HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING,-JUNE 5, 1989
CALL TO ORDER
MINUTES
The Harnett County Board of Commissioners met in regular session on Monday,
June 5, 1989, at the County Office Building, Lillington, North Carolina, with
the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson,
Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were:
Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W.
Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary.
Chairman Stewart called the meeting to order at 9:15 a.m.
Conuuissioner Collins moved for the approval of the minutes from the regular
meeting, May 15, 1989. Commissioner Shaw seconded the motion and it passed
with a unanimous vote.

FIRE DISTRICT
Goff, Director, Agriculture Extension, briefed the Board on Family
Prevention and Services Project. Commissioner Smith moved for the
continued participation in this project. Commissioner Collins
the motion and it passed with a unanimous vote.
E. Marshall Woodall, Attorney for Town of Coats, presented a proposed resolu-
tion concerning changing the boundaries of the Grove Rural Fire District by
including the territory of the Town of Coats. A public hearing concerning
this matter is scheduled for June 19, 1989.
Dr. Tom Wilson, Lee - Harnett Mental Health Authority, briefed the Board on
services provided by Lee - Harnett Mental Health and requested additional
funding consideration for F.Y. 89 -90.
W.P. FERRIS W. Glenn Johnson, County Attorney, presented a User Object Software Agreement
SOFTWARE AGREE. between W. P. Ferriss, Inc. and Harnett County involving Board of Elections.
Commissioner Smith moved for the approval of the agreement. Conmussioner Shaw
seconded the motion and it passed with a unanimous vote.

MCC BOARD
W. Glenn Johnson, County Attorney, presented a Software License Agreement
between Carolina Software, Inc. and Harnett County involving Public Utilities
Department. Commissioner Hudson moved for the approval of the agreement.
Commissioner Shaw seconded the motion and it passed with a unanimous vote.
Dallas H. Pope, County Manager, presented a contract between David M. Griffith
and Associates and Harnett County involving 1989 Cost Allocation Plan Update.
Commissioner Smith moved for the approval of the contract. Commissioner
Collins seconded the motion and it passed with a unanimous vote.
John M. Phelps, Public Utilities Attorney, presented a Resolution Amending an
Ordinance Regulating the Use of Water and Sewer Facilities Operated by the
County of Harnett Fixing Rents, Rates, Fees and Other Charges and Providing
for Collection of Same. Commissioner Hudson moved for the adoption of the
resolution. Commissioner Smith seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated June 5, 1989, as document no. 1.
John M. Phelps, Public Utilities Attorney, presented a Resolution Authorizing
Consent to Assignment of Engineering Agreements. Commissioner Shaw moved for
the adoption of the resolution. Commissioner Collins seconded the motion and
it passed with a unanimous vote. The resolution is copied in full at the end
of these minutes dated June 5, 1989, as document no. 2.
Commissioner Collins moved that Mr. Sam Miriello and Mr. Bill Shaw be reap-
pointed to Central Carolina Community Colleges' Board of Trustees.
Commissioner Smith seconded the motion and it passed with a unanimous vote.
MARGARET RANDALL Dallas H. Pope, County Manager, informed the Board that a letter of resig-

Carla Stephens, Planning Supervisor, presented a subdivision plat for 8 lots,
RA -30, owned by Fred Wagstaff, located in Buckhorn Township on S.R. 1406.
Commissioner Smith moved for the approval of the subdivision plat. Commis-
sioner Hudson seconded the motion and it passed with a unanimous vote.
Vanessa W. Young, Finance Officer, reported to the Board on list of 1978 taxes
to be charged off. Commissioner Shaw moved for the approval of the list of
taxes to be charged off. Commissioner Collins seconded the motion and it
passed with a unanimous vote.
ATH OF OFFICE Vanessa W. Young, Clerk to the Board, administered the Oath of Office for
ANDA SPIVEY Deputy Tax Clerk to Wanda Spivey. The Oath of Office is copied in full at the

ITY OF DUNN
Dallas H. Pope, County Manager, presented a resolution commending the City of
Dunn on receiving the A11- America City Award. Commissioner Smith moved for
the adoption of the resolution. Commissioner Hudson seconded the motion and
it passed with a unanimous vote. The resolution is copied in full at the end

RESOLUTION RE: Dallas H. Pope, County Manager, presented for consideration, a resolution for
JAMES F. LOVETTE Mr. James F. Lovette who recently received the Outstanding Senior Citizen
Award from the North Carolina Senior Citizens Association. Commissioner
Hudson moved for the adoption of the resolution. Commissioner Smith seconded
the motion and it passed with a unanimous vote. Chairman Stewart presented
the resolution to Mr. Lovette. The resolution is copied in full at the end of
these minutes dated June 5, 1989, as document no. 5.

