HomeMy WebLinkAbout01031989 (3)HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, JANUARY 3, 1989 DOT CABLEVISION The Harnett County Board of Commissioners met in regular session on Monday, January 3, 1989, at the County Office Building, Lillington, North Carolina, with the following members present: Bill Shaw, Rudy Collins, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Recording Secre- tary. Chairman Stewart called the meeting to order at 9:20 a.m. The minutes from the regular meeting, December 19, 1989, were approved. Ray Stone, Highway Maintenance Engineer, North Carolina Department of Trans- portation, appeared before the Board to discuss road matters and situations in Harnett County. Terry Brown, General Manager, Southern Cablevision, reported on the progress of the construction of cablevision in Harnett County. RESOLUTION RE: Tom Meece, Director, Planning and Development, presented a resolution con - CAMPION PRODUCTS, cerning Industrial Revenue Bond Issuance regarding Champion Products, Inc. INC. Commissioner Smith made a motion to adopt the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated January 3, 1989, as document No. 1. AGREEMENT FOR Commissioner Shaw moved that the Agreement for Engineering Services associated ENGINEERING SER. with Farmers Home Administration /Environmental Protection Agency joint funding RAGSDALE CONSULT.Project between County of Harnett and Ragsdale Consultants, P.A. be approved. Commissioner Collins seconded the motion and it passed with a unanimous vote. DARE PROGRAM Ellen McClay, Harnett County Schools, and Lee Guthrie, State Bureau of Investigation, made a presentation on Drug Abuse Resistance Education (DARE) The DARE Program is a seventeen -week program for fifth -grade students that teaches them drug abuse resistance skills. Harnett County's first DARE officer, Max Matthews will begin in four Harnett County Schools this semester with program proposed for implementation in other schools in the fall. LEASE AGREE. Commissioner Shaw moved that a lease agreement between County of Harnett, and MAMERS MINI -SITE Eunice A. Bland and husband, Thomas A. Bland, be approved with the lease property to be utilized for a community refuse container site. Commissioner Smith seconded the motion and it passed with a unanimous vote. RESOL. RE: APPOINTMENTS TO AVERASBORO TOUR. DEV. AUTH. MABEL TAYLOR REPOINTED TO NURSING HOME COM. ADV. COMM. RESOL. RE: EMS POLICY BUDGET AMEND. Dallas H. Pope, County Manager, presented a resolution concerning appointments to Averasboro Tourism Development Authority. Commissioner Smith made a motion to adopt the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated January 3, 1989, as document No. 2. Commissioner Collins made a motion to reappoint Ms. Mabel Taylor, Rt. 2, Lillington, and Ms. Evelyn Smith, Kipling, to serve on the Nursing Home Community Advisory Committee for three -year terms to expire December -, 1991. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, presented a resolution adopting the Harnett County Emergency Medical Services Policy. Commissioner Smith made a motion to adopt the resolution. Commissioner Collins seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated January 3, 1989, as document No. 3. The Board was unable to consider a request for funding support of operation of LAMB Project from the Knights of Columbus due to non - availability of special project funds. Dallas H. Pope, County Manager, requested a budget amendment for Planning and Development, Code 10- 7200-046, Land Use Study, $2,317. increase for parti- cipation in the Joint Compatible Land Use Study in the Fort Bragg /Pope Air Force Base area. Commissioner Shaw made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Public Utilities, Code 30- 4100 -004, Professional Services, $6,750. increase; and Code 30- 4100 -013, Utilities, $6,750. decrease. The budget amendment is needed for legal fees and audit. Commissioner Collins made a motion to approve the budget amendment. Commissioner Hudson seconded the motion and it passed with a unanimous vote. AGREE. RE: Dallas H. Pope, County Manager, presented for consideration, a proposed solid SOLID WASTE STUDYwaste study contract agreement with Ragsdale Consultants. Commissioner Shaw moved that the contract for engineering services for a solid waste study between County of Harnett and Ragsdale Consultants, P.A. be approved after 158 recommended changes have been made to the contract agreement and reviewed and approved by the county attorney. Commissioner Smith seconded the motion and it .passed with a unanimous vote. The Board was unable to consider a request for funding from the Angier Senior Citizens Organization due to non - availability of special project funds. Dallas H. Pope, County Manager, presented a report on Inter - Departmental Budget Amendments. The report is copied in full at the end of these minutes dated January); 1989, as document'No. 4. Bobby Wicker, _Tax Administrator; reported on activities of the Tax Department. TAX LISTING Bobby Wicker, Tax Administrator, requested that the deadline for. listing taxes DEADLINE - EXTEND' -.be extended until February 15, 1989. Commissioner Hudson moved that the ED tax- listing date be extended from January 31, 1989, to February 15, 1989, in :accordance with the provisions of the general statutes. Commissioner Shaw seconded the motion and it passed with a unanimous vote. REPORT' T -ON INTER- DEPT.. BUDGET AMEND. Young, Cle RESOLUTION e Board Commissioner Stewart then introduced the following resolution which was read at length: WHEREAS, the Board of County Commissioners has created a political subdivision and body corporate and politic of the State of North Carolina known as "The Harnett county Industrial Facilities and Pollution Control Financing Authority" (the "Authority "); and. WHEREAS, the Authority is authorized under the Industrial and Pollution Control Facilities Financing Act, Chapter 159C of the General Statutes of North Carolina, as amended (the "Act "), to issue revenue bonds for the purpose, among others, of paying all or