Minutes of Regular Meeting
August 6, 2012
The Harnett County Board of Commissioners met in regular session on Monday, August 6, 2012,
in the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman McNeill called the meeting to order at 9:00 am. Commissioner Burgin led the pledge
of allegiance and invocation.
Chairman McNeill called for additions and deletions to the published agenda. Chairman
McNeill requested the addition of the Designation of Voting Delegate for the upcoming NCACC
Annual Conference in Wake County. Commissioner Andrews moved to approve the agenda as
amended. Commissioner Burgin seconded the motion which passed unanimously.
Commissioner Burgin requested clarification for budget amendments #24 Public Utilities
Department Capital Project PU1002 South Central Wastewater 1B -2 in the amount of $63,000,
and #35 Various Departments, Social Services in the amount of $149,000. Commissioner
Burgin also requested the Report of Settlement for Marziano and McGougan, PA, against
Harnett County and the Harnett County Department of Public Utilities be removed from the
consent agenda for discussion.
Commissioner Burgin moved to approve the items on the revised consent agenda. Vice
Chairman Hill seconded the motion and the Board unanimously approved the following items on
the consent agenda:

3. Tax refunds, rebates and releases (Attachment 1)
4. Approval of the Harnett County 2013 Holiday Schedule
5. Public Utilities requested approval of the Revised Harnett County Department of Public
Utilities Capital Improvement Plan 2012 -2013.
6. Public Utilities requested approval of award of a construction contract in the amount of
$367,407.85 to Temple Grading and Construction. Harnett County received six (6) bids
with the lowest bid submitted by Temple Grading and Construction for the Campbell
University School of Osteopathic Medicine infrastructure project. HCDPU will be
reimbursed for this expenditure by Campbell University and a grant from the NC Rural
Center. (Attachment 2)
7. County Engineer requested approval of an agreement between Rural Center and Harnett
County for Campbell University Medical Center's water, sewer, natural gas and fiber
optic infrastructure improvements.
Chairman McNeill opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
- Lisa Teston and Morgan Cook, both teachers, spoke in support of building a new
middle school using QSCB money. Mrs. Teston said students cannot receive a
quality education in packed classrooms. They also spoke against the idea of
transporting students to under - capacity schools across the county.
- Karen Strecker, 225 Carolina Lakes, said her daughter has allergies as a result of
attending classes in a "vermin and mice infested" mobile unit. Superintendent Frye
said they were not aware of any mold in the mobile units.
- Joe Miller, of 136 Vick Keith Drive and a board of commissioners' candidate for
District 5, spoke in support of using the QSCB monies to build schools saying the
county needs to find a way to repay the interest free money even if it means
increasing taxes. Regarding bussing students; Mr. Miller said the county would still
be 600 seats short if every seat available was filled with a student.
- Daniel Glover, of Old Stage Road and a candidate for board of commissioners,
voiced his concerns regarding the county employees insurance plan and asked
commissioners to review and try to do something about it. Mr. Glover retracted his
earlier statement that the insurance plan is "catastrophic insurance" but said he
believes it is close to it.
- Victoria Hall of Green Springs Drive; a Harnett County native and real estate agent,
said she is selling homes to military families outside of Harnett County because they
feel like Harnett County is not putting their students first.
- Parrish Daughtry, 5063 Chicora Drive and President of the Harnett County Business
Education Partnership, said her children are not affected by the over - crowding in

