The Harnett County Board of Commissioners sitting as the governing body of Southwest Water and Sewer District of Harnett County met February 6, 1989, in the County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager.; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting t� order at 11:45 a.m. John M. Phelps, II, Public Utilities Attorney, presented a resolution re- garding filing application for approval of issuance of general obligation bonds of the district. Commissioner Shaw moved for the adoption of the resolution. Commissioner Collins seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated February 6, 1989, as document No. 1. John M. Phelps, II, Public Utilities Attorney, presented a resolution re- garding appointment of Vanessa W. Young as Clerk and Finance Officer of the district. .Commissioner Hudson moved for the adoption of the resolution. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated February 6, 1989, as document No. 2. John M. Phelps, II, Public Utilities Attorney, presented a resolution adopting a common seal for the district. Commissioner Collins moved for the adoption of the resolution. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated February 6, 1989, as document No. 3. Young, Clete to the Board RESOLUTION REGARDING FILING APPLICATION FOR APPROVAL OF ISSUANCE OF GENERAL OBLIGATION BONDS OF THE SOUTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, the Harnett County Board of Commissioners sitting as the governing body of the Southwest Water and Sewer District of Harnett County (hereinafter the "Board "), desires to provide a potable public water supply system to portions of the newly created Southwest Water and Sewer District of Harnett County (hereinafter "District "); and WHEREAS, it is now necessary to obtain funding to pay the costs of construction of the proposed system through the sale of general obligation bonds of the District; and WHEREAS, the District intends to construct water distribution pipelines in portions of the District where the number of users in a proposed area is of sufficient number so as to make construction of a water distribution pipeline in such area economically feasible; and WHEREAS, The District's Consulting Engineers have carefully studied the District and have prepared a construction Feasibility Report with total estimated costs of $3,828,000.00; and WHEREAS, the Board recognizes that there has been concern among the residents of the District regarding contamination of wells due to radon gas and lack of adequate ground water in the area and therefore finds that the project is necessary and expedient in order to provide potable and safe water to residents of the District, as well as A 1 L , _ .1 churches and places of business therein; and WHEREAS, the Board desires- to make application to the North Carolina Local Government Commission for the approval of the issuance of general obligation bonds of the District in an amount not to exceed $4,500,000.00; and WHEREAS, said amount is adequate and not excessive for the proposal prepared, in that it is sufficient to cover the estimated cost of construction of the water system and to cover any additional increase in cost due to inflation; and WHEREAS, the Board intends to construct the project without an increase in the property tax in the District; and WHEREAS, the estimated cost of water service for a user of the system as projected by. the District's Consulting Engineers is not excessive; and WHEREAS, the Board intends to construct the system only in the event that the project is economically feasible; and WHEREAS, during the construction and upon completion of the construction of the system in the District, the debt management policies and the budgetary and fiscal management policies of the District shall be carried out in full compliance with the applicable law; and WHEREAS, the Board desires to move forward with the application to seek approval of the above mentioned general obligation bonds, and desires to hold a bond election regarding the same as soon as practicable. NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS sitting as the governing body of the Southwest Water and Sewer District of Harnett County that: 1. The District is hereby authorized and directed to file an application with the North Carolina Local Government Commission seeking approval of the issuance of not more than $4,500,000.00 in general obligation bonds of the District. 2. John M. Phelps, II, Harnett County Public Utilities Attorney, is designated as representative of the District for the purpose of seeking the approval of the said bonds and is directed to file application for approval of bonds and to employ bond counsel to represent the District in the authorization and issuance of bonds. RESOLUTION REGARDING APPOINTMENT OF VANESSA W. YOUNG AS CLERK AND FINANCE OFFICER OF THE SOUTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, pursuant to the provisions of Article 6, Chapter 162A of the General Statutes of North Carolina, the Harnett County Board of Commissioners (hereinafter "the Board ") did, on October 17, 1988, create the Southwest Water and Sewer District of Harnett County; and WHEREAS, The Board now sits as the governing body of the Southwest Water and Sewer District of Harnett County (hereinafter "the District "); and WHEREAS, Vanessa W. Young currently serves as Clerk to the Harnett County Board of Commissioners and as Finance Officer for Harnett County and in such capacities will conducb.certain business of the District; and WHEREAS, the Board desires to acknowledge its intention that as Clerk to and Finance Officer for Harnett County, Mrs. Young shall serve as the Clerk to and for the Southwest Water and Sewer District and as Finance Officer for the same. NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners, sitting as the governing body of the Southwest Water and Sewer District of Harnett County, that: Vanessa W. Young as Clerk to and Finance Officer for Harnett County shall be and hereby is appointed Clerk and Finance Officer of the Southwest Water and Sewer District of Harnett County to serve in such capacity at the pleasure of the Board. Duly adopted this the (0 D-day of February, 1989, upon motion made by Commissioner ihalkok , seconded by Commissioner oS LIZ , and passed by the following vote: Ayes S Noes 0 Absent 0 Abstained U HARNETT COUNTY BOARD OF COMMISSIONERS SITTING AS THE GOVERNING BODY OF THE SOUTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY DOCOmPmT,mn RESOLUTION ADOPTING A COMMON SEAL FOR THE SOUTHWEST WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, the Southwest Water and Sewer District of Harnett County is a duly organized and existing county water and sewer district, having been created pursuant to Article 6, Chapter 162A of the North Carolina General Statutes and by resolution adopted October 17, 1988 by the Harnett County Board of Commissioners; and WHEREAS, N.C. Gen. Stat. §162&-88, provides that the District may have a common seal and alter and reuev, it at will; and WHEREAS, the District now desires to adopt as its common seal the seal of the County of Harnett. NOW, THEREFORE, BE IT RESOLVED, that the Barnett County Board of Commissioners, sitting as the governing body of the Southwest Water and Sewer District of Harnett County, does hereby adopt as the common seal for said District the following: A circular emblem with a circle drawn within it, and the name Southwest Water and Sewer District imprinted between the outer edge of the emblem and the inner circle.