Bobby Wicker, Tax Administrator, requested tax releases totaling $26,653.12.
Commissioner Smith moved that the tax releases be approved. Commissioner Shaw
seconded the motion and it passed with a unanimous vote. The list of tax
releases is copied in full at the end of these minutes dated June 5, 1989, as
document no. 6.

Commissioner Collins moved for the approval of the budget amendment. Commis-
sioner Smith seconded the motion and it passed with a unanimous vote.
Dallas H. Pope, Budget Officer, presented the proposed Harnett County
F.Y. 1989 -90 Budget Message to the Board. Mr. Pope explained in detail a
summary of the proposed budget and stated that the Board would not consider
the adoption of the budget at this time. He explained that the General
Statutes require that the budget, after its presentation, is to lay open for
public inspection in the Office of the Clerk to the Board for ten days; after
which, a public hearing will be held on the proposed budget. After the public
hearing, the Budget Ordinance will be presented to the Board for
consideration.
A.C. LANDFILL W. Glenn Johnson, County Attorney, presented a resolution concerning extension
PROPERTY TIMBER on timber removal from Anderson Creek Landfill property. Commissioner Smith
moved for the adoption of the resolution. Couuuissioner Collins seconded the
motion and it passed with a unanimous vote. The resolution is copied in full

Chairman Stewart recessed the meeting at 12:35 p.m.
Chairman Stewart reconvened the meeting at 1:30 p.m. and called to order a
public hearing concerning Secondary Roads Improvements Program for F.Y.
1989 -90.
Mr. Wayne Bailey, Division Engineer, North Carolina Department of Transpor-
tation, presented and discussed the proposed Secondary Roads Improvement
Program for F.Y. 1989 -90 and an extended program.
Chairman Stewart opened the meeting for public comments.
No comments were offered.
Chairman Stewart closed the public hearing at 2 :30 p.m.
Chairman Smith moved for the approval of the Secondary Roads Improvement
Program and Extended Program as presented by Mr. Bailey. Commissioner Shaw
seconded the motion and it passed with a unanimous vote.
There being no further business, the Harnett County Board of Commissioners
meeting of June 5, 1989, duly adjourned at 2:30 p.m.

. RESOLUTION AMENDING AN ORDINANCE
REGULATING THE USE OF WATER AND
SEWER FACILITIES OPERATED BY THE
COUNTY OF HARNETT FIXING RENTS, RATES,
FEES AND OTHER CHARGES AND PROVIDING FOR
COLLECTION OF SAME
PREAMBLE
WHEREAS, the County of Harnett has established a Department of
Public Utilities for the purpose of managing and operating water
supply and distribution systems owned and /or operated by said County;
and
WHEREAS, the County has heretofore adopted that certain ordinance
entitled "An Ordinance Regulating the Use of Water and Sewer
Facilities Operated by the County of Harnett Fixing Rents, Rates, Fees
and Other Charges and Providing for Collection of Same" to provide
said'Department of Public Utilities with reasonable rules and
regulations to protect and regulate said water supply and distribution
systems owned and /or operated by the County, and
WHEREAS, said Department of Public Utilities is incurring costs
with respect to processing delinquent accounts and related matters;
and
WHEREAS, it has been recommended that a delinquent service fee be
imposed upon overdue accounts for the purpose of defraying those costs
incurred by the Department of Public Utilities in processing the same;
and
WHEREAS, the Harnett County Board of Commissioners desires to
amend the above mentioned Ordinance by adopting a new Section 30
therefor, entitled "Delinquent Service Fees ".
NOW, THEREFORE, BE IT ORDAINED by the Harnett County Board of
Commissioners that the following shall be added to and become a part
of that ordinance entitled "An Ordinance Regulating the Use of Water
and Sewer Facilities Operated by the County of Harnett Fixing Rents,
Rates, Fees and Other Charges and Providing for Collection of Same ",
the same to apply to all water supply and distribution systems owned
and /or operated by the County of Harnett:
SECTION 30: DELINQUENT SERVICE FEES
a. FEE ESTABLISHED
Except as provided in subsection e of this section,
when a consumer shall have failed to pay his account (as
specified in subsection c of this section) by the due date
set forth on his bill, a delinquent service fee shall be
imposed upon him and the amount of such fee shall be added
to his balance due.
b. AMOUNT OF FEE
The amount of the delinquent service fee provided for
in this section shall be the sum of Five ($5.00) Dollars.
c. FAILURE TO PAY ACCOUNT - SPECIFIED
A consumer shall have failed to pay his account when
the full amount charged to him for services supplied as
stated on his bill has not been paid over to and received by
the County Department of Public Utilities by 5:00
• o'clock p.m. on the due date set forth on his bill.
d. BILL SPECIFICATIONS
The bill which shall be mailed to a consumer setting
forth the charges due for services supplied, shall state the
due date, the amount of the bill if paid by the due date,
the amount of the bill if paid after the due date and shall
further state that if payment is not made by the due date
that the delinquent service fee will be charged.
e. WAIVER
When a consumer has paid all bills rendered to him by
the due date set forth on each bill for twelve consecutive
billing periods, should that consumer then make a payment
after a due date, the delinquent service fee shall be waived
for that period.
f. EFFECTIVE DATE
This Section'shall be effective on and after the lst
day of July, 1989.
AND BE IT RESOLVED that the above stated amendment shall become
effective on the lst day of July, 1989.