any part of the cost of any industrial project for industry, to acquire, construct and equip any such project, and to make and execute financing agreements, security documents and other contracts and necessary or convenient in the exercise of such powers; and WHEREAS, the Authority has determined to issue its revenue bonds in the principal amount of not more than $10,000,000 to pay all or a portion of the costs of the acquisition, construction and installation of an expansion by Champion Products Inc. of its existing industrial facility at 200 Champion Drive in Dunn, Harnett County for the custom imprinting and embroidery of athletic apparel, including the construction of an approximately 65,000 square foot building addition and the acquisition and installation of machinery and equipment (the "Project") to be operated by Champion Products Inc.; and WHEREAS, the Authority intends to file an application for approval of the Project with the Secretary of the Department of Commerce (the "Department "), as required by the Act; and WHEREAS, the Department has, by regulation, provided that no application for approval of a project will be officially received until the elected board of county commissioners of the county from which the application is made has, by resolution after a public hearing, approved the issue of revenue bonds and approved in principle the proposed project and a certified copy of such resolution has been provided to the Department; and 159 DOCUMENT NO. 2. WHEREAS, the Board of County Commissioners, pursuant to public notice duly given, has held a public hearing on the advisability of the Project and the issuance of revenue bonds to finance the Project and has considered the comments of persons who requested to be heard; and WHEREAS, in accordance with Executive Order 37 of the Governor of the State of North Carolina pursuant to Section 146 of the Internal Revenue Code of 1986, the Authority has applied on behalf of the Project for an allocation of the private activity bonds volume limitation for the State of North Carolina for the calendar year 1989 and the Authority and the Board of County Commissioners understand that such allocation may be used only for the Project and that, to the extent that the face amount of the revenue bonds issued by the Authority to finance the Project is less than said allocation, such excess allocation shall revert to the State of North Carolina; and WHEREAS, the Board of County Commissioners desires to approve the Project in principle and the issuance of revenue bonds to finance the Project; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Harnett as follows: (1) The Project is hereby approved in principle. (2) The issuance of revenue bonds by the Authority to finance the Project is hereby approved. (3) The Clerk of the Board of Commissioners is hereby authorized and directed to provide a certified copy of this resolution to the Department of Commerce. (4) This resolution shall take effect immediately upon its passage. Commissioner Smith moved the passage of the foregoing resolution and Commissioner Hudson seconded the motion, and the resolution was passed by the following vote: AYES: 5 NAYS: U HARNETT COUNTY NORTH CAROLINA RESOLUTION NAMING MEMBERS OF THE AVERASBORO TOWNSHIP TOURISM DEVELOPMENT AUTHORITY THAT WHEREAS, the North Carolina General Assembly did, on the 5th day of May, 1987, ratify legislation entitled "An Act to Authorize the Levy of a Room Occupancy and Tourism Development Tax in Averasboro Township in Harnett County "; and WHEREAS, the Harnett County Board of Commissioners, by resolution adopted on July 6, 1987, did levy the tax therein authorized in Averasboro Township, Harnett County, North Carolina, effective on the 1st day of September, 1987; and WHEREAS, in said resolution so adopted on July 6, 1987, the Harnett County Board of Commissioners established the Averasboro Township Tourism Development Authority as provided in the above referenced act of the North Carolina General Assembly; and WHEREAS, the Harnett County Board of Commissioners is charged with the responsibility of appointing the members of such Tourism Development Authority as prescribed in the above referenced act; and WHEREAS, the Dunn Area Chamber of Commerce has submitted the names of its current new president, Mr. Dwight Snow, who replaces Mr. Doug Fulghum, and its new vice president of Economic and Industrial Development, Mr. Patrick H. Pope, who replaces Mr. Abe Elmore, and has recommended their appointment to the Authority. NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners that Mr. Dwight Snow, President of the Dunn Area Chamber of Commerce, and Mr. Patrick H. Pope, Vice President of Economic and Industrial Development of the Dunn area Chamber of Commerce, shall be and they are hereby appointed to serve as ex officio members of said Authority with Mr. Dwight Snow designated as Chair for the Authority as set forth in the above referred act. Duly adopted by the Harnett County Board of Commissioners this 3rd day of January, 1989. DOCUMENT NO. 3. HARNETT COUNTY NORTH CAROLINA. RESOLUTION- 'HARNETT COUNTY EMERGENCY MEDICAL SERVICES' THAT WHEREAS,, the policy procedures for the Harnett County Emergency Medical Services Department requires updating due to changes that have, occurred effecting :Emergency Medical Services requirements; and .- WHEREAS,: policy procedures have been developed and require implementation by the Harnett County Emergency Medical Services Department in order to ensure . properand standardized services are being provided; and WHEREAS,' immediate implementation of policies for the Harnett County. Emergency Medical Services Department is required. . NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners hereby adopts the Harnett County Emergency Medical Services Policies - as presented in the attached Policies document, that the Harnett County Emergency Medical Services Policies document will be filed in the Harnett County Ordinance Book, and will be implemented by the Harnett County Emergency Medical Services Department on adoption.
