Members present: Timothy B. McNeill, Chairman Beatrice B. Hill, Vice- Chaiiivan Dan B. Andrews, Commissioner Gary House, Commissioner Member absent: Jim Burgin, Commissioner Staff present: Scott Sauer, County Manager Tony Wilder, Deputy County Manager Dwight W. Snow, County Attorney Sylvia Blinson, Finance Officer Margaret Regina Wheeler, Clerk Chaiiinan McNeill called the meeting to order at 7:00 p.m. Vice Chairman Hill led the pledge of allegiance and invocation. Chairman McNeill called for additions and deletions to the published agenda. Chairman McNeill announced the removal of public hearings for zoning changes for Blaylock Grading Company on NC Hwy 210N, 1.84 +/- acres from RA -30 to Commercial Zoning in Neill's Creek Township; and H.M.'s Kids, Inc., Applicant: Bob Brantley, 3035 Hwy 87S, 6.54 + /- acres, RA- 30 to Commercial Zoning in Barbecue Township. The tax refunds, rebates, releases and Outstanding Levy Report were also removed to address some issues. Chairman McNeill requested the addition of 1) Resolution to change the meeting time of the August 2, 2010 Regular Meeting, 2) Cooperative Extension's request for permission to accept a grant from the Harnett County Partnership for Children for the continuation of the Parents As Teachers Program in the amount of $266,505 for the grant year 2010 -2011; 3) Cooperative Extension's request for permission to accept grants 1) Quality Enhancement in the amount of $250,629, 2) Raising a Reader in the amount of $56,000 and 3) Division of Child Development in the amount of $50,141 for CORE Services, for the continuation of their Resource & Referral Program for the grant year 2010 -2011; 5) Staff Attorney's request to approval of the Home and Community Care Block Grant for Older Adult Agreement for the Provision of County -Based Aging Services with Mid - Carolina Area Agency on Aging and Provider Services Summaries detailing the funding to be received by each department totaling $635,519 federal and state Home and Community Care Block Grant funding for Fiscal Year 2010 -2011; and 5) Budget ordinances for WIA Youth Program, Human Resources Department, Sheriff's Department and IT Department. Vice Chairman Hill seconded the motion which passed unanimously. Commissioner House moved to approve the following items on the consent agenda as amended. Vice Chairman Hill seconded the motion which passed unanimously. 1. Human Resources requested approval of modification to the Personnel Ordinance (Article V, Section 29) to ensure clarification for compensation of employees working while the Emergency Operations Center (EOC) is activated. 2. Legal Department requested public disclosure of settlement of the worker's compensation claim of Christopher Smith vs. County of Harnett, I.C. No. 895515 in the amount of $29,500 which was approved by the N.C. Industrial Commissioner on June 5, 2010. In addition to the amount paid, the terms of the settlement include full and final release of any and all claims and severance agreement. 3. Resolution to cancel August 16, 2010 Regular Meeting (Attachment 1) 4. Public Utilities requested adoption of the Wastewater Master Plan project ordinance in the amount of $266,000. This project consists of the development of a wastewater master plan for the Southern portion of Harnett County. An engineering services contract for development of the plan was awarded to Hazen & Sawyer on June 21, 2010. The project will be entirely funded from HCDPU funds. 5. Deputy County Manager requested approval of Talbert & Bright, Inc. work authorization No. 10 -01 for approach surveys for runway 5 and 23 required by NC DOT, Division of Aviation. The services will be reimbursed by grant #36237.11 referred to as the VISION 100 grant. 6. Planning Department requested approval of a contract to perform planning services for the Town of Erwin. The contract term is for 3 years and compensation is $1,500 per month plus reimbursement of directly incurred out -of- pocket expenses. Out of pocket expenses include cost for photographic or outside reproduction of materials which are separate billing cost. 7. The County Manager requested approval of Workforce Development Budget Amendment, Contract Modification and Professional Service Agreements with Jerry B. Bryant and Frances Simmons 8. Human Resources, on behalf of Workforce Development /JobLink Department, requested approval for a new position — Workforce Development Specialist. This position will be classified as a Grade 64. No one spoke. The annual presentation of the Sandhills Antique Farm Equipment Club was postponed as no one was present to give the report. Harnett County Board of Commissioners July 19, 2010 Regular Meeting Minutes Page 3 of 6 The Harnett County Board of Commissioners considered support and approval of Resolution of the Harnett County Board of Education Regarding the Need to Build Schools, Possible Additional Sources of Funding and a Referendum on the Local Option Sales and Use Tax Voter Referendum for the November 2010 