RESOLUTION AUTHORIZING
CONSENT TO ASSIGNMENT
OF ENGINEERING AGREEMENTS
WHEREAS, the Harnett County Board of Commissioners sits as the
governing body of six county water and sewer districts, each created
pursuant to Article 6 of Chapter 162A of the North Carolina General
Statutes; and
WHEREAS, such Districts have heretofore entered into agreements
with Black & Veatch, Inc. relating to engineering services for said
Districts; and
WHEREAS, Harnett County has also heretofore entered-into an
agreement with Black & Veatch, Inc. relating to engineering services
for said County; and
WHEREAS, said Black & Veatch, Inc. desires to assign all of its
rights, title and interest in and to said agreements to Black &
Veatch, a partnership; and
WHEREAS, the Harnett County Board of Commissioners, as the
governing body of Harnett County and of the said county water and
sewer districts, desires to consent to the assignment of the
hereinbelow described agreements from Black & Veatch, Inc. to Black &
Veatch, a partnership.

1. The assignment of the following agreements regarding
engineering services for the named county water and sewer
districts from Black & Veatch, Inc. to Black & Veatch, a
partnership is hereby consented to f,r and in behalf of said
Districts:
a. Agreement for Engineering Services dated December 1,
1986 and all amendments thereto with respect to the
Northwest Water and Sewer District of Harnett County.
b. Agreement for Engineering Services dated May 16,
1984 and all amendments thereto with respect to the
South Central Water and Sewer District of Harnett
County.
c. Agreement for Engineering Services dated May 6,
1986 and all amendments thereto with respect to the
West Central Water and Sewer District of Harnett
County.
d. Agreement for Engineering Services dated June 22,
1988 and all amendments thereto with respect to the
East Central Water and Sewer District of Harnett
County.
e. Agreement for Engineering Services dated April 18,
1988 and all amendments thereto with respect to the
Southeast Water and Sewer District of Harnett County.
f. Agreement for Engineering Services dated March 7,
1989 and all amendments thereto with respect to the
Southwest Water and Sewer District of Harnett County.
2. The assignment of the Agreement for Engineering Services
dated February 2, 1987 and all amendments thereto with
respect to engineering services for Harnett County from
Black & Veatch, Inc. to Black & Veatch, a partnership is
hereby consented to for and in behalf of said County.
3. Dallas H. Pope is hereby authorized to execute such
documents or other papers necessary so as to indicate the
consents hereinabove given.

THAT, WHEREAS, the City of Dunn has received the A11- America City Award
from competition with four hundred cities from across the United States; and,
WHEREAS, the City of Dunn was the smallest winning city, but had the
largest delegation of members at the National Civic.League Awards Jury
competition in Chicago; and,
WHEREAS, the City of Dunn, All- Pmerica City Award was based on a
partnership among all city citizens, the Chamber of Commerce, the civic and
Service organizations and churches of the City of Dunn; and,
WHEREAS, the City of Dunn community involvement with the General William
C. Lee Airborne Museum, the Afternoon in the Park celebration, the expansion
and renovation of the Betsy Johnson Memorial Hospital, the realignment of City
voting district to provide for minority representation of the City Council,
and the Community Pride exposition placed the City of Dunn in the winning
circle for the A11- America City Award; and,
WHEREAS, the Chairman of the National Civic League Board stated "the
unique American spirit of rolling up our sleeves and working together to make
our community a better place in which to live is truly reflected by the
accomplishments of the City of Dunn" in receiving the A11- America City Award.

NOW, THEREFORE BE IT RESOLVED, that the Harnett County Board of
Commissioners does hereby commend and congratulate the City of Dunn for its
accomplishments in winning the A11- America City Award.

