as Exhibit 1 and Exhibit 2 and the appropriate
officers of each are directed to execute the
same for and on behalf of each.
2. The appropriate representatives of the County
are directed to proceed with closing the
purchase of the described land and rights in
land so as to facilitate the construction of
the Bunnlevel- Riverside Wastewater Facilities
Project.
3. The expenditure of the costs of purchase of the
referenced land and rights in land is hereby

Daphine Bayles by Holman Milby and wife, Emma Milby by deed recorded
in Book 641, page 631 in the office of the Register of Deeds of said
County; and
WHEREAS, the County of Harnett for itself and as contracting
agent for the South Central Water and Sewer District of Harnett County
intends to construct wastewater collection facilities to serve the
Bunnlevel and Riverside Communities of Harnett County; and
WHEREAS, Purchaser is in need of a portion of the tract of land
described in the above mentioned Deed for the purpose of locating a
wastewater collection line thereon and to carry out one of its
governmental functions; and
WHEREAS, Seller desires to sell to Purchaser the easement and
right of way needed by said Purchaser; and
WHEREAS, Seller and Purchaser desire to enter into this Contract
of Purchase and Sale to set forth the .details of their agreement;
NOW, THEREFORE, in consideration of the mutual representations,
warranties, covenants, and agreements contained herein, and for good
and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, Seller and Purchaser agree as follows:
1. Purchase and Sale. Purchaser hereby agrees to purchase and
Seller hereby agrees to sell and convey unto Purchaser that easement
and right of way under and across that plot, piece or parcel of land
all as described in Paragraph 2 below (hereinafter "property ") in
accordance with the terms conditions herein set forth.

2. Property. The easement and right of way under and across
the property to be purchased by Purchaser and sold and conveyed unto
Purchaser by Seller is located in Stewart's Creek Township, Harnett
County, North Carolina and is more particularly described as follows:
A perpetual easement and right of way with the right to erect,
construct, install and lay, and thereafter use, operate, inspect,
repair, maintain, replace, remove, change the size of or protect a
pipeline or pipelines and appurtenances for sanitary sewer collection
purposes, together with the right of ingress and egress to and from
the same over the 'adjacent lands of the Seller, his successors and
assigns, for the purposes aforesaid, over, under, through and across
the land hereinafter described, which land, is situated in Stewart's
Creek Township, in Harnett County, State of North Carolina, and more
particularly described as follows:
Beginning at a point in the eastern margin of the right of
way of the Norfolk and Southern Railroad, said point also
being the southernmost corner of the property of William P.
Bayles and wife, Janet Daphine Bayles as set forth in that
deed recorded at Book 641, page 631, Harnett County
Registry, and runs thence from said beginning point along,
with and as the eastern margin of the right of way of said
railroad along an arc of 249.9 feet, with a chord bearing of
North 23° 48' 32" West and a chord distance of 249.41 feet
to a point, corner with Bunnlevel- Riverside Pump Station
Site No. 2; and runs thence along, with and as the line of
said pump station site, North 76° 10' 00" East 20.02 feet to
a point; and runs thence leaving the line of the said pump
station site, along an arc of 242.89 feet, with a chord
bearing of South 23" 48' 32" East, and a chord distance of
242.43 feet to a point in the southeastern line of the
property of William P. Bayles and wife, Janet Daphine
Bayles; and runs thence along, with and as said line South
56° 05' 16" West 20.03 feet to the point and place of
beginning, containing .113 acre and is designated as. "20'
Utility Easement D" on a plat entitled "County of Harnett,
Bunnlevel- Riverside 20' Utility Easements" prepared by
Ragsdale Consultants, P.A. dated December 13, 1988.
The above described property is a portion of that
property acquired by the Grantor by deed recorded at Book
641, page 631; Harnett County Registry.
3. Purchase Price. The purchase price for the property is
$200.00 and shall be paid to Seller at the time of closing upon
delivery of a good and sufficient Deed of Easement to said property to
Purchaser by Seller.
4. No Restrictions. It is agreed that there must be no
restrictions or easements upon the property that would prevent the
reasonable use of the property for purposes of construction and
maintenance of sewer collection pipelines and related appurtenances.
5. Prorations and Adjustments. Unless otherwise provided, the
following items shall be prorated and adjusted between the parties or
paid at closing:
a. Ad valorem taxes on real property, if any are
applicable, shall be prorated on a calendar year basis to the date of
closing.
b. All late listing penalties, if any, shall be paid by
Sellers.
6. Conditions.
a. All deeds of trust, liens land other charges against the
Property must be paid and cancelled by Seller prior to or at closing.
b. Title must be'delivered at closing by Deed of Easement
in a form approved by Purchaser free of all encumbrances except ad
valorem taxes for the current year, if any are applicable, (prorated
to date of closing), utility easements and unviolated restrictive
covenants that do not materially affect the value of property and such
other encumbrances as may be assumed or specially approved by
Purchaser. The subject Property must have legal access to a public
right of way.

7. Closing Expenses. Purchaser shall pay for the preparation
of a deed and for the revenue stamps required by law. Purchaser shall
pay for recording the deed.
8. Assignments. This contract may not be assigned without the
written agreement of all parties, but if the same is assigned by
agreement, then the same shall be binding on the Assignee and his
heirs, successors or assigns.
9. Parties. This contract shall be binding and shall inure to
the benefit of the parties and their heirs, successors, and assigns.
10. Entire Agreement. This contract contains the entire
agreement of the parties and there are no representations,
inducements, or to other provisions other than those expressed in
writing. All changes, additions or deletions hereto must be in
writing and signed by all parties.
11. Closing. All parties agree to execute any and all documents
and papers necessary in connection with closing and transfer of title
on or before October 18, 1989, at a place mutually agreed upon by the
parties. Deed of Easement is to be made to Purchaser.
12. Possession. Possession shall be delivered at the time of
closing.
13. Counterparts. This Contract of Purchase and Sale shall
become a binding contract when signed by both Seller and Purchaser and
is executed in duplicate counterparts with an executed counterpart
being retained by each party hereto.
14. Subject to Uniform Act. This Contract of Purchase and Sale
shall be subject to the provisions of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970.
15. Gender. The singular as used herein shall include the
plural and any reference to gender shall include masculine, feminine
and neuter.
