REPORT
The Harnett County Board of Commissioners met in regular session on Monday,
July 3, 1989, at the County Office Building in Lillington, North Carolina,
with the following members present: Mack Reid Hudson, Rudy Collins, and
Vice - Chairman Bill Shaw presiding. Others present were Dallas H. Pope, County
Manager; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board;
and Shirley Wicker, Recording Secretary.
Vice - Chairman Bill Shaw called the meeting to order at 9 a.m.
Commissioner Rudy Collins offered the invocation.
The minutes from the regular meeting of June 19, 1989, and special meeting of
June 26, 1989, were approved.
Commissioner Collins made a motion to designate Commissioner Lloyd G. Stewart
as primary voting delegate for the NCACC Annual Conference in Raleigh on
August 10 -13, 1989, and Commissioner Collins as alternate. Commissioner
Hudson seconded the motion and it passed with a unanimous vote.
Commissioner Collins made a motion for the reappointment of Ms. Lyda Sanderfer
to the Domiciliary Advisory Committee for a three -year term. Commissioner
Hudson seconded the motion and it passed with a unanimous vote.
Bobby Wicker, Tax Administrator, presented a Resolution Adopting a Real
Property Revaluation System on Each Even Calendar Year for the County of
Harnett, State of North Carolina. Commissioner Hudson made a motion to adopt
the resolution. Commissioner Collins seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated July 3, 1989, as Document No. 1.
Tony Wilder, Project Supervisor, Tax Department, submitted to the Board for
its consideration, a proposed 1990 Revaluation Schedule of Values.
Commissioner Collins made a motion that the Board consider the proposed 1990
Revaluation Schedule of Values; that the Board publish a statement in a
newspaper having general circulation in the county stating the proposed
schedules have been submitted to the Board and are available for public
inspection in the assessor's office; and that a public hearing on the proposed
schedules will be held by the. Board on August 7, 1989, at 9 a.m. in the County
Office Building. Commissioner Hudson seconded the motion and it passed with a
unanimous vote.
Dallas H. Pope, County Manager, reported on inter - departmental budget
amendments. This report is copied in full at the end of these minutes dated
July 3, 1989, as Document No. 2.
Bobby Wicker, Tax Administrator, reported on activities of the Tax Department
for the month of June and requested the following tax refunds:

Commissioner Collins made a motion to approve the tax refunds. Commissioner
Hudson seconded the motion and it passed with a unanimous vote.
Bobby Wicker, Tax Administrator, presented a list of tax release requests.
Commissioner Hudson made a motion to approve the releases. Commissioner
Collins seconded the motion an it passed with a unanimous vote. The list of
tax releases is copied in full at the end of these minutes dated July 3, 1989,
as Document No. 3.
Dallas H. Pope, County Manger; gave the Tax Attorney's report for the month of
June and the report is copied in full at the end of these minutes dated July
3, 1989, as Document No. 4.
REQUEST FOR Carla Stephens, Planning Supervisor, requested the appointment of alternate
ALTERNATE MEMS. member(s) to the Board of Adjustment. After much discussion, Commissioner
BD. OF ADJUST. Collins moved to call for a public hearing on the proposal to appoint
alternate members to the Board of Adjustment. Commissioner Hudson seconded
the motion and it passed with a unanimous vote.
Rodney Tart, Public Utilities Director, presented to the Board an Ordinance

ORD.- USER User Charge System for Bunnlevel- Riverside. Commissioner Hudson made a motion
USER CHARGE SYS. that the Ordinance User Charge System be adopted. Commissioner Collins
seconded the motion and it passed with a unanimous vote. The Ordinance is
copied in full at the end of these minutes dated July 3, 1989, as Document No.
5.

DOCUMENT NO. 1.
John M. Phelps, II, Public Utilities Attorney, presented two resolutions
regarding encroachment agreement with Southern Railway System for Northwest
Water and Sewer District. Commissioner Collins made a motion that the two
resolutions be adopted. Commissioner Hudson seconded the motion and it passed
with a unanimous vote. The resolutions are copied in full at the end of these
minutes dated July 3, 1989, as Document Nos. 6 and 7.
Dallas H. Pope, County Manager, presented the Sheriff's Department report for
the month of June.
Commissioner Collins made a motion to go into executive session concerning
pending litigation. Commissioner Hudson seconded the motion and it passed
with a unanimous vote.

Commissioner Collins made a motion to approve the budget amendment for Public
Utilities. Commissioner Hudson seconded the motion and it passed with a
unanimous vote.
Dallas H. Pope, County Manager, presented a Memorandum of Understanding
between St. Joseph of the Pines, Inc., dba St. Joseph Hospital Home Health
Agency, and Harnett County Department of Social Services for Chore Services.
Commissioner Hudson made a motion to approve the Memorandum of Understanding.
Commissioner Collins seconded the motion and it passed with a unanimous vote.
There being no further business, the Harnett County Board of Commissioners
regular meeting of July 3, 1989, duly adjourned at 11 a.m.