RESOLUTION
THAT, WHEREAS, James F. Lovette, Retired Pharmacist, received the
Outstanding Senior Citizen Award from the North Carolina Senior Citizens
Association; and,
WHEREAS, James F. Lovette, even though restricted with rheumatoid
arthritis contributed enumerable hours in addressing the problem of illiteracy
in Harnett County; and,
WHEREAS, James F. Lovette, serves as President of the Harnett County
Literacy Council and has tutored eleven adults, seven of whom are inmates at
the State Correctional Center, serves as Vice Chairman of the Retired Senior
Volunteer Program Advisory Council, is a member of the One -on -One Youth
Services Advisory Council, is active in his church as teacher and member,
worked with Special Olympics program, has provided programs on Drug Abuse, and
has been involved with many other programs of support; and,
WHEREAS, James F. Lovette, is highly respected among his colleagues and
although retired, continues to be an active member of the Harnett
Pharmaceutical Society and the North Carolina Pharmaceutical Society; and,
WHEREAS, James F. Lovette, has been recognized and commended numerous
times for his services including, Volunteer of the Year Award, Harnett County
Community Leader Award, Governor's Volunteer Award for Community Service,
Lillington Chamber of Commerce Man of the the Year Award, Liberty's Man of the
Year Award, and the Congressional Prisoner of War Award.
NOW, THEREFORE, BE IT RESOLVED, that the Harnett County Board of
Commissioners does hereby commend and congratulate James F. Lovette for his
accomplishments in receiving the Outstanding Senior Citizen Award from the
North Carolina Senior Citizens Association.
BE IT FURTHER RESOLVED, that this resolution be spread upon the minutes,
copies be made available to the media, and presented to James F. Lovette.

THAT WHEREAS, the County of Harnett has heretofore purchased
from B. Leon Johnson and Lenda J. Taylor a parcel of property
containing 85.30 acres, more or less, which is described in the
deed recorded in Book 880, Page 48, Harnett County Registry; and
WHEREAS, as a part of such purchase the County of Harnett
agreed that the grantors shown in such deed shall be entitled to
harvest and sell any and all timber located on said parcel of
property at any time prior to Twelve Midnight on December 27,
1989, at which time such right is to automatically expire and
become void and of no effect; and
WHEREAS, said grantors have requested that the County of
Harnett extend the time for the harvesting of such timber through
and including Midnight on June 30, 1990; and
WHEREAS, the County of Harnett has agreed to such extension,
subject to the conditions hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board
of Commissioners as follows:
1. That the time period during which the grantors in the
above named instrument shall be entitled to harvest and sell any
and all timber located on the property described in the above
identified deed shall be and same is hereby extended for a period
beginning December 27, 1989 at Midnight and continuing through
and including June 30, 1990 at Midnight, subject, however to the
limitations hereinafter set forth.
2. In the event the grantors have not sold and had removed
or themselves harvested and removed said timber by the time the
County of Harnett desires to occupy and develop the subject
property then said County shall be entitled to proceed with its
occupancy and use of such property within the period of the
extension hereby granted without regard to any further rights of
said grantors or any successor in interest and may cut, push down
or otherwise remove or destroy said timber so that such usage by
the County of Harnett shall not be impeded, provided; however,
that the County of Harnett shall give to the grantors not less
than sixty (60) days prior notice of the date upon which it shall
begin its occupancy and development of said property if such is
to occur during the period of the extension of time hereby
granted.

3. The Chairman of the Harnett County Board of
Commissioners and Clerk to said Board are respectively authorized
to execute and attest this resolution and any documents which
might be recordable at the office of the Register of Deeds for
Harnett County in order to evidence the extension of time hereby.