ballot. Commissioner House said Harnett County is facing a massive undertaking in building these schools and we need to look for every revenue stream that we can. He said he will always be in support of giving the voters the opportunity to tell them what they want them to do. Commissioner House moved to support putting the local option sales tax on the ballot along with the other items listed on the resolution presented by the Board of Education. The motion was seconded by Vice - Chairman Hill. Chairman McNeill noted the state has taken approximately $600,000 of lottery money in addition to taking back ADM funding which is over $1 Million. Chaiiman McNeill said we have to come up with alternate sources of revenues to pay for existing schools we've already built let alone any new schools. He said he feels like a sales tax is a fairer tax as property owners shouldn't always have to bare all of the burden themselves and noted a 1/4 cent sales tax would generate $1 million a year based on present numbers. Chairman McNeill said Harnett County is between a rock and hard place as we are growing in the middle of a recession. He said the county gained over 600 students this year and we are faced with the need to build over $136 Million of schools in the next four years. Commissioner House pleaded for the federal government and Department of Defense to help and said the influx of students is coming from the military and they should help bare the burden. Commissioner House read a statement from Commissioner Burgin who stated he would support the '/ cent sales tax if they lower the property tax rate a 'h cent. Chairman McNeill said they could not commit to anything like that at this state of the game. The motion passed unanimously 4 to 0. John Birath, Director of Facilities and Planning for Harnett County Schools, delivered earlier in work session contracts by the design professionals for the proposed four new schools for Harnett County. Updated budgets for one elementary school, two middle schools and one high school were also provided to commissioners. Mr. Birath reported they had gone through an accelerated process for selection of designers in these projects through the Request for Qualification Procedure. Mr. Birath noted a committee including representatives of the Harnett County Board of Commissioners and the Harnett County Board of Education created a shortlist from 15 respondents and interviewed the top six firms. Moseley Architects were selected to do the design of the elementary school and SFL +a Architects were selected to do the design of the two middle schools and the high school. Mr. Birath requested approval of the submitted contracts. He said the contracts needed to be delivered to USDA the following day to meet the deadline for funding. Commissioner House and Vice Chaimian Hill both served on the selection committee for these design professionals. Commissioner House said he called USDA and asked questions and feels very fortunate that we have the people at USDA looking after us in Harnett County. He said if we don't go ahead and do these applications now; the money would not be there next year. Vice Chairman Hill said she was very appreciative for all the excellent work done. She agreed that we Harnett County Board of Commissioners July 19, 2010 Regular Meeting Minutes Page 4 of 6 need to stay on the federal government to help us with these new schools due to the new students flooding the schools. Commissioner House moved to approve the architectural selections for professional services and authorize the chairman to sign the contract. The motion was seconded by Vice Chairman Hill and passed unanimously 4 to 1. Jennifer Slusser, Staff Attorney, requested approval of the Memorandum of Understanding (MOU) Relating to the Good Hope Hospital, Inc. Nonprofit Inpatient Psychiatric Facility for Harnett County. It was noted the group had discuss the MOU at length in work session. Commissioner House said he had worked on this project for over four years and these inpatient mental health beds are desperately needed in Harnett County. He said he read the final draft of the MOU thoroughly and found it to be very reasonable. Commissioner House made a plea to Good Hope's Board to adopt the MOU if approved by the Harnett County Board of Commissioners. Vice Chaiiinan Hill moved to approve the Memorandum of Understanding as presented. Commissioner House seconded the motion which passed unanimously. Heather Hooper and Chandra Hyacinth with Sanford Housing Authority presented for approval the Harnett County Public Housing Agency 5 Year and Annual Plan. Ms. Hooper said the proposed plan is what they anticipate for Harnett County Housing Authority over the next 5 years. She said they still intend to make the local preferences and keep the leasing up as much as possible but plan to also incorporate the Family Self Sufficiency (FSS) and Home Ownership so clients have more options. Ms. Hooper said Harnett County currently has more properties than they are