Western Harnett schools yet strongly urged commissioners to build this new school.
Mrs. Daughtry said Harnett County is one of the lowest per student capita counties.
Teresa Suitt, a life -long resident of Harnett County, and Kern Burrell of 494 Crown
Point both spoke in support of the county using the zero percent interest monies to
build this new school.
Audra Desorbo of 5845 Old US Drive in Lillington said she did not want her children
riding a bus for an hour to get to school and she was sure commissioners wouldn't
want this for their children either.
Tammy Pope of 61 Bluebird Court and Jackie Kinnear of 444 Crown Point in
Carolina Lakes shared their concerns about the condition and safety of the mobile
units in use.
Harnett County Board of Education members Thomas Womble, Chairman Billy Tart
and Chuck Levorse thanked the commissioners for what they have done for schools
but stressed the need to build new schools in Harnett County.
Jason Yarborough or Lillington said he did not believe busing students to other
schools around the county seemed like the best thing to do.
Sharlene Jones of Angier asked if the county was hiring a doctor for county
employees which she was told they were not.
Mr. Tom Frye, Harnett County Superintendent, presented to the commissioners an update on the
Highland Middle School project. Mr. Frye said his first obligation is to ensure a safe
environment for the students. Mr. Frye reported the county's student enrollment is quickly
approaching 20,000. The student population in Harnett County increased by 77 students in
2011 -2012 which was considerably less than anticipated. He shared a table detailing out -of-
capacity facilities. Mr. Frye also reported that Harnett County has the 20th largest school district
out of 115 school districts in North Carolina.
Mr. Frye stated the Harnett County Board of Education's most pressing new construction need is
for a middle school in the vicinity of Highland Elementary School. In December 2011, the
Board of Education purchased approximately 180 acres of property adjacent to Highland
Elementary for the construction of a middle school and a high school. The total cost to open a
new middle school is approximately $30.9 Million of which approximately $28.6 Million of this
cost could be funded with QSCB dollars. Mr. Frye stated it takes approximately 24 months to
construct a middle school and to prepare it for opening and to meet the timeline to have a new
middle school open for the 2015 -2016 school year, Harnett County Commissioners must give
foitual approval to proceed with the project no later than August 31, 2012.
Mr. Jeff Tsai made a presentation to the Board. Mr. Tsai, a school enrollment forecasting
specialist from NCSU, has worked with Harnett County for years projecting school growth
populations. He said the county as a whole is 108 percent over capacity for middle schools. Mr.
Tsai said bussing students to less densely - populated schools like Dunn and Coats -Erwin would
still leave the county with more middle school students than it has room for. The current
capacity deficit is 338 for middle schools and 621 in high schools.

Ted Cole and Bob High with Davenport and Company LLC, gave an overview of the Highland
Middle School Funding analysis which they prepared and distributed. Mr. Cole delivered the
goals and objectives of their report as:
1) Review the County's existing tax supported debt profile
2) Discuss the Qualified School Construction Bond program available to the County
under the American Recovery and Reinvestment Act.
3) Review the preliminary project budget for Highland Middle School and determine the
eligibility of project cost for Qualified School Construction Bond financing.
4) Analyze the debt affordability of the potential Highland Middle School Project under
a traditional tax exempt financing and compare the results to utilizing the Qualified
School Construction Bond program.
5) Discuss the potential time frame and next steps in order to undertake the Highland
Middle School Project.
Mr. Cole noted that Harnett County has been given an allocation of QSCBs from the Department
of Public Instruction for up to $31.9 million which is scheduled to expire on December 31, 2012.
Mr. Cole stressed the County had the opportunity to borrow this money for school capital
projects with little or no interest costs.
Mr. Cole reported that Harnett County would have a $2.6 million deficient in 2014 just on its
current obligations outstanding. He said this would be the equivalent of about 3.7 pennies in tax
rate based on the same tax base. Mr. Coles said the county must identify additional dollars to
meet the current obligations. Mr. Cole also demonstrated cash flows associated with Highland
Middle School project which would be the equivalent of 1.6 pennies in tax rate assuming no
growth in the tax base. Existing debt and middle school construction totaled a proposed 5.6
pennies increase in the tax rate.
It was the consensus of the Board to hold a public hearing on the financing for the new middle
school. Commissioner Andrews moved to adopt the schedule proposed by bond counsel for the
potential financing. Commissioner Burgin seconded the motion which passed unanimously. The
Harnett County Board of Commissioners will call for a public hearing on the financing for
September 4, 2012 at their August 20, 2012, regular meeting as well as request for construction
bid distributed.
Dionne White, Transit Services Manager, petitioned the Board for a public hearing regarding the
Rural Operating Assistance Program Grant FY 2012 -2013. These funds will provide operating
assistance to passenger's trips and other transportation services for Harnett County which
includes:
- Elderly and Disabled Transportation Assistance ($81,834) provide operating
assistance for the transportation of elderly and disabled citizens.
Employment Transportation Assistance Program ($34,095) is intended to provide
operating assistance for person with employment related transportation needs.
- Rural General Public ($117,527) funds are intended to provide operating assistance
for individuals who do not have human services transportation assistance to pay for
their transportation needs and live in a non - urbanized area.

