The Harnett County Board of Commissioners sitting as the governing body of
Northwest Water and Sewer District of Harnett County met May 15, 1989, in the
County Office Building, Lillington, North Carolina, with the following members
present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman
Lloyd G. Stewart presiding. Others present were Dallas H. Pope, County
Manager; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Re-
cording Secretary.
CALL TO ORDER Chairman Stewart called the meeting to order at 9:30 p.m.
John M. Phelps, II, Public Utilities Attorney, briefed the Board concerning
purpose of the meeting.
Ralph Troutman, Engineer, Black & Veatch, Inc., presented and discussed bids
received for contracts for Water Facilities Project.
RESOLUTION RE: John M. Phelps, II, Public Utilities Attorney, presented resolution awarding
AWARD CONTRACTS contracts for Water Facilities Project - Phase I. Commissioner Collins moved
PHASE I. for the adoption of the resolution. Commissioner Hudson seconded the motion
and it passed with a unanimous vote. The resolution is copied in full at the
end of these minutes dated May 15, 1989, as document no. 1.

RESOLUTION RE:
TANK SITE
Vanessa W. Young, Clerk to the Board, presented a Project Ordinance to the
Board. Commissioner Collins moved for the adoption of the Project Ordinance.
Commissioner Smith seconded the motion and it passed with a unanimous vote.
The Project Ordinance is copied in full at the end of these minutes dated May
15, 1989, as document no. 2.
John M. Phelps, II, Public Utilities Attorney, presented a resolution re-
garding purchase of tank site. Commissioner Hudson moved for the adoption of
the resolution. Commissioner Smith seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes
dated May 15, 1989, as document no. 3.

ADJOURNMENT
There being no further business, the Harnett County Board of Commissioners
sitting as the governing body of Northwest Water and Sewer District of Harnett
County duly adjourned at 9:50 p.m.

DOCUMENT NO. 1.
RESOLUTION AWARDING CONTRACTS FOR
WATER FACILITIES PROJECT - PHASE I
(NORTHWEST WATER AND SEWER DISTRICT
OF HARNETT COUNTY)
WHEREAS, the Harnett County Board of Commissioners, sitting as
the governing body of the Northwest Water and Sewer District of
Harnett County (hereinafter the "Board ") has received from the
Consulting Engineers the results from the public bids on Contracts I
through IV of the Phase I Water Facilities Project for the Northwest
Water and Sewer District of Harnett County (hereinafter the
"District "); and
WHEREAS, the Engineers' Discussion of Bids has recommended award
of the contracts to the lowest responsible bidders which have
presented legally sufficient bids based on acceptance of the proposals
that will result in the best pricing available to the District; and
WHEREAS, the Board considers it in the best interest of the
District to proceed with acceptance of the lowest contract proposals
recommended by the Consulting Engineers, subject to final approval by
the attorney for the District and the Farmers Home Administration, and
desires to make provisions for the execution of contract documents and
other related matters with respect thereto.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners, sitting as the governing body of the Northwest Water
and Sewer District of Harnett County, as follows:
1. That Contracts I through IV for the Phase I Water Facilities
Project are hereby awarded to the following contractors at the amount
shown, contingent upon approval by the Farmers Home Administration of
the United States Department of Agriculture, and subject to the final
approval by the attorney for the District:
Contract I - Water Line Construction
Award to: Shutt Hartman Construction Co., Inc.
Route 2, Highway 150
Clemmons, N.C. 27012
For the unit price of $1,373,897.69, subject to adjustment
as provided by the contract documents.
Contract II - Water Line Construction
Award to: Hawley Construction, Inc.
Route 3, Box 214C
Kenly, N.C. 27524
For the unit price of $1,110,881.40, subject to adjustment
as provided by the contract documents.
Contract III - Booster Pumping Stations
Award to: Brown Utility Co.
202 Branchview Drive
Concord, N.C. 28025
For the lump sum contract price of $359,000.00, subject to
adjustment as provided by the contract documents.

Contract IV - 500,000 Gallon Elevated
Storage Tank
Award to: Caldwell Tanks, Inc.
4000 Tower Road
Louisville, Kentucky 40219
For the lump sum contract price of $378,000.00, subject to
adjustment as provided by the contract documents.
2. That after the approvals as stated above have been obtained,
the Chairman of the Board and the Clerk to the Board are authorized to
execute the contract documents pertaining to the above made contract
awards.
3. That upon completion of the proper execution of said
contract documents, and upon further authorization by the Farmers Home
Administration of the United States Department of Agriculture, Dallas
H. Pope, Harnett County Manager, is hereby authorized to issue Notices
to Proceed so as to cause the construction of the aforementioned
Project to commence.
4. 'That, Dallas H. Pope is hereby authorized to execute such
other documents and take such actions as are necessary to implement
the directions of this Resolution.