RESOLUTION
ADOPTING A REAL PROPERTY REVALUATION SYSTEM ON EACH EVEN CALENDAR YEAR
FOR THE COUNTY OF HARNETT, STATE OF NORTH CAROLINA
WHEREAS, the Board of County Commissioners is authorized by the
General Statutes of North Carolina to establish a revaluation system
on each even calendar year for real property in Harnett County; and
WHEREAS, it has been determined by the Harnett County Board of
Commissioners that such a system would facilitate a more adequate
fair market value of real property and would be helpful to the tax-
payers of Harnett County.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that effective January 1, 1990, a revaluation system on
each even calendar year will be established and applied to all real
property in Harnett County, in accordance with the provisions of
G.S. 105-286(a)(2); .and
BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded
according to G.S. 105- 286(a)(2) to the North Carolina Department of
Revenue for approval.

WASTEWATER USER CHARGE SYSTEM
BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS THAT
THE USER CHARGE SYSTEM FOR THE BUNNLEVEL - RIVERSIDE WASTEWATER
COLLECTION FACILITIES SHALL BE AS FOLLOWS:
General:
The Bunnlevel /Riverside Wastewater Collection. System, a small diameter
variable grade collection system, consists of approximately 27,000 1.f of
4 ", 6 ", and 8" collection lines, 281 interceptor tanks and service lines,
41.000 1.f of 2" through 8" force mains, and six (6) wastewater pumping
stations. The Bunnlevel /Riverside Collection System serves approximately
281 customers.
Metered water usage for customers is anticipated to be 16,590,000
gallons in 1990 (45,450 gpd.).
User Charges
The system user charges consist of the following separately determined
costs:

- Special Services Costs
Customers costs consist of billing, collection, administrative, debt
amortization costs, account service, and code enforcement. These costs are
shared equally by all customers regardless of the amount of wastewater
discharged.
Commodity costs include administration; operation, maintenance and
repairs; collection, pumping and treatment costs.
Commodity costs are based on the quantity of domestic strength
wastewater discharged and are calculated on a unit amount per 1000 gallons.
For simplicity, services charges are based on metered water usage. Unit
amounts are calculated on the basis of actual water metered.
Special services costs include charges for sewer service
installations, sewer main extensions, industrial wastewater monitoring (if
needed), and laboratory analyses of industrial wastewater.
The following is a synopsis of the user charge calculations:

With a total annual volume collected and pumped by Bunnlevel- Riverside
of 16,590',000 gallons, the cost per 1,000 gallons for collection and
pumping wastewater inside project limits:

Special Services Cost:
The cost for service connections including interceptor tank, service
line, connections to the mains, and labor is recovered by direct fee to the
user in the amount of the actual cost of the Harnett County Public
Utilities Department.
Other costs associated with individual users include industrial
wastewater monitoring, treatability studies, special sewer main extensions,
etc. Cost for these services are recovered by direct fee to the user in
the amount of the actual cost of the Harnett County Public Utilities
Department.

Other Provisions:
Each user shall be notified, at least annually, in conjunction with a
regular bill, of the rate and that portion of the user charges which are
attributable to wastewater treatment services.
The County shall review not less often than every two (2) years the
wastewater contribution of users and user classes, the total costs of
operation and maintenance of the treatment works, and its approved user
charge system pursuant to the applicable Federal and State rules and
regulations.
This User Charge System shall be operated pursuant to the applicable
North Carolina General Statutes which provide for an accurate accounting
for revenues and expenditures, and shall be based upon an adequate budget
identifying the basis for determining the annual operation and maintenance
costs and the costs of personnel, material, energy and administration.

WHEREAS, the County of Harnett, through its Department of Public
Utilities, pursuant to contract, will operate water transmission lines
in the Northwest Water and Sewer District of Harnett County; and
WHEREAS, in order to obtain the necessary license to construct
and maintain water transmission lines upon and under rights of way or
properties owned by the Southern Railway Company, it is necessary for
the County of Harnett to enter into the Agreement attached hereto as
Exhibit "A "; and
WHEREAS, the County of Harnett desires to enter into said
Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that:.
1. The County of Harnett is hereby authorized to and shall
enter into the Agreement with Southern Railway Company
attached hereto as Exhibit "A ".
2. Dallas H. Pope, Harnett County Manager is hereby authorized
..ant directed to execute the said Agreement for and in behalf
of the County of Harnett.
3. The expenditure of the sum of Twelve Hundred ($1,200.00)

