HomeMy WebLinkAbout2013/10/21 RESOLUTION AMENDING THE HC UNIFIED DEVELOPMENT ORD ART V SET 1.2,7.0, 11.0 & ART XIV SECT 2.2®Harnett COUNT Y NORTH CAROLINA w .harneR.org HARNETT COUNTY NORTH CAROLINA A RESOLUTION AMENDING THE HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE WHEREAS. the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the purpose of promoting the health, safety, and general welfare of the county residents; and WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North Carolina, particularly G.S. 15' A -340: and WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been followed: and WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the UDO as listed below and recommends the adoption of the following amendment. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY, NORTH CAROLINA that Article V, Sections 1.2 "Table of Use Types and Regulations ". 7.0 "Commercial Uses', 11.0 "Other Uses' and Article XIV, Section 2.2 "General Definitions" of the Unified Development Ordinance shall be amended as to read as indicated in "Attachments 1. 2. 3 and 4 ". `Attachments` are filed with the Unified Development Ordinance in the Clerk to the Board's Office. Use Regulations, Section 7.5.6 Shooting Range (Indoor & Outdoor) 7.5.6 FidngShoutigg Range (Indoor & Outdoor Shooting Ranges) A. Governmental training facilities. pubhc and private high schools_ colleges or universities shall not be required to adhere to the following regulations when firing ranges are utilized under the supervision of an instructor as a training or pracuce facility. In all other situations, all fixing ranges shall be required to obtain a conditional use pertnn whether the range is considered to be the primary or ancillary use of the property, unless otherwise specified within this Ordinance-In the required eonditienal tine litriiiii. 1. In addition to notification of conditional use permit requests for the purpose of outdoor firing— ranges made by the County, the applicant(s) shall make notification to all property owners within one (1) mile of the proposed facility. Such notification shall include the same information in the notification provided by the Count. proof of such notification shall be provided by the applicant(s), either by certified mail receipt, sworn statement, or evidence of publication of a one -half (' /z) page ad in a newspaper of local distribution. 13. The Following information shall be contained on the required conditional use permit application and site plan: 1. Information regarding the caliber of weapon(s) to be used at the facility, including details regarding the highest caliber weapon(s) to be used: 2. Information regarding how the facility will be designed to facilitate use of the highest caliber %veapon(s) proposed, including details regarding how the public will be protected from projectiles for such xveapon(s), in accordance with The NR9 Runge Soun e Book: 3. Information regarding how- the facility will provide containment of projectiles entirely within the bounds of such facility, in accordance with The tATRA Runge Soune Book: and il. A fib Ong range safer plan, including, at a minimum, the following information, written in accordance with The t\TRI1 Runge Soune Book to be used during the planning, construction, and operation of the facility. a. Guarantees of notification. 5. proposed hours and days of operation, which may be amended by the Board of Adjustment. C. The noise emitted from such facility shall be in compliance with the applicable regulations of the Harnett County Sheriffs Department. D. Indoor facilities shall, to the maximum extent feasible, be designed to meet the standards for indoor fiie<hrn� ranges in accordance with T lie NIU Range Sourre Book. Lice fire shoot houses shall be designed to meet the same standards. L. Outdoor facilities shall meet the follo%ung standards: 1. Adequate, handicap accessible restroom and parking facilities shall be provided to the rear of the firing fine. 2. Range boundarc shall be a nunimum of 200 feet from any public right(s) -of -way or dedicated access easement. 3. The target line shall be a minimum of 1,500 feet from any residential structure when the structure is located to the rear of the target line backstop. All other residential structures shall be located a minimum of 500 feet from the target line- 4. The direction of fire shall be parallel to or perpendicular to and agar from the public right(s)- of -wac or dedicated access casement. 5. Range shall be enclosed on two (2) sides be an earthen berm, stabilized using standard practices. Said berm shall be a minimum of 10 feet in height at a thickness that will not allow penetration of amv projectiles fired on the range. 6. Range target line shall be constructed to withstand the highest caliber weapons that will be shot on site, in accordance with 7be t \'R9 R nse Sorote Book. %. Sigrage shall announce the potential dangers and the presence of an active firing range utilizing highly risible colors. 9. A range safety officer shall be present at all times during the use of lire weapons. 