.NORTHWEST WATER AND SEWER DISTRICT
PROJECT ORDINANCE
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina sitting as the governing
board for Northwest Water and Sewer District:
Section 1.
The Northwest Phase I project consists of Hectors Creek and Buckhorn Townships. The
present population within the district is approximately 3,288 based on 2.74 persons per household. There
are over 1,200 potential connections along the proposed line of Phase I. There are presently over 850
connections that have committed to take water upon completion of the project. It is estimated that with
the completion of Phase I of this district, the total customer count will be 1,000.
The project will mainly consist of 72 miles of water mains in sizes of 2" throuth 12 ", fire hydrants,
one master meter vault, one booster pumping station, one 500,000 elevated storage tank and approximately
850 individual meter services. Water for this Phase will be purchased from the Northeast Metropolitan
Water District at the connection point located at the intersection of SR 1403 and Hwy 210. The district will
contract with the County utility department to manage and operate the system. The district will be
regulated by the Northwest Water and Sewer District Board of Advisors and the Harnett County Board of
Commissioners.
Section 2. The following amounts are hereby appropriated in the Northwest Phase I Water and
District for the construction of this project:
Construction $ 3,221,779.
Engineering Fees 272,395.
Land and Right -of -Ways 10,000.
Legal and Administration 30,000.
Meters 26,000.
Telemetry 88,000.
Interest 200,000.
Contingency 242,119.
TOTAL $ 4,090,293.
Section 3. It is estimated that the following revenues will be available in the Northwest Phase
I Water and Sewer District:
Farmers Home Administration Loan $ 1,604,000.
Farmers Home Administration Grant 1,674,000.
Tap -On -Fees 40,000.
Fuquay- Varina 772,293.
TOTAL $ 4,090,293.

DOCUMENT NO. 3.
RESOLUTION REGARDING PURCHASE OF
TANK SITE
(NORTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY)
WHEREAS, pursuant to a resolution entitled "Resolution
Regarding Option to Purchase Tank Site" adopted by the Harnett
County Board of Commissioners sitting as the governing body of the
Northwest Water and Sewer District of Harnett County (hereinafter
the "Board ") at its meeting on November 7, 1988, the Northwest
Water and Sewer District of Harnett County (hereinafter "District ")
entered into an Option to Purchase Real Estate from L. W. Bennett,
Jr., Trustee, as provided in that Deed recorded at Book 537, Page
211, Harnett County Registry; and
WHEREAS, said Option to Purchase Real Estate provides the
District with the exclusive right and option to purchase a .240
acre tract of real estate located along S.R. #1407 in Buckhorn
Township, Harnett County, North Carolina; and
WHEREAS, said Option further provides that the consideration
paid therefor, which is the amount of $100.00, shall be applied to
the purchase price of said tract, which purchase price is
$6,000.00; and
WHEREAS, the term of said Option, which originally expired on
April 3, 1989, was extended pursuant to an Option Extension dated
March 27, 1989 until the 5th day of July, 1989; and
WHEREAS, the consideration paid for said Option Extension,
which was the sum of $25.00, by its terms, shall also be applied
to the purchase price of the property, along with the original
option money; and

WHEREAS, the tract of real estate described in said Option to
Purchase Real Estate is of sufficient size to accommodate a water
storage tank and is physically located at a point which is
hydraulically suitable for such use; and
WHEREAS, the Board finds that within the next sixty days
construction of the water distribution system in the District
should commence and that the real estate described will be needed
in connection therewith; and
WHEREAS, the Board further finds that it is in the best
interest of the District to exercise the District's option to
purchase the referenced real estate, and to thereafter purchase the
same;
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners, sitting as the governing body of the Northwest Water
and Sewer District of Harnett County that:
1. The District is hereby authorized to exercise
its rights under the Option to Purchase Real
Estate and Option Extension described above,
and to thereafter purchase for the sum of
$6,000.00 (including the option monies
previously paid) the real estate described.
2. The appropriate officers and agents of the
governing body of the District, are hereby
directed and authorized to take any and all
such further action and to execute and deliver
such documents as may be necessary or advisable
to carry out the intent of this resolution and
to effect the purchase of the described real
property.

DOCUMENT NO. 4.
RESOLUTION REGARDING PURCHASE OF
MASTER METER SITE
(NORTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY)
WHEREAS, pursuant to a resolution entitled "Resolution
Regarding Option to Purchase Master Meter Site" adopted by the
Harnett County Board of Commissioners sitting as the governing body
of the Northwest Water and Sewer District of Harnett County
(hereinafter the "Board ") at its meeting on November 7, 1988, the
Northwest Water and Sewer District of Harnett County (hereinafter
"District ") entered into an Option to Purchase Real Estate from
Mary Sue Cotton Eason and husband, John D. Eason, and Richard Lewis
Cotton and wife, Doris S. Cotton; and
WHEREAS, said Option to Purchase Real Estate provides the
District with the exclusive right and option to purchase a .166
acre tract of real estate located along S.R. #1403 in Hector's
Creek Township, Harnett County, North Carolina; and
WHEREAS, said Option further provides that the consideration
paid therefor, which is the amount of $100.00, shall be applied to
the purchase price of said tract, which purchase price is $500.00;
and
WHEREAS, the term of said Option, which originally expired on
April 3, 1989, was extended pursuant to an Option Extension dated
March 27, 1989 until the 5th day of July, 1989; and
WHEREAS, the consideration paid for said Option Extension,
which was the sum of $25.00, by its terms, shall also be applied