EXHIBIT A
IT IS AGREED between
SOUTHERN RAILWAY COMPANY, a Virginia corporation, hereinafter styled
Company; and
HARNETT COUNTY, an instrumentality of government created pursuant to
the laws of the State of North Carolina, hereinafter styled Licensee:
1. Company grants unto Licensee, insofar as its title enables it so
to do, the license, as a personal privilege and not transferable without the
written consent of Company, to construct and ,maintain a 12 -inch water pipeline
encased in a 24 -inch pipeline along, across r.nd under the right of way or
property (hereinafter called "property ") of Company, at or near RAWLS, North
Carolina, crossing said property at a point 2166.18 feet south of Milepost 4,
and continuing within said property a distance of 160 feet to a point 2006.18
feet south of Milepost 4; the aforementioned installation, hereinafter called
"Facility ", being that identified and located substantially as shown on
annexed print of Drawing marked Exhibit A, dated February 6, 1989 (furnished
by Licensee).
Licensee will pay the lump sum of $1,200.00 as a consideration for the license
hereby granted. Licensee further agrees to reimburse Company, upon bill
rendered, for any and all expenses which may be incurred by Company, resulting
from or in connection with any such special engineering studies, field
supervision Or flagging protection as Company may find necessary to perform in
connection with the installation or maintenance of said Facility.

2. Licensee will construct and maintain Facility, at its expense, in
such manner as will not interfere with operations of Company or endanger
persons or property of Company, and in accordance with (a) plans and
specifications (1f any) shown on said print and any other specifications
reasonably prescribed by Company, (b) applicable regulations prescribed by
statute or by governmental authority, and (c) applicable specifications
adopted by the American Railway Engineering Association when not in conflict
with plans, specifications or regulations mentioned in (a) and (b) above.
Licensee shall give the Division Superintendent of Company at least 72 hours'
advance notice of Licensee's intention to begin construction of said
Facility. Licensee will, at its expense, make such changes in location, grade
or construction of Facility, as may be, at any time, required by Company.
3. Whenever cathodic protection is installed, Licensee will notify
Company prior to its being placed In service in order that tests may be
conducted on Company's signal and communications systems for possible
interference. If said Facility causes degradation of the signal or
communications facilities of Company, Licensee, at its expense, will relocate
the cathodic protection and /or provide such necessary protection and /or
corrective equipment as may be necessary to eliminate said interference to the
satisfaction of Company. This provision applies to the existing signal and
communications equipment of Company and to any said signal or communications
equipment which Company may install in the future.
4. If Facility endangers or Interferes with operations of Company,
or if Licensee Is in default hereunder and does not remedy such default or
condition after notice by Company so to do, this license may be revoked by
Company and Licensee shall, at its expense, upon written notice by Company,
and in any event upon termination of this agreement by either party as
hereinafter provided, remove Facility from Company's property and restore said
property to its condition existing prior to construction of Facility. If
Licensee fails to remove Facility, Company may do so at Licensee's expense.
If an emergency arises which in Company's judgment requires immediate repairs
to Facility, Licensee will, upon request, do the necessary work, or failing so
to do, Company may make such repairs at Licensee's expense.
5. Said Facility shall be constructed and maintained at the sole
risk of Licensee and Licensee agrees, without regard to negligence on the part
of Company or any other corporation controlling, controlled by or under common
control with Company, to save Company or any other corporation controlling,
controlled by or under common control with Company. wholly harmless from and
against all claims, damages, expenses and liability (whether or not such
liability has been judicially determined) for loss of life, personal injury or
damage to property, resulting from or in any manner attributable to the
construction, maintenance, use, operation or presence of the Facility, or to
the presence of the equipment or employees of Licensee, on Company's
property.
6. (a) During the period of construction or any period of
maintenance, repair, renewal, removal or relocation of the Facility, Licensee
shall insure the obligations assumed in Article 5 in a manner and with a
company satisfactory to Company and with a combined single limit (bodily
injury, death or property damage) of not less than $2,000,000.
(b) In the event a pipeline involves hazardous materials,
Licensee shall provide evidence of General Liability insurance with a combined
single limit of not less than $2,000,000 throughout the term of the agreement.
(c) If an outside contractor is to construct, maintain, repair,
renew, remove or relocate said Facility on Company's premises, then Licensee,
in addition to the insurance provided for in subsection (a) hereof, shall
require said contractor to furnish Company with a Railroad Protective
Liability Insurance Policy naming Company as the named insured and Issued to
the contractor, with a combined single limit of $2,000,000 for all damages
arising out of bodily injury, death, property damage liability and physical
damage to property liability per occurrence with an aggregate limit of
$6,000,000.

"Facility" being that identified and located substantially as shown on
annexed print of Drawing marked Exhibit A, dated February 17, 1989 (furnished
by Licensee).
Licensee will pay the lump sum of $1,500.00 as a consideration for the license
hereby granted. Licensee further agrees to reimburse Company, upon bill
rendered, for any and all expenses which may be incurred by Company, resulting
from or in connection with any such special engineering studies, field
supervision or flagging protection as Company may find necessary to perform to
connection with the installation or maintenance of said Facility.