able to assist. There are 218 Harnett County citizens in the program of which many of those clients are disabled as is one of Harnett County's preferences. Ms. Hyacinth said the Family Self Sufficiency program is set up to eventually help the families become self sufficient. She said when citizens reach their goals; money that the government is no longer paying for them is put in to an escrow account. The hope is clients would then take that money to put down on a home through the Home Ownership program. Vice Chairman Hill moved to approve the Harnett County Public Housing Agency 5 Year and Annual Plan as presented. Commissioner House seconded the motion which passed unanimously. Mark Locklear, Planning Manager, petitioned the board for a public hearing regarding Proposed Text Amendments to the Harnett County Subdivision Ordinance Article V: Design Standards, Section 5.12.4 Mr. Locklear reviewed the request to amend the subdivision ordinance to give authority to the Development Review Board to allow an exception to the current curb and gutter requirements in order to allow developers to take advantage of existing infrastructures when applicable such as existing mobile home parks being developed as subdivisions. Mr. Locklear noted the Planning Board reviewed the proposed amendment July 6, 2010, and unanimously recommends approval. Mr. Locklear reported Harnett County has received requests in recent months for the redevelopment of existing mobile home parks to single family subdivisions, some of which have existing street systems in place. In an effort to continue to encourage such redevelopment, staff Harnett County Board of Commissioners July 19, 2010 Regular Meeting Minutes Page 5 of 6 has proposed that the Development Review Board be able to approve an exception to our current curb and gutter requirements, in order to allow developers to take advantage of the existing infrastructures for such developments when applicable. Chairman McNeill called to order a public hearing on the matter and opened the meeting for comments from the public. Seeing no one move, Chairman McNeill closed the public hearing Commissioner House moved to approve the request as presented. Vice Chairman Hill seconded the motion which passed unanimously. (Attachment 3) Mr. Sauer presented the following report and request: • Planning Services May 2010 Report • Veteran Affairs June 2010 Activities Report Mr. Sauer also mentioned a very good article in the Dunn Daily Record regarding outreach efforts by Harnett County's Veteran Affairs. Commissioner House moved that the Board go into closed session to discuss matters relating to the location or expansion of industries or other businesses in Harnett County. This motion is made pursuant to N.C. General Statute Section 143- 318.11(a)(4). The motion was seconded by Commissioner Hill and passed unanimously. Chaiiiiian McNeill moved that the Board come out of closed session. Commissioner House seconded the motion which passed unanimously. There being no new business, Commissioner House moved to adjourn the meeting at 7:48 pm. McNeill, Chairman Attachment 3 HARNETT COUNTY NORTH CAROLINA A RESOLUTION AMENDING THE HARNETT COUNTY SUBDIVISION REGULATIONS WHEREAS, the Board of Commissioners of Harnett County adopted the Harnett County Subdivision Regulations on April 7, 1977 for the purpose of promoting the health, safety, and general welfare of the county residents; and WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North Carolina, particularly G.S. 153A -330; and WHEREAS, the Subdivision Regulations contains provisions for amending said ordinance and those provisions have been followed; and WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the Subdivision Regulations as listed below and recommends the adoption of the following amendment. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY, NORTH CAROLINA that Article V "Design Standards", Section 5.11.4 " Curb and Gutter" of the Subdivision Regulations shall be amended to read as indicated below: All curb and gutter sections shall be concrete and meet Division of Highways Standards. In the instance where redevelopment is taking place of an existing use, such as Mobile Home Parks or other similar uses with an existing street system in place that is currently utilizing asphalt curb and gutter that is built to N.C. Department of Transportation standards, then asphalt curb and gutter may be allowable upon approval by the Development Review Board. Further all new street additions to the development may also be allowed to continue to use the asphalt curb and gutter in order to make the development consistent in appearance throughout as long as the total linear feet of new street additions does not exceed the total linear feet of the existing street system. All Neo- Traditional designed lots shall conform to North Carolina Department of Transportation Traditional Neighborhood Development Guidelines. Duly adopted this 19t day of July, 2010 and effective upon adoption.