10. \'chicle and pedestrian travel shall not be permitted within the 300 feet restricted area while the range is active. ATTACHMENT 3 Harnett County Unified Development Ordinance Use Regulations (Adopted October 17, 2011) Amend Article V. Use Regulations, Section 11.0 Article V. Use Regulations Section 11.0 Other Uses 11.3 Firearm Certification Facilities All firearm certification facilities not operating or located on an approved firing range are required to obtain conditional use approval from the Harnett Count Board of Adjustment. All certification facilities that contain a firing range shall adhere to the following standards: A. The firearm certification facility's firing range shall only be utilized for the purpose of displaying the practical shills necessary to obtain certification in this area of instruction. The display of practical shills involving firearms must be conducted in the presence of a certified firearms instructor. B. The firing range shall only be occupied by one student and the certified firearms instructor during the qualifying session of the certification process. C. The firing range utilized for qualification purposes shall be constructed to be in compliance with the following requirements: 1. The range backstop shall be constructed in a manner to contain projectiles without risk of ricochet or escape. 2. The range backstop or berm shall be constructed to a minimum height of ten (10) feet. D. The firing range shall be located to the rear of any structure approved for occupancy that is located on the same parcel of property. E. The length of the range measured from the firing line to the backstop shall be no greater than thirty (30) feet. F The range shall be designed to establish the direction of fire to be parallel or perpendicular to and away from all public right(s) -of -way. G. Adequate handicap accessible restroom and parking facilities shall be provided. 11.4 Gunsmithing Gunsmithing facilities operating in conjunction with and arc located on an approved firing facility shall be deemed as a permitted accessory use and shall not be required to obtain a conditional use permit. All other gunsmithing activities and facilities shall be required to obtain a conditional use permit. All non - exempt gunsmithing facilities shall adhere to the following requirements: :1. Gunsmithing facilities located within a residential structure shall not engage in the onsite displac or sale of firearms. B. Facilities that will utilize a test fire vault or berm shall disclose this information on the Board of Adjustment application, site plan and be approved as part of the conditional use approval. C. Gunsmithing facilities shall only utilize a test fire berm for the purpose of verifying proper working order of an assembled or repaired firearm. Recreational or anY other form of shooting is prohibited on a test fire berm. D. Facilities located Nvithin a residential subdivision shall only discharge a firearm within an approved test fire vault. Outdoor test fire berms are prohibited when gunsmithing facilities are located Nvithin a residential subdivision. G. Outdoor test fire berms shall only be fired upon from a distance no greater than avenrv- five (23) feet. Definitions & Certifications, Section 2.2 General Definitions IN'SIaRT the following: "Firearm Certification Facility, Firing Range, Governmental Trai ing Facilin, Gunsinithing, Test Fire Benn and Test Fire Vault'". DEL.ITE the definition "Shooting Range" 2.2 General Definitions Firearm Certification Facility A facility designed and utilized to perform instruction in areas associated with the concealment, possession, operation or discharge of a firearm which results in the granting of a level of certification issued by a licensed professional. Such facilities mac or may not include a qualifying range for the purpose of illustrating practical skill levels associated with a level of certification. Firing Range A specialized facility, either indoor or outdoor, that has been designed or utilized for the purpose of discharging projectiles from various sources such as firearns, archery equipment and other sources capable of propelling an object to impact a target. Governmental Training Facilities Facilities owned and operated by a Federal, State or Local form of government that are designed and utilized for the purpose of trailing or aiding in the practical skills necessary to perform duties as assigned be a governmental bode or agency. Such agencies mac include police, fire, rescue or other fornns of public service and protection. GunsmithinQ The act of performing repairs, modifications, design or assembly of a firearm. SHoeti� Test Fire Berm A compaction of soil utilized solely for the purpose of conducting a test to establish the proper working order of a firearm or other device that has the capabilit of propelling a projectile. Thus earthen bernm is generally located in an outdoor environment and must be constructed to a thickness that will allow for the projectile to be lodged within the berm without risk of escape and compacted to a minimum height of four (3) feet above target location. Test Fire Vault A structure designed and utilized solely for the purpose of conducting a test to establish the proper working order of a firearm or other device that has the capabilirc of propelling a projectile. This tepe of structure is designed to receive and contain the projectile without risk of escape.