SOUTH CENTRAL WATER & SEWER DISTRICT MEETING, JUNE 5, 1989
CALL TO ORDER
The Harnett County Board of Commissioners sitting as the Governing Body of
South Central Water and Sewer District of Harnett County met June 5, 1989, in
at the Harnett County Office Building, Lillington, North Carolina, with the
following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo
Smith, and Chairman Lloyd G. Stewart presiding. Also present were Dallas H.
Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young,
Clerk to the Board; and Kay S. Blanchard, Recording Secretary..
Chairman Stewart called the meeting to order at 12:15 p.m.
Commissioner Shaw presented the following resolution
and moved that it be adopted:
WHEREAS, the bond order hereinafter described has taken
effect and the Board of Commissioners of Harnett County, sitting
as the governing .body of South Central Water and Sewer District
of Harnett County, North Carolina, desires to borrow money for
.the purposes for which bonds are authorized to -be issued by said,
bond order in anticipation of the receipt of the proceeds of the
sale of said water bonds, as hereinafter provided; NOW, THEREFORE,
BE IT RESOLVED by the Board of Commissioners of Harnett
County, sitting as the governing body of South Central Water and
Sewer District of Harnett County, North Carolina (the "Issuer "),
as follows:
(1). The sum of $951,000 will be borrowed by the Issuer
in anticipation of the receipt of the proceeds of the sale of
bonds authorized to be issued by the water bond order, adopted by
the Board of Commissioners of :.Harnett County, sitting as the
governing body of the Issuer on July 22, 1985, for the purpose
for which said bonds are authorized to be issued. Negotiable
notes, each designated "Water Bond Anticipation Note," shall be
issued for said sum so borrowed.
(2) Said notes shall be dated June 20, 1989, shall be
payable March 21, 1990 and shall bear interest from their date at
a rate which shall not exceed twelve per centum (12%) per annum.
Such interest shall be payable at the maturity of said notes.
Each of said notes shall be signed by the Chairman of the
governing body of the Issuer and the Clerk of the Issuer and the
seal of the Issuer shall be affixed to each of said notes.

(3) The power to fix the rate of interest to be borne
by said notes and to determine the denomination or denominations
of the notes and the place of payment of the notes is hereby del-
egated to the Chairman of the governing body of the Issuer and
the Clerk of the Issuer who are hereby authorized and directed to
cause said notes to be prepared and to execute said notes when
they shall have been sold by the Local Government Commission of
North Carolina.
(4) The Chairman of the governing body of the Issuer
and the Clerk of the Issuer are hereby authorized to make
application to the Local Government Commission of North Carolina
for its approval of said notes in the manner prescribed by The
Local Government Finance Act. Said Local Government Commission
is hereby requested to sell the notes in the manner prescribed by
said Act. Said notes, when they shall have been sold by said
Commission in the manner provided by law and when they shall have
been executed in the manner prescribed by this resolution, shall
be turned over to the State Treasurer of the State of North
Carolina for delivery to the purchasers to whom they may be sold
by said Commission.
(5) The Issuer covenants, to the extent permitted by
the Constitution and laws of the State of North Carolina, to com-
ply with the provisions of the Internal Revenue Code of 1986 (the
"Code ") as enacted into law to the extent required to preserve
the exclusion from gross income of interest on the notes for
Federal income tax purposes.
(6) The Issuer hereby represents that (i) the proposed
$951,000 Water Bond Anticipation Notes, dated June 20, 1989,
authorized by Section 1, hereof, are not private activity bonds
as defined in the Code and (ii) the Issuer, the County of
Harnett, other water and sewer districts and subordinate entities
to the County of Harnett, together with any subordinate entities
of the Issuer, reasonably expects that it will not issue more
than $10,000,000 of tax - exempt obligations (other than private
activity bonds which are not qualified 501(c)(3) bonds) during
calendar year 1989. In addition, the Issuer hereby designates
the above - mentioned notes as "qualified tax - exempt obligations"
for the purposes of Section 265(b)(3) of the Code.
The motion having been duly seconded and the resolution
having been considered, it was adopted by the following vote:

John M. Phelps, II, Public Utilities. Attorney, presented a Resolution Amending
Rules and Regulations of the South Central Water and Sewer District of Harnett
County - Section 28(b). Commissioner SHaw moved for the adoption of the
resolution. Commissioner Smith seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated June 5, 1989, as document no. 1.
Commissioner Collins moved that the newly adopted rate schedules be implemented
July 1, 1989. Commissioner Smith seconded the motion and it passed with a unanimous
vote.
There being no further business, the Harnett County Board of Commissioners sitting
as the governing body of South Central Water and Sewer District of Harnett County
duly adjourned at 12:30 p.m.

RESOLUTION AMENDING RULES AND REGULATIONS
OF THE SOUTH CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY
- SECTION 28(b)
WHEREAS, the Harnett County Board of Commissioners, sitting
as the governing body of the South Central Water and Sewer District
of Harnett County (hereinafter the "Board ") has heretofore
established Rules and Regulations for the operation of the
District's water distributionsystem; -and
WHEREAS, the Board, upon recommendation of the Harnett County
Department of Public Utilities, now desires to amend said Rules and
Regulations as hereafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners, sitting as the governing body of the South Central
Water and Sewer District of Harnett County that:
Section 28(b) of said Rules and Regulations as it is now
written is deleted; and the following Section 28(b) is substituted
in lieu thereof:
