The Harnett County Board of Commissioners met in regular session on Monday,
February 6, 1989, at the County Office Building, Lillington, North Carolina,
with the following members present: Rudy Collins, Bill Shaw, Mack Reid
Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present
were: Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney;
Vanessa W. Young, Clerk to the Board; and Kay 5. Blanchard, Recording Secre-
tary.
Chairman Stewart called the meeting to order at 9:25 a.m.
The minutes from the regular meeting, January 17, 1989 were approved.
Ray Stone, Highway Maintenance Engineer, North Carolina Department of Trans-
portation, appeared before the Board to discuss road matters and situations in
Harnett County.
Dallas H. Pope, County Manager presented to Mr. Stone, a petition concerning
maintenance improvement of McDuffie Road.
Commissioner Collins moved for the adoption of a resolution for addition of
the realignment of SR 1413 to the Secondary Road Construction Program.
Commissioner Shaw seconded the motion and it passed with a unanimous vote.
The resolution is copied in full at the end of these minutes dated February 6,
1989, as document No. 1.
Carla Stephens, Planning Supervisor, presented an amendment to the Harnett
County Zoning Ordinance. Commissioner Hudson moved for the adoption of the
amendment. Commissioner Shaw seconded the motion and it passed with a unani-
mous vote. The amendment is copied in full in the Harnett County Ordinance
Book.
Carla Stephens, Planning Supervisor, presented an amendment to the Subdivision
Regulations for Harnett County. Commissioner Shaw moved for the adoption of
the amendment. Commissioner Smith seconded the motion and it passed with a
unanimous vote. The amendment is copied in full in the Harnett County Ordi-
nance Book.
Rodney M. Tart, Director, Public Utilities, presented an agreement between
Harnett County and Black & Veatch, Inc. for engineering services concerning a
Supervisory Control and Data Acquisition (SCADA) System, a computer telemetry
system to monitor and control the county water distribution system. Commis-
sioner Shaw moved for the execution of the agreement after approval by the
County Manager and County attorney. Commissioner Smith seconded the motion
and it passed with a unanimous vote.
Rodney M. Tart, Director, Public Utilities, presented an agreement between
Harnett County and Black & Veatch, Inc. for engineering services concerning a
new raw water pumping station to serve the Northeast Metropolitan Water Plant.
Commissioner Hudson moved for the approval of the agreement. Commissioner
Shaw seconded the motion and it passed with a unanimous vote.
'OSITION ADDED Rodney M. Tart, Director, Public Utilities, briefed the Board concerning the
0 PUBLIC UTILI. need of additional office support for Northeast and West Central Water and
Sewer Districts. Commissioner Smith made a motion that a clerk /typist posi-
tion be added. Commissioner Collins seconded the motion and it passed with a
unanimous vote.
'EQUEST FOR 911 Dallas H. Pope, County Manager, briefed the Board on resolutions that have
been received from the City of Dunn, and the Town of Erwin, requesting the
County conduct a feasibility study concerning the establishment of a 911
emergency number for Harnett County. The request will be considered during
the F.Y. 1989 -90 budget cycle.
:UDDY HINTON Commissioner Smith moved for the adoption of a resolution naming Mr. Buddy
PPOINTED TO Hinton as a member of the Averasboro Township Tourism Development Authority.
VERASBORO TOUR. Commissioner Hudson seconded the motion and it passed with a unanimous vote.

.Commissioner Collins made a motion to appoint Ms. Marie Dew, Lillington, to
the Domiciliary Home Community Advisory Committee. Commissioner Hudson
seconded the motion and it passed with a unanimous vote.
Commissioner Smith made a motion to appoint Mr. Eugene Smith, Dunn, to Mid -
Carolina Aging Advisory Board. Commissioner Hudson seconded the motion and it
passed with a unanimous vote.
Commissioner Collins moved that Commissioner Hudson be appointed to the D.O.D.
Joint Compatible Land Use Study Group Committee of the whole and that Dallas
H. Pope be appointed as alternate, and that Carla Stephens be appointed to the
Steering Committee and that Greg Wilder be appointed as alternate to the
Steering Committee. Commissioner Smith seconded the motion and it passed with

a unanimous vote.
RESOL. RE: W. Glenn Johnson, County Attorney, presented a resolution concerning request
PARCEL OF LAND by Board of Education regarding parcel of land near Triton School. Commis -
NEAR TRITON SCH. sioner Smith moved for the adoption of the resolution. Commissioner Hudson
seconded the motion and it passed with a unanimous vote. The resolution is
copied in full at the end of these minutes dated February 6, 1989, as document
No. 3.
AUTHORIZATION Gayle P. Holder, Register of Deeds, requested authorization to dispose of

RESOLUTION
- BE IT RESOLVED that the Harnett county Board of Commissioners do hereby,
by the proper execution 'of this document, request that the North Carolina
Department of Transportation add to the State's Secondary -Road System, the
addition of the realignment of State Road 1413, that was paved during the
1988 =89 Secondary Road Construction Program.

AVERASBORO TOWNSHIP TOURISM DEVELOPMENT AUTHORITY
THAT WHEREAS, the North Carolina General Assembly did, on the 5th day of
May, 1987, ratify legislation entitled "An Act to Authorize the Levy of a Room
Occupancy and Tourism Development Tax in Averasboro Township in Harnett County';
and
WHEREAS, the Harnett County Board of Commissioners, by resolution adopted
on July 6, 1987 ', did levy the tax therein authorized in Averasboro Township,
Harnett County, North Carolina, effective on the 1st day of September, 1987;
and
WHEREAS, in .said resolution so adopted on July 6, 1987, the Harnett County
Board of Commissioners established the Averasboro Township Tourism Development
Authority as provided in'the above referenced act of the North Carolina General
Assembly;: and
WHEREAS, the Harnett County Board of Commissioners.is charged with the
responsibility of appointing the members of such Tourism Development Authority
as prescribed in the above referenced act; and.
WHEREAS,.the Dunn Area .Chamber of Commerce has submitted the name of. Mr.
Buddy Hinton, Manager of Ramada Inn, to replace Mrs. Harriett Bennett, Manager
. of Howard Johnson, and has recommended his appointment to the Authority.
NOW, •THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners.
that Mr. Buddy Hinton, Manager of Ramada. Inn, shall be and is hereby appointed
to serve as -a member of said Authority. - -
Duly adopted by the Harnett County Board of Commissioners this 6th day of
February, 1989. .

HARNETT COUNTY.
RESOLUTION
THAT, WHEREAS the Harnett County Board of Education has
notified the Harnett County Board of Commissioners that the
property shown on the plat which is attached hereto as Exhibit A
and included within the area which is "crosshatched" on such
exhibit is in its opinion unnecessary or undesirable for public
school purposes; and
WHEREAS, the Harnett County Board of Education desires to
dispose of such property so identified according to the
procedures prescribed in the General Statutes of the State of
North Carolina; and
WHEREAS, the provisions of North Carolina General Statute
115C -518 require that the Board of Commissioners of the County in
which such property is located be given the first opportunity to
obtain said property; and
WHEREAS, the Harnett County Board of Commissioners has
determined that the subject property is not of value to the
County of Harnett for any public purpose and that said County
will not exercise the right to acquire such property as provided
by law:
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board
of Commissioners that the right of the County of Harnett to
acquire the above referenced property in the manner prescribed by
the General Statutes of the State of North Carolina shall not be
exercised, and that such property shall be and same is hereby
released from such right.

WHEREAS, the County of Harnett, by and through its Department of
Public Utilities, plans to operate sewer collection lines in the South
Central Water and Sewer District of Harnett County; and
WHEREAS, in order to obtain the necessary license to construct
and maintain certain sewer collection lines upon and under rights of
way or properties owned by the Southern Railway Company, it is
necessary for the County of Harnett to enter into the Agreement
attached hereto as Exhibit "A "; and
WHEREAS, the County of Harnett desires to enter into said
Agreement;
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that:
1. The County of Harnett is hereby authorized to and shall

2. Dallas H. Pope, Harnett County Manager, is hereby directed

attached hereto as Exhibit "A "; and.
WHEREAS, the County of Harnett desires to enter into said
Agreement;

top soil over the pipeline(s) is not permitted, unless otherwise
approved by Colonial's representative.
3. Right of way will stay clear of equipment vehicles and material at all

times, except as noted in Item 12.
4. Permanent structures are not permitted on the right of way. Manholes,
junction boxes, valve boxes, fire hydrants, service meters, storm
drain inlets, and utility poles are considered permanent structures.
The impoundment of water over the pipeline(s) is not allowed. No
fences or temporary structures shall be allowed in the right of way
without the express approval of Colonial's representative. Temporary
structures (ncl.:c• such items as signs, trailers, temporary power
poles, etc.
5. Upon request by the encroaching party, landowner or their agents,
Colonial will determine the approximate location of its pipeline(s)
and right of way limits; however, in doing so, Colonial makes no
warranty as to the accuracy of the locations and measurements given.
Colonial also cannot provide assurance that its permanent line markers
are positioned directly over its pipeline(s).
6. Pipeline markers made unusable or damaged shall be repaired or
replaced at the encroaching party's expense. In addition, no pipeline
markers shall be obscured from public view.
7. Blasting within the immediate vicinity of Colonial's right of way
shall be conditionally allowed. Blasting on Colonial's right of way
shall be permitted only with the approval of a Colonial representative
as to time and method with the prior approval of the Region
Engineering Manager.
8. The encroaching party agrees that all work on Colonial's right of way
shall be performed in a workmanlike manner and in compliance with
applicable governmental and industry standards and codes.
9. This approval is granted only to the extent of, and with no actual or
implied diminishment of, Colonial's rights and interests, and without
either express or implied warranty.
10. County Of Harnett agrees to defend and hold
Colonial harmless from all loss, cost, or other expense, attorney's
fees and court costs necessary to enforce any of the provisions
herein, including personal property and bodily injury damages, whether
occurring to it or to Colonial; the respective employees, agents, or
servants of either; or to third parties, which are proximately caused
by or arise from the installation, maintenance, or repair of your
works, with the exception of claims due to the sole negligence of
Colonial.
_..11...— Should any damage occur to the herein permitted encroachment,_as _a__.__
result of Colonial Pipeline Company exercising any of its rights at
any time, Colonial will not be responsible for said damages; and any
expense or monetary cost involved in the repair of said damages will
be borne by owners of said damaged encroachment.

Item•12: Only the initialed conditions by both the encroaching party and
Colonial`t•epteaentative shall apply.
A. Parallel occupancy of foreign utilities shall not be permitted
longitudinally within Colonial's right of way.
B. Foreign utilities crossing Colonial right of way shall be
installed a minimum of 2' -0" above or below Colonial's
pipeline(s), and this elevation must be maintained for the
entire width of the right of way. The angle of crossing shall
be as near a 90° angle as possible.
C. Ductile iron or steel foreign utility crossings do not require
encasement. Other utility crossings .shall be encasing in
( ) steel, ( ) concrete, or ( ) N/A
D. Fences shall be .constructed with gates sufficiently large to
allow Colonial's .maintenance personnel and equipment the right
of ingress and egress. Fence posts shall be installed to the
side of'the pipeline with a minimum of two (2) feet of hori-
zontal clearance.

E. The encroaching party acknowledges that Colonial's pipeline(s)
have impressed electrical current for the protection of the
steel. Any loss of this protection caused by the encroaching
party will be corrected -by Colonial personnel only. The cost
to correct this damage will be paid by the encroaching party.
F. The proposed new road or railroad shall comply with the minimum
clearances specified in Exhibit 13 or 13A. If these clearances
cannot be maintained, concrete protective slabs per Exhibits 14,
14A, 15, and 15A may be installed to protect the pipeline(s).
If the pipeline(s) have to be exposed and checked for coating
holidays, it shalt be paid for by the encroaching party.
• If the approximate location of the pipeline(s) is required,
steel prod bars, shovels and electrical sensing devices may be
used by Colonial'.s field personnel. It should be noted that
these methods are only approximate and can be misleading. The
exact location of the pipeline(s) can best be found through
test pitting!
•
H. If test pitting is required to determine the exact location and
elevation of the pipeline(s) at the time of construction,
Caution; notify • (per Item 1) so
that he may provide a Colonial representative at the site.
This representative must be present during the test pitting for
the protection of the pipeline(s) and common verification of
its location. All costs for this test pitting will be borne by
the encroaching party. Any, engineering based on Colonial or
other design criteria stemming from the amount or location of
this test, pit data is tha responsibility of the encroaching
party.
I. Colonial reserves the right to pen, cut, excavate and dig
acrosa'the proposed road or railroad, including avenues and
sidewalks; and in either such event, Colonial shall not be
liable for the restoration of same or the payment of any
damages to the encroaching party.
J. Excavation or grading which might result in erosion or which
could render the Colonial right of way inaccessible shall not
be permitted unless the encroaching party agrees to restore the
area and provide .protection to Colonial's pipeline(s). Any
erosion control measures within or protecting the right of way
including diversion dikes, sediment traps, silt fences, gravel
outlets, and emergency spillways will require approval of
Colonial's field representative as ,to equipment and method.
Heavy equipment shall not be permitted to operate over the
pipeline(s) unless earth padding has been provided to protect
the pipeline from vibrating, overloading or physical damage.
Temporary equipment crossings over the pipeline(s) are
permitted at selected locations as approved by Colonial's field
representative. Light to medium weight equipment will require
five (5) vertical feet of cover over the pipeline(s), and heavy
equipment will require six (6) vertical feet of cover. Colored
strips of plastic. shall be placed under the temporary fill at
original grade so that original grade will not be disturbed
when the temporary fill is removed. No equipment or vehicles
may be parked over the pipeline(s).

L. Original vegetation on Colonial's right of way shall not be
disturbed except areas of the above mentioned construction
and approved equipment crossings. High visiblity plastic fence
or other approved barricade shall be installed and maintained
by (check one) encroaching party , Colonial Pipeline
Company , along Colonial's right of way within the limits
of the project to insure that traffic does not travel over
Colonial's pipeline(s).
M. Burning or burying of trash, brush, debris, etc. shall not be
permitted within the Colonial right of way without approval__
from the Colonial representacive.
N. Only low—growing, ornamental type shrubbery or trees, with a
maximum height of four (4) feet tall, shall be allowed within
the right of way.
0. Cover above the pipeline(s) shall be a minimum of four (4)
feet, and in general, the following criteria as the maximum.

This criteria for maximum cover is for soil load only. If

Please signify acceptance of the above conditions by a proper official in the
space provided below.
Upon the failure of the encroaching party, owner or his agents to comply with
any of the terms of this Agreement, Colonial reserves the right to revoke this
Agreement in its entirety, prevent same from continuing any activity in viola-
tion of the terms of this Agreement or its rights under its easements and prior
agreements and make any necessary repairs or adjustments to its pipeline(s) or
right of way with its own forces at the expense of the party requesting the
encroachment.

RESOLUTION AUTHORIZING PUBLIC HEARING CONCERNING
CREATION OF THE EAST CENTRAL WATER AND SEWER DISTRICT
OF HARNETT COUNTY
WITNESSE.TH:
The Harnett County Board of Commissioners (hereinafter "the
Board") has been advised by citizens and residents of an area of
the County which is described hereinbelow, that there is a need
for public water facilities therein.
The area of the County is fully described below and is
referred to as the "East Central Water and Sewer District of
Harnett County":
BEGINNING at the point where the dividing line
between Averasboro and Grove Townships meets the Harnett
County - Johnston County line and runs thence in a
northwesterly direction along, with and as the Harnett
County - Johnston County line to the point where the
Harnett County - Johnston County and Wake County lines
meet; and runs thence in a west, northwesterly direction
along, with and as the Harnett County - Wake County line
to the point where the thread of Neill's Creek crosses
said county line; and runs thence along, with and as the
thread of Neill's Creek the courses and distances of said
creek in a south, southwesterly direction to the point
where the thread of said Neill's Creek, if extended,
would meet the southern bank of the Cape Fear River; and
runs thence along, with and as the southern bank of the
Cape_Fear River in a northwesterly direction to a point,
corner with the West Central Water and Sewer District of
Harnett County, said point begin. located 2700 feet east,
southeast of the point where the thread of Hector's Creek
meets the Cape Fear River; and runs thence leaving the
southern bank of the Cape Fear River, along, with and as
the boundary of the West Central Water and Sewer District
of Harnett County along a straight line South 45° West
perpendicular to and at right angles with said point on
the southern bank of the Cape Fear River 13,600 feet,

Road 1258, the same being at the community of Luart; and

The Board has heretofore authorized the preparation of a
"Feasibility Report" by Black & Veatch, Consulting Engineers,
regarding said East Central Water and Sewer District of Harnett
County and the report was presented to the Board at its meeting on
January 17, 1989.
After studying said report, and in an effort to satisfy the
needs and desires of the people of the area, the Board wishes to
consider creation of a water and sewer district to provide water
facilities therein.
The Board now desires to hold a public hearing, pursuant to
N.C. Gen. Stat. 8162A-86 et seq to consider creation of the East
Central Water and Sewer District of Harnett County.
NOW; THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS THAT:

1. A public hearing be held pursuant to N.C. Gen. Stat.
S162A -86 et sec( on Monday, March 13, 1989 at 7:00 o'clock p.m. at
the Coats Senior Citizens Center, Coats, North Carolina to consider
creation of the East Central Water and Sewer District of Harnett
County.
2. The County, and its officers, agents and attorneys are
hereby directed to take such actions of whatsoever nature and
execute such documents as necessary to hold the public hearing
herein described.
Duly adopted this (o* day of February, 1989, upon motion made
by Commissioner 4udioh , seconded by Commissioner