Commissioner Burgin requested the total number of users that benefit from the use of these grant
funds.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move, Chairman McNeill closed the public hearing.
Commissioner Burgin nominated Commissioner Dan Andrews as the designated voting delegate
for Harnett County at the 105th Annual Conference of the North Carolina Association of County
Commissioners to be held in Wake County, NC on August 16 — 19, 2012. Vice Chairman Hill
seconded the motion which passed unanimously
Commissioner Burgin stated he had problems with the Report of Settlement for Marziano &
McGougan, PA against Harnett County and the Harnett County Department of Public Utilities.
Commissioner Burgin said he felt the County had been handcuffed into an agreement costing
$300,000 to keep us from being in a lawsuit even though there were no contracts. Commissioner
Burgin said he was against this and wished he could have read the settlement earlier. County
Attorney Snow noted the issue was covered in closed session and was not up for a vote; only
included on the agenda to comply with the open meetings law. Commissioner Burgin moved to
release the information as a public document. The motion was seconded by Commissioner
Andrews and passed unanimously.
Mr. Sauer presented the following report:
• July 2012 Veterans Affairs July 2012 Activities Report
• July 2012 Landfill Billing
Mr. Sauer reminded the group of their upcoming special session schedule at 9:00 am on August
14, 2012.
Mr. Sauer also presented the following donation requests:
• Harnett County Arts Council
• Coats Chamber of Commerce — 100th Farmer's Day Festival
• Habitat for Humanity of Harnett County
• Heart of Harnett Playhouse
Commissioner Burgin said he would like for groups to present their funding request to the Board
as well as sharing their other fund- raising efforts. Vice Chairman Hill moved to fund Habitat for
Humanity for $15,000. Commissioner Burgin seconded the motion which passed unanimously.
Tony Wilder, Tax Administrator, was also asked about the possibility of the county donating
some of their surplus land to Habitat for Humanity.

Vice Chairman Hill moved that the Board go into closed session to consider and give instruction
to county legal staff concerning the handling of certain claims and legal actions including the
following pending cases:
(a) Felmet, et al vs County of Harnett case file no. 11 CVS 1646
(b) Felmet, et al vs County of Harnett case file no. 11 CVS 1647
The motion was seconded by Commissioner Andrews and passed unanimously.
Commissioner Burgin moved that the Board come out of closed session. Commissioner
Andrews seconded the motion which passed unanimously.
Chairman McNeill called for any new business. Commissioner Burgin asked Public Utilities to
work with Mr. Pat Flowers regarding a key needed to unlock a cable so he could disc fire lanes.
Commissioner Burgin asked about the policy regarding employee reviews saying he hoped they
were performed annually on all employees. He again stressed the need to sale surplus property
owned by the County.
Commissioner Burgin asked about the status of releasing the Poyner and Spruill documents. Mr.
Snow reported there had been preliminary discussions and staff would hopefully have
recommendation available at the next special session. Commissioner Burgin moved to requested
Finance Officer Sylvia Blinson to bring forward a plan of how to perform an audit of all fixed
assets of $5000 or more. The motion was seconded by Commissioner House and passed 4 to 1
with Commissioner Andrews opposing.
Commissioner Burgin moved that all county vehicles not being driving by on -call staff be
parked. Commissioner House seconded the motion which was later withdrawn with the
understanding that staff would be bring forward a plan regarding the use of county vehicles to
the commissioners on September 4, 2012.
Vice Chairman Hill and Chairman McNeill noted they were receiving lots of complaints by
county employees regarding the current insurance plan. Vice Chairman Hill moved that the
county meet with BC /BS representatives to talk about possible plan modifications and education
for the insurance program. Commissioner Andrews seconded the motion which passed
unanimously.
Commissioner Andrews moved to adjourn the meeting at 11:30 am. Commissioner Burgin
seconded the motion which passed unanimously.
